Toutefois, face à un gouvernement qui accélère le cours des réformes néolibérales, le rapport de forces nécessaire pour le faire reculer doit être porté à un niveau très haut — et peut-être même hors de portée dans les conditions actuelles. La grève générale reste présente dans bien des représentations militantes, mais elle semble inaccessible, alors que bloquer l’activité économique demeure le moyen le plus décisif de peser sur le patronat, et donc sur le gouvernement.
Au cours des vingt-cinq dernières années – en 1995, en 2003, puis en 2010 –, de grandes mobilisations, scandées par une succession d’impressionnantes manifestations, ont eu lieu pour la sauvegarde des retraites. En novembre et décembre 1995, la participation aux cortèges était corrélée à un important mouvement de grève dans de nombreuses entreprises et administrations : la Société nationale des chemins de fer français (SNCF), la Régie autonome des transports parisiens (RATP), Électricité de France (EDF), La Poste, France Télécom, Air France et Air Inter (dans une moindre mesure), les impôts, la fonction publique territoriale… Le secteur privé n’était pas absent, avec quelques journées d’arrêt de travail dans l’automobile (Renault, Peugeot, Ford) et dans l’électronique (Alcatel, Thomson), mais de façon beaucoup plus limitée.
En 2003, le mouvement s’était étendu sur cinq mois, avec neuf journées nationales interprofessionnelles, quatre manifestations rassemblant près de deux millions de personnes et une grève de presque six semaines dans l’éducation nationale. Dans ce secteur, le rejet du mouvement de décentralisation des personnels administratifs, techniques, ouvriers, sociaux et de santé (Atoss) s’ajoutait à celui d’une réforme des retraites qui alignait en partie le régime des fonctionnaires sur le privé.
L’ampleur des manifestations sur l’ensemble du territoire, y compris dans de petites localités, constitue le trait marquant de cette période. Cependant, on commence à voir des salariés qui y participent en posant des heures ou des jours de réduction du temps de travail (RTT), et donc en évitant la grève. Le gouvernement avait alors pris la précaution de laisser à l’écart la question des régimes spéciaux afin de ne pas bloquer le pays.
Il fera de même en 2010. Cette année-là, le mouvement s’étale sur six mois, avec quatorze manifestations, mais un fond gréviste extrêmement réduit, sauf à Marseille, dans les cantines. Une grève reconductible d’ampleur limitée se déroule à la SNCF. Après quelques semaines, la Confédération générale du travail (CGT) et Force ouvrière (FO) se tournent vers les raffineries dans l’espoir que quelques équipes mobilisées bloquent l’approvisionnement en essence, comme lors d’un épisode important de 1968. Les acteurs syndicaux voient alors les limites de leur stratégie. À elle seule, la puissance des manifestations ne vaut pas manifestation de la puissance.

Depuis 2003, la question de la construction de grèves reconductibles et de la convergence des luttes est présente dans les débats militants. D’autant que le gouvernement a multiplié les mesures contre les blocages menés par de petits groupes : retrait immédiat de permis de conduire par la police pour les chauffeurs routiers – lesquels avaient été actifs en 1995 – lorsqu’ils cherchent à bloquer la circulation ; recours à la réquisition dans les raffineries et, depuis 2010, constitution préalable de stocks. Cette politique de containment s’est étendue au droit de manifester, avec des pressions considérables lors du mouvement contre la loi travail en 2016, et surtout la répression des « gilets jaunes » et des manifestations de cet hiver. Une stratégie de la tension a été adoptée dans le maintien de l’ordre, par l’utilisation disproportionnée de grenades et de gaz lacrymogènes surpuissants et par le « nassage » des manifestants.
Dans ce contexte, les directions syndicales ont poussé leurs équipes militantes à construire des mouvements de grève reconductibles dans divers secteurs, sans parvenir à y entraîner de façon décisive les salariés du privé.
La faiblesse des implantations syndicales en est la première cause : en effet, quand l’enjeu est la mobilisation, et non plus la seule participation aux organismes officiels de l’entreprise, la capacité d’action passe d’abord par la présence de syndiqués au sein du salariat, et par l’existence de collectifs, lieux de discussion et d’émulation. Si 37,6 % des établissements du secteur privé disposaient d’au moins un délégué syndical en 2005, ce chiffre était passé à 30,6 % en 2017 (1). Même là où la couverture syndicale est assurée, il s’agit le plus souvent de petits collectifs aptes à mener la négociation annuelle obligatoire, mais rarement à même d’aller au-delà de l’information des salariés.
