Rothrock Law Firm, Attorneys in Fort Myers and Naples, FL How to prepare for an IRS audit.  First, hire counsel.  Second, organize your documents.  The primary benefit of hiring an attorney to represent you in an IRS audit is to avoid the imposition of a civil fraud penalty.  Civil fraud penalties will be asserted when there is clear and convincing evidence to prove that some part of the underpayment of tax was due to fraud. Such evidence must show the taxpayer’s intent to evade the assessment of tax, which the taxpayer believed to be owing. Unfortunately, many taxpayers do not consider their conduct fraudulent.  A tax attorney will review the taxpayer's return and supporting document before the audit to detect any potential fraud issues.  If the attorney detects fraud issues, he or she will develop a strategy to minimize the chance of a fraud penalty.  Fraud penalties are 75% of the total tax liability.  Gross negligence penalties are 40% of the total tax liability.  Regular negligence penalties are 20% of the total tax liability.
Organize Your Documents
The taxpayer should organize all documents that the auditor requests. If the taxpayer uses Quick Books or a spreadsheet, and the auditor requests proof of payment for advertising expenses, the taxpayer should provide proof of advertising expenses only.  The taxpayer should provide the spreadsheet showing the specific expense by date and should enclose a copy of the checks of each expense behind the spreadsheet. Preparation is time consuming; however, the end result is worth the time.  If the numbers add up and the auditor can locate everything, the auditor is less likely to ask for proof of other expense.  The more documents that the auditor asks for, the greater chance the taxpayer has of owing money.  Well organized documents also put the auditor in a better mood because the auditor does not have to spend hours digging through a shoe box of disorganized receipts.  A happy auditor is more likely to recommend a negligence penalty of 20% rather than a fraud penalty of 75%.

After the IRS concludes its audit, it will send a report assessing the amount of taxes that the taxpayer owes, if any.  If taxes are owed, the attorney will then negotiate payment of the taxes with the IRS  through an installment agreement, submit an offer in compromise, or file an appeal with the Tax Court.
