Types of FSSAI Licenses
There are 3 types of FSSAI license mentioned below:
1. Basic FSSAI License: Food business operators who are engaged in small scale food business have to obtain FSSAI registration. Food business with an annual turnover less than Rs. 12 Lakhs requires to obtain Basic FSSAI license.
2. FSSAI State License: State FSSAI license is required for manufacturers, storage, transporters, retailers, marketers, distributors etc. These licenses are issued by the respective state authorities in each state. Annual turnover more than Rs. 12 lakhs, but more than Rs. 20 crore for food businesses to obtain state FSSAI licenses.
3. FSSAI Central License: Central FSSAI license is issued by FSSAI regional offices which are functioning across the country. This FSSAI license can be issued and renewed for a period of 1 to 5 years. Annual turnover of more than Rs. 20 crore for food businesses to obtain Central FSSAI licenses.
How to Transfer/change/modification the food license?
If the FSSAI license has already been issued, you must follow certain steps to transfer the food license. For updating FSSAI license or registration, application must be submitted.
In case the FSSAI license holder dies, the license may be transferred to the legal representative or any surviving family members. The legal representative or family member must request that the certificate be transferred in their favor to the appropriate authority. After verification, the authority can approve or reject the application.
However, the application cannot be rejected by the FSSAI Licensing Authority without giving an opportunity to consider the applicant. FSSAI license shall be continued in case of death of registration certificate or license holder and only when legal representative or other surviving family member requests transfer of said certificate. The FSSAI certificate expires if it is not produced within 90 days of the expiry of the holder’s registration certificate or license.
What is the process for transfer of food license?
The steps to transfer food license are as follows:
Go to the website of FSSAI and login to the portal.
Select “Apply to Duplicate/Transfer/Surrender License” from the drop-down menu.
In the Action column next to the license number, select “Transfer”.
Fill in the required information, such as business address, contact information, registered office information, cause of death of the licensee, date of death, etc.
The designated officer is responsible for processing food license transfer applications.
Application for transfer of license must be accompanied by death certificate and certificate of legal heir.

1. What is FSSAI?
FSSAI stands for Food Safety and Standards Authority of India which is an organization that monitors and governs the food business in India.It is an autonomous body which is established under the Ministry of Health & Family Welfare, Government of India. The FSSAI has been established under the Food Safety and Standards Act, 2006 (FSS Act) which is a consolidating statute related to food safety and regulation in India. It ensures the food products undergo quality checks thereby curtailing the food adulteration and sale of sub-standard products. It is responsible for the registering and licensing of the Food Business Operators (FBO) in India and it lays down the rules and regulation for running the food business in India.

2. Why is FSSAI Registration Required?
Every food business operator involved in the manufacturing, processing, storage distribution and sale of food products must compulsorily obtain FSSAI Registration or License. FSSAI Registration is different from FSSAI License in the sense that depending on the size and nature of the business, FBO should obtain the necessary registration or license. It is a 14-digit registration or a license number which is printed on all the food packages. The 14 digit registration number gives details about the assembling state, producer’s permit. This registration procedure is aimed to create more accountability on the FBO to maintain the quality of the food products. The licensing and registration procedure and requirements are regulated by Food Safety & Standards (Licensing and Registration of food Business) Regulations, 2011.
3. FSSAI Registration/ Fssai License Procedure
FSSAI registration or license is based on the business volume and premises. Depending upon the installed capacity or turnover or location, applicant premises are eligible for the license such as basic license, central license, and state license.
4. FSSAI Registration Requirements
FSSAI Registration is a basic license and it is required for all the FBO involved in the small-scale food business. This category covers the following businesses:
Any FBO with an annual turnover of not more than Rs. 12 lakh.
Petty retailer dealing in food products
Any person who manufactures or sells any food article by himself
Food sale is done by the temporary stall holder
Any individual who distributes food in any religious or social gathering except a caterer
Small-scale or cottage industries dealing in the food business and the following:
5. Procedure for Obtaining FSSAI Registration
FSSAI registration is initiated by submitting Form A (application) to the Food and Safety Department.
This application can be accepted or it may be rejected by the Department within 7 days from the date of receipt of an application and the rejection has to be intimated to the applicant in writing
If the application is accepted, then the department will grant a registration certificate with the registration number and the photo of the applicant.
FBO should prominently display the certificate of registration at the place of business during the business hours.
The common documents required for Basic, State and Central Registration are a passport photo and a photo ID proof. For State and Central license, the following additional documents will be needed:

