The Emirati legislator issued the Civil Personal Status Law pursuant to Federal Decree Law No. (41) of 2022, and the provisions of this law apply to non-Muslims, whether citizens or residents of the United Arab Emirates, and one of the parties may insist on applying the law of his nationality in matters of marriage, divorce, inheritance, wills, and proving Lineage
It may also be agreed to implement other legislation regulating the family or personal status in force in the country instead of applying the provisions of this decree law.
In applying its provisions, the law took into account equality between men and women in rights and duties, such as testimony, so a woman’s testimony before the court is taken into account just like a man’s testimony, as well as inheritance. Men and women are equal in the distribution of inheritance.
Here we will only highlight civil marriage, divorce, and joint custody in accordance with the provisions of this law
Civil marriage
In order to contract a civil marriage, both spouses must have reached at least 21 years of age
Marriage must not be between brothers, sons, grandchildren, paternal uncles, or uncles
The marriage is performed before the documentation judge of the competent court through the spouses filling out the form prepared for this purpose
The spouses may agree on the terms of the contract, and what is stipulated in this contract regarding the rights of the husband and wife during the marriage and post-divorce rights, in particular joint custody of children, shall be taken into account between them.
The marriage contract form must include the disclosure of each spouse about the existence of any other previous marital relationship for either of them, indicating the date of the divorce, if any, as well as the wife’s acknowledgment that there is no existing marital relationship.
The husband must submit this declaration if his legislation does not allow him to have multiple wives. In all cases, the husband must disclose any existing marital relationship before the documentation judge.
The marriage contract shall include evidence of the consent of both spouses verbally and in writing
Divorce and its procedures
This decree law excludes divorce lawsuits filed based on its provisions from being presented to family guidance committees, and they are presented directly to the court to issue a ruling in the first session.
Both husband and wife may, of their own volition, request the court to sign a divorce without prejudice to the rights related to divorce.
It is sufficient to request and sign a divorce if one of the spouses expresses before the court his desire to separate and not continue the marital relationship without the need to justify that request, explain the harm, or place blame on the other party. The divorce takes place by court ruling after the other party announces it.
The divorced woman may submit a request to the court after the divorce ruling is issued to obtain a ruling for alimony from her ex-husband. In the event of failure to agree on the conditions or controls for this alimony or other financial requests in the marriage contract, acceptance of the request and its duration are subject to the judge’s discretion.
Joint custody
This decree law also introduced a new concept of custody that was not applied in the United Arab Emirates, where men and women have equal right to joint custody of the child until he reaches the age of eighteen (18), after which the child has freedom of choice.
Custody, according to the meaning of this law, is a joint right and a shared and equal responsibility of the father and mother after the divorce. It is also a right for the children so that one parent does not have the sole responsibility of raising and seeing the child without the other.
This is unless the two parties submit a request to the court to prove custody of the person who is worthy of achieving the interests of the child in custody
Or one of them requests to waive his right to custody in writing before the court
Or submit a request to the court to remove the other party from joint custody and drop his right to custody for any reason acceptable to the court, such as eligibility issues, the danger of the person participating in custody, or the failure of the joint custodian to perform his duties.
In the event that the father and mother disagree regarding any matter of joint custody, either of them has the right to submit a request to the court to decide what the court deems appropriate in the interest of the child in custody.

Wills for Non-Muslim Foreigners in the UAE

It is legally agreed that there will be no will for the heir unless approved by the heirs of legal age. Therefore, lawyers in dubai will advise to court the endowed funds are transferred to the legatee after the testator's death, unless the testator specifies other conditions, for example (to be transferred to the legatee at a later date after the testator's death).
In addition, according to the provisions of article (272) on the mandatory will of someone who dies, or is presumed dead by a court ruling, and has a son or daughter who died before or with the testator; the grandchildren will have the right to testament for the third part of the inheritance within the limits and conditions of this.
The need for non-Muslim foreigners to write their wills:
As previously stated, the foundation is the application of the requirements of the UAE Personal Status Law to all UAE nationals and foreign residents. However, suppose foreigners follow the application of their law. In that case, this law should be applied in this situation, provided that a legally authenticated copy of it is supplied, even if its provisions are not by Islamic Sharia, and provided that the parties to the dispute are non-nationals and non-Muslims.
Concerning the applicability of foreign law in the United Arab Emirates regarding the will, if it included or contained property owned by a testator within the United Arab Emirates, the legislator of the United Arab Emirates made an absolute prohibition in this regard and decided that the applicable law in such a case shall be UAE law only. الزواج والطلاق في قانون الأحوال الشخصية المدني

