THE KING AND QUEEN OF AMESTRIS – AN EXCLUSIVE LOOK INTO THE WEDDING OF THE YEAR
by Violet Whittaker and Laura Richter for PRIMA Magazine (photographs supplied by Wolffe Photography)
“We never thought this day would happen.” It’s the event Amestris has been waiting for with feverish anticipation – the wedding of Führer Roy Mustang to Lieutenant-Colonel Riza Hawkeye. Violet Whittaker and Laura Richter follow the pair on their wedding day and gain some insight into the private lives of the most talked-about people in the country.
It is a new experience for the leader of the nation, after a frantic year of picking up the mantle left in his wake by a country transformed almost overnight into a democracy. Nobody could say that the transition, led by the former Führer President, George Grumman, was not without its issues. But even as then-General Roy Mustang was sworn in after a historical vote that saw the Amestrian public having a say in their future for the very first time, nobody could have expected this new presidency to usher in such a feeling of hope and anticipation for what lies ahead. Mustang’s views, well-articulated from his campaign and debates, resonated deeply with the country – resulting in a landslide victory that proved the man and his vision for the future were unparalleled.
But it seems he’s met his match in his bride, the woman who has been one step behind him for almost his entire career in the military and politics. Riza Hawkeye, is a force to be reckoned with in her own right, with a much-decorated military career spanning back to her tender years as a teenager. An ever-present shadow in the background of many a press photo, Lieutenant-Colonel Hawkeye oversees her fiancé’s security detail – a job, she admits, that never seems to stop even when she’s off the clock.
On a quiet Thursday morning, the craggy, snow-dusted tops of the Cremil Ranges provide an unforgettable backdrop to today’s event. The blushing bride and groom are radiant since tying the knot in a gorgeous, relaxed and deeply personal ceremony overlooking Lake Mély, the place where they became engaged just over a year ago. It’s a sentimental moment to reflect on their romantic – and emotional – exchange of vows.
“When I saw her for the first time I choked up a bit,” the Führer confesses to PRIMA, never taking eyes off the now First Lady. “I was blown away. I knew I would be, but more so than I thought. She was beautiful.”
There is no pomp, no circumstance and none of the stiff formalities one might expect with such a high-profile wedding. Instead, it is a ceremony filled with laughter and joy, influenced by the couple’s own down-to-earth, understated and old-fashioned romance.
Flanked by his groomsmen, a beaming Roy is positioned under an arch that was created especially for this event. The groom waits patiently as the guests take their seats. But nerves that never made themselves known on the political ground seem to take over Roy, looking exceptionally clean-cut in his Mikhail Abel suit, keeps sneaking glances at the point where Riza will emerge.
The groom has spent the morning with his old military buddies at a friend’s house in the idyllic town of Lyford, East Province, while Riza, 32, gets ready with her small contingency of bridesmaids at the nearby Watkin Lodge, where the reception will be held afterwards. In high spirits, she manages to laugh about the less-than-favourable weather forecast as the radio plays in the background. Between each song, you can hear the messages of congratulations from the public being passed along by the radio hosts.
“We’re unbelievably humbled by all the support,” she says, fiddling with her earrings – which are, in a nod to tradition, her ‘something old’. Her veil has been borrowed from her maid of honour, a modest piece with delicate lacing detailing the edges. Her new wedding dress follows in a similar fashion – a simplistic A-line design that allows the bride’s beauty to shine through. The high neck and long sleeves are a choice that will undoubtedly be imitated by other brides, despite her protests that she is nothing of a ‘fashion icon’. Her simple, uncluttered approach has quickly made an impression with the public, with garments being sold out within days after she’s pictured wearing them.
However, Riza admits that she found herself a little stumped by the ‘something blue’.
“Honestly, I should’ve just worn the dress uniform – that would’ve covered it nicely.” The pragmatism is a refreshing change that reflects not only on Riza’s character, but the overall direction in which the Mustang’s wish to guide the country towards. In the end, her bouquet has been threaded with forget-me-nots, with bright yellow splashes of coronella and pink peonies.
Before long, cars are arriving, and last-minute adjustments are being made before the bridal party sets off for Lake Mély. The freshly-woven crown of clover is the last accessory to be added, pinned into her hair with care.
As he sees his bride finally appear, Roy’s eyes light up and that familiar, dazzling grin plays across his face – though this time it is a lot softer and meant for only his bride. Guests beam, and in some cases, shed tears as Riza walks past. But the real waterworks come out when their vows are spoken, small speeches that can only scrape the surface of a relationship that has gone back decades. There is large whooping from the guests when Roy calls Riza ‘his queen’, and similar cheering when Riza takes a moment to compose herself mid-speech, blinking furiously and promising in no uncertain terms that she will follow him anywhere.
“It’s been a long time since I’ve felt butterflies in my stomach,” Riza tells after the ceremony, smoothing down the silk of her dress. “But it wasn’t nervousness. Why would it be?” Here, she shoots a rare smile to her new husband. “It’s like you’ve been imagining this insurmountable obstacle and then you actually see it and realise it’s not as bad as you thought. I remember seeing you standing there and all I could think was – ‘oh, there you are. I’ve been waiting for you’.”
Tumblr media
Both openly admit that marriage was never on the cards for them originally – with their positions as superior and subordinate for so long during their careers in the military, working together meant that any feelings the couple had for one another had to be buried deep, and never explored. “To say that there was a day when I didn’t love Riza Hawkeye, and then a day where I did is completely wrong,” Roy says. “Ever since I met her, I knew she would be a person who would have a monumental impact on my life. But we both knew that there were more important things to do than complain about where our choices left us.”
The two of them share a long and complicated history, most notably marred by the Ishvallan Civil War. Both served during the conflict, and the pair have always remained tight-lipped about their experiences there. But the choice to share their wedding with the public was not an easy one to make.
“We appreciated that there was a lot of interest,” Roy says diplomatically. “And we wanted to acknowledge the widespread support we’ve received following the announcement of our engagement.”
The following reception is rumoured to be legendary, but strictly a private affair. For the guests invited, it is sure to be a party filled with plenty of laughs and stories (both inspiring and embarrassing) about the couple. For the rest of us? Perhaps a reminder that love can be found and expressed in unassuming ways, and that you don’t need big flashy displays to reflect the years of quiet devotion that all of us can only dream of one day having.
The entire team at PRIMA Magazine wishes the newlyweds all the best in their new marriage.
(this piece was originally written for @royaizine and i finally remembered to upload it here! this is in the same fashion as my ‘hawk’s eye: definitive interview’ piece. please go and check out what everyone else did in the zine! there’s some truly spectacular writing and art created bc of it <3)

Okay, 4x9:
-There’s more than usual ‘Shut up, Chet’ kinda stuff in this one, but ’I didn’t know slightly demented firemen drove a special kind of car’ is pretty funny.
-There’s a bed in the back of Johnny’s Land Rover? For camping, or trying to get some action? (Or both?) If it’s the latter, we may have a clue as to why he keeps getting the brush-off, jeez, at least have an indoor bed at hand, dude.
-The frat house rescue: When Johnny and Roy were in training for this job, I bet neither of them ever envisioned ‘pulling raw liver out of an unconscious man’s throat while surrounded by a bunch of other guys in diapers’ but here we are.
-Dixie in Full Rant Mode is always fun -- when she hangs up after talking to O’Brien, she really looks like she’s about to curse. And clearly Brackett has seen her and O’Brien go several rounds of this argument before.
-(Her ‘typing’ during the ‘banging out a Very Pissed-Off Letter on this typewriter’ bit looks like random keysmashing though, which makes it somehow even funnier)
-And Dix goes from ‘writing letter so ferocious it kinda scares Brackett’ straight to consoling that freaked-out woman = emotional whiplash
-At the station: Lookit these two idiots who are seriously having second thoughts about this whole car-trade thing but don’t want to admit it. And then Chet shows up to troll them.
-Everyone offering cures for Early’s hiccups, nobody listening to the kid, and the kid finally just fetching some damn soda. Was Dixie’s sudden little crack-up and ‘He looks like an elephant’ scripted, or did Julie London lose it for a second and they left it in because it worked? (And wow she had an endearingly dorky full-out grin.)
-OH SHIT O’Brien shows up and here’s where ‘this is the least believeable thing I’ve seen on this show’ enters: Because a Man in Authority who’s been challenged repeatedly by a woman who’s also a subordinate is sure as hell not likely to offer that woman a promotion. He’d be way more likely to find ways to give her shit unlimited for however long they were both there.
