Presently the Walmart China has traced the supplies of 23 products and soon will release another 100 products. On the other hand, their neighbour Vietnam, there the Te-Food has currently implemented blockchain-powered traceability at Vinamilk, one of the biggest dairy companies in the Southeast Asian countries.
Most of the companies are tracking their food for their safety. Earlier in April, Swiss food technology company Buhler has launched two blockchain-ready products: Laatu, a tool targeting to decrease microbial contamination in dry goods, and Tubex Pro, a scaling system that self-optimizes and produces a continues flow of the produced data. The Bulher tools are connected with the Internet of Things(IoT) service, which hosted by Azure cloud platform of Microsoft.
As per the information of the company Laatu can destroy over 99.999% of salmonella and maintain the nutritional quality of food. Also, Iota Foundation has teamed up with the digital food safety management firm Priority in the month of June. It also enables the user to check the different variety of foods for allergens. And it also provides the customer with the detail of food products by scanning the barcode on the app.
Possible problems: The food industry is adopting blockchain technology but it has limitations too. The data entered into blockchain systems by the supplier is not guaranteed to be sure, but the technology ensures the prevention of the tampering or entering of false in the last stages. In most cases, it is difficult to collect and digitize the date because of numerous different setups utilized by suppliers, Ripe.io’s Gabor says,
“As we have engaged with the farmers in the food areas of dairy, meat, produce, citrus, commodities, a primary challenge is the access and availability of data. Farmers capture data in many different forms and the ability to digitize this data for capture and sharing has been our primary challenge.”
“The main challenges of implementations are not blockchain-related, ” assured Marton Ven from Te-Food. He further said,
“The hardest obstacle comes from collecting data from a large number of different companies. In recent decades, supply chains have become global, sometimes incorporating hundreds of companies from different countries, with different technological maturity, using different identification methodologies.
Keeping the data integrity – which is the backbone of traceability – requires all of them to actively cooperate on what data to collect, how to capture the data, and how to compile the information into meaningful product data, which the consumers can read.”
As per Keogh, there is another problem that needs the attention that if blockchain becomes compliant with the present GS1 standards. The food industry mainly depends upon them to format their data for communications sharing across supply chains before the blockchain technology.
Keogh said, “In this context, a Blockchain should be viewed as an outcome of a configuration of multiple technologies, tools and methods and hence interoperability is a critical component.
The Blockchain solutions using the GS1 standards for product identification, company identification, location identification and the joint GS1/ISO interoperability standards called Electronic Product Code Information System (EPICS) will excel in this space.”
As an academic’s view, the blockchain is like a record-keeping solution and not traceability. The state of supply chains in the food industry will immensely depend on how these blockchain-based solutions are implemented:
“WalMarts’ strategy with a single platform from IBM Food Trust is an example of both progress and a hurdle at the same time. […] I would have preferred to see WalMart providing a blockchain-enabled, standards-based platform and then their hundreds of suppliers who will use dozens of Blockchain solutions being able to connect and share a vendor lock-in is counterintuitive in the evolving Blockchain world.”
Ven agreed, “As traceability throughout food supply chains barely exists worldwide, blockchain has a good chance to become the de facto standard technology for it.” He further added, “But to provide global solution, other standards have to be applied as well, like GS1 standards for identification and event structure.”
Therefore, more and more suppliers and retailers are joining with blockchain companies or firms. The experts were stressing about the blockchain adoption inside the field, but it is not much about concluding out the technology as the shortage of proper data analysis in the first place. Ven told,
“We haven’t ever met any food company which refused to use blockchain. Although solution providers have to put in a lot of education effort, food companies are open to the idea of using blockchain. Certainly, the media hype around blockchain helps this effort, but 90% of the implementation challenges are not blockchain-related ones.”

Ninth Circuit Chunks Another Section 230 Ruling—HomeAway v. Santa Monica (Catch-up Post)
I’m finally blogging this Airbnb/HomeAway 230 ruling from 6 weeks ago. Why so long? Honestly, I lacked the emotional fortitude to blog it. The outcome isn’t novel—it reaches the same conclusion as the Airbnb v. San Francisco ruling from 2016 (a case I ranked in my top 10 Internet Law rulings of all time)��but the opinion’s overexpansive language and tone deafness sapped my strength. I’m finally ready to blog this ruling, but feel free to send me extra tissues for the future, because I used up my inventory blogging this opinion.
