JEFFERSON CITY, Mo. — A Missouri judge on Wednesday temporarily halted a first-of-its-kind rule restricting access to gender-affirming health care for transgender kids and adults, just hours before it was set to take effect.

St. Louis County Circuit Judge Ellen Ribaudo put Republican Attorney General Andrew Bailey’s emergency rule on transgender health care on hold until at least Monday.

JEFFERSON CITY, Mo. (AP) — The Missouri Supreme Court will hear arguments Monday as attorneys working on behalf of Marcellus Williams seek to save him, just a day before his scheduled execution.

Oral arguments were scheduled for Monday morning in the hearing before the state Supreme Court. Williams, 55, is set to die by injection Tuesday evening for the 1998 stabbing death of Lisha Gayle in University City, Missouri, a St. Louis suburb.

Williams has long maintained his innocence. DNA evidence raised enough questions that a previous governor halted an execution in 2017, and St. Louis County's current prosecutor challenged Williams' guilt in a court hearing last month.

Attorneys for Williams also have an appeal before the U.S. Supreme Court. Meanwhile, a clemency request before Gov. Mike Parson focuses largely on how Gayle's own relatives want the sentence commuted to life in prison without parole. The national NAACP also is urging Parson, a Republican, to stop the execution of Williams, who is Black.

The execution would be the third in Missouri this year and the 15th nationwide.

Williams was hours away from execution in August 2017 when then-Gov. Eric Greitens, a Republican, granted a stay after reviewing DNA evidence that found no trace of Williams’ DNA on the knife used in the killing. Greitens appointed a panel of retired judges to examine the case, but that panel never reached any conclusion.

That same DNA evidence prompted Democratic St. Louis County Prosecuting Attorney Wesley Bell to request a hearing challenging Williams’ guilt. But days before the Aug. 21 hearing, new testing showed that the DNA evidence was spoiled because members of the prosecutor’s office touched the knife without gloves before the original trial.

With the DNA evidence unavailable, Midwest Innocence Project attorneys reached a compromise with the prosecutor’s office: Williams would enter a new, no-contest plea to first-degree murder in exchange for a new sentence of life in prison without parole.

Judge Bruce Hilton signed off on the agreement, as did Gayle’s family. But at Republican Attorney General Andrew Bailey’s urging, the Missouri Supreme Court blocked the agreement and ordered Hilton to proceed with an evidentiary hearing, which took place Aug. 28.

Hilton ruled on Sept. 12 that the first-degree murder conviction and death sentence would stand.

“Every claim of error Williams has asserted on direct appeal, post-conviction review, and habeas review has been rejected by Missouri’s courts,” Hilton wrote. “There is no basis for a court to find that Williams is innocent, and no court has made such a finding.”

The clemency petition from the Midwest Innocence Project focuses heavily on how Gayle’s relatives want the sentence commuted to life without parole. “The family defines closure as Marcellus being allowed to live,” the petition states.

Parson, a former county sheriff, has been in office for 11 executions, and has never granted clemency.

Issues of racial bias in Williams’ conviction also have been raised.

The prosecutor in the 2001 first-degree murder case, Keith Larner, testified at the August hearing that the trial jury was fair, even though it included just one Black member on the panel.

Larner said he struck just three potential Black jurors, including one man because he looked too much like Williams. He didn’t say why he felt that mattered.

Executing Williams would perpetuate a history of racial injustice in the use of the death penalty in Missouri and elsewhere, NAACP President Derrick Johnson wrote to Parson last week. The NAACP is opposed to the death penalty.

“Taking the life of Marcellus Williams would be an unequivocal statement that when a white woman is killed, a Black man must die. And any Black man will do,” Johnson wrote.

Prosecutors at Williams’ original trial said he broke into Gayle’s home on Aug. 11, 1998, heard water running in the shower, and found a large butcher knife. When Gayle came downstairs, she was stabbed 43 times. Her purse and her husband’s laptop were stolen.

