The Supreme Court has upheld a federal law designed to keep Native American children connected to Native American families in custody and adoption proceedings. 

A 7-2 majority of justices rejected challenges to the Indian Child Welfare Act from several states and White families who were seeking to permanently adopt Native children. They had argued they are being discriminated against and disadvantaged, in violation of equal protection guarantees in the Constitution.

"They argue that it exceeds federal authority, infringes state sovereignty, and discriminates on the basis of race," Justice Amy Coney Barrett wrote in the court's opinion for the case of Haaland v. Brackeen. "The United States, joined by several Indian Tribes, defends the law. The issues are complicated… .But the bottom line is that we reject all of petitioners’ challenges to the statute, some on the merits and others for lack of standing."

The dispute is a clash of tribal sovereignty, states' rights and racial discrimination claims.

At issue is whether the high court should toss out or severely dismantle the Indian Child Welfare Act of 1978, meant to protect Native American rights in state child custody proceedings. It has long been championed by tribal leaders as a means of preserving their families and culture. 

The case dealt with aspects of a unique relationship between Native tribes and the federal government, and the ability of state courts to broadly determine the discretionary "best interests" of children in placement hearings.

Among those challenging the law were Jennifer and Chad Brackeen of Fort Worth, Texas, who had first fostered, then adopted, a son known in court papers as A.L.M., beginning in 2016, after his mother, a member of the Navajo Nation was unable to care for him. The tribe sought to place the boy with other out-of-state tribal members not related to him. 

The Brackeens eventually won custody of A.L.M but now would like to adopt the child's half-sister, identified in state proceedings as Y.R.J.

"It's been three-and-a-half years in court, and we have not been able to finalize the adoption," Chad Brackeen told Fox News Digital. "Ultimately, these two siblings belong together."

But the more than three-fourths of the 574 federally-recognized American tribes told the Supreme Court in various amicus briefs the law has been on the books for 44 years and is working.

"The precedent of the Supreme Court is that Indian tribes are political groups of people, they are not racial groups of people," said Chrissi Ross Nimmo, the deputy attorney general of Cherokee Nation. "Tribes determine citizenship... just like countries." 

Many tribes warn of a broader loss of political sovereignty if the ICWA is struck down or weakened, over such matters as health care, education and housing, which are all covered under specific federal laws. 

Texas, along with Indiana and Louisiana, have also challenged the federal law, saying it oversteps authority over state child custody matters.

These categories are based off of actual policy enacted by both of these men while they were in office.

If the ONLY LINE YOU CARE ABOUT is line 12, you have an incredible amount of privilege, AND YOU DO NOT CARE ABOUT PALESTINIANS. Biden openly supports access to abortion and has taken steps to protect those rights at a federal level even after Roe v Wade was overturned. Trump, on the other hand, was the man who appointed the judges who helped overturn Roe v Wade and he openly brags about how proud he is of that decision. He also states that he believes individual states should have the final say in whether or not abortion is legal, and that he trusts them to "do the right thing", meaning he supports stronger abortion bans.

I'm rolling healthcare and prescriptions and vaccines and public health all into one category here since they are related. Biden has lowered drug costs, expanded access to medicaid, and ACA enrollment has risen during his presidency. He has also made it so medical debt no longer applies to a person's credit score. He signed many executive orders during his first few weeks in office in order to get a handle on Trump's grievous mishandling of the COVID pandemic. Trump also wants to end the ACA. Trump is well known for refusing to wear a mask during the pandemic, encouraging the use of hydroxylchloroquine to "treat" COVID, and being openly anti-vaxx.

Trump wants to reverse the student loan forgiveness plans Biden has enacted. Biden has already forgiven billions of dollars in loans and continues to work towards forgiving more.

Infrastructure funding:

I'm putting these links next together because they are all about infrastructure.

In general, Trump's "achievements" for infrastructure were to destroy environmental protections to speed up projects. Many of his plans were ineffective due to the fact that he did not clearly outline where the money was going to come from, and he was unwilling to raise taxes to pay for the projects. He was unable (and unwilling) to pass a bipartisan infrastructure bill during his 4 years in office. He did sign a few disaster relief bills. He did not enthusiastically promote renewable energy infrastructure. He created "Infrastructure Weeks" that the federal government then failed to fund. Trump did not do nothing for infrastructure, but his no-tax stance and his dislike for renewable energy means the contributions he made to American infrastructure were not as much as he claimed they were, nor as much as they could have been. Basically, he made a lot of promises, and delivered on very few of them. He is not "against" infrastructure, but he's certainly against funding it.