-(Maybe O’Brien is trying to promote Dix to shove her out of the ER without it looking like retaliation/hoping she’d fail at the increased responsibility and he could fire her -- but if so they really didn’t put it across very well.)
-Dix rather spacily checking out her prospective office and I was just imagining her train of thought: Don’t really want this promotion. Nice setup, though. Window and everything. A couch, could be useful, I could sneak Kel up here when we’re both on break and -- oh, what the hell am I even thinking?
-At the station: Did no one ever tell Johnny not to talk with his mouth full? (Hey, are the 2nd or 3rd dates women always seem to dump him after dinner dates by any chance?) And is Cap’s ‘Don’t look at me -- my wife drives an Edsel’ one of Michael Norell’s ad-libs?
-The basketball player stuck in the car is a very plausible WTF and there are also some great potential double entendres in this scene. (I lost it right around when Johnny starts talking about how delicate he can be with his tool.)
-So Dix turns down the promotion and O’Brien is just...okay with this, and never mentions it again, and I’m pretty sure we never hear about him or their conflict ever again? Least Believeable Thing, I’m telling you.
-At the station: Johnny, if you’ve ‘seen that woman on that same corner for years’ the odds she’s a sex worker and was waving cos she figured ‘guy in sports car = disposable $, possible client’ are likely higher than zero, is all I’m saying. (Which somehow makes Chet’s ‘Maybe she thought you were Roy’ even funnier.)
-And suddenly the drawbridge accident slams us from that into something really seriously harrowing like holy shit. The guys climbing up that severely tilted bridge with ropes is surreal. (I don’t like heights so this one really freaks me out.)
-At the station: ’Isn’t it something how you can form an attachment to a piece of machinery?’ one engaging dingbat says to the other engaging dingbat who bought an antique fire engine with him. (And they finally admit they don’t want to trade cars.)

When The Best You Can Do Is Shoot A Gun
The Animal Crossing / Doom Eternal Covid19 launch coincidentally seems to be related to this discussion, even tho I’d say Doom Eternal has an excellent combat system and isn’t really relevant to what I’m going to bring up. I don’t have a problem with shooty-shooty, I have purchased, played and will continue to purchase and play plenty of video games that engage with firearm violence. There are plenty of discussions about how intelligent, consenting adults can do this without any problems and I won’t retread them here. Doom is simple game themed vaguely around demons; demons bad, player protagonist good, good player shoot bad demons - OK you got it, apply an incredible movement system into that and enjoy.
What I want to discuss involves of-course that pesky word and idea nuance, which annoys the shit out of more people these days, for its applications and misapplications - fingers-crossed I don’t fuck it up, but first I want to bring up Ubisoft and systems, so now’s as good a place as any for a stolen picture from the internet.
Tumblr media
As far as concept art goes, that’s actually very representative of the final product in-game.
Ubisoft appear to have a long-term open-world tech development objective. I believe at some point very soon, these individual objectives will converge into one single middleware product with a mandate to producce retail licenses that combine what each of these individual franchises have been testing and achieving in isolation, those being;
Ghost Recon Wildlands and Breakpoint: 3rd person Load-On-Demand
The Division: 3rd Person Cover and interactivity
Assassin’s Creed: Environmental mapping and interactivity
Starlink: Scaling Load-On-Demand
Far Cry: First Person implementation of various combinations of above
I’ll put it another way;
Ghost Recon: Load everything
The Division: stick to everything
Assassin’s Creed: climb everything
Starlink: scale everything
Far Cry: do it in first person perspective
It looks like all of these games are running in Ubisoft in-house proprietary engines. Ghost Recon and Assassin’s Creed are running in Anvil, developed for the very first Assassin’s game and in which the Prince of Persia 2008 and Forgotten Sands also ran in. Oddly, (Rainbow Six) Seige, Steep (lol) and For Honor are also running in Anvil.
Both Division games and Starlink are running in Snowdrop and this appears to be due to The Division having come from Massive Entertainment. I’ll be honest, from the perspective of a consumer (read: punter) and someone with extremely minimal 3rd-hand development experience, The Division looks far more impressive than both the Ghost Recon and Assasin’s games, and former Massive brand and art director Rodrigo Cortes has said of the engine that it was design to “do things  better not bigger” and I think it shows. Anyway, it was still developed with Ubisoft so as I understand it, they own it. Massive is a Ubisoft subsidiary, their studio based in Sweden.
Far Cry is going to be a little different, being a little older and having its roots slightly before... what shall we call this mess... the cynical age? The microtransaciton age? Anyway. The first game used the CryEngine developed by Crytek. At some point, Ubisoft seemed to develop an offshoot of the engine called Dunia because the CryEngine was licensed and clearly lucrative, I think. I’m not entirely sure, but Dunia does appear to remain in-house and under the auspices of Ubisoft Montreal. Where am I going with all this?
Tumblr media
Starlink was “toys to life” a-la Skylanders but way too late, combined with No Man’s Sky-lite, but the game itself other than being overstuffed with Ubisoft copy-and-paste template-quests is an excellent proof of concept.
I do need to say that in general, I don’t have any particular affinity for Ubisoft. So I am yes, absolutely fascinated with something I do think is happening as far as tech goes and now I’m writing about it in this piece, and yes you can tell I’ve played and even enjoyed some of the games they’ve produced and published, but there’s a lot not to like about many of their practices, the least of which is the overbearing sense of cynicism pervasive in many of their games.
I played Far Cry 3 long after it released and got perhaps 20% thru the campaign before giving up entirely. For starters, nothing about how it controlled felt right and I appreciate that’s purely a personal preference. Being a Battlefield player, there’s something about DICE’s sense of locomotion that is perfect to me, even tho it varies from title to title from Bad Company 2 all the way to V most recently. Other things about Far Cry bother me tho - if there’s wildlife around, it always attacks the player, guaranteed. Everything about this game seems to be designed to force the player into engagement, to provide you with materials to collect, craft or sell, but also to run you short of ammunition to either scrounge for more or have to buy it because *surprise* - it prompts you to purchase ammunition for real-world money. ARE YOU FUCKING KIDDING ME? Fuck off. I uninstalled the game immediately. I can deal with ridiculous AI with magical aim and irrational scripting. I can deal with absurd narrative for the sake of reading (and roasting later), but the entire package culminating in purchasing more ammunition was otherworldly, it was truly bizarre. To this day, I don’t understand what world Ubisoft inhabits that this is something that makes sense to anyone in management or marketing, and yet there it is and there are consumers that not only accept it but embrace it. No doubt there are metrics from the mobile industry that support it and dear lord the capitalist apocalypse is upon us.
What will Ubisoft do when they can merge these technologies? They definitely want to and likely already have in-house, they just need the engine to run client-side for the Consumer. You and I and Inside Gaming are all laughing it up at Stadia right now, but we’re at the wrong end of the business. For Ubisoft, they can ignore the faltering at the start, it’s the long-term they focus on. The pittance Google are losing now, even if they end-up shuttering the project will be meaningless if they end-up getting the hardware to work, even if the end-result is the hardware sitting in a box in the consumer’s home in 10 years. Sure, that’s a long loop, but the journey still doesn’t matter, only the eventual ROI.
If this piece hasn’t gotten boring for you yet, it’s about to because you’re probably excited for what Ubisoft will do with this impending technological power and development and I rally am not. What will Ubisoft do with it? Probably just more Assassin’s Creed, except you’ll be able to snap to cover and have a fully mapped country. Probably more The Division, but you’ll have a fully mapped city that you can also climb on the outside of buildings and then enter them without any loading. Probably more Far Cry but with bigger maps and more interactivity and less loading. The next generation of consumer hardware consoles from Microsoft and Sony are upon us and as much as PC enthusiasts hate to admit it, the consumer market is largely gated by the generational hardware stepping of these platforms. That may change after this era depending on how Google, Amazon and indeed Microsoft and Sony go with cloud computing, but for the moment the status-quo will remain as alternative products develop. Bear in mind with Covid19, climate change and the general sustainability and ethical standards of working and living being under growing scrutiny the world over, things are changing more each day, our technology development may change in ways we don’t expect so who even knows what’s in store for the future.
So What Do I Actually Want?