Authorities said Williams stole a jacket to conceal blood on his shirt. Williams’ girlfriend asked him why he would wear a jacket on a hot day. The girlfriend said she later saw the laptop in the car and that Williams sold it a day or two later.

Prosecutors also cited testimony from Henry Cole, who shared a cell with Williams in 1999 while Williams was jailed on unrelated charges. Cole told prosecutors Williams confessed to the killing and offered details about it.

Williams’ attorneys responded that the girlfriend and Cole were both convicted of felonies and wanted a $10,000 reward.

Missouri Attorney General Bailey Joins 13 State Coalition Fighting for Pork Producers JEFFERSON CITY, MO (STL.News) Missouri Attorney General Andrew Bailey announced Friday that he joined 12 states in challenging Massachusetts’ pork ban.  The amicus brief opposes the new law, Question 3, that prohibits states from selling or shipping pork through Massachusetts if they do not meet burdensome hog-housing requirements. “I will always fight to protect Missouri farmers, and that includes the pork industry that is critical to the success of our state,” said Attorney General Bailey.  “I will not stand idly by while rogue progressive activists in Massachusetts attempt to hamper the ability of Missouri farmers to raise their hogs.” Massachusetts’ pork ban goes even further than California’s similar Proposition 12 by prohibiting the shipment of “non-compliant” pork through the state.  Even if Missouri-produced pork meets all state and federal safety and quality standards, it cannot be sold in or even transported through, Massachusetts if it does not also comply with Massachusetts’ impossible hog-housing requirements. The new ban will cost pork producers across the country hundreds of millions of dollars, drive many pork producers out of business, and dramatically raise pork prices.  This new ban also sets a dangerous precedent that would allow states to upend markets across the nation based on their political agendas. The states note, “Massachusetts itself has few hog farmers or pork producers — most live elsewhere.  That means, in effect, that the state is trying to regulate a market in which it lacks expertise and economic stake.” In the amicus brief, the attorneys general assert that the Massachusetts pork ban violates the Constitution, including the following: - Dormant Commerce Clause, which gives the federal government, not state governments, the power to regulate interstate commerce; - Import-Export Clause, which arguably prohibits states from imposing import regulations on products brought in from other states; - Full Faith and Credit Clause, which requires states to respect the laws passed in other states. - Joining Attorney General Bailey in filing the amicus brief are Iowa, Louisiana, Mississippi, Montana, Nebraska, New Hampshire, North Dakota, Oklahoma, South Carolina, South Dakota, Utah, and Wyoming. The suit accuses the company of overcharging customers for necessities and charging higher prices for items at the register than were listed on the shelf.

JEFFERSON CITY, Mo. — Missouri Attorney General Andrew Bailey is suing Dollar General, claiming the store has "unfair and deceptive pricing practices."

The suit, filed jointly by the Republican attorney general and the Missouri Department of Agriculture, accused the company of overcharging customers for necessities, as well as charging higher prices for items at the register than were listed on the shelf. The lawsuit listed examples such as candles, toilet paper, lip balm, lemonade, tire foam and drink coolers.

"Dollar General is routinely overcharging Missouri consumers for every day staples and the necessities of life," the suit stated. "Worse still, consumers are being deceived as to the prices they are actually paying for these items."

The lawsuit said a statewide investigation conducted by Bailey's office and the agriculture department found 92 of 147 businesses that were looked into failed inspection.

As part of the inspection, 50 items were randomly selected at several Dollar General stores, including locations in the St. Louis area. Their listed prices were compared with their point-of-sale scanned price. 

Several stores were found to have more than two violations, which is the limit for failing inspection, according to the Agriculture Department. Bailey's office said price discrepancies were up to $6.50 per item, with an average overcharge of $2.71 for more than 5,000 items that were pricechecked.

“As long as I’m Attorney General, my office will always pursue those who attempt to rip off Missouri consumers,” Bailey said in a statement announcing the lawsuit. “Prices are at an all-time high; the last thing Missourians need is to feel the brunt of Dollar General’s scheme. We will move forward undeterred in our fight to obtain full restitution for all affected.”

