Salt Lake City — Utah on Wednesday became the first state to pass legislation requiring app stores to verify users' ages and get parental consent for minors to download apps to their devices.
The bill headed to the desk of Gov. Spencer Cox has pitted Meta, which operates Facebook and Instagram, against app store giants Apple and Google over who should be responsible for verifying ages. Similar bills have been introduced in at least eight other states in the latest fight over children's online safety. The proposals targeting app stores follow legal fights over laws requiring social media platforms to verify the ages of users.
Meta and other social media companies support putting the onus on app stores to verify ages amid criticism that they don't do enough to make their products safe for children - or verify that no kids under 13 use them.
"Parents want a one-stop shop to verify their child's age and grant permission for them to download apps in a privacy-preserving way. The app store is the best place for it," Meta, X and Snap Inc. said in a joint statement Wednesday. "We applaud Utah for putting parents in charge with its landmark legislation and urge Congress to follow suit."
The app stores say app developers are better equipped to handle age verification and other safety measures. Requiring app stores to confirm ages will make it so all users have to hand over sensitive identifying information, such as a driver's license, passport, credit card or Social Security number, even if they don't want to use an age-restricted app, Apple said.
"Because many kids in the U.S. don't have government-issued IDs, parents in the U.S. will have to provide even more sensitive documentation just to allow their child to access apps meant for children. That's not in the interest of user safety or privacy," the company said in its most recent online safety report.
Apple considers age a matter of privacy and lets users decide whether to disclose it. The company gives parents the option to set age-appropriate parameters for app downloads. The Google Play Store does the same.
Apple and Google are among a litany of tech companies that help support the Chamber of Progress, a tech policy group that lobbied Utah lawmakers to reject the bill. Last year, Apple helped kill a similar bill in Louisiana that would have required app stores to help enforce age restrictions.
Kouri Marshall, a spokesperson for the Chamber of Progress, called the measure "a tremendous encroachment of individual privacy" that he said places a heavy burden on app stores to ensure online safety.
Republican Sen. Todd Weiler, the bill's sponsor, argued it's "a lot easier to target two app stores than it is to target 10,000 (app) developers."
Under the bill, app stores would be required to request age information when someone creates an account. If a minor tries to open one, the bill directs the app store to link it to their parent's account and may request a form of ID to confirm their identity. Weiler said a credit card could be used as an age verification tool in most cases.
If a child tries to download an app that allows in-app purchases or requires them to agree to terms and conditions, the parent will first have to approve.
Melissa McKay, a Utah mother, is among those who pushed for the legislation. She said she started asking questions about device safety after her nephew in 2017 was exposed to "really harmful content on another student's device at school." Inaccurate age ratings on apps and faulty parental controls are "at the root of online harm," McKay said.
The eight other states considering proposals would similarly place responsibility on app stores to verify ages and seek parental permissions. A legislative committee advanced Alabama's bill last week.
Lawsuits have delayed implementation of state laws regulating social media apps and websites. A federal judge in 2024 temporarily blocked Utah's first-in-the-nation law requiring social media companies to check the ages of all users and place restrictions on accounts belonging to minors.
If Cox signs the Utah bill into law, most provisions would take effect May 7. The governor's office didn't respond to emails seeking comment Wednesday. Cox, a Republican, supported the state law currently on hold that requires age verification on social media.

Park City women with a passion for the outdoors gathered at the Stio on Main Street on Wednesday evening to learn about ILLA, a company that connects women based on their interests.
“I just want to say, thank you guys for coming out,” said Tana Hoffman, the founder of ILLA, who drove down from her home in Jackson Hole, Wyo.
Fifteen women gathered around as she explained how ILLA’s app works.
“You create a profile and you can find other skiers, snowboarders, bikers, mountain bikers, climbers, surfers, whatever you love to do, depending on your area,” she said.
Based on your profile, members receive notifications when, for example, another person pings for a ski partner on a coming day. Those available or interested are thrown into a group chat to plan their own adventure. It’s a cross between a friendship dating app and a Facebook group. 
This “activation” event on Wednesday was a chance for people to learn about ILLA, connect face-to-face, find some ski or boarding buddies for the winter and develop their own women-centric community.
Hoffman had attendees raise their hands to identify fellow skiers or boarders, and then encouraged each other to connect — like an in-person ILLA group chat. She passed out cards with information about how to create a profile.
Sarah Kodric, winner of the night’s $75 Stio gift card prize, came looking to find friends and fellow Epic Pass-holding snowboarders in the Park City area. After moving from her home in Slovenia to Utah with her boyfriend in June, she was eager to find some women to hang out with. 
Madison Blackley, a Park City born-and-raised professional snowboarder, popped in after boarding at Woodward’s monthly women’s night. She talked to the group about her passion for encouraging adult women towards sports they love.