Good question. NB: before you ask, Animal Crossing isn’t my thing. I played it years ago on Gamecube. It’s cute, it’s fine. I’ve no interest in it. I’m writing this note in retrospect because I realise you may say “Just play Animal Crossing or The Sims but hopefully I can illustrate by neither of those games is what I’m after, nor do I just want to build a house in something like No Man’s Sky and fill it with crap. Let’s see if I get there... A few weeks ago I wrote about how the best thing Naughty Dog did with Uncharted 4 was Elena and Nathan’s domestic spaces. I did purchase The Division 2 on the cheap a couple of weeks ago and I’ll be honest, there’s a lot about it that I’m enjoying quite a bit. For a start, visually it’s stunning. The art team have done an excellent job of both filling the world with immense detail, but also making every area of Washington unique and distinct which is a huge feat given the total space covered. Thus far, I’ve spent a whole lot of time just walking around and gathering resources, in part just to sightsee and explore without any particular objective in mind. After a while, I got the impression that the map was a bit flat, but the more you explore, the more you find places where you get verticality, and then doing missions always adds verticality and variety in environmental and art design, it’s a marvel to see.
Tumblr media
Apologies to James and Thomas (above) for ripping these images, but I’m glad your names are in frame so you have direct credit - outstanding work. The art in this game is without question its strongest element.
And that’s just the thing - The Division is an interesting game in that what I enjoy most is the sense of walking around exploring, gather resources and helping people. I’m not here on an anti-violence kick - I play Battlefield, I actually don’t mind the shooting in The Division, it’s fine, whatever, I’m not going to justify that. What I’m saying is that it gets boring.
THERE ARE A LOT OF GAMES ABOUT SHOOTING.
Like... a lot. More than enough. There will always be a lot of games about shooting and that’s fine. I think I’ll always play them. Hey, I even play games about shooting *in very specific ways* - it’s not like I don’t care about the shooting, I’m playing The Division with only a bullpup DMR and shotgun combo, plus I’m trying to use my sidearm when traversing the streets as much as possible so don’t at me, I’m in the game.
But we seem to mostly get high detail assets in games with guns because shooty games get all the money. I get it - shooty games get all the sales because we as gamers like to play them - sure, I’m one of them, but I didn’t buy The Division until it was under AUD$30 because gotdam the shooting is so boring and even now yes, it really do be just more boring shooting, just like it’s boring in Uncharted, just like it’s boring in Ghost Recon (my goooooood so boring), just like it is in Destiny, and the umpteenth shooty mcshooty game. I’m getting too old for this.
Uncharted 4 had an opportunity to do something more and it almost did. For many players, it probably achieved enough of what I was after by those two visits to the Fisher and North residences but I wanted so much more of that. I want to see Sully’s house or houses, more of his life. I want to know where Chloe’s life is at. I want to know of their lives and emotional engagements outside of the frankly stupid narrative I have no interest in because it’s clearly stupid and an excuse for running and jumping that other games have since done better. If Uncharted as a whole was a subtext for character, then by the fourth game, the focus should have been the characters that carried the series thru to the end - no disrespect to Tom Baker - not the heretofore unrevealed older brother.
For Years I Didn’t Know “Walking Simulator” Was A Pejorative
I think this is why I replayed and continue to replay Dear Ester so much. I remember laughing my ass off at YouTubers making videos about how it wasn’t a game and that it didn’t have objectives. Yet there were still threads and might still be on reddit or Discord wherever gamers congregate these days - about “virtual tourism” and “just chillin’ in place x because it’s so awesome” etc. It’s fine, each generation will rediscover virtual tourism again and again and we can’t denigrate anyone for doing so, it’s certainly nothing we invented given it comes from literature and oral tradition before that, but it’s remarkable that there’s this resistance to experiences crafted purely for the purposes of being immersed in them.
I adore Dear Ester and Everybody’s Gone To The Rapture. Absolutely loved What Remains Of Edith Finch and only if you have already played Edith Finch, because it’s full of spoilers but also its own spoiler warnings, I heartily recommend Joseph Anderson’s outstanding video The Villain of Edith Finch. It’s a 53 minute watch so I won’t embed it, and he has a certain style of presentation that won’t gel with everyone, nor do I always agree with everything he says which should go without saying but at some point folks, you have to stop pursuing art, criticism and media that just wholly aligns with your own views. That said, I generally do find most of what he says agreeable, innit. Anyway he’s great and the video is great.
Tumblr media
While Dear Esther is more surreal and Rapture and Edith Finch are in part slightly more fantastical than the real-life settings of Uncharted 4′s home and Division’s post-apocalyptic cities, they all visually represent dense, very human object-rich spaces that to me are quite interesting to explore. Dear Esther might be a little more rooted in nature but its human elements tie-in to its narrative in an extremely interesting way. Each game offers different levels of interaction, some that serve the narrative directly, some as subtexts and others quite mildly in the periphery.
I’m sorry if I’m repeating myself but I remember seeing a promo for Battlefield Hardline coming off the back of Battlefield 4 and the ridiculous marketing phrase “levolution” - the term they coined for large-scale environmental destruction (please take the keys away from the marketing department). I remember seeing video footage of a large construction crane falling in a level and thinking
“All this intelligence, all this tech, and this is what we do with it? Is this all we can achieve? This is it?”
That’s how I feel about this emerging technology. Somewhere out there (on YouTube, to be fair), there’s all this footage buried of the Beyond Good And Evil sequel that to everyone’s knowledge is still in development. I’d put my money on that being the first project built in Ubisoft’s convergence engine that they hope successfully implements everything that each of these games executes individually. I know the BG&E fans are frothing for it and when I saw those early demos, what I interpret of the tech did blow me away, but from an experience perspective, I did still think the same thing...
“Is this it?”
Because of-course, a huge part of the new game is going to be combat. I just - don’t - care. When I think about what was lacking in Uncharted 4, what I wanted more of, it was intimacy. What didn’t I like about the conversation and resolution between Elena and Nathan? About the tours of their homes, the little time spent playing as Cassie, the few insights into Sully as a character, the absence of Chloe who was such a great contrast to Nathan, Elena and Sully all-together... it was intimacy. Yea oroight, so I don’t exactly mean the type of real-life intimacy between lovers, do I - that much is clear. But if I don’t mean shooty because there’s enough of that, and I’m leaning into domestic detail and emotional exploration and reflections of that in objects, spaces and interactivity, then that’s what I mean.
Tho I’m loath to bring it up, I feel like in the worst possible way, David Cage is right on the periphery of this discussion (and for that reason, I ain’t tagging him or his games in this entry, get fucked). He has the most vague notion of trying to ground his games in the intimacy of human experience, so he tries to tie human locomotion and objects to the digital representations of interactivity. If we take those as perhaps the worst possible examples and then come back to some really good examples in Uncharted 4 so I can stop whipping it - I maintain that the house tours are strengths and the high-points of the game, and then look at something like The Division and consider opportunities for more complex interactivity centred around helping people and emotional engagement, I feel like that’s what I’m after.
Which is impossible, right? No-one’s going to make a game even a quarter of the scope of The Division, with all that amazing dynamic lighting, with all those awesome textures and mapped objects, animations, rigged character models, complex scripting and AI, interactivity, load-on-demand tech and full voice-talented support, just to be a game about exploring, sightseeing, meeting and learning about people and helping them? Because who would play that?
I would, for a start.

Thank you so much, for everything P.2 (Biadore) ~Rat~
An: thank you so much for the love on part one, I really appreciate it. Be warned this chapter does contain some smut towards the end (words: 1508)
Roy’s eyes fluttered open as he slowly started to register his surroundings. He scanned the walls and room; this wasn’t his bed. He found his body under the weight of another person who seemed to be completely oblivious in their dreamy state. As he became more conscious, he became very aware that he and this other person were naked. And then like a flip of a switch everything made sense and came flooding back. Danny.
A tidal wave of emotions rushed over him, panic, regret, lust, but most of all, guilt. His mind is going insane. How dare he take advantage of Danny like that? He had just gotten out of his first long term relationship a mere 2 weeks ago.
As Roy is just about to slip out and leave a note but Danny completely dashes all his plans by abruptly waking up with no warning. The younger immediately sits up in a panic like state, his face like he had just witnessed a murder. He glanced over the body who was awkwardly half sitting and laying down, next to him. Relief visibly washed over him.
‘Oh it’s just you’ he sighed as lay back down with a thud.