Biden was able to pass that bipartisan bill after taking office. The Bipartisan Infrastructure Plan that Trump tried to prevent from passing during Biden's term contains concrete funding sources and step by step plans to rebuild America's infrastructure. Biden has done far more for American infrastructure than Trump did, most notably by actually getting the bipartisan bill through congress.

Trump's racist policies are loud and clear for everyone to hear. We all heard him call Mexicans "Drug dealers, criminals, rapists". We all watched as he enacted travel bans on people from majority-Muslim nations. Biden, on the other hand, has done quite a lot during his term to attempt to reconcile racism in this country, including reversing Trump's "Muslim ban" the first day he was in office.

From pardons for non-violent marijuana convictions to reducing the federal government's reliance on private prisons, Biden has done a lot in four years to reform our criminal justice system on the federal level. Meanwhile, Trump has described himself as "tough on crime". He advocates for more policing, including "stop and frisk" activities. Ironically it's actually quite difficult to find sources about what Trump thinks about crime, because almost all of the search results are about his own crimes.

Biden supports Israel financially and militarily and promotes holding Israel close. So did Trump. Trump was also very pro-Israel during his time in office and even moved the embassy to Jerusalem and declared Jerusalem the capitol of Israel, a move that inflamed attitudes in the region.

Trump has tried to be quiet on the issue but recently said he wants Israel to "finish the problem". He of course claims he could have prevented the whole problem. Trump also openly stated after Oct 7th that he would bar immigrants who support Hamas from the country and send in officers to American protests to arrest anyone supporting Hamas.

Biden meanwhile has been quietly urging Netanyahu to accept a ceasefire deal for months, including the most recent announcement earlier in June, though it seems as though that deal has finally fallen through as well.

Numerous scholars, historians, political scientists, and journalists have characterized those efforts to overturn the election as an attempted self-coup by Trump.

Ya see, The fact that someone could use our political system to bastardize it as Trump has done, and is presently doing, is a testament that the system was designed to favor the wealthy and not middle class Americans,....which are the majority of Americans,... always have been, because without the middle class there would be no labor to build the America we see today.

It is extremely disturbing how many posts I see claiming that Roe v. Wade was overturned on Biden's watch and blaming him and the Democratic Party for it. It's disturbing on a number of levels.

First, it was Trump and Bush-appointed justices who handed down the Dobbs decision. This is a flagrant example of blaming Democrats for things Republicans did, and not coincidentally is one of the the most widely felt differences between the two parties. As a result, it's usually the first example Democrats and their allies point to; this misappropriation suggests a deliberate attempt to undercut that fact.

Secondly, and related to the first point, it obfuscates who the real enemy is, and I am comfortable using word "enemy" to describe the Republican Party because of the policies they advocate and enact. The truth is that states controlled by the Republican Party were where the effects of Dobbs are most severely felt, while states controlled by the Democratic Party are passing laws to protect abortion. It is important to know which party opposes abortion and which party supports it. If the Republicans gain control of the House, Senate, and White House, they will pass a national abortion ban, as they have done at the state level in several places.

Thirdly, blaming Biden for Dobbs demonstrates a very concerning lack of understanding of how the government functions. The judiciary is its own branch of government; judges are appointed by the president and confirmed by the senate. It doesn't matter who is president when a decision is handed down, it matters who was president when the justices were appointed. People sometimes react to this by moving the goalposts and claiming the real issue was a failure by Democrats to "codify" Roe v. Wade. I am not sure what "codify" means in this context, and I'm not sure they are either. One thing it does not mean is that congress can pass a law saying "abortion is legal forever." Republicans could easily repeal such a law and it the federal government cannot necessarily prevent states from restricting abortion at the state level. Roe v. Wade was a ruling stating that the constitution guaranteed a right to privacy, which included the right to have an abortion. This prevented abortion restrictions in a way federal law cannot. That doesn't mean passing federal law protecting abortion is a bad idea, but it isn't a foolproof protection. It's fair to argue that the Democratic Party and the left of center generally were complacent about abortion. The form of this complacency was not taking the courts seriously, while the right spent fifty years openly filling the courts with anti-abortion judges.

The last thing that worries me is that this is popping up phrased almost the exact same way all over the place. I am afraid that it is not merely incompetence, but intentional misinformation, that is then repeated by the incompetent who believe it.

I know some will probably dismiss this post as being from a "vote harder" liberal Biden supporter, but whatever your feelings about Biden, the Democratic Party, or the democratic process in the U.S., you should care about the truth. The truth is that Roe v. Wade was overturned by Republican-appointed judges and abortion bans are being enacted by Republican elected officials, and Joe Biden opposes these things. You can do with that information whatever you wish, but you denying it is dishonest.