“I coach for women’s camps called Beyond the Bounds. We run women’s adult snowboard camps,” said Blackley. “(These camps are for) anyone, a beginner, never been in the park, if you’re trying to keep up with your boyfriend, if that’s your goal, whatever your goal is.” 
One girl called out, “It’s for him to keep up with us!” The group laughed.
This was the attitude for many of the women who attended. And for ILLA’s creator, that’s the whole goal.
The New Hampshire native said she’d always been involved in the outdoor industry but struggled in the male-dominated world. 
“Most of the ski shops I was in, surf shops I was in, I was always kind of the little sister,” said Hoffman. 
Hoffman said gaining confidence as a woman in the outdoors was not easy, a challenge shared by many of the women she met, and she found herself drawn toward women-first communities.
Over the years, Hoffman began connecting other female outdoor-enthusiasts with each other through social media or group chats. But as one person, she could only do so much. What if there was an app for that? 
With this mission, Hoffman founded ILLA in February 2022. 
“ILLA was a way of, how do we scale this beyond myself, beyond me doing group text messages and group Instagram introductions,” she said.
Currently there are about 1,000 users from all across the country, she said, but certain areas have more concentration than others.
“We find that wherever you think of as a mountain hub, we tend to see more. So like the Tahoes and Missoula and Bozeman, … areas that you think of as being inherently attractive to the outdoor industry,” said Hoffman.
Park City is one of those places, and Hoffman said she hopes events like Wednesday’s will bring more women onto the platform.
“The women focus — we use the term women+ — (is) self selecting. If you feel that you belong in a feminine space, we want you to feel welcome here,” said Hoffman. “ILLA is very much a choose-your-own adventure. We’re the tool, not the enforcer.” 
Still in early stages, the platform is a web app, but plans to launch in the app store by the end of December or early 2024.

Court watch 29may25 - the NEPA case
I don't usually write about civil jurisprudence, but Seven County Infrastructure Coalition v. Eagle County, 605 U. S. __ (2025) is interesting.
First of all, the decision was unanimous, 8-0. Those are somewhat rate. J. Gorsuch did not participate.
In this case, the U. S. Surface Transportation Board considered a proposal by a group of seven Utah counties for the construction and operation of an approximately 88-mile railroad line in northeastern Utah. Under federal law, the Board determines whether to approve construction of new railroad lines. The railroad line here would connect Utah’s oil-rich Uinta Basin—a rural territory roughly the size of the State of Maryland—to the national rail network. By doing so, the new railroad line would facilitate the transportation of crude oil from Utah to refineries in Louisiana, Texas, and elsewhere. And the project would bring significant economic development and jobs to the isolated Uinta Basin by better connecting the Basin to the national economy. For that proposed 88-mile Utah railroad line, the Board prepared an extraordinarily lengthy EIS, spanning more than 3,600 pages of environmental analysis. The Board’s EIS addressed the environmental effects of the railroad line. But the U. S. Court of Appeals for the D. C. Circuit nonetheless faulted the EIS for not sufficiently considering the environmental effects of projects separate from the railroad line itself—primarily, the environmental effects that could ensue from (i) increased oil drilling upstream in the Uinta Basin and (ii) increased oil refining downstream along the Gulf Coast of Louisiana and Texas.***
Eagle County, Colorado, sued. Eagle County is on the Continent Divide, hundreds of miles away from the proposed railroad.
review of an agency’s EIS is not the same thing as review of the agency’s final decision concerning the project. *** That, too, follows from NEPA’s status as a purely procedural statute. The ultimate question is not whether an EIS in and of itself is inadequate, but whether the agency’s final decision was reasonable and reasonably explained. Review of an EIS is only one component of that analysis. Even if an EIS falls short in some respects, that deficiency may not necessarily require a court to vacate the agency’s ultimate approval of a project, at least absent reason to believe that the agency might disapprove the project if it added more to the EIS.***
Even apart from failing to afford sufficient deference to the Surface Transportation Board, the D. C. Circuit’s decision was mistaken on the merits under NEPA. The D. C. Circuit erroneously required the Board to address environmental effects from projects that are separate in time or place from the 88-mile railroad project at hand— that is, effects from potential future projects or from geographically separate projects. Moreover, those separate projects fall outside the Board’s authority and would be initiated, if at all, by third parties. In its EIS, the Board determined that upstream oil drilling in the Uinta Basin and downstream oil refining along the Gulf Coast were separate from the construction and operation of the 88-mile railroad line. The Board’s EIS explained that the “proposed rail line and any future oil and gas development projects are not two phases of a single action,” but “separate, independent projects.” App. 523. Those other projects, the Board reasoned, should not be considered “part of the proposed action assessed in the EIS.” Ibid. The Board concluded that its EIS need not evaluate the possible environmental effects from separate upstream or downstream projects.***
Three justices concurred in the decision.

Why It's Banned
Most of the articles I've seen in reference to Homegoing's ban cite "sexual content" and discussions of race. BookLooks* rated Homegoing as “Not For Minors,”and claims, "This book contains sexual activities; sexual assault; sexual nudity; profanity and derogatory terms; violence; hate involving racism; alcohol and drug use; and controversial social commentary."
My response? This is History. No matter how painful it may be to read about this history, it is necessary in order for us to understand the past and our present. The "sexual activities"literally refers to the violence inflicted upon Black women in connection to colonization and enslavement. Skating over that is irresponsible, as is avoiding conversations about racism and "alcohol and drug use." In my opinion, high school is the perfect time to assign this. If you can assign The Scarlet Letter, The Crucible, and The Great Gatsby, your students are capable of reading Homegoing.

Why I Recommend This Book
Homegoing gives readers a chance to see the ways in which the past actually affects the present and our future. This multi-generational story shows us how interconnected we actually are. When I read this book in 2018, I felt like I could finally understand the choices my ancestors made. Similar to the impact of Roots: The Saga of an American Family by Alex Haley, the story of Black History does not begin at enslavement. If we want to push back against the age old narrative that Black folks don't have history, everyone needs to read stories like these.

State Sen. Todd Weiler, R-Woods Cross, is sponsoring the bill. If passed, it would require age verification from both app stores and developers.
Kids under 18 years of age would need their parent’s permission before downloading an app, no matter the rating.
“We want the parents to approve of their children’s digital interactions. The current practices bypass the safeguards and expose children, I think, to unnecessary risks,” said Weiler.