A Dollar General spokesperson provided a statement Friday, which reads, "Dollar General is committed to providing customers with accurate prices on items purchased in our stores, and we are disappointed any time we fail to deliver on this commitment. When a pricing discrepancy is identified, our store teams are empowered to correct the matter on the spot for our customers. We typically do not comment on pending litigation."

For nearly two weeks, tornados have ripped across the United States. Today was the 12th consecutive day with at least eight tornado reports per day, which sets a new record for the U.S., according to CNN. That accounts for more than 365 tornado reports. Esquire is giving us the news for today about the tornado that struck the United States of America. I saw many devastating photos of the tornados ripping. In fact, as what I have read, there was a tornado to the 22 states in the last 12 days, making it a new record. Houses were ruined, trucks were piled on top of each other, other cars were overthrown, classrooms were ruined, and many other destructions. As a whole, this tornado brought so much damage to many states, and to the United States as a whole. I hope that all the houses that were destroyed will be repaired, cars that were damaged will be fixed, and the states will rise again after this destruction.

The Jefferson Landing State Historic Sites located in Jefferson City is an important site is Missouri Landing River. This building depicts a general store and warehouse from the 1850s, and it features a film on the history of this beautiful city. I enjoyed the film because it was very informative. There are also exhibits being done in the Lohman Building and the Union Hotels. Walk-ins to this place are always welcome. By the way, these two buildings have free admission. If you are going and you are about 10 people, it is better to have a reservation. It is necessary to make sure that there is a space for you to watch the film for 17 minutes.

DENVER (CBS4) – A female passenger parading through a Denver International Airport concourse last month without any clothing drew attention from fellow passengers and airport police. The woman, who had no luggage, appeared to be carrying some kind of a thermos, bottle or drink holder in her right hand. Beyond that, she was completely naked.

“How are you doing? Where are you from?” she asked bystanders who were videotaping her.

In a minute-long video clip shared with CBS4, Denver police officers with a large blanket can be seen following the woman in an attempt to get her to cover up. She was smiling and laughing.

Two newly hired physical education teachers at Florida elementary schools were arrested after the shooting of a man whose apartment they entered thinking it belonged to someone else following a night of drinking.

One of the teachers mistakenly climbed into bed with the man, his wife and their baby, and the other teacher went to the bathroom before the male occupant of the house escorted them out. The teachers believed they had entered the apartment of one of their friends.***

The teachers were Darius Cohen and Akkua Hallback.***

Cohen admitted to detectives that he fired the shots, the arrest affidavit said. Cohen, 26, is facing a charge of attempted felony murder. Court records showed he was still in jail Tuesday, and a court docket showed no attorney listed for him.

Lewis and two middle school pals — Rashaun Weaver, then 14, and Zyairr Davis, then 13 — stabbed Majors, 18, to death during the botched robbery in Morningside Park.***

Weaver was the first to attack the college freshman after she passed the trio while staring down at her phone. He ran up behind her and kicked her hard in the back. A tussle ensued and Majors bit Weaver, then yelled for help.

That’s when Lewis allegedly held her in a headlock, and Weaver repeatedly stabbed her, piercing her heart, and sending the feathers of her down coat into the air. The boys fled with her iPhone.

PORTLAND, Ore. (KOIN) — Portland police say new legislation passed in Oregon dramatically limits their options when it comes to intervening during destructive protests and riots.

Lt. Jake Jensen with the Portland Police Bureau joined the Pearl District Neighborhood Association meeting Thursday night on the heels of widespread vandalism in the area.***

“The reason that we did not intervene goes back to what we talked about last month with HB 2928 and the restrictions placed on us in a crowd control environment,” he explained.

A KOIN 6 News crew watched as officers remained in their vehicles Tuesday night as the destruction unfolded.

“That’s the way our legislature has said we need to operate in a crowd control environment. So that’s the way we are going to operate in a crowd control environment,” Jensen said.