‘And good morning to you too’ Roy retorted.
Danny glanced outside only to see its pitch black out, he grabbed his phone from the bedside table to check the time
21:04
‘Evening actually, it’s 9pm’ Danny replied, smirking slightly for no real reason
Then an awkward silence fell upon the pair. They were so close so silences had never been weird before but I suppose it’s different when you’re naked in bed with your best friend a mere two weeks after a serious breakup. Besides what are you supposed to say after that?
‘Look Danny I’m sorry’ the older began, breaking the silence
‘For what?’ Danny said, laughing but with genuine confusion laced in his tone
‘For taking advantage of you, you were in a bad place and really vulnerable. I slept with you when you were probably not thinking straight. I mean what kind of friend does that?’ He practically whispered in upset and defeat.
‘Woah, woah, Roy no. It’s not like that. I’m not a kid, I’m 26. I have to take some responsibility no matter what state of mind I was in’ Danny replied, still slightly laughing but also very sympathetically
‘I know, but-‘ Roy said before he was cut off
‘Plus I initiated it! I wanted to and I don’t know about you but I don’t regret it one bit’ he interrupted
‘Still…I could’ve said no’ he uttered
‘Well ya didn’t. And what’s done is done’ the younger practically sung cheerfully in an attempt to lighten the mood ‘you want pizza?’
‘Nah I should really be heading back now. Also Danny, I know you don’t regret it and I don’t either, but we can’t do this again. We’re about to do BOTs again and I don’t want to ruin anything if one of us catches feelings’ Roy explained.
‘No I totally get it. I was going to say the same’ Danny lied.
———————————————
After seeing Roy out, Danny’s mind went manic. What did he mean by ‘catch feelings’? Did Roy feel something? Was Danny feeling something? Why was he so disappointing that Roy didn’t want to sleep with him again?
As Roy basically did the walk of shame back to his apartment his mind was also racing. How could he do that to Danny? Was he catching feelings for him? Is a 14 year age gap too much? Is BOTs gunna be awkward? Will they ever be the same again? His train of thought came to a halt when he was greeted by two elated pups at his feet.
———————————————
Three weeks had passed since the incident and the pair had barely spoken to one another. However that was going to change because BOTs was starting today. They’ve got to act normal or the other queens will figure out something happened.
Danny hauled his over-packed suitcases into the storage compartment of the bus before taking his comparatively tiny night bag to the bus. Danny being the social butterfly he is, he picked a bunk that was surrounded by other full bunks. However he had failed to realise his bed was directly opposite Roy’s. ‘It’s fine’ he thought to himself. Roy’s supposed to be his best friend so this was gunna be fun right? Deciding he didn’t want other queens to become suspicious, he did what he did what he did best. Annoy Roy
‘Hey roomie’ he giggled as he poked Roy’s back, who was laying in his bed facing the wall.
‘Oh god’ the older queen scoffed with a soft laugh as he rolled over to face Danny and the rest of the world.
And just like that the previous 3 weeks of awkwardness melted away. Roy sat up to have a proper conversation. They chatted about life for around 5 or so minutes before they were interrupted by a certain someone.
‘Hieeeeeee’ Alaska yelled as he pranced on the bus with his recently won all stars crown on his head.
‘Why are you wearing that?’ Danny snorted in an attempt to speak through his hysterical laughter
‘Even though Violet has her crown I still don’t trust her so I have to keep it on me at all times’ Alaska spoke, loud enough so Violet could hear which sent the entire bus into a giggle fit.
And almost as if planned Kim Chi fell onto the bus which just set everyone off even more. This tour was going to be great
———————————————
The 3rd show of the BOTs tour had finished around an hour ago and everything had gone perfectly. Roy and Danny were back to normal like nothing had happened so both their performances were flawless as usual. All the other queens de-dragged and either went to the club or the bus quite quickly. But Roy liked to take his time with it. He wanted everything to be clean so the janitors didn’t have too big of a job. Danny decided to wait today as they were the last two left and he didn’t want to walk alone.
‘Why are you so sweet?’ Danny sighed in awe
‘What?’ Roy asked as he was only half listening
‘I mean, literally no other queens takes so much care like you do. With the places they work and with other people. It’s adorable’ Danny replied, still in awe
‘Oh, I just always have’ Roy said.
He picked up the last few pieces of trash from the floor then turned to Danny who was sat on the now empty snack table, drinking a red bull.
‘Ready to go then?’ Roy half asked/announced.
‘Yeah just one thing’ he paused to take a sip of red bull ‘can I have a hug pleeaseee?’ Danny begged like a toddler.
It was no secret that Danny got very lonely on tour and consequently became very clingy, especially towards Roy. So Roy happily obliged and padded over to the pouting boy to engulf him in the tightest hug possible.
‘Thank you’ Danny muttered against the other queens neck.
Roy wordlessly began stroking Danny’s hair and slightly rocking the boy. They pulled away after what felt centuries but, as if like magnets, their lips came together. It was just as, if not more, electrifying than last time. Their lips and tongues moving together perfectly like they were made for each other. Everything in that moment felt right.
Roy began to kiss and nibble at Danny’s neck as the younger lifted the hem of his shirt, urgent to get it off.
Soon enough, their aforementioned promise to never do this again disappeared as Roy was fucking Danny against the table. Their sweaty bodies melted together seamlessly. Roy was biting his neck and practically hugging Danny as he finished inside the condom. He pulled out, swiftly took it off and put it in the trash. He went straight back to Danny who was sat on the table, head against the wall, legs wide open, naked and panting covered in sweat.
Roy got on his knees and asked Danny if he was okay. Once he got his response he began sucking Danny off until he came.
———————————————
They got dressed again without saying a word. This time it was Danny to break the silence
‘So much for never doing that again aye’ he joked
‘Yeah that’s too good to never do again’ the other replied ‘tell you what, for the rest of this tour we continue this but keep it strictly physical. We can sleep with other people. No feelings. What do you say?’
‘How could I say no?’ Danny winked and smirked with his tongue poking out through his teeth.
And so began the tour that would change their lives

The Art of Influence: 11 Techniques to Steal from House of Cards
No one personifies the dark arts of influence and persuasion like Frank Underwood from House of Cards.
Since my moniker is to bring the dark arts of influence into the light,  I’m going to explain his most influential techniques in order for you to start using them in your own life. So, if you’d like more people to bend to your will — in a positive, ethical way — you’re in the right place.
You might notice that most of these examples come from seasons 1-3 (I’ll try to avoid spoilers, but no promises.) and there’s a reason for this. As Frank rises to power throughout the series, he uses fewer skills of conversational influence and begins to default towards straight-up coercion.
I’ve chosen specific principles and techniques that you can (and should) use in your every day life. Frank uses these tools for nefarious purposes, but that doesn’t mean the tools themselves are evil. A hammer can kill, but it can also build a shelter. The hammer is neither good nor bad: the intention with which the hammer is used is, and the same is true of each of these techniques.
1. Influence the Influencer
In the first episode, Frank shares a poignant piece of influential advice.
FRANK: When it comes to the White House, you not only need the keys in your back pocket, you need the gatekeeper. (referring to the President’s Chief of Staff)
When you need to influence someone, you need to know who already influences that person. Whose opinion do they heed. Sometimes the best route to influencing your mark (the person you want to influence) is to actually build rapport with the person who already has influence over them and get them to do the convincing.
This comes up again later in the series when Frank says,
FRANK: The president is like a tree, bending whichever way the wind blows. And Raymond Tusk’s wind blows a little too strongly for my taste.
Frank knows that he has a strong opponent to either win over or remove from the equation. He is always aware of who holds sway over the person he wants to influence.
2. Communicate with a Goal
As a viewer, we have no idea of what Frank is up to, nor the scope of his schemes. But, it is clear that from day one, Frank and Claire have their plan.
The Underwoods exhibit a critical persuasive principle: influence is communication with a goal.
In episode one, Claire hints to their massive plans when she says, “This is going to be a big year for us.”
That quote also highlights another influential principle that most people struggle with…
3. Know Your Influential Timelines
People often associate the term influence with a single conversation. They believe that you are influential in one moment, but the best influencers know that influence requires time and strategy.
Influence is actually a 3-step process: 1. Observe, 2. Connect, 3. Influence.
If you try to jump to the 3rd step (influence) without learning (observe) your mark’s influential drivers and without building rapport (connect), then you might bungle the whole deal.