Les adhérents se trouvent très majoritairement dans de grands établissements, et ceux qui s’investissent sont très vite aspirés par l’activité de représentation dans les instances. Selon une étude de la direction de l’animation de la recherche, des études et des statistiques (Dares) consacrée aux 11 % de salariés syndiqués en France, moins d’un tiers d’entre eux participent régulièrement aux activités de leur organisation (2). Le plus souvent, les équipes militantes se résument au noyau dur des élus et des mandatés, avec très peu de temps disponible pour mener un travail de sensibilisation et de discussion avec les autres salariés.
Cette situation s’est encore aggravée avec les ordonnances Macron de 2017, qui ont supprimé les anciens comités d’entreprise, les délégués du personnel et les comités d’hygiène, de sécurité et des conditions de travail (CHSCT) pour les fondre dans une instance unique, les comités sociaux et économiques (CSE). Les équipes militantes ont été accaparées par de longues négociations pour en définir le périmètre et le fonctionnement ; elles en sont sorties exsangues. D’autant que ces ordonnances ont entraîné une diminution du nombre des élus et du temps de représentation des travailleurs (jusqu’à 30 % ou 40 % de moins dans la plupart des entreprises).
Dans les plus petites structures, une part croissante des adhérents sont des « isolés », seuls syndiqués de leur entreprise. C’est le cas pour ceux de la CGT, notamment, en particulier dans le commerce et les services, où des luttes localisées existent, mais où l’absence de communauté militante rend difficile une participation à une action longue. La décision de faire grève devient plus difficile à prendre lorsqu’elle est strictement individuelle et qu’elle peut se traduire, au mieux, par une participation en pointillé.
Cet isolement pourrait être compensé par le rôle actif d’organisations de proximité, telles les unions locales. Ces structures interprofessionnelles se sont affaiblies ; lorsqu’elles demeurent actives, elles n’ont souvent qu’une vie limitée, car elles reposent sur l’implication de quelques retraités.
De nouvelles initiatives voient le jour. À Malakoff, en région parisienne, l’union locale CGT a créé un syndicat multientreprises pour organiser les isolés, leur fournir un cadre de débat et de décision commun, permettre un développement de la syndicalisation et donner de l’énergie à ces adhérents dispersés. Mais de tels cas sont encore très rares.
Au cours des dernières années, des implantations ont été créées dans des secteurs peu habitués aux luttes sociales, comme celui de l’aide à domicile, des établissements d’hébergement pour les personnes âgées dépendantes (Ehpad) ou encore dans la grande distribution. Mais, dans ces secteurs, les salaires sont très bas, et la répression est forte. Se mobiliser dans la durée, à travers une grève reconductible, demeure une pratique exceptionnelle.
Simultanément, dans les anciens bastions syndicaux – l’industrie ou les fonctions publiques –, le développement de la sous-traitance a conduit à une externalisation des emplois ouvriers vers de petites entreprises dépourvues de présence syndicale. Quant aux entreprises plus grandes, elles connaissent des réorganisations permanentes qui conduisent à l’éclatement des collectifs de travail, avec un fort recours à des salariés mis à disposition, en intérim ou en contrat précaire. Ainsi, à EDF, des restructurations ont contribué à affaiblir les solidarités de corps ou de métier. Et dans l’industrie automobile, à quoi bon faire grève si les lignes de production, qui emploient en permanence entre 30 % et 50 % d’intérimaires, voire davantage, ne s’arrêtent pas ?
Surtout, les syndicats n’ont plus la puissance suffisante pour entraver le fonctionnement du cœur du capitalisme français, celui des sociétés du CAC 40, largement internationalisées, et dont le rapport au territoire national et à ses conflits s’est largement distendu. Renault a délocalisé ses lignes de production en Espagne, en Turquie, en Slovénie ou au Maroc : les grèves en France affectent de moins en moins ses produits-phares. De même, en cas d’arrêt de la production sidérurgique en France, M. Lakshmi Mittal s’empresserait de redistribuer ses commandes au sein des autres usines – en Europe ou au-delà – du gigantesque groupe ArcelorMittal.
Une implantation solide demeure dans les transports. D’ailleurs, le gouvernement a eu l’habileté de céder très vite sur les revendications des navigants – qui, à Air France, en 2018, ont montré leur capacité à mener une grève longue. Au passage, les déplacements des élites auront été moins affectés par les grèves que ceux des classes moyennes et populaires…
Mais les freins à l’action longue résultent aussi de facteurs plus généraux. Les formes d’individualisation et d’évaluation du travail, la gestion par le stress et la dégradation des conditions de travail conduisent un grand nombre de salariés à redouter les effets de la grève, celle-ci impliquant de laisser des tâches s’accumuler ou d’aggraver les contraintes pesant déjà sur les collègues. Cette pression s’exerce encore plus fortement sur ceux qui produisent des services pour autrui (éducation, santé, aide à la personne) (3). De plus, en contraignant une partie des cadres à prendre en charge le travail des grévistes — comme à la RATP ou à la SNCF, où certains ont appris à conduire des trains —, ou en ayant recours à des intérimaires, les directions utilisent des procédés classiques de contournement qui nient le droit de grève et ostracisent ceux qui s’en saisissent.