Background
In this case, Santa Monica banned short-term rentals of 30 days or less. The ordinance purports to advance the city’s goals of “preserving its housing stock and preserving the quality and character of its existing single and multi-family residential neighborhoods.” Further, “the Ordinance imposes four obligations on hosting platforms directly: (1) collecting and remitting ‘Transient Occupancy Taxes,’ (2) disclosing certain listing and booking information regularly, (3) refraining from completing any booking transaction for properties not licensed and listed on the City’s registry, and (4) refraining from collecting or receiving a fee for ‘facilitating or providing services ancillary to a vacation rental or unregistered home-share.’”
Airbnb and HomeAway challenged the ordinance on several grounds, including Section 230 and the First Amendment. The district court rejected the challenge. The appeals court affirmed.
Section 230
The court says that the ordinance doesn’t regulate “publisher or speaker” activity:
It does not require the Platforms to review the content provided by the hosts of listings on their websites. Rather, the only monitoring that appears necessary in order to comply with the Ordinance relates to incoming requests to complete a booking transaction—content that, while resulting from the third-party listings, is distinct, internal, and nonpublic. As in Internet Brands, it is not enough that the third-party listings are a ‘but-for’ cause of such internal monitoring.
Hold on, what’s that? Is the court saying that Section 230 doesn’t apply to third-party content that is “distinct,” “internal,” and “nonpublic”? What do those words even mean? Distinct from what? What does “external” content look like? Note that the platforms must transmit the third-party content to others, including the lodging vendor and third-party payment services, so that doesn’t sound very “internal” to me. And what does “nonpublic” mean, and how does it differ from “internal”?
Read literally, this legal standard implies that Section 230 would not apply to private messaging functions—though we know that cannot be true, because otherwise there would have been no need to statutorily exclude ECPA claims from Section 230’s reach. So has the Ninth Circuit has adopted a stylized view of Section 230’s applicability—it applies to Yelp’s consumer reviews, but not to Facebook Messenger? That would disrupt a large swath of Section 230 jurisprudence, including in the Ninth Circuit.
The court continues that it’s not “publisher or speaker” liability to require the platforms to cross-check the city’s property registry. The court says (possibly snarkily), “the Ordinance can fairly charge parties with keeping abreast of the law without running afoul of the CDA.”
Uh…no. This line of thinking was expressly rejected in the Backpage litigation over state laws that required verification that people depicted in prostitution ads were over 18. Imposing verification obligations on publishers of third-party content is just another way of constraining their editorial decision-making, and Section 230 and the First Amendment don’t allow it.
Here’s another way to evaluate the court’s statements. Imagine a city required eBay or Amazon to verify that every marketplace seller in the city to prove it has an appropriate license from the city to conduct business before it could finalize the seller’s transactions. (Assume there is an easily-accessed online public registry of licensed businesses). The Ninth Circuit seems to be greenlighting cities across the country to impose such verification obligations on eBay and Amazon. Why wouldn’t cities deputize online services as their law enforcement operators for business licenses? That should generate net incremental revenues to the city, even if it comes at horrible transaction costs socially.
The Ninth Circuit says “the Platforms face no liability for the content of the bookings; rather, any liability arises only from unlicensed bookings.” In response, Airbnb/HomeAway argued that restricting transactions would force them to remove listings because no one wants “a website chock-full of un-bookable listings.” Indeed, this is not just about user demand; it’s a legal requirement. Advertising unavailable third-party listings is a classic bait-and-switch that should support various false advertising and unfair competition claims against the Internet service. See, e.g., Anthony v. Yahoo. So regulating the consummation of marketplace transactions necessarily forces the marketplace to push compliance upstream to the listings.
The Ninth Circuit responds “whatever”: “assuming that removing certain listings may be the Platforms’ most practical compliance option, allowing internet companies to claim CDA immunity under these circumstances would risk exempting them from most local regulations.”
This is an obviously false dichotomy. Marketplaces still have to comply with wage-and-hour laws for their employees because those laws have nothing to do with liability for third-party content. In contrast, the Santa Monica ordinance has everything to do with third-party content. It’s disingenuous to create that kind of false equivalence.