For example, CIA agents will plan on a year or more for turning an asset.
Every step counts. Don’t skip them.
Frank highlights his awareness of the time it takes and these necessary steps when he says, “”You can’t turn a no to a yes without a maybe in between.”
This is a particularly difficult lesson for our era of instant gratification. Most people aren’t wired for long term planning – especially when we really want to land a big business deal.
Just remember that the bigger the opportunity, the longer your influential timeline might need to be.
4. Suspend Your Ego
Frank Underwood seems to be pure ego, but he also knows the importance of suspending his ego when it’ll serve his greater purpose.
When he finds out that he won’t be named Secretary of State, even though he was promised the position, he is at an impasse. He could tell them all to go to hell, but instead he makes the smarter move. He doesn’t burn bridges.
He responds, “Whatever the President needs.” He knows it’s more important to be perceived as a team player than to be ousted from the group. By suspending his ego, he is able to adjust his plans and continue to influence from the inside.
And, of course, his ego is only suspended. When he gets a moment to himself, he let his anger and frustration out by smashing his cabinet at home.
Which is more important: your ego or the mission? That’s a question you must answer in many influential endeavors.
5. The Familiarity Principle
We watch Frank’s climb to power by how close he is to the President during press events. At first, he’s barely in the shot, then he’s only one or two people removed from the President, and then he is standing right behind him during the State of the Union.
In his words…
FRANK: Power is a lot like real estate. It’s all about location, location, location. The closer you are to the source, the higher your property value.
A related influential lesson is the familiarity principle. This basically states that people tend to build a preference for things simply because they have been exposed to them often enough. This is also called the mere-exposure effect. It’s the reason why companies spend so much in advertising and product placement. They want you to become familiar with their brand so that you develop a preference towards it.
There is a personal application for this principle as well. If you want to influence someone, plan out how they can regularly be exposed to you. Attend events that they will be at, communicate periodically, and include video conversations in your plan because you want them to see and hear you. Video is much more influential than email.
6. Quid Pro Quo
Everything about House of Cards is give and take — with the emphasis on take. Even though Frank’s angle is always to someone’s detriment, there is a lesson to be learned here: the Law of Reciprocity.
In general, the Law of Reciprocity goes like this: someone is more likely to do you a favor if you have done something or given them something first.
The interesting thing about the Law of Reciprocity is that you can likely get a return on value that well exceeds the value that you initially gave. Frank is aware of this when he helps Edward Meechum get back on his security detail.
FRANK: It requires very little of me and will mean the world to him. It’s a very inexpensive investment.
Simple favors can have a significant ROI. And Frank is right because that one favor earned him a highly loyal servant.
Frank also twists reciprocity into something much more diabolical when he says, “Generosity is its own form of power.”
7. Appeal to the Higher Self
There is only one glimmer of positive influence from Frank Underwood in the series. It is when he convinces Congressman Russo to get sober and not have a drink for a month so that he can run for Governor. A month goes by and Russo accomplishes the task. He returns to Frank saying that he’s prepared and ready to run.
When they conclude the meeting, Frank says, “Peter, I feel like I just met you for the first time right now” — implying he’s a changed man now that he’s sober. Frank is positively reinforcing Russo’s behavior. With this, he is appealing to Russo’s higher self.
Everyone has a vision for themselves—the person they know they can become. One of the best positive ways to influence someone is to show them how your idea will help them attain their higher self.
Of course, in House of Cards, this positive technique is overshadowed by Frank’s bigger plans.
8. Strategic Confession
Frank (almost) gets caught in one of his schemes when the President’s Chief of Staff directly asks him if he helped her son get into Stanford in hopes that she would help him get appointed to a high-level position. She clearly has figured it out and she puts him on the spot.
Most people would panic, but not Frank.
He knows how to leverage the moment to actually make himself seem even more trustworthy. He uses the opportunity to make a strategic confession. He confirms all of her suspicions. And because she feels like she finally has the whole story (which she really doesn’t), she feels comfortable enough to move forward with their plan.
Making concessions or sharing your flaws can actually be highly influential. I outline this specific technique in more detail in this article.
9. Use Their Words, Not Yours
Once again Frank takes a blow when he finds out that the President wants to nominate someone else to a job instead of Frank.
And once again, Frank is faced with the need to suspend his ego so that he can serve his bigger mission.
When the President asks Frank what he thinks about the idea, Frank responds,
FRANK: I think that Raymond Tusk is an exciting, bold idea.
Clearly, Frank doesn’t share what he actually thinks. He did something even smarter.
Frank chose those words — “exciting” and “bold”— specifically because he was told prior to the meeting that that’s how the President felt about the decision. Frank used the President’s words instead of his own, which made the President feel good and validated.
Be aware of the specific words your mark uses to describe a person, situation, thing, or their feelings. When the opportunity presents itself, use those keywords in conversation and you’ll get the same effect that Frank did.
They will feel heard and validated, like you get them.
10. The Door in the Face Technique
Sometimes the most influential thing you can do is NOT get what you want.
This is known as the “door in the face” technique, when you purposefully ask for something that you know the other person is likely to say no to. The theory is that if they have said no to you for one thing, they are more likely to comply to the next…or the next. When done well, you trigger the person’s desire to be polite and helpful, and they are more likely to work with you because they did, after all, already shut you down on one thing.
Or, in Frank’s words:
FRANK: The only thing more satisfying than convincing someone to do what I want is failing to persuade them on purpose. It’s like a do not enter sign. It just begs you to walk in the door.
11. A Partner in Persuasion
Here’s the it’s-so-obvious-that-you-probably-missed-it influential lesson of House of Cards. Frank isn’t working alone; he has Claire with him. They create their plan together. They adjust to the unexpected together. They role play through critical conversations together.
This is directly reflected with the world’s best influencers as well. Field agents have their handlers to plan with. Some of the biggest cons are done with a team. Trial attorneys role play with fellow attorneys within the firm. Hostage negotiators will have a team of other law enforcement officers feeding them information.
Business professionals need the same amount of influential support as anyone else. You need someone to bounce ideas off of. You need another pair of eyes on marketing materials before a launch. You need to role-play a negotiation for a massive deal. You need someone to build a cohesive strategy that leads you to your goal.
Find your partner in persuasion.
I’d be honored to be your partner in persuasion. Sign up for my newsletter and never miss another influential technique that can help you achieve your personal and professional goals.

Cognitive Advertising and marketing: 5 Psychological Methods to Enhance Your Advertising and marketing ROI
As entrepreneurs, we should always perceive the decision-making means of all customers. Because the financial system grows and the selection of merchandise will increase exponentially, it’s extra vital now than ever to know why the shopper selected model A as a substitute of a really related model B. Was it calculated? Was it random? Was it pricing, location, the colour of packaging? All collectively?
Classical financial theories clarify human conduct in a rational, mathematical method. They declare that prospects select the product that brings them essentially the most utility: that’s finest for them and the most cost effective one amongst its rivals. As entrepreneurs, we all know that’s not less than not all the time the case. In any other case, promoting wouldn’t be as efficient as it’s. However psychologists know extra – they know that is completely mistaken. They know persons are irrational, unreasonable and impulsive, and, most of all, they’re horrible at maths, in contrast to what economists assume.
This put up is an outline of some cognitive biases folks depend on when making a choice, and a peek at which advertising and marketing concepts you’ll be able to apply after discovering these biases.
1. Affirmation bias
Picture Supply
Our brains course of info in a different way relying on how this info is framed initially. For instance, you’ve obtained a colleague Mark. Like nearly any human being, Mark is neither one of the best individual you’ve ever met nor a horrible one. When you have been requested “Is Mark an excellent individual?”, your mind would immediately recall one thing good Mark has carried out. You’d keep in mind that he smiles lots, he’s pleasant, and he’s good at his job. You’d be extra more likely to reply to the query that Mark is an efficient individual. Nonetheless, in the event you have been requested “Is Mark a foul individual?”, totally different instances would come to thoughts. You’d recall how he took your sandwich as soon as and the way he smiled at an inappropriate joke – he most likely is a somewhat dangerous individual.
As unbelievable because it sounds, analysis exhibits you’ll make a special judgment of Mark’s character relying solely on how the query is requested. And that’s just the start of the story!