Jensen cited limitations regarding the use of pepper spray and other tools officers previously used.***

“Does that mean we are now like a lawless city, anyone can come in and just bash around and do all the damage they want without any repercussions whatsoever?” asked resident Linda Witt.

An explosion of violence in Portland has forced police to resort to creative tactics in an effort to address increasing gun violence with limited resources.

City officials began earlier this month placing traffic barrels on streets where high-speed drive-by shootings have broken out in an effort to obstruct future ones.

Portland police are also no longer pulling over drivers for minor traffic violations, such as expired tags.***

Portland marked a grim milestone in recent weeks when it recorded its 67th homicide, breaking the city’s previous record of 66 homicides in a single year, which occurred in 1987.***

Meanwhile, residents have reported long wait times for 911 calls as police and dispatchers struggle to handle the growing number of calls, with violence spreading.

A man was charged with raping a woman on a train outside of Philadelphia as fellow passengers watched, held up phones and did nothing to intervene, police said.

The man, Fiston Ngoy, 35, harassed the woman, groped her and eventually raped her as fellow passengers watched the assault through more than two dozen train stops, authorities said. Police believe no one called authorities, though they are investigating whether any of the witnesses may have recorded the incident.***

surveillance footage captured the assault and appeared to show other passengers possibly recording the attack. "There were people witnessing the act with phones in their hands," Nestel said. "People were holding their phone up in the direction of this woman being attacked."***

Ngoy sat down next to the woman about a minute after he boarded the train car, shortly after 9:15 p.m. The video shows her pushing him away multiple times until he is seen ripping her pants down at about 9:52 p.m.***

According to the court documents, the woman told police that Ngoy ignored her pleas to go away. Ngoy claimed he knew the victim and said the encounter was consensual, but he could not remember her name, the arrest affidavit states. A federal judge placed top officials in the U.S. Department of Corrections in contempt Wednesday after ruling they violated the civil rights of a prisoner.

District Judge Royce Lamberth said the violation came when Washington's Department of Corrections Director Quincy Booth and Warden Wanda Patten refused to provide medical papers for Christopher Worrell, an accused Jan. 6 rioter. Worrell broke his hand in May, and a surgeon recommended in June he get surgery, medical treatment that he reportedly still has not received.

"It is more than just inept and bureaucratic shuffling of papers," Lamberth said, according to multiple outlets. "I find that the civil rights of the defendant have been abridged. I don't know if it's because he is a Jan. 6 defendant or not, but I find that this matter should be referred to the attorney general of the United States ... for a civil rights investigation."***

This summer, Erica and Zach Mallory of Eagle, Wisconsin, scored an important victory for the freedom to speak out against government abuses. A federal court ruled for them and for IJ in our challenge to unconstitutional retaliation from local government officials who didn’t like the Mallorys’ criticism of their bad behavior. The judge ordered Eagle to stop enforcement actions against the couple while their case continues.

Back in November 2020, IJ stepped in to help Erica and Zach, who own a family farm in Eagle, a small town in southeastern Wisconsin. The Mallorys started speaking out against actions by local government there when they noticed neighbors being treated unfairly. Unhappy with these criticisms, town officials soon came after the Mallorys, issuing citations for petty code violations like patches of grass being too tall and an unpermitted flower box. The Mallorys tried to comply with the ordinances enforced against them, making numerous changes to their property. The town wouldn’t relent; instead, it repeatedly inspected the Mallorys’ farm and threatened them with tens of thousands of dollars in fines.

So the Mallorys joined with IJ to hold the town accountable for its retaliatory, unconstitutional ordinance enforcement practices. Eagle’s actions violate the First Amendment’s protections against government retaliation, and the town’s enforcement methods violate due process. For instance, Eagle relies on an hourly paid law firm to enforce its code, then passes its hefty legal bills on to accused town residents. A federal grand jury in Philadelphia, Pennsylvania, returned an indictment in July, which was unsealed [Tues], charging a South Carolina man with tax evasion and attempting to obstruct an IRS civil audit and an IRS criminal investigation.

