Portal e-Cidadania teve recorde de participação em 2018 embalado pelas eleições
Em 2018, as eleições desencadearam um intenso debate social, principalmente pela internet, o que elevou consideravelmente o número de acessos ao Portal e-Cidadania do Senado. Cerca de 19 milhões de pessoas se manifestaram pelo canal no ano passado. Um dos temas mais discutidos foi a proposta de revogação do Estatuto do Desarmamento. A sugestão de um plebiscito (PDS 175/2018) apresentada pelo senador Sérgio Petecão (PSD-AC), que depois foi retirada, alcançou mais de 1.600 acessos ao canal só no dia 30 de outubro.
O Portal já conta com mais de 35 milhões de perfis cadastrados distribuídos de forma proporcional à população de cada estado. O maior número de participantes é de São Paulo (27,11%), seguido do Rio de Janeiro (14,16%) e de Minas Gerais (9,85%). Além disso, 3% dos usuários acessam o site de fora do Brasil.
O assessor da Coordenação de Apoio ao Programa e-Cidadania, Ricardo Vaz, destaca que não há como separar as propostas como melhores e piores, pois todas são importantes para o processo democrático.
— O movimento social e político é o que pauta os temas das Ideias Legislativas enviadas pelos cidadãos. Cada fato político ou social de interesse público provoca o surgimento de novos temas. Não há como estabelecer critérios de qualidade das propostas, já que todas atendem ao anseio de parte da população, assim como também seria impossível medir a qualidade das proposições apresentadas pelos parlamentares — pontua Ricardo Vaz.
Sugestões
No movimentado ano de 2018, foram apresentadas 19.808 Ideias Legislativas, 50 delas receberam 20 mil apoios, o mínimo necessário para avançarem no Senado. Na Comissão de Direitos Humanos e Participação Legislativa (CDH), foram aprovadas quatro sugestões, que passaram a tramitar como projetos de lei. São eles: o que pune chefes do Executivo que não enviarem revisão salarial dos servidores (PLS 228/2018), pronta para a pauta na Comissão de Constituição, Justiça e Cidadania (CCJ); o que cria a Lei Geral de Licenciamento Ambiental (PLS 168/2018), também na CCJ; o projeto que proíbe a distribuição de canudos e sacolas plásticas em estabelecimentos comerciais, (PLS 263/2018), que tramita na Comissão de Meio Ambiente (CMA); e a proposta de considerar como microempreendedor individual os profissionais de Tecnologia da Informação, que aguarda relator na Comissão de Assuntos Econômicos (CAE).
Libras
Foram rejeitadas e arquivadas 18 propostas, entre elas a que incluía o ensino de Libras como disciplina obrigatória nas escolas públicas do país. A pedagoga Marilei Monteiro, de São Paulo, que apresentou a Ideia Legislativa, argumentou que a Língua Brasileira de Sinais (Libras) é o segundo idioma oficial brasileiro, porém não está inserida no currículo educacional. A iniciativa de inclusão nas escolas buscava mais igualdade social e aproximar estudantes surdos e ouvintes.
A ideia legislativa recebeu mais de 20 mil apoios na internet em menos de quatro meses. A proposta foi transformada na Sugestão (SUG) 15/2018, entretanto acabou rejeitada na CDH e foi arquivada.
Repercussão
As sugestões apresentadas pela população no Portal e-Cidadania repercutiram nas mídias sociais, principalmente durante o período da campanha eleitoral. Com destaque para temas como a criminalização do Movimento dos Trabalhadores Rurais Sem-Terra (MST) e outros movimentos sociais (SUG 2/2018) com mais de 900 mil votos, rejeitada e arquivada pela CDH; a criminalização da discussão sobre identidade de gênero nas escolas (SUG 24/2018) com mais de 560 mil votos registrados, que aguarda designação de relator; e a instituição do voto impresso no processo eleitoral (SUG 9/2018), que obteve mais de 160 mil votos e também aguarda relatório.
Outras sugestões de grande repercussão no ano passado foram a proibição de materiais plásticos; o fim do auxílio-moradia; e a revogação da Lei Rouanet, entre outros.