Individuals make extremely vital selections based mostly on which response is supplied within the query requested. For instance, the finest single predictor of whether or not or not folks will donate their organs is which field (opt-in or opt-out) is a default possibility. This occurs as a result of the choice is in a method already there, and our brains choose to substantiate no matter they see.
Advertising and marketing takeaway:
Introduce a default possibility (e.g., an electronic mail subscription, re-ordering, and many others.) Make it straightforward to see, and folks’s notion will do the remaining – the bulk will go together with no matter you plan.
Would you like a buyer to determine your product/service was good? Type a query in a optimistic method. E.g., “Was product X a helpful one?” Not solely will you get greater rankings and testimonials that you should use later, however the optimistic reminiscence of your model will even keep within the buyer’s thoughts, even when in any other case they wouldn’t ensure easy methods to price it.
2. Halo impact
Picture Supply
Halo impact is without doubt one of the finest identified cognitive biases. It happens when one optimistic attribute of an individual (normally the attribute we discover first) dominates the way in which we view that individual as a complete.
For instance, it was discovered that individuals decide a politician’s competence by combining their energy and trustworthiness. They determine the extent of those traits by trying on the politician’s face. It ought to mix a robust chin with a slight confident-appearing smile, and folks will readily conclude that the individual is competent. Clearly, there is no such thing as a proof that these facial options predict how properly politicians will carry out in workplace.
Different research additionally present that engaging people are rated greater with regards to judging their intelligence, job standing, dad or mum expertise, happiness, altruism, extraversion, and kindness in comparison with average-looking and unattractive people. Attractiveness certainly works like a halo. Nonetheless, it’s not the one trait. When discovering an individual is clever, folks typically proceed to assume they’re additionally form, courageous and have many different optimistic traits.
Many are conscious of this bias, however, firstly, they nonetheless fall sufferer to it and secondly, underestimate the ability of it.
Advertising and marketing takeaway:
Market considered one of your model’s options to extend the general status of your model. For instance, when a model claims to be environmentally pleasant, folks typically assume it’s nice all collectively.
Have excellent customer support – when an organization gives wonderful customer support, folks assume that typically, the corporate is a high one.
Use influencer advertising and marketing. Get good and engaging folks to signify your model, and the associations will do the trick.
3. Decoy Impact
In a well-known instance, the Economist provided three kinds of subscription choices:
Economist.com subscription (net version) – US $59.00
Print subscription – US $125
Print and net subscription – US $125
Picture Supply
In Dan Ariely’s examine on a scholar class, 84% selected the print and net subscription and solely 16% selected net solely. As anticipated, no one selected simply the print. When you relied on the classical financial concept, you’d conclude that individuals selected one of the best and most cost-effective possibility based on their preferences. If that’s proper, taking away the print subscription wouldn’t change the ultimate outcome. Nonetheless, when the print-only possibility was taken away, solely 32% ended up with the print+net subscription, whereas 68% selected web-only.
That is the decoy impact in a nutshell. It means introducing a 3rd unattractive possibility that contrasts with one of many good ones and has an infinite impact on the ultimate resolution.
Advertising and marketing takeaways:
The decoy impact is thought for use lots in retail – one home that’s much like one other one however worse and costlier is proven merely to let you know the way dangerous life can get. As you’ll be able to think about, it may be utilized in completely any trade – it has been proven to extend gross sales of the whole lot from chocolate bars to TV-sets.
4. Anchoring
Picture Supply
It’s very exhausting for our brains to make judgments in a vacuum. We all the time search info to depend on, and, very often, we discover info that’s fully irrelevant and depend on it anyway. All of this occurs unconsciously and really rapidly. In all the experiments on cognitive biases, folks declare that they weren’t affected by any exterior cues.
Brains are likely to depend on no matter info was offered to them first. This piece of knowledge is named an anchor. Anchoring, subsequently, describes the tendency to make use of no matter info is supplied first as a cue for making selections. For instance, when coming into a furnishings retailer you see a settee for $3000, you’ll understand different costs in relation to $3000. Not solely the costs of sofas however the whole lot else within the retailer. So, if subsequent to the couch you see a pleasant pillow for $90, it might appear low cost to you and also you’re extra probably to purchase it even when in every other case, you wouldn’t spend greater than $30 on a pillow.
The pioneering examine on the anchoring impact confirmed that random social safety digits when recalled first, can have an effect on selections on the amount of cash one would spend on a keyboard. Equally, totally different research confirmed a strong anchoring impact in authorized judgments, buying selections, and negotiations.
Advertising and marketing takeaway:
Anchoring is extensively utilized in negotiations – the primary provide is nearly all the time totally different from what the individual assumes to get or lose. Nonetheless, it’s not that overused in advertising and marketing (which, to be truthful, wouldn’t matter, because the anchoring impact nonetheless occurs when the individual is conscious of it). The important thing factor is to current the primary merchandise wherever with the inflated worth. This might be the primary couch in a store, the primary bottle of wine on the menu, the advert for one of the best resort on planet Earth subsequent to the record of reasonably priced hostels. The impact shall be there.
5. The “free breakfast” impact
Picture Supply
Individuals overreact to free merchandise. They’re prepared to surrender on utility worth, logic, and preferences when one thing is obtainable free of charge. For instance, if there’s a alternative process with a “higher” sweet for 15 cents and a “worse” one for 1 cent, persons are extra more likely to go together with their preferences and select the higher sweet. Equally, if the worth of a sweet drops from 2 cents to 1 cent, they received’t care a lot. Nonetheless, if the worth drops from 1 cent to 0 – that’s when the demand skyrockets.
In experiments with totally different merchandise, the discount of a worth to zero turned out to be extra highly effective than a 5‐occasions‐bigger worth discount that was inside the vary of optimistic costs. It’s as if folks understand the worth of a free product as larger than that of a paid product, which is mistaken from the attitude of classical financial concept.
However as you’ll be able to think about, firms don’t get pleasure from giving out merchandise free of charge (though, this has helped some manufacturers to do fairly properly). Free merchandise normally come along with a paid one, and this system is closely underused, contemplating how a free something can fully shift the shopper’s alternative.
The identify of the “free breakfast impact” comes from a latest experiment within the vacationer purposes of the impact. This area is kind of new, so not a lot analysis has been carried out normally, and the next examine stays groundbreaking. In it, researchers instructed individuals to think about they have been going to spend a weekend in Valencia. That they had a alternative of a four-star Meliá resort and a three-star Ibañez resort. Individuals initially most well-liked the primary one (it’s a widely known resort, whereas the opposite one is made up), however desire was simply shifted if the second resort launched a free breakfast. If breakfast was even as little as 2 euros, folks didn’t pay any consideration to it and went with their preliminary preferences.
This occurs as a result of free affords draw extra consideration and since folks get robust optimistic emotions once they get one thing free of charge – even when it means making a lower than intelligent judgment.
Advertising and marketing takeaways:
Neglect about reductions. Free further something will appeal to and convert much more prospects.
Introduce free trials/samples/pay as you go present playing cards or something related. Make the magic of “free” work on your profit.
Conclusion
Cognitive biases don’t finish right here – you’ll by no means know which psychological attributes enhance and which of them harm your gross sales till you examine the rules of human conduct. However the excellent news is, it pays off lots to understand how your prospects’ minds work. For instance, have a look at how Amazon used the data of psychology to get profitable. Equally, you’ll be able to then introduce minor modifications in your advertising and marketing technique that can have monumental results in your ROI.

[Jonathan H. Adler] Closing in on the Next Supreme Court Justice
President Trump is scheduled to announce his nomination to replace Justice Anthony Kennedy on the Supreme Court Monday evening. According to press reports, rollout packages have been prepared for four potential nominees, all of whom sit as judges on U.S. Courts of Appeals: Brett Kavanaugh (D.C. Circuit), Raymond Kethledge (6th Circuit), Amy Coney Barrett (7th Circuit), and Thomas Hardiman (3rd Circuit). All four potential nominees are on Trump's list of 25 potential SCOTUS nominees, and all four are highly qualified jurists of the sort the President said he would appoint.
While the situation is in flux, Judge Kavanaugh appears to be the current favorite (though the voting at FantasySCOTUS would suggest otherwise). This makes some sense. Not only did Judge Kavanaugh for Justice Kennedy, he has spent the past twelve years contending with the administrative state on the D.C. Circuit, the court where most challenges to major federal regulations are heard. He also has Executive Branch experience and worked for Independent Counsel Ken Starr.