Airbnb/HomeAway also argued that Section 230 was designed to prevent national online services from being subject to geographically diverse legal rules, which is precisely what’s happening with city-level ordinances of short-term housing. The Ninth Circuit is unmoved:
while we acknowledge the Platforms’ concerns about the difficulties of complying with numerous state and local regulations, the CDA does not provide internet companies with a one-size-fits-all body of law. Like their brick-and-mortar counterparts, internet companies must also comply with any number of local regulations concerning, for example, employment, tax, or zoning. Because the Ordinance would not pose an obstacle to Congress’s aim to encourage self-monitoring of third-party content, we hold that obstacle preemption does not preclude Santa Monica from enforcing the Ordinance.
First Amendment
The Ninth Circuit says the First Amendment doesn’t apply because “the conduct at issue—completing booking transactions for unlawful rentals—consists only of nonspeech, nonexpressive conduct.” Among other things, the ordinance is a “housing and rental regulation.” The court misleadingly reiterates that the ordinance doesn’t reach the listings themselves:
Contrary to the Platforms’ claim, the Ordinance does not “require” that they monitor or screen advertisements. It instead leaves them to decide how best to comply with the prohibition on booking unlawful transactions.
The court says checking listings is an “incidental burden” and, citing the Pittsburgh Press case, it’s OK to ban ads for illegal commercial activity. The fact that the ordinance treats Craiglist differently is fine to the court, because Craigslist doesn’t book transactions. It’s also OK that the ordinance doesn’t have a scienter requirement.
Implications
The court reaches a lousy result. If Section 230 doesn’t protect the marketplace operator from liability for closing marketplace transactions, eventually local governments will lard up the transaction process and that will lead to the end of online marketplaces. This litigation previews how that’s going to go. Even if any online marketplace does find a way to navigate the tsunami of local legal obligations, the entry barriers will be so high as to preclude genuine competition. When we wake up in 10 years and wonder what happened to innovation among online marketplaces, we can point the finger at this opinion.
Still, this opinion was shocking for the sloppy way it reached the same result as the SF ruling. It’s almost as if the panel wanted to mess up Section 230 jurisprudence more generally, not just in the online marketplace category. In particular, the references to “distinct, internal, and nonpublic” content was nonsensical but potentially pernicious, and the approval of verification obligations will open the door for other pernicious regulatory efforts.
So even if the result doesn’t change, this opinion is a good candidate for en banc review (HomeAway and Airbnb have already requested it). Perhaps an en banc panel can clean up this opinion to reduce the unnecessary and avoidable damage it will otherwise cause.

We had the opportunity to attend Amazon AWS reinvent user conference, held from November 26th till 30th 2018, across Las Vegas. With over 50k attendees, reinvent has become the yearly come and get together of the IT industry, a unique position that AWS first achieved in 2017 and has more than well defended in 2018.

Event Report - AWS reinvent : Push, push and AI from Holger Mueller

Here you go: AWS announces AWS Outposts – An area where AWS risked falling behind against the rest of the IaaS competition was the area of workload portability from cloud to on-premises. The next generation computing platform as I call it has been described in the Market Overview that can be found here… And AWS was holding out likely the longest being the public cloud market leader. With the Outposts announcements, together with VMware, AWS will now bring key services to on premises, giving customer a choice between an AWS or VMware control plane. It will be available in the 2nd half of 2019 – so still a little time out. But probably the most impactful announcement from AWS – ever. It catapults AWS into the hardware maker and tech stack maker market… something you could not see coming a little back. AWS takes AI to hardware – An area where AWS in our view was behind as well, was in custom hardware for AI loads. It has partnered with Nvidia as many others – but not brought forward a custom design… that changes with the new Amazon EC2 P3dn instances, that run a custom / optimized version of Tensorflow that increased efficiency from, 65 to 95%. They also support (vanilla?) Tensorflow, PyTorch, Apache MXNet, Caffe, Caffe2, Microsoft Cognitive Toolkit (CNTK), Chainer, Theano, Keras, Gluon, and Torch. Not enough, AWS announced a custom chip, Inferentia, that will become an alternative to GPUs, and will be optimized for high throughput and low latency. Last but not least, Amazon added Amazon Elastic Inference - making it more efficient for customers to provision just the GPU istances they need for their AI / ML worklodas. All four announcements are key make AWS more competitive vs Google, that still has a 2-3-year lead in custom AI hardware. But it is good to see AWS (finally) engaging here, more competition is good for enterprises and fosters innovation as well as price competition… all good trends for enterprises.  