Enfin, la faiblesse des « restes à vivre » dans la comptabilité des ménages a été mise au jour avec les « gilets jaunes ». Elle affecte une grande partie des travailleurs, y compris ceux qui ne sont pas au bas de l’échelle. L’endettement et le surendettement des familles sont devenus des réalités communes dans le monde du travail : selon la Banque de France, en 2018, si 25,7 % des surendettés étaient des chômeurs, 28,6 % étaient des actifs en contrat à durée indéterminée (CDI) (4). L’absence ou la faiblesse des collectifs syndicaux sur les lieux de travail ne permet pas de surmonter ces obstacles.
De plus, le lieu où l’on vit coïncide de moins en moins avec celui où l’on travaille. Cela contribue à affaiblir des solidarités territoriales (de la part des municipalités, des agriculteurs, des commerçants…) qui continuent à exister lors de conflits localisés contre des fermetures d’entreprise. Le succès des caisses de grève en ligne renoue avec une longue tradition de soutien aux grévistes, les réseaux sociaux remplaçant les solidarités collectives construites dans la proximité (5).
Une communauté protestataire
Malgré – ou à cause de – ces handicaps, le mouvement social de cet hiver fait preuve d’une vitalité exceptionnelle et d’une capacité à élargir le répertoire d’action traditionnel. L’animation des cortèges, les flashmobs, les « marées de meufs », les démonstrations artistiques, les banderoles ou affiches individuelles témoignent d’une créativité impressionnante, même si le phénomène n’est pas entièrement nouveau : les charivaris et les carnavals d’autrefois s’accompagnaient fréquemment de mises en scène grotesques du pouvoir des dominants.
On le voit depuis 1995 : les syndicats ne sont pas des armées en campagne qui déplacent des troupes à volonté, et les mobilisations montrent une grande part d’autonomie par rapport à leurs mots d’ordre. Le mouvement de l’hiver 2019-2020 renforce encore le trait. Des communautés semblent s’être constituées, comme par capillarité ; par exemple, les collèges et les lycées d’un même territoire, ou encore ces collectifs féministes qui ont donné tant de couleurs aux cortèges. Souvent, ce sont des syndicalistes qui ont impulsé ces formes d’auto-organisation locales, mais on ne peut pas ramener la contestation à une lutte syndicale classique. Le mouvement des « gilets jaunes » avait montré la voie de modes d’action affranchis de toute forme de représentation ; le mouvement de l’hiver suivant a revêtu lui aussi la forme d’une mobilisation autant citoyenne que syndicale.
Ces mises en mouvement n’ont certes pas débouché sur une grève générale, largement mythique (6), mais elles ont contribué au façonnement d’une communauté protestataire, par-delà les différences statutaires et les inégalités qui structurent le monde salarial : médecins hospitaliers et avocats ont fait cortège avec les égoutiers, les employés municipaux et bien d’autres, la convergence étant assurée par le rejet fédérateur du président de la République.
À ce titre, les manifestations se sont révélées autant politiques et idéologiques que syndicales. Pour autant, on est loin d’un processus de politisation de larges fractions de la population tel qu’il s’était produit en 2005 autour du référendum sur le projet de traité constitutionnel européen, lorsque des militants associatifs, syndicaux et politiques avaient réussi à percer le mur des médias et du pouvoir. Le sujet des retraites n’est pas moins politique, et, pris séparément, les syndicats ne manquaient pas de propositions alternatives. Mais ils n’ont pas réussi à les rendre audibles, à imprimer leurs idées dans l’espace public. Et la question de la pression effective sur le pouvoir ou sur l’économie reste posée.

ABSTRACT. Amazon is the titan of twenty-first century commerce. In addition to being a retailer, it is now a marketing platform, a delivery and logistics network, a payment service, a credit lender, an auction house, a major book publisher, a producer of television and films, a fashion designer, a hardware manufacturer, and a leading host of cloud server space. Although Amazon has clocked staggering growth, it generates meager profits, choosing to price below-cost and expand widely instead. Through this strategy, the company has positioned itself at the center of e-commerce and now serves as essential infrastructure for a host of other businesses that depend upon it. Elements of the firm’s structure and conduct pose anticompetitive concerns—yet it has escaped antitrust scrutiny.
