Less than one month after U.S. District Judge Gloria Navarro declared a mistrial in the case against Cliven Bundy, his two sons, and a self-styled militiaman, Navarro has dismissed the charges entirely. The decision Monday puts an end to the federal case against the four men for their role in the 2014 armed standoff over cattle-grazing rights in Nevada.
Navarro found that the prosecution had committed "flagrant misconduct" by withholding evidence that could have supported the defendants' case. Namely, Navarro explained that federal prosecutors had failed to disclose information from cameras recording video from the standoff and the presence of federal snipers around the Bundy Ranch.
Because the violations prevented the men from receiving a fair trial, according to Navarro's ruling Monday, the felony case against them was dismissed "with prejudice."

  After declaring a mistrial just weeks ago amid  ‘epic corruption’, a U.S. judge on Monday dismissed the criminal case against Nevada rancher Cliven Bundy and three other men on charges stemming from an armed 2014 standoff with federal law enforcement officers over a cattle grazing rights dispute.
As AZCentral.com reported three weeks agos, Navarro cited five key pieces of information that prosecutors did not disclose: records about surveillance and snipers at the Bundy Ranch; unredacted FBI logs about activity at the ranch in the days around the standoff; threat assessments about the Bundys dating to 2012; and internal affairs reports about the BLM.
Navarro methodically laid out her reasoning for about an hour, citing legal standards and case law, before delivering her ruling.
She said the evidence that was withheld could have been favorable to the accused and could have affected the outcome of the case.
Navarro stopped short of dismissing charges against the four men. It is unclear whether the case will be retried because Navarro did not rule whether the mistrial was with or without prejudice.
Navarro is considering dismissing the case “with prejudice” and blocking prosecutors from retrying the case. Her decision will come Jan. 8, according to The New York Times.
“There were approximately 3,000 pages that were provided to us only after we started trial,” Bundy lawyer Bret D. Whipple told TheNYT.
“I personally have never seen anything like this, especially in a case of such importance.”
Navarro had set another hearing for January and had tentatively scheduled a new trial to begin Feb. 26..
And now, as Reuters reports,  she has made her decision.
U.S. District Judge Gloria Navarro cited multiple willful evidence violations by prosecutors in dropping the case, saying they prevented a fair trial and amounted to prosecutorial misconduct.
It is now clear that  Cliven Bundy’s son’s  opening statement:
“The indictment and grand jury testimony is full of lies. Truth has been blocked in previous trials.
Listen closely – we will try to get you the truth. The truth will set me free and I’m counting on you to help me see that.”
Has been entirely vindicated.

Charges Against Bundys in Ranch Standoff Case Are Dismissed

A federal judge in Las Vegas dismissed charges against Cliven Bundy and his sons, Ammon and Ryan, on Monday.
Judge Gloria M. Navarro of Federal District Court, in a ruling from the bench, said that the government’s missteps in withholding evidence against the three Bundy family members and a supporter, Ryan W. Payne, were so grave that the indictment against them would be dismissed.
The decision could be appealed by prosecutors. But they would only be able to bring charges again if they won the appeal and the ruling was reversed--and they then got a new indictment from a new grand jury.
Judge Navarro declared a mistrial last month in the case, stemming from an armed standoff at the Bundy ranch in 2014 that had arisen over land-grazing fees. She said then that prosecutors had erred in failing to turn over important evidence to the defense, including video taken surreptitiously within the ranch during the standoff, and evidence that F.B.I. agents were involved in the incident.
Her decision on Monday to throw out the case shattered a long-standing government effort to portray the Bundy family members as violent extremists.
The 2014 standoff, the focus of Monday’s hearing, was set off when the Bureau of Land Management seized cattle from Cliven Bundy’s ranch in Bunkerville, Nev., in an attempt to force him to pay decades of back fees for grazing his cattle on federal land. Mr. Bundy insisted he did not have to pay the charges because, he said, he had inherited water rights on the land. At the height of the standoff, hundreds of antigovernment activists, many of them carrying guns, rallied to the Bundys cause, until the confrontation ended with the withdrawal of federal agents.
In the years since, the family became even more firmly entrenched in the deep and bitter debate over public land policy in the West--seen either as right-wing extremists or stalwarts in standing up against federal government overreach, depending on whom you asked. And the Bundys also became symbols of law enforcement failure, as prosecutors, through multiple trials, failed for the most part to convince juries that the family members and their followers, beyond their armed militance, were criminals.
Ammon and Ryan Bundy and five of their followers were acquitted by a federal jury in October 2016 on all charges related to their takeover of the Malheur National Wildlife Refuge in Oregon earlier that year. Last August, another federal jury, in Nevada, declined to convict four men who were involved in the Bundy ranch standoff, and earlier this year a jury in Oregon split on charges against four men in the Malheur takeover--convicting two of conspiracy charges but acquitting two others.
In the latest trial, the defense team said prosecutors had violated due process rules and undermined the entire case, which they said could not now properly be retried.
Daniel Hill, a lawyer representing Ammon Bundy, said that if prosecutors decided to appeal the decision, they would have to overcome what he described as a detailed, point-by-point rebuke by the judge, which took her about half an hour to read from the bench.
“It was the most unwavering, clear-cut and almost personal dismissal that I’ve ever heard in federal court,” he said. “I am very confident of the concreteness and airtightness of Judge Navarro’s findings.”

She dismissed the charges against the four men "with prejudice," meaning they cannot face trial again.   As the courtroom doors opened after Navarro's ruling, a huge cheer went up from the crowd of spectators gathered outside.  Navarro's decision comes less than a month after she declared a mistrial in case and found that federal prosecutors willfully withheld critical and "potentially exculpatory" evidence from the defense. Cliven Bundy, his sons Ammon and Ryan Bundy, and militia member Ryan Payne were all in court. Cliven Bundy had remained in jail until the hearing. The judge ordered his immediate release.  On Dec. 20, Navarro cited six pieces of evidence the Nevada U.S. Attorney's Office failed to disclose that were favorable to the defense and could have changed the outcome of the trial. The evidence included the following:  • Records about surveillance at the Bundy ranch • Maps about government surveillance • Records about the presence of government snipers • FBI logs about activity at the ranch in the days leading up to standoff • Law-enforcement assessments dating to 2012 that found the Bundys posed no threat • Internal affairs reports about misconduct by Bureau of Land Management agents "Failure to turn over such evidence violates due process," Navarro said last month. "A fair trial at this point is impossible."
