30.336 — CS, agosto 23-977. — Gobierno CS, de la provincia de Mendoza c. Gobierno Nacional. 2da Parte

Considerando: 1° Que tanto la provincia de La Pampa cuanto la Secretaría de Energía plantean en sus respectivas presentaciones, el no agotamiento por parte de la actora de la instancia administrativa, 10 que impediría el reclamo en sede judicial. Dada la naturaleza de tal defensa, corresponde se la considere como cuestión previa al tratamiento de los demás aspectos debatidos en la causa.

2° Que no aparece controvertido en autos, el hecho de que la provincia de Mendoza interpuso, contra el decreto 1560/73 del Poder Ejecutivo Nacional, el recurso de reconsideración previsto en el art. 84 del reglamento de la ley nacional de procedimiento administrativo (decreto 1759/72).

3° Que el referido planteo se basa — como lo afirma la actora a fs. 92 — en el art. 73 de dicho reglamento que prevé la impugnación por medio de recursos administrativos de 103 actos de ese carácter por razones fundadas en la legitimidad, oportunidad, mérito o conveniencia de la decisión cuestionada así como también en el Interés público.

4° Que según se expresa a Is. 9 del expediente 173/73 el pedido de reconsideración lleva, por lo tanto, implícito el reclamo administrativo previo a la demanda judicial que establece el art. 30 de la ley 19.549 (EL DERECHO, 42-917) y agotada en forma definitiva para el caso de tener que interponer acciones judiciales como las reservadas para el supuesto de no hacerse lugar al presente recurso. Solicita, en consecuencia, la actora que “se tenga presentado en tiempo y forma este recurso de reconsideración con el alcance de reclamación administrativa previa”.

5° Que sin necesidad de pronunciarse sobre si el reclamo administrativo era o no necesario en este caso, la verdad es que la actora abrió la vía de la administración mediante el escrito presentado el 16 de marzo de 1973 a fs. 1 del expediente 173/73. 

6° Que la denegatoria tácita que invoca fundada en el art. 86 del decreto 1759/72 no se produjo, como ella pretende, antes de iniciarse este proceso el 22 de mayo de 1973, toda vez que el 26 de noviembre de ese mismo año la provincia de Mendoza alegaba sobre la prueba pericial.

7° Que en tales condiciones no puede aceptarse la continuación del trámite en forma paralela y simultánea del procedimiento administrativo y del proceso judicial, ya que no hay en el expediente 173/73 ninguna presentación de la provincia actora que implique un desistimiento de su recurso.

8° Que no resulta óbice a estas conclusiones el argumento de la demandante acerca de la necesaria intervención de esta Corte habida cuenta del planteo de inconstitucionalidad, toda vez que no fue solo ese el objeto de su demanda. Por lo demás, el análisis de la cuestión debatida era posible —como lo admite— en el ámbito del Poder Administrador, quien podía resolver sobre aspectos que hacen a sus atribuciones propias (art. 73, decreto 1759/72) y que resultan ajenos por su naturaleza a la competencia de esta Corte, de suyo insusceptible de ser ampliada o restringida (Fallos, 271-145; 280-176 [EL DERECHO, 38-336, fallo 18.5151; 280-203 [EL DERECHO, 38-345, fallo 18.5481; causa H. 137, L XVII, de abril 21-977).

9° Que el trámite del reclamo formulado en los términos de la ley 19.549 y su decreto reglamentario de 6, pues, ser observado por la privacidad actora, máxime si, como se ha manifestado en el considerando c9, su propia conducta en esa instancia importaba la admisión concreta de no me-dar, al momento de iniciar la demanda judicial, la denegatoria tácita o expresa de su pretensión.

10° Que si bien es cierto que en sede administrativa no puede declararse la inconstitucionalidad de leyes y decretos, no lo es menos que el atacado por la accionante pudo allí ser dejado sin efecto por la ilegitimidad y los vicios formales que ésta le imputa y aun por razones de conveniencia u oportunidad. Lo que resulta idóneo en el caso toda vez que esta Corte tiene resuelto que declarar inconstitucional una norma, por su trascendencia, es un acto de suma gravedad institucional que debe ser considerado ultima ratio del orden jurídico (Fallos, 260-158; 264-364; 286-76 [EL DERE-ано, 52-265, fallo 23.696]; 288-325 [EL DE-, fallo 24.495] y causas L. 15,LO XVII, “Linck, Ricardo, s/circulación”, de mayo 18-876 [EL DERECHO, 68-214, fallo 28.486] У M. 242 L. XVII, “Mizrahi de Tucumán, S.