According to the indictment, Wayne M. Garvin, currently of Columbia, South Carolina, and previously of Philadelphia, allegedly filed individual income tax returns for the years 2012 through 2016 on which he claimed fraudulent deductions and expenses, including charitable contribution deductions and expenses associated with rental properties that he owned for some years. For the year 2013, Garvin also allegedly claimed he had expenses associated with service in the U.S. Army Reserves even though he did not perform any reservist duty that year. At the time Garvin filed his false tax returns, he was employed as a Supervisory Associate Advocate with the IRS’s Taxpayer Advocate Service in Philadelphia.

An enrolled member of the Seminole Nation of Oklahoma and member of the Indian Brotherhood (IBH), a prison-based gang active in Oklahoma, pleaded guilty today to charges related to two separate homicides that took place in 2015 and 2017 within Indian Country in Oklahoma.

According to court documents, in May 2015, Matthew Onesimo Armstrong, 32, of Seminole, Oklahoma, received orders from the IBH to question an individual about an unrelated homicide. On May 30, 2015, Armstrong went to victim Scotty Candler’s home with a firearm to question, scare and assault Candler. He was purportedly accompanied by John Douglas Knight, who was also associated with IBH and carrying a firearm. Outside the residence, Armstrong discharged two gunshots when Candler’s dogs ran out, while Knight, allegedly, entered the residence and fired one shot, killing Candler.

As set forth in the plea agreement, in 2017 Armstrong was involved in smuggling methamphetamine and other contraband for IBH into various prisons and jails. On April 16, 2017, at Armstrong’s residence, Armstrong had a dispute with victim Nicole Owl, who was also staying at the home. Armstrong and Nicholas Earl Faulkner took Owl into a wooded area behind the residence where Armstrong tied her to a tree. He left Owl tied to the tree for several hours and then returned with a rifle. JEFFERSON CITY, Mo. Responding to concerns from state officials, the U.S. Treasury Department said Wednesday that states can cut taxes without penalty under a new federal pandemic relief law so long as they use their own funds to offset those cuts.

Republican governors, lawmakers and attorneys general have expressed apprehension about a provision in the wide-ranging relief act signed by President Joe Biden that prohibits states from using $195 billion of federal aid to either directly or indirectly offset a reduction in net tax revenue. The restriction could apply through 2024.

A treasury spokesperson told The Associated Press that the provision isnt meant as a blanket prohibition on tax cuts. States can still offset tax reductions through other means.

We should not let federal restrictions weigh in on that direction were going as a state, Hutchinson said.

Now what I find interesting is that the GOP has been erroneously prognosticating that tax increases on the rich would hurt the economy since way back in 1993. Its like Collins and Scott simply cut and pasted GOP talking points from the Clinton and Obama years. Lets take a little trip down memory lane and see how previous D.C. Republican predictions of doom and gloom played out.

Even before Biden formally unveiled his plans, Republicans sent a message that they consider the 2017 law that slashed personal and corporate tax rates as a sacrosanct measure that theyve no intention of gutting.

Sen. Roger Wicker explained this ethos in unusually blunt fashion when he returned to the Capitol on April12 after Biden met with a small bipartisan group of lawmakers involved in infrastructure issues, telling the group he was targeting the very taxes that Republicans slashed four years ago.

Clearly there are parts of his program that are non-starters for Republicans. The pay-for, I view the pay-for as a problem, Wicker told reporters in the Capitol after that meeting. I view the 2017 tax bill as one of my signature achievements in my entire career.

In many ways, Wicker signaled to Biden that Republicans view the 2017 law in the same manner that Democrats regard the 2010 passage of the Affordable Care Act: a signature achievement of domestic policy that they will defend in every way possible.

The two laws obviously had very different goals and very different results, one trying to provide health insurance for millions of uninsured Americans and the other reducing taxes on corporations and the wealthy.

Republicans on Thursday also unveiled a plan to increase state support for public schools. The plan increases state money paid to schools, but doesn’t increase the amount of money schools will have to work with, because it simply replaces school funding previously provided;through property taxes with funding from the state.