Judge Kavanaugh's opinions are often influential, particularly his dissents, several of which have been vindicated by the Supreme Court, including opinions on the constitutionality of the Public Company Accounting Oversight Board (PCAOB) and legal challenges to EPA regulations on mercury and greenhouse gas emissions. As a justice, Kavanaugh would likely have a significant influence on the future of administrative law. (For profiles of all the shortlisters' views of administrative law, see this post at the Yale Journal on Regulation's Notice & Comment blog.)
For those interested, here's a lecture Judge Kavanaugh gave at CWRU on the D.C. Circuit at the Case Western Reserve University School of Law. A published version of the lecture is here. Beyond consulting his opinions, those interested in Judge Kavanaugh's thoughts on various legal issues may want to consult this Minnesota Law Review article on the separation powers and this Harvard Law Review piece on statutory interpretation. J.D. Vance made the case for a Kavanaugh nomination in the WSJ here, and Ed Whelan rebutted some erroneous attacks on Kavanaugh on Bench Memos here and here.
Judge Kethledge is another former Kennedy clerk in contention. For the last decade he has been a judge on the U.S. Court of Appeals for the Sixth Circuit. Prior to that he worked in private practice and for Senator Spence Abraham. One of the biggest differences between Kethledge and Kavanaugh is in the content of their judicial records. Whereas Judge Kavanaugh has consumed a steady diet of administrative law cases, Judge Kethledge has heard a wider range of cases, including the sorts of business law disputes and tort litigation that occupy substantial portions of federal dockets. Whereas Judge Kavanaugh has spent most of his professional career inside the beltway, Judge Kethledge has mostly worked in his home state of Michigan, which is also where he went to law school.
Judge Kethledge is widely regarded as an excellent writer (and with good reason). His opinions are a joy to read and often reflect common sense - such as the idea that it's unreasonable for a court to sanction a class-action settlement in which the lawyers get millions while unnamed class members get nothing of value, that it's not unlawful racial discrimination to run credit checks on job applicants, or that a benefit claimant's spouse is part of his "family."
Judge Kethledge co-authored a book on leadership the value of solitude and delivered a recent lecture outlining his views on administrative law (published in the Vanderbilt Law Review). He's also a favorite of my co-blogger Orin Kerr, who corrected distortions of his record here and here.
Judge Barrett is somewhat of a dark-horse candidate, if only for her relatively short stint as a federal judge. Whereas Judges Kavanaugh and Kethledge were appointed by President George W. Bush, Judge Barrett was an early Trump nominee, and was only confirmed last year. As a consequence, her judicial record is somewhat thin: Nine reported cases by my count, all but one of which were unanimous. Substantial judicial experience is not a requirement for the Supreme Court, even if it is the current norm. Justices Kagan, Rehnquist, Fortas, White, Powell and Frankfurter, along with a few dozen others, were confirmed without ever having spent a single day as a judge.
Prior to joining the bench, Judge Barrett was a professor at the University of Notre Dame Law School. As a consequence, she has a longer record of published law review articles than other potential nominees, most of which may be found here. She also spent six years (serving two terms) on the Advisory Committee on the Federal Rules of Appellate Procedure, and clerked for Justice Scalia.
An impressive intellect, Judge Barrett is the favorite of many conservative activists (as discussed in this NYT piece). Ramesh Ponnuru made the case for her here, and her Notre Dame colleague Rick Garnett offered this powerful endorsement. As with other potential nominees, Judge Barrett has been the subject of false claims, one of which Ed Whelan rebuts here.
Most reports indicate Judges Kavanaugh, Kethledge and Barrett are the top three contenders, but there are indications Trump is also considering Judge Hardiman, who was reportedly the runner-up behind Neil Gorsuch to replace Justice Scalia. He's seen as more of a populist or "blue-collar" choice than the others, if only for his lack of "elite" academic credentials and Supreme Court clerkship, but do not sell him short. (See David Lat's profile here.) Like the others, he is a well-respected jurist and has a long and distinguished judicial career.
Alone among the four reported finalists, Judge Hardiman has experience as a trial court judge, having served just over three years as a federal judge in the Western District of Pennsylvania. He also has the distinction of having been confirmed unanimously by the Senate, twice. He is seen as a staunch defender of Second Amendment rights and is apparently a favorite of Trump's sister, Judge Maryanne Trump Barry.
Beyond the four discussed above, Trump also reportedly interviewed Sixth Circuit Judges Amul Thapar and Joan Larsen, two more solid potential picks. Both will remain potential nominees for future vacancies, should any occur.
One judge conspicuously absent from the short-list this time around is Judge William Pryor of the Eleventh Circuit. I suspect this is because Judge Pryor was seen as more difficult to confirm than the others. Where as most potential Supreme Court nominees are circumspect about their views of Roe v. Wade, Judge Pryor once called Roe the "worst abomination in the history of constitutional law" and refused to disavow this sentiment when he was first nominated to the federal bench by President Bush. this caused Senator Susan Collins (and other pro-choice Republicans) to vote against his confirmation, and could make him a tough sell today.
It's perhaps ironic that Judge Pryor's candor and integrity would make him unconfirmable given concerns that the next Supreme Court nominee be willing to stand up for the rule of law -- and against President Trump -- should the need arise. After all, Judge Pryor -- more than any other judicial nominee of either party in recent memory -- has shown himself willing to stnad up for the rule of law at great personal and political risk, as when he led the charge to remove Chief Justice Roy Moore from the Alabama Supreme Court for defying a federal court order.
In all likelihood, Trump's nominee will be confirmed, albeit by a slim margin. Republicans have a slim majority in the Senate and any of the four above-mentioned possibilities are likely to get a few Democratic votes. A filibuster is off the table -- which is fitting because the filibustering of judicial nominations was never really a thing. Partisan filibusters had not been successful until Senate Democrats tried it in the 2000s and did not last after Republicans responded in kind. (See also here.) The first-ever cloture vote on a Supreme Court nomination was in 1967, and it only happened three more times before 2008. Abe Fortas is the only Supreme Court nominee to be blocked by filibuster, and his was quite the special case.
As noted at the outset, Judge Kavanaugh appears to be the favorite at the moment, but things are still in flux. Even if a tentative decision has been made, Trump could change his mind. In any event, so long as the President stays on schedule, we'll know the name of the next Supreme Court nominee by Monday evening, and that individual is almost certain to join the Supreme Court later this fall.