6. FSSAI License Requirement
For all other FBO apart from small-scale business, FSSAI license has to be obtained. FSSAI License can be classified into two categories i.e. State FSSAI License and Central FSSAI License based on the size of the business whether it is a medium scale or large scale business. Generally, FBO who are large manufacturers, importers, exporters dealing in large-scale food business need to obtain FSSAI registration from central government and FBO with small to medium sized manufacturing units, transporters, marketers, traders, etc., need to take FSSAI registration from the state government. To apply for State License the FBO must have a turnover between Rs 12 lakh to Rs 20 crore. Other conditions include manufacturing units having capacity of 2MT per day, dairy units handling business up to 50000 liters per day. 3 star hotels and above, repackers, relabelling units, clubs, canterns all catering business irrespective of their turnover need to apply for the license. The tenure of the license being maximum of 5 years and minimum of 1 year. To apply for a central license the FBO must have a turnover exceeding Rs. 20 crores and needs to have operations in two or more states. All importers and exporters need to apply for this license. The maximum tenure is 5 years and minimum is 1 year.
7. Documents Required For Obtaining the Central FSSAI License:
Form B duly completed and signed
Plan of the processing unit showing the dimensions and operation-wise area allocation
List of Directors/ Partners/ Proprietor with address, contact details, and photo ID
Name and list of equipment and machinery used with the number and installed capacity

Any registered or licensed person under the FSSAI has to adhere to the rules and regulation under the FSS Act, 2006. Food safety officer generally conducts the inspection of the food business operator’s facility and identifies the level of compliance with the regulation using a checklist. Based on the compliance level, the food safety officer marks it as:
Compliance (C)
Non-compliance (NC)
Partial compliance (PC)
Not applicable/Not observed (NA)
Based on the above, the food safety officer might issue an improvement notice where ever required per Sec 32 of the FSS Act, 2006. If the business operator fails to comply with the improvement notice, the officer after giving the licensee an opportunity to show cause may cancel his license. Any food business operator aggrieved by an improvement notice can appeal to the State Commissioner of Food Safety. The decision thereon can be challenged through appealing to the Food safety appellate tribunal/high court.
11. Renewal of FSSAI License
The FSSAI license is essential to commence the food business, similarly it is imperative to renew the license. The license is issued for a validity of 1 year or 5 years, so the business must apply for renewal 30 days prior to the expiry of current license. FSSAI has introduced an online application called Food Licensing and Registration System (FLRS) so businesses can apply online for the licences. The FLRS is utilized in five Regional Offices for the issue of licenses and entitlements. They are:
Northern Region -New Delhi
Eastern Region – Kolkata
North Eastern Region – Guwahati
Western Region – Mumbai and Kerala
Southern Region – Chennai

The Food Safety and Standards Authority of India (FSSAI) has issued an order exempting Food Category ‘13', which refers to foods intended for specific nutritional purposes, from the definition of proprietary foods. According to the order, FBOs must apply for product approval for Category 13.
he order released by FSSAI says, “Since the FC 13 broadly covers Infant food products and products covered under Food Safety and Standards (Health Supplements, Nutraceuticals, Food for Special Dietary Use, Food for Special Medical Purpose, Functional Food and Novel Food) Regulations, 2016, therefore, it is inferred that the products covered under all the sub-categories under the Food Category 13, i.e., Foodstuffs intended for particular nutritional shall either have to comply with the standards set out in the respective regulations or have to seek product approval under FSS (Approval for Non-Specified Food and Food Ingredients) Regulations, 2017. Hence, all such products cannot be licensed as Proprietary Foods in any case”.