Under the plan, the state would:

Buy down property taxes that fund schools by increasing;state general school aid funding by $408 million over two years.

Provide $167 million to replace property tax funding sent to charter schools associated with the City of Milwaukee, University of Wisconsin-Milwaukee, and UW-Parkside.

Spend $72 million on buying down property taxes directed to;the Wisconsin Technical College System.

Overall, the plan would cost $647 million over two years.;

An Exhaustive Lobbying Campaign

Almost immediately after Mr. Trump signed the bill, companies and their lobbyists including G.E.s Mr. Brown began a full-court pressure campaign to try to shield themselves from the BEAT and GILTI.

The Treasury Department had to figure out how to carry out the hastily written law, which lacked crucial details.

Chip Harter was the Treasury official in charge of writing the rules for the BEAT and GILTI. He had spent decades at PwC and the law firm Baker McKenzie, counseling companies on the same sorts of tax-avoidance arrangements that the new law was supposed to discourage.

Starting in January 2018, he and his colleagues found themselves in nonstop meetings roughly 10 a week at times with lobbyists for companies and industry groups.

The Organization for International Investment a powerful trade group for foreign multinationals like the Swiss food company Nestlé and the Dutch chemical maker LyondellBasell objected to a Treasury proposal that would have prevented companies from using a complex currency-accounting maneuver to avoid the BEAT.

The groups lobbyists were from PwC and Baker McKenzie, Mr. Harters former firms, according to public lobbying disclosures. One of them, Pam Olson, was the top Treasury tax official in the George W. Bush administration.

Democrats hope to unwind many of the tax cuts Republicans enacted under former President Donald Trump as a way to pay for the majority of the $3.5 trillion spending bill currently under consideration in Congress.

House Ways and Means Committee Chairman Richard Neal, D-Mass., released details Monday of a plan that includes increasing the top corporate tax rate to 26.5%, up from the current rate of 21%, and restoring the top rate to 39.6% for individuals earning more than $400,000 and married couples earning over $450,000.

The changes are part of the tricky balancing act plaguing Democrats’ efforts to approve the bulk of President Biden’s domestic agenda. Leaders are attempting to prove to skeptics within their own party it is possible to finance a vast expansion of federal spending on everything from housing and health care to financial support for families and climate change all without increasing taxes on everyday Americans.

All taxpayer income groups with incomes of $75,000 and under thats about 65 percent of taxpayers will face a higher tax rate in 2027 than in 2019.

For most, in fact, its a delayed tax increase dressed up as a tax cut. How many times have you heard Trump and his allies mention that? They surmised correctly, so far that if they waited to add the tax increases until after the 2020 election, few of the people most affected were likely to remember who was responsible.

Looking at the analyses of the nonpartisan Congressional Budget Office and the Joint Committee on Taxation at the time the December 2017 tax bill was enacted, we see very clearly how different income groups are affected by the Trump tax plan. And its disturbing.

They must be stopped.

Kevin Hassett, then chair of the White House Council of Economic Advisers, agreed: You dont really need to have a big growth effect to have Secretary Mnuchin be correct. Former Rep. Jeb Hensarling, chair of the House Financial Services Committee, insisted that economic growth would be more than enough to make up for the lower tax rates.

That growth failed to materialize. Unsurprisingly, so have higher tax revenues. Corporate tax receipts plummeted from $240 billion to $140 billion in the first quarter after the tax cut passed, and have stayed at that level ever since.

So what happened to the federal deficit? Republicans lied about the effect of their cut on tax receipts and at the same time they also decided to stop worrying about keeping spending down. As a result, the federal deficit has gone upand thats not even accounting for the COVID-19 stimulus spending. This comes as no surprise to anyone who has heard the same Republican tax arguments for decades and now recognizes them for the fabrications they are.

The plan from Trump would cut the payroll tax over the rest of the year. It would provide 140 million low and middle income Americans a 6 percent tax cut and would lower payroll costs for 30 million small businesses. The typical family with an income of around $60,000 would receive a $1,000 pay raise for the rest of the year.
