EU Challenges China at WTO Over High-Tech Patent Royalty Policies
The European Commission has filed a complaint with the WTO, accusing China of unfairly setting global royalty rates for EU standard-essential patents (SEPs) without patent owners' consent. The Commission claims Chinese courts pressure European tech firms, particularly in telecoms, to lower royalty rates, benefiting Chinese manufacturers.
China’s commerce ministry expressed regret over the complaint, stating it would address the issue under WTO rules. The dispute involves SEPs, vital for technologies like 5G, held by companies such as Nokia and Ericsson.
The EU has requested consultations with China, the first step in WTO dispute resolution. If unresolved within 60 days, a panel may be formed to adjudicate, with proceedings typically taking a year. This case also ties to a 2022 EU complaint about Chinese anti-suit injunctions restricting global patent enforcement.

🎯 Samsung Ordered to Pay $118 Million for Infringing Netlist Patents
A federal jury in Marshall, Texas, has ordered Samsung Electronics to pay $118 million in damages to Netlist, a computer memory company, following a patent dispute over technology designed to enhance data processing in high-performance memory products. This decision comes after a similar ruling last year, where Samsung was ordered to pay $303 million to the Irvine, California-based company.
In a separate case, Netlist secured $445 million in damages from Micron Technology in May for infringing on related patents. Representatives from both Samsung and Netlist have not yet commented on the latest verdict. The jury also found Samsung’s infringement to be willful, which could lead to the damages being tripled by the court.
Netlist initially filed the lawsuit against Samsung in 2022, claiming that its memory modules, used in cloud servers and other data-intensive applications, violated Netlist’s patents. According to Netlist, their patented innovations improve memory efficiency and allow faster processing of large data sets.
Samsung refuted the allegations, arguing the patents were invalid and that its technology operated differently. The company has also filed a separate lawsuit in Delaware, accusing Netlist of failing to provide fair licensing terms for technology aligned with international standards.

🎯 Oracle sues payment software company Procore over trade secrets
On October 28, Oracle, the major software company, filed a lawsuit against Procore Technologies, a provider of software for the construction industry, in a federal court in California. The suit accuses Procore of misappropriating confidential information to advance its business. According to Oracle’s claims, former Oracle employee Mark Mariano allegedly took "thousands" of trade secrets with him when he joined Procore, aiding the development of a competing software platform for managing construction payments.
Representatives for Procore, along with Oracle’s attorneys and spokespeople, did not immediately respond to requests for comment on Monday regarding the complaint. Efforts to reach Mariano for comment were also unsuccessful. Oracle, headquartered in Austin, Texas, stated that Mariano previously worked at Textura Payment Management, a construction invoicing and payment services company acquired by Oracle in 2016. The lawsuit claims that Mariano led a team at Oracle responsible for integrating third-party software with Oracle’s payment management platform.
The complaint states that Procore, headquartered in Carpinteria, California, recruited Mariano from Oracle in 2021. Oracle alleges that Mariano brought with him thousands of its files, including source code, customer data, and strategic research plans, which reportedly helped the "struggling" Procore reshape its business. According to Oracle, "soon after Mariano joined Procore with Oracle's confidential documents," Procore launched its own competing platform and swiftly introduced integrations similar to those that Oracle had previously developed while Mariano was involved in those projects.