FSSAI Licensing and Registration:
FSSAI or Food Safety and Standards Authority of India isan autonomous bodyestablished under the Ministry of Health and Family Welfare, Government of India. FSSAI Registration process
When the annual business turnover is less than Rs.12 lakhs then a business operator is required to obtain the basic FSSAI registration.
To obtain FSSAI Registration, the FBO is required to submitForm A to the department of food safety and within 7 days it is known whether the application is accepted or rejected.If it is accepted then a registration certificate is granted along with a registration number and applicant photo.
How to get FSSAI license?
Well! There are three two types of FSSAI license and it is categorised depending on the volume of business, turnover andlocation.In general, if the annual turnover of an FBO ismore than Rs.12 lakhs, but less than Rs.20 crores, then it is necessary to obtain FSSAI state license and when it is more than Rs. 20 crores, then an FSSAI central license is required to be obtained.
For obtaining the FSSAI state or central license, an FBO has to submit the application Form B,along with required documents to the concerned authority. Some keydocuments required for the application of FSSAI state or central license are
· Form B completed and signed.
· Complete blueprint or layout of the unit where food will be processed.
· Complete list of director(s)/ partners/ proprietor
· Machinery and equipment utilized in the process.
· The food category(s) desired to be manufactured.
· Water analysis report
· Raw material source
· Premises possession proof
· Recall plan wherever possible
· Form IX
· NOC from municipality
· Declaration for Annual Turnover/Supporting evidence
Above mentioned are the importantdocuments required for the application to obtain an FSSAI license before starting any food business.
An FSSAI license/ registration can be applied for a period ranging from 1 year to 5 years. The renewal of fssai regulations for nutraceuticals is required to be done by an FBO to ensure continuous compliance. Additionally, Food business operator whose food production capacity is not over 100 kg or liter a day, or the handling or procurement and collection of Milk per day is not exceeding over 500 liters a day, or the slaughtering capacity is not above 2 large animals or 10 small animals or 50 poultry birds per day or less
The Food business operators need to submit the Form A when applying for the FSSAI registration. Form A is the basic form to be filled which comprise a Food business operator (FBO’s) Business Activities. Along with the Form A the FBO’s need to submit the other important documents as per their business activities. FSSAI License

Any person or entity or food business operators need to acquire the FSSAI license in order to operate the food business in India. The FSSAI License is basically two types of the-
State FSSAI License
Central FSSAI License
Based on the nature and the size of the food business the FBO need to obtain the FSSAI license from the licensing relevant authority which. The large FBO’s that are involved in manufacturing, processing, selling, importing, transportation and distribution of the food products need to obtain the Central FSSAI License and the medium-sized FBO’s to obtain a State FSSAI License for operating their business. This food license granted by FSSAI is location specific and is termed bound.

Any Food business operator that is in the food business need to obtain the FSSAI License-
If the Food business operator whose annual turnover is more than 12 lakhs
Any Food business whose production capacity is more 100 kg or liter a day, or the handling and collection of Milk per day is over 500 liters a day or the slaughtering capacity is more than 2 large animals or 10 small animals or 50 poultry birds per day.
The FSSAI License is granted for a period of 1 to 5 years. The FSSAI license needs to be renewed before its expiry that is not less than 30 days. If the food business operators need a license for more years then they need to pay a higher fee.
To obtain the License the food business operators need for fill and submit the Form B which is a mandatory document to apply for the FSSAI License. The food business operators with the annual turnover between 12 to 20 lakhs need to fill the State License (FORM B) and the food business operators with the annual turnover above 20 lakhs need to fill the Central License (FORM C). Additionally, after obtaining the License the Food business operators (FBOs) require display the License Format a prominent place in the premise and they must inform the authorities about and modifications and changes in business activities.

All the food business operators must follow the food safety and standard regulations strictly and need to conform to the regulations laid by FSSAI. It is imperative for the FBO’s to follow the food safety laws very careful and ensure fulfilling all requirements or otherwise they will be liable for penalties or cancellation of their existing registration or license for operating the food business.