A. c. Gobierno de la Provincia de Tucumán”, de septiembre 16-976 [EL DERECHO, 70-191, fallo 28.7691). Tanto más si se advierte que tal petición iba dirigida no solo contra el decreto 1560/73 mencionado, sino también contra la propia ley 15.336, actitud que con respecto a esta última no aparece totalmente desvirtuada durante la tramitación ulterior de la causa.

Por ello, y oído el Procurador General, se decide no hacer lugar a la demanda seguida por la provincia de Mendoza por no haberse agotado la vía administrativa intentada. If you think about it, all Disney princesses are beautiful, well-dressed, thin, with long hair, often naïve, and especially in the first movies, white. And all of them always follow the same basic model: they wait for the intervention of prince charming to solve the problems of their existence. Disney has luckily evolved over the years, but do you realize that they’ve made us grow up with the idea that to save us from our troubles and to change our lives, will be the encounter with ‘the right man’? Disney movies, undoubtedly, convey a lot of positive messages. They can spur us on to being altruistic and optimistic, to commit ourselves to what we do, to try to change our own destiny, etc., etc. But they also have negative aspects and messages like, indeed, a Cinderella. The poor and beautiful maid, forced to work as a scullery maid by her stepmother and evil stepsisters, envious of her beauty. An unhappy housewife who doesn’t lift a finger to change the bad situation she’s in. And what's the only way her life changes? When the handsome and rich prince she met for only five minutes, marries her. I mean, what? Sis, you danced for a couple of hours at a party with him! TSM reportedly ‘close’ to signing new CS2 roster core highlighted by former G2, C9 players

After more than six years away from Counter-Strike, TSM is reportedly close to signing a core team that will guide the organization's comeback. TSM is apparently moving forward with an international squad of players for CS2, featuring some of the greatest names in the scene. According to French CS journalist neL for 1pv, TSM is “on the verge” of signing the trio of Englishman Cai “CYPHER” Watson, French player Audric “JACKZ” Jug, and Russian player Timofey “interz” Yakushin, all under the direction of former Vitality/G2 coach Rémy “XTQZZZ” Quoniam. NeL reports that XTQZZZ was behind the scenes aiding Vitality still during their BLAST Paris Major victory in May, despite stepping back from the head coaching role at the end of 2022. The BLAST Paris Major was where the worldwide pro Counter-Strike audience received a proper introduction to CYPHER. He was a crucial part of the improbable Into The Breach playoff run, during which a British roster core reached the playoffs of a Major for the first time. Reportedly flanking him on the new TSM roster will be JACKZ, formerly and most notably playing for G2 and most recently playing for the French roster HEET. JACKZ was originally reported to be heading to Evil Geniuses as part of an ambitious international roster that included the likes of electroNic and EliGE, but those moves fell by the wayside, paving the way for TSM to reportedly sign the Frenchman. TSM will also reportedly be the new home for interz, who recently departed the Cloud9 roster after spending years with that core. He and his former C9 teammates graduated from Gambit Youngsters to become that organization’s main roster in late 2020 before winning a handful of big trophies during the 2021 “online era” and eventually leaving as a group for C9. C9 removed interz to make way for buster at the beginning of this year. LEC weekly review / week 1

　フランチャイズ化に伴いUnicorns of Love、H2K、Team ROCCAT、Giants Gamingがリーグを去り、新たに4つのチームが加わった欧州リーグ。4チームとは言うものの、Origen(OG）とSK Gaming(SK）はそれぞれ優勝争いを演じていたこともある懐かしいチームの復帰、Rogueは過去にROCCAT在籍歴のある関係者が揃ったチームなので完全に新規参加（イギリスのアマチュアリーグで数年活動しているが今回選手は総入れ替え）のExcelを合わせて新チームは実質1.5チーム分ぐらいという気がしないでもない。とはいえ、従来のEU LCSから続投しているチームも主力選手の離脱やテコ入れのための大型補強によりメンバーは大きく変化している。昨年までの勢力図はアテにはならないだろう。新たな選手やチームの台頭、変化はいつだって歓迎される競技の世界、生まれ変わったLECの第一週を簡単に振り返ってみる。