O Portal e-Cidadania é um canal criado em 2012 com o objetivo de proporcionar ao cidadão maior participação na atividade política, nas dimensões legislativa, representativa e fiscalizadora.
No Portal, as pessoas podem interagir de três formas: propondo e apoiando ideias legislativas, opinando sobre propostas em tramitação ou acompanhando eventos interativos, como audiências públicas, sabatinas e eventos abertos, ocasiões em que podem fazer comentários, perguntas, críticas ou sugestões. Para interagir no site, basta fazer um cadastro com e-mail ou por meio de contas do Google e da rede social Facebook.
As ideias legislativas podem ser propostas por qualquer cidadão devidamente cadastrado no e-Cidadania, sendo necessárias no mínimo 20 mil apoios dos internautas, em até 120 dias (período em que fica aberta a votação popular) para se transformarem em uma sugestão legislativa e serem analisadas pela CDH. Caso aprovadas, passam a tramitar como projeto de lei.
Já as ideias que não atingem o número mínimo de apoios no período de disponibilidade estabelecido são automaticamente encerradas. O Portal garante ao usuário privacidade e transparência às informações.

Plenário aprova texto-base de projeto sobre distrato imobiliário
O Senado aprovou nesta terça-feira (20), em Plenário, o texto-base do projeto que fixa direitos e deveres das partes nos casos de rescisão de contratos de aquisição de imóveis em regime de incorporação imobiliária ou loteamento (PLC 68/2018). Após a aprovação, a votação foi interrompida e deve ser retomada na quarta-feira (21), com a análise das emendas ao projeto aprovadas pela Comissão de Assuntos Econômicos (CAE).
Do deputado Celso Russomano (PRB-SP), a proposta havia sido rejeitada pela CAE em julho, mas um recurso fez com que voltasse para o Plenário, onde recebeu novas emendas. Com isso, o projeto teve que ser analisado novamente pela comissão, que aprovou o relatório do senador Armando Monteiro (PTB-PE), favorável a seis emendas e contrário a outras seis. O relator ainda fez adaptações para acolher mais duas sugestões. O texto retornou ao Plenário e em regime de urgência.
Os senadores favoráveis argumentam que o projeto atualiza as regras, dando segurança jurídica às construtoras e aos consumidores na hora da negociação. Por outro lado, há parlamentares que consideraram o texto mais favorável às empresas, sendo necessário mais equilíbrio.

Conforme o PLC 68/2018, o atraso de até 180 dias para a entrega do imóvel não gerará ônus para a construtora. Mas se houver atraso maior na entrega das chaves, o comprador poderá desfazer o negócio, tendo direito a receber tudo o que pagou de volta, além da multa prevista em contrato, em até 60 dias. Se não houver multa prevista, o cliente terá direito a 1% do valor já desembolsado para cada mês de atraso.
Além disso, o projeto permite que as construtoras fiquem com até 50% dos valores pagos pelo consumidor em caso de desistência da compra, quando o empreendimento tiver seu patrimônio separado do da construtora (mecanismo chamado de patrimônio de afetação).

Para os demais casos, ou seja, fora do patrimônio de afetação, a multa prevista para o consumidor é de até 25%.
O que prevê o PLC 68/2018
Em caso de inadimplemento do vendedor
— O atraso de até 180 dias para a entrega do imóvel vendido na planta não gerará ônus para a construtora.
— Se o atraso na entrega das chaves for maior que 180 dias, o comprador poderá desfazer o negócio e terá direito a receber tudo o que pagou de volta, além da multa prevista em contrato, em até 60 dias.
— O comprador pode optar por manter o contrato no caso de atraso com direito a indenização de 1% do valor já pago.
— Veda a cumulação de multa moratória com a compensatória em favor do comprador.
Em caso de inadimplemento do comprador
— Pune o inadimplente com multa compensatória de 25% do valor pago ou, se houver patrimônio de afetação, com multa de até 50%.
— O comprador perderá integralmente os valores pagos a título de comissão de corretagem.
— O comprador inadimplente terá de arcar com despesas de fruição do imóvel, se já tiver sido disponibilizado.
— Em caso de arrependimento, o comprador terá prazo de 7 dias a partir da assinatura do contrato.
— A rescisão do contrato permitirá que o comprador só reaverá o valor pago, decrescido dos encargos decorrentes da inadimplência, após 180 dias do distrato ou, se houver patrimônio de afetação, após 30 dias da obtenção do “habite-se” da construção.