AWS launches AI apps – Making it easier for business users to use AI apps is key these days and the strategy for vendors is to help them with specific, targeted apps. With Amazon Personalize, Amazon Forecast (both re-using and building on expertise and technology from Amazon.com), Amazon Textract (an OCR replacement)-and Amazon Comprehend Medical (Healthcare use case with NLP for unstructured medical text) there has been a broad push into AI apps. We will have to see how well practical adoption will pan out, but interests were big at reinvent.  Database Innovation is alive and well – Amazon execs know how important databases are and how much critical enterprise load is in relational databases. The strategy of AWS is to combat the generic, all-purpose databases with more dedicated databases, all in a suite of database products. Last year Amazon unveiled AWS Neptune, it's graph database, this year it unveiled Amazon Quantum Ledger Database (QLDB – a distributed ledger database, but what a confusing name) and Amazon Timestream (a time series database). A good strategy that seems to get more traction in enterprises. But AWS knows that entrenched vendors are the challenge, and Oracle specifically has almost become an obsession. Multiple references in Jassy's and Vogels' keynote as well as almost 30 minutes on the topic in Vogels' keynote are almost too much attention. AWS open sources Firecracker – Influencing industry standards via open source has been the trend of the last two three years. Google has shown the way with Kubernetes and TensorFlow… so AWS did not want to stand back and open sources its serverless framework (Amazon likes to call it virtual machine manager) Firecracker… with Google focusing a level higher currently at the service mesh level, with Istio, this is an open space for anyone. And AWS has good chances given that Firecracker runs Lamba at AWS, and Lambda is the leading serverless platform in the cloud (from a load / uptake perspective). Now we must see if other IaaS vendors will support Firecracker and how successful AWS is at stewarding a strategic open source project. CxOs have accepted open source by now, so it really comes back to show traction in the offering from a roadmap and consumption perspective. Amazon QuickSight Renaissance – Two years ago Amazon debuted Amazon QuickSight a product that targets to replace the usual BI tools (remember Business Objects, Cognos, MicroStrategy?). The most promising capability was its automatic capability to visualize data. A key vision and step towards user free software, ahead of its time back then. Then it got quiet around Amazon QuickSight… but AWS does not give up easy and came back with a new attempt to win this market, and the value proposition remains strong. Time to look and evaluate this product for CxOs. True to cloud DNA, the pricing is now no longer per seat, but per session (with a maximum of $5 per reader user per month) – an innovation on the licensing side. AWS Tooling everywhere – Last year Amazon announced its own IDE, a key strategy to get closer to developers. But switching IDEs is not easy, so this year AWS is bringing the AWS Toolkit to PyCharm, IntelliJ (Preview), and Visual Studio Code (Preview). It's important to help developers build apps fast and bringing the toolkit to the 'living room' (aka IDE) is the right strategic move.

Another monster re:Invent with progress across the board. If there are areas where AWS was weaker, or even behind (on premise support, AI hardware), AWS has reacted and is making product available. The AWS Outposts announcement is changing the market for hardware fundamentally. Given AWS readiness to commit to aggressive pricing and ability to manage tight margins successfully, it is bad news for the Dell, HPs et al… and good news for CxOs. It's a great reward for long term AWS customers, who now can move loads from the AWS cloud to on premise – should they need or wish. On the hardware front AWS is correcting its miscalculation from a few years ago when it thought Machine Learning is all about… linear regression. With the adoption of Tensorflow across the board AWS acknowledges that MxNet has not won, but is also not giving up on the toolset yet. Both are important course corrections and innovations that are key to keep AWS in the overall IaaS market leadership position. In general AWS is impressive when it comes to delivering innovation across the board, across the product set. An astonishing feat that the AWS product teams manage to repeat year over year. And that raises the bar for innovation for the overall industry to keep up with. On the concern side, the AWS portfolio is broader and deeper than ever before. AWS keeps staying with the Chinese menu philosophy, and it means massive choice… but staying with the analogy, when a Chinese restaurant adds a full menu every year, even the most loyal customers will have a hard time to keep an overview of the menu – and manage to repeat-order the same dishes (aka products) at the next visit (aka implementation project). I was not around to ask Andy Jassy my traditional question (Is AWS getting too complex?) but he came prepared (very Amazons style) and negated the question (no surprise). Customers though are struggling to find repeatable success across the vast AWS services portfolio. And cross portfolio QA and testing is getting close to impossible. So, simplification by grouping services, testing them together, aligning roadmaps, versioning and more … must be in AWS future – at some point. But overall respect to AWS to a massive, well organized and amazing event, sharing the breadth and depth of the AWS services portfolio and innovation. Here is to another year taming the dragon.