以下、試合の結果を含む。

Rogue（RGE:0-2） 

　新規参戦のチームにとっては難しい初戦はMSF戦、sOAZ選手による「赤バフをサポートしたフリ」に引っ掛けられボットレーンでのLv2ガンクをカウンターされた結果、MSFのドレイヴンに赤バフとFBを渡すという非常に厳しい状況に陥る。その後もボットレーンを押し込まれ続け、ドレイヴンの前に膝を屈するゲームとなった。翌日のXL戦はProfit選手の不幸な事故（ストップウォッチでサイオンの猪突猛進を回避した結果、バックラインに刺さって被害が拡大した）やXL側のジリアンによってキルを阻まれ、カジックスに発生した賞金を回収できなかったことが原因で反撃が実らなかった。

　2試合の結果���しては、ボットレーンのピックが受け気味なのが少々気になるところ。各プレイヤーの技術は確かなものがあるメンバーが揃っているのだが、どこのレーンからでもゲームを壊す用意ができているかどうかは大きな差になりそうだ。

 Fnatic（FNC:0-2）

　昨年の欧州を席捲し、WCS決勝まで進んだチームという事で期待も大きかったであろうFNCだが、新ミッドのNemesis選手がカウンターピックを当てられて潰されたこともあって2敗からのスタートとなった。現在のゲーム展開はミッドを押さえてジャングルの選択肢を増やし各レーンを勝つのが主流なので、ルーキーを狙い撃ちにされた格好だ。

　SK戦ではレーンから少数での戦闘では期待に違わぬ活躍を見せられたが、最後の集団戦ではポッピーやリサンドラの存在もあって良い位置への飛び込みは難しかったし、OG戦はねこばばヴェインが最序盤で一方的にゴールドを稼いだことが最後まで響く結果となった。また、Rekkles選手がチャンピオンプールを改善するために以前はあまり使用してこなかったルシアン(2016年以来！)やジンを使用したりもしており、新しいことを試しつつスプリットを通して改善していくプランなのだろう。

　昨シーズンのC9がWeek3終了の時点で最下位に沈んだ後の飛躍を考えれば、最悪スプリット6位からプレイオフ全勝すればいいのでFNCファンは初週の結果をそこまで深刻にとらえることはない。

Team Vitality (VIT:1-1)

　まずは上位争いに絡んでくるライバルの一角となるF04との一戦、Jiizuke選手のヤスオに合わせた構成のVITに対し、S04も強力なエンゲージ能力を備えたチャンピオンを揃えてぶつかり合う姿勢を見せる。各レーンほぼ五分の時間が続いたものの、より強力なAoEダメージを揃えるF04に対しバロンを中断する中でタワーを失い、最後はバロンを先に獲得しに入ったF04にカウンターされる形で集団戦に敗北、バロンを得たF04に押し込まれてしまった。

　SPY戦はミッドカーサスにヴェイン、トップがジェイスで組み立ての難しい構成での試合となった。トップレーン以外のマッチアップは不利な状態だったが、カーサスの鎮魂歌を警戒してバロンに踏み切れないSPYに対して試合時間を引き延ばすことに成功。巧みに姿を消すジェイスとカーサスに対して有効なエンゲージができないSPYを左右に引き回して勝利を収めた。

　いずれの2試合もVITらしいと言えばらしいゲームだったように思う。Jiizuke選手を軸に試合を運ぼうとする動きやサイドレーンから揺さぶるマクロはラグビーと評されたこともあるVITらしい。一方でF04戦のようにずるずると判断が崩れる不安定さも見せており、スプリットを通じて修正していきたいポイントとなりそうだ。

Splyce (SPY:1-1)

　初戦となったXL戦。序盤はXLがボットレーンにシン・ジャオを送り込んだため苦しい展開となったが、中盤以降に孤立したジャングル・トップを的確にキャッチできたこと、XLの構成に強固な前線を構築できる純粋なタンクが不在だったことを的確に突いて勝利を収めることができた。

　続くVIT戦だが、序盤の苦しいヴェインに対してシヴィア、ザックで優位を取れたもののカーサスの鎮魂歌を警戒してバロンにアクセスできない時間帯が続いてしまった。そのままヴェインの装備が整い、集団戦を勝ちきることができなかった。VITは決して集団戦に強い構成ではなかったのだが、モルガナがヴェインを常に守り残りのソロレーナーがキャッチされるようなミスも見せなかったため試合を決めきれなかった。

　XL戦は勝利しているものの、展開としてはカウンター気味の形で有利を取っている点が少々気になった。ピックからの帰結として無理もないのだが、ミッドから圧倒していくような試合にも期待したい。

SK Gaming(SK:1-1)