This Note argues that the current framework in antitrust—specifically its pegging competition to “consumer welfare,” defined as short-term price effects—is unequipped to capture the architecture of market power in the modern economy. We cannot cognize the potential harms to competition posed by Amazon’s dominance if we measure competition primarily through price and output. Specifically, current doctrine underappreciates the risk of predatory pricing and how integration across distinct business lines may prove anticompetitive. These concerns are heightened in the context of online platforms for two reasons. First, the economics of platform markets create incentives for a company to pursue growth over profits, a strategy that investors have rewarded. Under these conditions, predatory pricing becomes highly rational—even as existing doctrine treats it as irrational and therefore implausible. Second, because online platforms serve as critical intermediaries, integrating across business lines positions these platforms to control the essential infrastructure on which their rivals depend. This dual role also enables a platform to exploit information collected on companies using its services to undermine them as competitors.
This Note maps out facets of Amazon’s dominance. Doing so enables us to make sense of its business strategy, illuminates anticompetitive aspects of Amazon’s structure and conduct, and underscores deficiencies in current doctrine. The Note closes by considering two potential regimes for addressing Amazon’s power: restoring traditional antitrust and competition policy principles or applying common carrier obligations and duties.

In Amazon’s early years, a running joke among Wall Street analysts was that CEO Jeff Bezos was building a house of cards. Entering its sixth year in 2000, the company had yet to crack a profit and was mounting millions of dollars in continuous losses, each quarter’s larger than the last. Nevertheless, a segment of shareholders believed that by dumping money into advertising and steep discounts, Amazon was making a sound investment that would yield returns once e-commerce took off. Each quarter the company would report losses, and its stock price would rise. One news site captured the split sentiment by asking, “Amazon: Ponzi Scheme or Wal-Mart of the Web?”3
Sixteen years on, nobody seriously doubts that Amazon is anything but the titan of twenty-first century commerce. In 2015, it earned $107 billion in revenue,4 and, as of 2013, it sold more than its next twelve online competitors combined.5 By some estimates, Amazon now captures 46% of online shopping, with its share growing faster than the sector as a whole.6 In addition to being a retailer, it is a marketing platform, a delivery and logistics network, a payment service, a credit lender, an auction house, a major book publisher, a producer of television and films, a fashion designer, a hardware manufacturer, and a leading provider of cloud server space and computing power. Although Amazon has clocked staggering growth—reporting double-digit increases in net sales yearly—it reports meager profits, choosing to invest aggressively instead. The company listed consistent losses for the first seven years it was in business, with debts of $2 billion.7 While it exits the red more regularly now,8 negative returns are still common. The company reported losses in two of the last five years, for example, and its highest yearly net income was still less than 1% of its net sales.9
Despite the company’s history of thin returns, investors have zealously backed it: Amazon’s shares trade at over 900 times diluted earnings, making it the most expensive stock in the Standard & Poor’s 500.10 As one reporter marveled, “The company barely ekes out a profit, spends a fortune on expansion and free shipping and is famously opaque about its business operations. Yet investors . . . pour into the stock.”11 Another commented that Amazon is in “a class of its own when it comes to valuation.”12
Reporters and financial analysts continue to speculate about when and how Amazon’s deep investments and steep losses will pay off.13 Customers, meanwhile, universally seem to love the company. Close to half of all online buyers go directly to Amazon first to search for products,14 and in 2016, the Reputation Institute named the firm the “most reputable company in America” for the third year running.15 In recent years, journalists have exposed the aggressive business tactics Amazon employs. For instance Amazon named one campaign “The Gazelle Project,” a strategy whereby Amazon would approach small publishers “the way a cheetah would a sickly gazelle.”16 This, as well as other reporting,17 drew widespread attention,18 perhaps because it offered a glimpse at the potential social costs of Amazon’s dominance. The firm’s highly public dispute with Hachette in 2014—in which Amazon delisted the publisher’s books from its website during business negotiations—similarly generated extensive press scrutiny and dialogue.19 More generally, there is growing public awareness that Amazon has established itself as an essential part of the internet economy,20 and a gnawing sense that its dominance—its sheer scale and breadth—may pose hazards.21 But when pressed on why, critics often fumble to explain how a company that has so clearly delivered enormous benefits to consumers—not to mention revolutionized e-commerce in general—could, at the end of the day, threaten our markets. Trying to make sense of the contradiction, one journalist noted that the critics’ argument seems to be that “even though Amazon’s activities tend to reduce book prices, which is considered good for consumers, they ultimately hurt consumers.”22.
