Pay-When-Paid Provisions Still Unenforceable in New York State
Pay-When-Paid Provisions Still Unenforceable in New York State
While New York State’s Prompt Payment Act (“PPA”) provides a potential workaround for the invalid pay-when-paid provisions that appear in many construction contracts, a recent decision from the State’s Appellate Division narrows, if not closes, that loophole. In the construction industry, it is common for a general contractor to include “pay-when- paid” or “pay-if-paid”1 clauses in its contracts…

5 Takeaways From an Investigation Into Hysterectomies in India’s Sugar Industry (Megha Rajagopalan, The New York Times, March 24 2024)
"Women who cut sugar cane in the Indian state of Maharashtra are getting unnecessary hysterectomies, often as a way to keep working, undistracted by periods, pregnancies or gynecological checkups. (…)
Some women sought the surgery to avoid menstruating in the fields, where workers sleep beneath tarps with no running water or toilets.
Menstrual pads are expensive and hard to find, and there’s nowhere to dispose of them.
Women often address their periods with cloth that they wash by hand.
Others saw the surgery as an alternative to routine gynecological care.
To take a day off for a doctor’s visit, women must not only sacrifice income, but pay a fee to their employers.
Some women said they hoped the surgery would end their cramps and the pain of heavy, irregular periods.
Others are falsely told by doctors that a hysterectomy is necessary.
It’s such a widespread problem that a 2019 government investigation found that, of about 82,000 female sugar-cane workers in Beed, roughly 20 percent had undergone hysterectomies.
In the five years since that report, nobody forced the industry to change. (…)
Almost every woman I spoke to said she had married as a child, even though India bans child marriage.
They told me that they were married off to cut sugar cane alongside their husbands.
Sugar-mill contractors generally hire couples, not individuals. That system, workers said, incentivizes families to marry their daughters off early.
Child labor is also widespread, according to workers and company reports. A New York Times photographer saw children working in the fields. (…)
Coca-Cola said it buys sugar from Maharashtra, where these labor abuses are endemic.
And a businessman who runs a sugar mill in Maharashtra for Dalmia Bharat Sugar said his mill supplies Coca-Cola. A new Coke factory is under construction in Maharashtra.
PepsiCo said that one of its largest franchisees also buys sugar in the state."

A new audit by the New York City Comptroller’s Office found the city overpaid upstate hotels and other subcontractors by millions to shelter illegal immigrants last spring.
The audit also finds sizable undue commission payments to DocGo, a main city contractor responsible for running temporary shelters in the metro area at an annual cost of $432 million.
DocGo was one of a few city contractors tasked with developing upstate hotels-turned-shelters last May, a novel city practice that auditors deem “unusual,” and has met with strong opposition from several upstate counties, including Rockland and Orange.
Although the city’s DocGo contract has been running for over a year, the audit only looks at city payments for services rendered in the beginning months of May and June last year.
The audit covers more than 30 temporary hotels-turned-shelters managed by DocGo both inside and outside the city, including two in the town of Newburgh in Orange County.
It finds that as high as 80 percent of payments for that two-month period—at $11 million—either lack proof of services rendered or are unauthorized per the contract.
Of the questionable payments, $2.5 million were for unauthorized security, medical, and social services, $1.7 million for vacant rooms, and $230,000 for inflated food bills, according to the audit.
For example, a Newburgh hotel billed a total of $57,000 for hundreds of unoccupied rooms in early May, for which DocGo got an additional $40,000 in commissions.

Federal and local authorities arrested dozens of employees of New York City's public housing agency in a series of morning raids Tuesday linked to a massive bribery and extortion plot, according to prosecutors.
The raids, coordinated by Homeland Security Investigations and the city's Department of Investigation, netted the most single-day bribery arrests in the history of the Justice Department, according to Damian Williams, the U.S. Attorney for the Southern District of New York.
In all, 70 people were arrested in six states.
ILLEGAL MASTERMINDS OF NYC ROBBERY RING HACKED BANK APPS, RESOLD STOLEN PHONES OVERSEAS
"As we allege, the 70 defendants charged today allegedly demanded over $2 million in bribe money from contractors in exchange for giving out over $13 million of work," he said at a news briefing. "And if the contractors didn't pay up, the defendants wouldn't give them the work."
According to court documents, an unnamed co-conspirator allegedly texted another asking how much of a bribe she should demand: "1k per cool?"
NYPD RELEASES MIGRANT RAID PHOTOS AS SOFT-ON-CRIME LEADERS FACE NATIONAL OUTRAGE
"No problem babe, as long as your are being blessed," Angela Williams, a 64-year-old suspect who is not related to the U.S. attorney, allegedly replied.
The New York City Housing Authority, or NYCHA, is the country's largest public housing system and takes in more than $1.5 billion in federal funding every year, according to the DOJ.
As a public entity, it is required to bid contracts for most repairs or construction work and go with the lowest bidder. But there is an exemption for essential projects, such as plumbing emergencies or broken windows, that cost under $10,000.
Management at each building was allowed to make "no-bid" deals for those jobs.
All of the suspects were NYCHA superintendents or assistant superintendents when prosecutors say they demanded cuts of between $500 to $2,000 or more per job, ultimately collecting $2 million of taxpayers' money since it came out of the funds contractors received from city and federal agencies.
"That's classic pay-to-play, and this culture of corruption at NYCHA ends today," Williams said.
The kickback scheme was so pervasive it took place in almost a third of NYCHA's properties, he said.
Investigators are asking contractors who may have been victimized by similar demands for pay-to-play bribes to contact the DOJ's whistleblower program at [email protected] or the city's inspector general.
Most of the suspects have been charged with taking bribes and extortion, which carry 10- and 20-year maximum sentences in federal prison, respectively. Several face more charges.