　帰ってきた伝統の一戦となった対FNC戦、トラブルによるリマッチもあり両チームとも集中を維持するのが難しい状態となったがミッドのPirean選手がほぼレーンのコントロールを保ち、FNCがサイドレーンで仕掛けてくる動きに対しても適切な交換を行ってリードを許さないゲームを作ることができた。中盤の少数戦ではアカリ・パイク・リーシンの機動力でキャッチされる展開も見られたが、Werlyb選手のポッピーをはじめとしてFNCの仕掛けをズラし、全体としては構成が脆いという弱点を突いて集団戦に勝利、バロンを獲得して新たな「伝統の一戦」に勝利した。

　勢いに乗って迎えたMSF戦、互いにエンゲージ能力の高いチャンピオンを並べての試合となったがより速い時間帯から仕掛ける権利を持っていたのはカミールを擁するMSFだった。Lv2ガンクでボット側のフラッシュが尽き、ジャングルをカバーすることが難しくなった直後に自陣ジャングル内での戦闘でルシアンに2キル入った時点でSKのノクターンが仕掛ける余地は失われた。

　初週を終えて1-1、新規のロースターということで一部では不安視もされていた中での結果としては上出来と言えるだろう。MSFはLECの第一週時点ではG2と双璧となる完成度のチームなので、次の対戦までに序盤の組み立てを研究して対抗できれば良しと考えた方が良さそうだ。次回のS04戦やXL戦で勝利できれば予想を覆しての名門復活も見えてくる。

Origen (OG:1-1)

　オーナー同士が競技シーン黎明期においてライバル関係にあったG2との試合は、G2の変則的な構成に対して序盤のボットレーンを重視しつつバランスの良い構成で挑むOGという形で始まった。レーンにめっぽう強いドレイヴンが序盤を有利に進めることができたものの、中盤以降G2の豊富なポークと鎮魂歌によるキルの危険があまりにも高く次第に身動きが取れなくなり、最後は十分なヘルスを確保して当たることが不可能となり試合を落とすこととなった。

　翌日の試合は2015シーズン以来の因縁となるFNCとの一戦。勝利して1-1で終えたい試合である。OGはミッドレーンでFNCのガリオに対してラストピックで”ねこばば”ヴェインを当てる戦略を採用。Lv1から執拗にハラスを続けてどんどんゴールド差を作っていく。そして20分を待たずに王剣とグインソーが完成したヴェイン（ソロレーンなので成長も早い！）がFNCを粉砕した。他レーンは中盤までの当たりあいは五分、少数戦の動きはむしろFNC側が優勢だったが最後はゴールドの集まったハイパーキャリーがゲームを粉砕した。

　新ロースターで昨年までの上位チーム相手の2戦としては満足のいく初週だったと言えるだろう。ただ、いずれの結果もB/Pはかなり変則的な構成だったので、今後の結果について考えるのはまだ早そうだ。

FC Schalke 04 (F04:1-1)

　互いにトップチームに名を連ねるべく争うライバルにあたるVITとの一戦、序盤はサイドレーンをS04が押さえ、ミッドレーンはVITのヤスオがセジュアニと共にリードを作る展開となった。中盤以降も集団戦��互いにキルを交換しあい、エンゲージ志向のS04に対してゾーニングとピールのツールが多いVIT側がバロン周辺を確保する時間が続いた。しかし、AoEダメージを警戒してVITがバロンを取り切れず消費した時間でS04側がオブジェクトを獲得、最後は逆にバロンを獲得して押し切ることに成功した。

　上位を狙うチームとしては是非とも勝利したい難敵G2戦、F04側はエズリアルで低リスクなレーンを作り、IgNar選手のスレッシュがロームしやすい試合を作る目論見だったが、カイ＝サにFBが渡ってしまった所からボットレーンでの均衡が崩れてしまった。ミッドレーンのマッチアップも対アカリではなく、G2のプレイヤーが非常に幅広くフレックスピックを融通できるという点に振り回された格好となった。

　1-1という戦績は、初週の結果としてはまずまず問題無いものだろう。ルーキーのAbbedagge選手はかなりのプレッシャーと試合上での相手からの圧があったであろう中で、良いプレイをいくつか見せている。今回は手札をさらすことを嫌ったのか、ミッドがリサンドラ、ボットがエズリアルで2試合を戦っていたが、今後他のピックでもどのような試合を展開していくのかが注目されるだろう。

Excel Esports (XL:1-1)

