Guahati High Court directed SBI to reimburse the amount siphoned off by the Cyber Criminals

Hon’ble Mr. Justice Kalyan Rai Surana J of Guahati High Court has directed the State Bank of India (#SBI) to reimburse an amount of Rs. 4,44,699 to the #cybercrime victim who was #swindled of the #amount from his #account through illegal #onlinetransactions petitioner within a period of 60 days from the date of service of a certified copy of this order to the State Bank of India, Panjabari Branch. with liberty to recover the said from the persons to whose account said money or part thereof were #siphonedoff.

Facts

The victim, a customer of SBI, Panjabari branch, was swindled for a sum of Rs. 4,44,699 out of his account through illegal online transactions from June 8, 2012, to June 17, 2012, although no SMS alert was received by him during the period when the crime was committed. Thirty-five transactions took place in the short period from June 8 to June 17, 2012, which the victim had not done.

On June 17, 2012, the victim lodged a complaint in the State Bank of India, Panjabari Branch, followed by lodging of an FIR before the CID, Assam under Section 420 IPC, along with Sections 66 and 66(d) of the Information Technology Act, 2000. The petitioner also filed a complaint with the #BankingOmbudsman, but his complaint was rejected.

Aggrieved by the rejection of his complaint by the Ombudsman the petitioner-victim filed a #writpetition before the #GauhatiHighCourt, praying for an inquiry into the matter as to why #SMSalerts for online transactions to the extent of Rs. 4,44,699 did not reach his registered mobile phone and for directing the #refund of the #amount, with applicable #interests.

During the hearing of the case, the CID stated that unknown criminals had committed the offence online through computer devices and that the investigation revealed that the #crime had #originated from the #Thane #district of Maharashtra using #12IPaddresses in the Thane District, out of which two IP addresses turned out to be fake. Therefore, the court ruled that the #preponderance of #probability is that the #petitioner is a #victim of #cybercrime.

The court also said that in the event the money is not deposited in the bank account of the petitioner within the time allowed, the said amount shall carry interest at the rate of 6% p.a. from the date of the order until realization with liberty to recover the said from the persons to whose account said money or part thereof were siphoned off.

This work focus on design and development of an environmental temperature controller for application to a poultry environment with an sms alert feature a risk reduction approach. The poultry farmer needs to be assured that his investment is secure against risks that are beyond his control. This risks have most of their origins in the variable temperature of the environment. The objective of the project is to control or regulate the temperature in the poultry environment to make for effective functioning of the biological activities taking place inside the bodies of the birds. This objective was realized using a microcontroller to help the farmer be able to regulate the temperature in the farm. In the case of abrupt temperature variation, is able to be aware via an sms alert feature and empowered to control it. Results obtained proved to be very helpful to poultry farmers.

बदल गए SBI एटीएम से पैसे निकालने के कई नियम, पहले ही जान लें वरना देना पड़ेगा जुर्माना

चैतन्य भारत न्यूज भारतीय स्टेट बैंक के खाताधारकों के लिए एक महत्वपूर्ण खबर है। एसबीआई ने अब एटीएम से पैसे निकालने के कई नियम बदल दिए हैं। इन बदले हुए नियमों के अनुसार, अब से फ्री ट्रांजैक्शन (मुफ्त निकासी) की लिमिट को पार करने पर खाताधारकों पर जुर्माना लगेगा। इतना ही नहीं बल्कि अगर एसबीआई के खाताधारक के अकाउंट में बैलेंस नहीं है तो ट्रांजैक्शन फेल होने वाले पर भी जुर्माना भरना होगा। SBI's Savings Account means amazing benefits! To get freedom from unnecessary apps, download #YONOSBI now: https://t.co/wWHot51u7y #HappyIndependenceDay #Freedom pic.twitter.com/lX0Y9TQAdu — State Bank of India (@TheOfficialSBI) August 15, 2020 आपको बता दें मेट्रो शहरों में एसबीआई 8 बार के मुफ्ल लेनदेन की सुविधा देता है। यानी 8 बार एटीएम से पैसे निकालने पर आपको कोई चार्ज नहीं देना होगा। लेकिन यदि आपने इससे ज्यादा बार पैसे निकाले तो आपको जुर्माना भरना पड़ सकता है। एसबीआई एटीएम से मुफ्त पैसे निकालने के नियमों के मुताबिक, मेट्रो शहरों में एसबीआई के खाताधारक 5 बार SBI ATM से लेनदेन कर सकते हैं और 3 बार अन्य बैंकों के ATM का इस्तेमाल कर सकते हैं। मेट्रो शहरों में मुंबई, नई दिल्ली, चेन्नई, कोलकाता, बेंगलुरु और हैदराबाद शामिल हैं। इसके अलावा गैर-मेट्रो शहरों की बात करें तो एसबीआई के खाताधारक 10 बार एटीएम से मुफ्त लेनदेन कर सकते हैं, इसमें 5 बार SBI ATM से और 5 अन्य बैंकों के एटीएम से लेनदेन किया जा सकता है। इस लिमिट को पार करने पर बैंक आपसे 10 रुपए से लेकर 20 रुपए तक GST शुल्क वसूल सकता है। एसबीआई के अन्य बदले गए नियम के मुताबिक, यदि एसबीआई के खाताधारक के अकाउंट में पैसे नहीं हैं और वो फिर भी में एटीएम से पैसा निकालता है और यदि ट्रांजेक्शन फेल हो जाता है तो एसबीआई खाताधारक को जुर्माना भरना होगा। बैंक इसके लिए 20 रुपए फाइन और GST चार्ज करेगा। यानी आपके खाते में पैसा नहीं होने पर एटीएम का इस्तेमाल करने पर जुर्माना लगेगा। इसके अलावा अगर आप एसबीआई एटीएम से 10 हजार रुपए से ज्यादा की राशि निकालते हैं तो आपके मोबाइल पर ओटीपी (OTP) भेजा जाएगा जिसे एटीएम में भरने के बाद ही आप पैसा निकाल सकेंगे। इसके अलावा एसबीआई के एटीएम से रात 8 बजे से लेकर सुबह के 8 बजे तक कैश निकालने के लिए OTP (वन टाइम पासवर्ड) की जरूरत होगी। हालांकि, अगर आप किसी और एटीएम से पैसा निकालते हैं तो फिर आपको OTP की जरूरत नहीं होगी। SBI के ग्राहकों के लिए खुशखबरी नियमों के बदलने के साथ ही SBI ने अपने ग्राहकों को कुछ राहत भी दी है। पहली तो यह कि बैंक अकाउंट में महीने में 1,00,000 रुपए से ज्यादा का औसत बैलेंस रखने वाले सेविंग अकाउंट होल्डर्स के लिए असीमित लेनदेन की सुविधा दी है। यानी अगर आपके खाते में महीने में 1 लाख रुपए की राशि बनी रहती है तो आप ATM से कितनी बार भी लेनदेन कर सकते हैं। दूसरी राहत यह है कि भारतीय स्टेट बैंक के नए नियम के मुताबिक ग्राहकों को अब SMS अलर्ट के लिए किसी प्रकार का चार्ज नहीं देना होगा। SBI ने खाताधारकों के अकाउंट से रजिस्टर्ड मोबाइल नंबर पर आने वाले SMS अलर्ट के चार्ज को खत्म कर दिया है। Read the full article