We have come a long way since our first post (6 months ago), here!I plan to continue updating our progress every 6 months, highlighting our mistakes and our hits in hopes your can utilize some ideas to help your ecommerce and the difficult business that is fresh (24 hours) perishable shipping.Who we are: https://www.cameronsseafood.com/in 1985 my Dad and Uncle started the Maryland Seafood business and today it does $20 million in gross revenue each year. We sell raw and cooked seafood, and prepared dishes at 14 locations — 11 storefronts and three trucks — We have over 1,000,000 customers in the Baltimore-Washington-Philadelphia market. On June 24th 2017 my cousin and I started the nationwide home shipping business as a separate entity. The operation is run by me, my wife, dad, uncle, brother, cousin and 60 employees. I have no ownership in the stores, food trucks, and franchises. My uncle owns and handles all that.My Background: the business was named after me in 1985 as I am the oldest son of 6 children. My main business is apartment brokerage and investing. I have been a MD, DC, and VA broker for 17 years www.idealrealty.com. I sell 100+ unit complexes to institutions and high net-worth individuals.Coolest Online Customers: Gilbert Arenas and Mia KhalifaWhat seafood do we sell online: Virtually everything but, 85% of sales are Maryland crabs, Maryland crab cakes, Maryland crab soups, and Free shipping samplers. What we do: we ship freshly cooked Maryland Blue Crabs, Crab cakes and seafood to your door in 24 hours after being caught in the Chesapeake Bay, Maryland. We send you seafood that is 3 days fresher than the grocery store. Btw, we accept bitcoin!Where do we get our Seafood? Chesapeake Bay, Maryland for Maryland products, using our own crabbers and contracted crabbers over the past 32 years. Although our COGS is 30%, shipping with 1-2 day delivery is very expensive, with the packaging materials outweighing the FedEx fees. We ship it fresh with Snow/King crab legs, soft shells (in off-season) and lobster tails being the items we ship frozen. Some items we receive frozen like Bee Gee shrimp from Louisiana. We are True Blue Certified, meaning In order to be True Blue certified, participating food service establishments commit that at least 75% of their annual crab usage will be from Maryland harvested or processed crabs.Startup Leverage: We do have some amazing advantages and you should tab into yours: 1) We don’t pay rent because we operate out of my uncles seafood headquarters. 2) We don’t need employees to handle extra orders (my partners handles up to 50 orders a day by himself) because we can use our existing employees. 4) We don’t have “employees” we contract existing employees meaning you don’t have to pay 15% tax 3) We don’t have food spoilage because we buy only what we need from our the stores each morning.Online Profit Margins: We aim for 35% gross margins with our cost of goods sold at 30%. However, packaging and shipping costs wipe out most of it while paid-advertisement has wiped out the rest leaving us with 10% gross for the first 6 months. 1) We eliminated AdWords since our ROI/customer acquisition costs were too high. 2) We reduced all packaging costs through trial and error. We eliminated anything not necessary then negotiated each material with three vendors. You need to create a bidding war. 3) We negotiated shipping rates by switching vendors 3x. We formed a strategic partnership to tab into their FedEx account. With a growing customer base we are on track to hit 30% gross next year but it’s possible to hit 40% and 10% net.Free Shipping Model: We offer free shipping to 29 states (1-2 day zones through FedEx ground network) when a customer spends over $200. Since our average order is $160 we think that’s a solid minimum order. We offer flat-rate air shipping everywhere else. National shipping is $94.99 or $79.99 when they spend $200+. We offer many free shipping sampler combos to local and regional customers. It’s too expensive to ship nationally without ridiculous pricing. That’s ok, if we can capitalize on the 29 ground states we will hit our $20,000,000 number. We don’t make any money on shipping, and I wish we could. Shipping page.Chargeback Fraud: people are creative and fraud has cost us thousands We cannot require signatures on shipments without incurring a $4.50 fee and what if the person isn’t home? FedEx will return the box to their hub subjecting it to transit issues and spoilage. A lot of our customers order our food as gifts so the billing and shipping don’t match. We learned you can get expensive software that charges a per transaction fee. It’s only worth if at higher volume but you can do your own fraud detection. For example, look up the shipping address in google maps. Google the person and look for articles about them to show they live in the state. Modify your payment processor’s security features so you can monitor the results. We noted most fraudsters order our frozen items (to store or resell them) so we carefully review each frozen order with wide eyes.Losses: We have made many errors totaling $15,000. Shipping wrong items, missing items, item arrives late or spoiled, gel packs melt, things happen. The important thing is to address the root cause, which helped us lower our losses rate from 15% down to 5% with a 3% goal in mind for 2018.Shipping – pin FedEx vs UPS and save money. Make sure the “rates” include a residential fee and fuel fees. Also know like new credit cards they will give you introductory rates that eventually run out and use your monthly sales volume to adjust up/down. Negotiate longer into rate periods if you can! UPS offers insurance on the entire sale and will grant 25% off next day air on any bad deliveries and charge $1.80 per $100 but there is a catch. Your customers need to provide you photo proofs, and UPS has to be at fault to receive a claim (late delivery which occurs less than 1%) or a forgetting to deliver. However, UPS has abysmal Saturday ground delivery networks as it’s new as of August 2017 when FedEx has the entire network open. UPS has a smaller ground delivery range that FedEx too. No brainer for us, we chose FedEx. We don’t take insurance because it’s a loss. This will depend on your line of business.Packaging Perishables – we reverse engineered Blue Apron and competitors to figure out how to ship fresh (and live) seafood. It also teaches you where to find suppliers (use manufacturers not resellers as they have a markup). Call them and form relationships.Gel Packs: It takes 5 weeks to properly freeze a gel pack! I thought our business was doomed when I learned this because how can I store that many gel packs and replenish them within my walk-in freezer? Solution: we pay for pre-frozen ones and have pallets stored at -10. We learned this from ordering from Blue Apron and calling the gel pack manufacturer.Boxes: to ship perishable seafood you probably need an insulated cooler and corrugated box kit. Since we started, we reduced costs by 30% by searching for a manufacturer (not a distributor) that can cut costs and store surplus for us. Costs include freight so find someone local within 1-2 hours of your HQ.Customer Service: We sell seafood but we are in the customer service business. We are open 7 days per week and either I or my brother will answer your phone calls (888-404-7454 x1). Our competitors are only open 5-days per week. We offer cash refunds and reshipments on any customer complaint. Our competitors may give you a credit on your next order…The customer is always right and we ensure 100% satisfaction guaranteed. This has converted customers to repeat customers. We treat each customer as we want to be treated. Give a little, get a lot.Website: I know you think I am biased because my wife created our site from scratch but she did an amazing job for her first ecommerce site! We modify content daily and advertise to our email list once per week with discount codes. This would have cost me $10,000 to $30,000 with all the changes we have made. It’s constantly evolving and the project never ends. Find a good partner that will grow with you. No 3rd party will put in the passion a strategic partner could offer. Try offering a lower hourly rate but give them a piece of the action for the difference.Advertising: The best advertisement for us has been word-of-mouth. We carry 5-star reviews on Facebook but getting satisfied customers to review is hard (after a sale they receive an email asking them to rate their experience). We thought about offering a coupon but it feels like a bribe. We do offer a coupon once someone abandons their cart to remarket. We send out weekly coupons via mailing list and we offer weekly storewide specials (the real savings happen when you sign up). Social media is free, get good at it. Learn which outlets suit your business. For us, Facebook and Instagram work whereas Twitter has no traction. I learned ads on social media don’t convert. Nobody wants to be spammed ads. They want to discuss a topic and engage on pictures, videos, and education about your field. They will find a way to buy from you. Instead of offering a coupon teach them a recipe, explain why a Maryland Crab is the world’s best crab (in the Chesapeake Bay, due to the specific climate, the Blue Crabs lie dormant for 6 months and form a layer of fat on their meat which gives them a their sweat buttery flavor!). You see, that’s interesting! When you post ask yourself how will this engage an audience? You want to advertise? Then try doing giveaways using www.gleam.io, which has amazing social networking tools to spread the word.Facebook is another animal where most of our success has been through remarketing. Currently, we are brainstorming both organic and paid Facebook ideas…I’m open to any suggestions. Getting customers to your homepage is the hardest part. Once they get there, your site has to convert them. When we started, we used Adwords to bring attention to our product pages but we had no other supportive information to convert them. We recrafted each page to stand on its own (assuming they never leave that page) and doubled our conversion rates! We outsource our SEO/AdWords to a company that we learned about through our first Reddit Post. SEO can take at least 6+ months to build up your keywords on the rankings list. You need to be on the 1st page or you won’t convert traffic. We started with most organic keyword rankings on the 64th page and are have almost all of our keywords now on the 3rd page. By February most of our keywords should be on the 1st page! Many things went into this including getting quality backlinks, blogging 6 times per month with SEO rich content, carefully titling each page, section, and product; and Keyword/URL optimization.Adwords: We foolishly spent $42,000 on AdWords and ended our campaign with $37 cost per conversion and 186.29% ROI, which doesn’t allow us to make profit during the off-season (crabs are seasonal from April to November) so we will try again in Q2, 2018.Influencers: overall this hasn’t been profitable. We have social media influencers with 100k+ dedicated seafood/food followers whereby we grant them a vanity link and discount but it hasn’t worked. We belong to several influencer networks were they receive 8% for posting banner adds, this has only brought in $10,000…Mia Khalifa: We reached out to Mia as she has the strongest influences (4m+ followers) for a Maryland native that loves our seafood. We sent her food and she spent a week hyping the brand including social media posts, PMs and featured a Twitch episode about Cameron’s. Definitely drove tremendous traffic although we can only ship to the USA due the transit time lag of customs. We look forward to working more with her.Gilbert Arenas: I’m a huge Gilbert and Wizards fan! He replied to Mia’s post and a PM worked to get his interest. He is a real character and orders a lot of our seafood each month. He love the high-protein variety that (Maryland) seafood provides. Chicken and vegetables does get boring.Washington Post: We were featured in the Washington Post on Dec 1st, see here. They did a good job summarizing our business so far. We have also been featured in Forbes, New York Times, Huffington Post and more. How? I googled the food reviewer from each of the above and figured out their contact info. Sent them a 2-line email asking them to review our food and boom!Videos We started sharing videos of the entire process so you can see the experience before you risk order fresh seafood online.