　完全な新規チームかつ新たなロースターでの参戦となったXL。初戦はSPY相手に落としてしまったが、RGE戦はJeskla選手のルシアンに王剣が完成した時間帯に5v5を仕掛けて勝利。そこからCaedrel選手のカジックスがスノーボールして勝利を収めた。いずれの試合も最ベテランのkaSing選手のプレイが要所で刺さり、多くのファンの期待に応えたのではないだろうか。負けた試合の方はトップージャングルーミッドの構成が難しく、Caedrel選手がFBを獲られてしまったのが響いた。トップサイドのコミュニケーションと戦術に関して完成度が高まれば、今後もいい試合を見せてくれるのではないだろうか。

Misfits Gaming (2-0)

　初戦となった対RGE戦では、ジャングルのスタートを隠蔽するsOAZ選手の動きから見事なカウンターガンクを決めてHans Sama選手のドレイヴンにFBと赤バフを渡すことに成功、そのままボットレーンでゴールド差を広げてサイオンのCSと引き換えに勝利を獲得した。

　二日目の対SK戦でもMaxlore選手のカミールが華麗なLv2ガンクでボットレーンのフラッシュを全て吐かせ、そのままの流れで相手ジャングル内での戦闘を起こしてHans Sama選手にまたしてもキルを渡すことに成功。序盤の相手ジャングルを潰し、かつアシストのゴールドを得たカミールがレーンに現れる度に差を広げていくゲームを展開して勝利した。

　いずれの試合もプレイヤーの技術の高��と、強力なLv2ガンクに絡んだプレイから掴んだリードを離さない力強さを見せつけている。最序盤の準備においてMSFを上回らなければ彼らに勝利するのは難しいだろう。

G2 Esports (2-0)

　欧州でも最高峰のミッドレーナーに数えられるであろうPerkz選手のボットレーンへのコンバートがどのような結果をもたらすのか注目されたG2、初戦で見せたのはなんとジャングルカーサスとボットゾーイだった。対するOGはドレイヴンとモルガナで序盤から押し込むゲームを志向し、実際レーンフェイズにおいてG2のボットレーンは苦戦していた。しかし、ジェイスのQがLv5に到達する頃から展開が変化する。ポークダメージを受けすぎればカーサスの鎮魂歌でキルが確定（デスグラインダーも可）するため、OGは”危険”のラインが非常に低くなってしまったのだ。ゾーイが2コア完成させたところでOG側は主導権を喪失。誰もが予想しなかった構成でG2が勝利を収めた。

　初戦のインパクトから、どのようなピックが飛び出すか注目が集まった対S04戦、ボットレーンはカイ＝サを選択したもののジャングルはまたしてもカーサス。またWunder選手にアカリを渡すG2お得意の交換も見せた。試合の方は、ミッドレーンで優勢を確保したCaps選手の早い寄せからF04のカ＝ジックスを捕えてPerkz選手にFBを渡すことに成功。全てのレーンで優勢を築いてそのまま25分を待たず勝利した。全体でのゴールド差を15kと広げての大勝である。

　スターミッドレーナー2名を抱え、Team DuoMidとも放送中に評されたG2だが、他のプレイヤーも一様に優れた技術とEUでは珍しい部類のチャンピオンプールを誇っている。彼らはピックした後にチャンピオンを自在に入れ替えて戦うことができる。G2にどれだけの「チーズ」が用意されているのか。誰にも予想できないシーズンとなりそうである。（ただ、Mikyx選手の負担がとんでもなく大きいシーズンにもなりそうだが）

╚ Woodam was known for his high notes and he is the brother of SISTAR member, Soyou. Jinyoung amazed the national producers with his performance of SMTM's I Am Not What You Think where his nickname "Woo Jinyoung micheotji" (Woo Jinyoung is crazy) came from.

╚ After the show, Woodam, Jinyoung and Yonggeun joined another survival show, MIX NINE. Woodam didn't made it to the cut, Yonggeun was eliminated in the 3rd round and Jinyoung actually WON the show, he was in the 1st place set to debut in YG's new group. UNFORTUNATELY, YG and other companies disagreed with the new contract YG set (As far as I know, YG changed the contract saying the winning members of MIX NINE should promote for THREE YEARS which is very impossible for a SURVIVAL SHOW group since they came from different entertainments). This misunderstanding made HF Music file a lawsuit against YG Entertainment (and up until now, there's no result yet). Like, guys Jinyoung BEGGED YG for another chance during MIX NINE cause he is so determined to debut. He did well during the show and got the 1st place but YG suddenly fucked up. (Sorry, I'm just mad at YG for not letting MIX NINE debut)