أصدر المشرع الإماراتي قانون الأحوال الشخصية المدني بموجب المرسوم بقانون اتحادي رقم (41) لسنة 2022 ، وتسري أحكام هذا القانون على غير المسلمين سواء من مواطني دولة الإمارات العربية المتحدة أو المقيمين بها ويجوز لأحد الأطراف التمسك بتطبيق قانون جنسيته وذلك في مسائل الزواج والطلاق والتركات والوصايا وإثبات النسب
كما يجوز الاتفاق على تطبيق التشريعات الأخرى المنظمة للأسرة أو للأحوال الشخصية النافذة في الدولة بدلاً من تطبيق أحكام هذا المرسوم بقانون
وقد راعى القانون في تطبيق أحكامه المساواة بين الرجل والمرأة في الحقوق والواجبات كمثال الشهادة فيعتد بشهادة المرأة أمام المحكمة مثلها مثل شهادة الرجل وكذلك الإرث يتساوى الرجل والمرأة في توزيع الإرث.
ونكتفي هنا فقط بتسليط الضوء على الزواج المدني والطلاق والحضانة المشتركة وفق أحكام هذا القانون
الزواج المدني.
يشترط لعقد الزواج المدني أن يكون كلا الزوجين قد بلغ 21 سنة ميلادية على الأقل
وألا يكون الزواج بين الأخوة أو الأبناء أو الأحفاد أو الأعمام أو الأخوال
ويتم إجراء الزواج أمام قاضي التوثيقات بالمحكمة المختصة من خلال تعبئة الزوجين للنموذج المعد لذلك
وللزوجين الاتفاق على شروط العقد ويتم الاعتداد فيما بينهما بما ورد في هذا العقد من حقوق الزوج والزوجة خلال فترة الزواج وحقوق ما بعد الطلاق وعلى وجه الخصوص الحضانة المشتركة للأطفال
ويتعين أن يتضمن نموذج عقد الزواج إفصاح كل من الزوجين عن وجود أي علاقة زوجية أخرى سابقة لأي منهما مع بيان تاريخ وقوع الطلاق إن وجد وكذلك إقرار الزوجة بعدم وجود أي علاقة زوجية قائمة
وعلى الزوج تقديم هذا الإقرار في حال لم تكن تشريعاته تجيز له تعدد الزوجات وفي جميع الأحوال يتعين على الزوج أن يفصح عن أي علاقة زوجية قائمة أمام قاضي التوثيقات
ويكون عقد الزواج مشتملاً على ما يفيد رضا الزوجين نطقاً وكتابة
 الطلاق وإجراءاته
استثنى هذا المرسوم بالقانون دعاوى الطلاق التي ترفع استناداً لأحكامه من العرض على لجان التوجيه الأسري وتعرض مباشرة على المحكمة لإصدار الحكم من الجلسة الأولى
للزوج والزوجة على حد سواء كل بإرادته المنفردة طلب توقيع الطلاق من المحكمة دون الإخلال بالحقوق المتعلقة بالطلاق
يُكتفى لطلب الطلاق وتوقيعه أن يبدي أحد الزوجين أمام المحكمة رغبته في الانفصال وعدم الاستمرار في العلاقة الزوجية دون الحاجة لتبرير ذلك الطلب أو بيان الضرر أو إلقاء اللوم على الطرف الآخر ويقع الطلاق بحكم المحكمة بعد إعلان الطرف الآخر
للمطلقة تقديم طلب للمحكمة بعد صدور حكم الطلاق للحصول على حكم بالنفقة من مطلقها وفي حال عدم الاتفاق على شروط أو ضوابط هذه النفقة أو الطلبات المالية الأخرى في عقد الزواج يخضع قبول الطلب ومدته للسلطة التقديرية للقاضي
الحضانة المشتركة
استحدث هذا المرسوم بقانون أيضاً مفهوماً جديداً للحضانة لم يكن مطبقاً بدولة الإمارات العربية المتحدة حيث يتساوى الرجل والمرأة في الحق في حضانة الطفل بشكل مشترك حتى بلوغه سن (18) الثمانية عشر عاماً وبعدها يكون للطفل حرية الإختيار
فالحضانة بمفهوم هذا القانون حق مشترك ومسؤولية مشتركة ومتساوية للأب والأم بعد وقوع الطلاق وهي كذلك حق للأبناء في عدم استحواذ أحد الأبوين دون الآخر بتربية الطفل ورؤيته
وذلك ما لم يقدم الطرفان طلباً للمحكمة بإثبات الحضانة لمن هو جدير بتحقيق مصالح المحضون
 أو يطلب أحدهما التنازل كتابة أمام المحكمة عن حقه في الحضانة
أو تقديم طلب للمحكمة بعزل الطرف الآخر من الحضانة المشتركة وإسقاط حقه في الحضانة لأي سبب تقبله المحكمة مثل عوارض الأهلية أو خطورة اشتراك الشخص في الحضانة أو عدم قيام الحاضن المشترك بمهامه
وفي حالة اختلاف الأب والأم في أي أمر من أمور الحضانة المشتركة يحق لأي منهما التقدم بطلب للمحكمة وذلك لتقرير ما تراه المحكمة مناسباً لمصلحة المحضون
