PROCESSO IN VATICANO, 86 UDIENZE E 124 MILA PAGINE

(ANSA) - CITTÀ DEL VATICANO, 16 DIC - Ottantasei udienze dibattimentali, compresa quella finale di oggi, nell'arco di quasi due anni e mezzo, a partire dal 27 luglio 2021: le prime otto, in sette mesi e un giorno fino al 28 febbraio 2022, dedicate alle istanze ed eccezioni preliminari; poi quelle dedicate all'ascolto dei 69 testimoni; infine le sette udienze dedicate alla requisitoria dell'accusa e alla replica; le 13 riservate alle arringhe e alle repliche delle dieci difese; le cinque per le altrettante parti civili (Segreteria di Stato, Apsa, Ior, Asif e mons. Alberto Perlasca) e le loro repliche.

Sono alcuni dei "numeri" del processo sulla gestione dei fondi della Segreteria di Stato e la compravendita del Palazzo di Londra, che si è concluso oggi nella Sala polifunzionale dei Musei Vaticani. Il maggior processo celebrato in Vaticano, tanto da meritarsi l'appellativo del "secolo". Dieci gli imputati e quattro le società alla sbarra, rinviati a giudizio il 3 luglio 2021: il cardinale Angelo Becciu, mons. Mauro Carlino, Enrico Crasso, Raffaele Mincione, Fabrizio Tirabassi, Cecilia Marogna, Gianluigi Torzi, Nicola Squillace, René Bruelhart, Tommaso Di Ruzza, più la Logsic Humanitarne Dejavnosti della Marogna, e la Prestige Family Office, la Sogenel Capital Investment e la Hp Finance di Crasso.

I capi d'imputazione iniziali erano 37, poi saliti a 41 il 25 gennaio 2022 e a 49 il 30 marzo di quest'anno: le ipotesi di reato vanno dalla truffa aggravata al peculato, dall'abuso d'ufficio aggravato all'appropriazione indebita, dalla corruzione aggravata al riciclaggio e autoriciclaggio, dall'estorsione fino alla subornazione di testimone e al falso materiale in atto pubblico commesso dal privato.

Per dire ancora delle dimensioni del processo e della sua accuratezza in termini procedurali: 11.350 le pagine di trascrizione delle udienze; 124.563 pagine cartacee e in dispositivi informatici e 2.479.062 file analizzati presentati dall'accusa; 20.150 pagine comprensive di allegati depositate dalle difese; 48.731 dalle parti civili.

CECILIA MAROGNA CONDANNATA A 3 ANNI E 9 MESI DI RECLUSIONE

(ANSA) - CITTÀ DEL VATICANO, 16 DIC - La ex manager sarda Cecilia Marogna è stata condannata alla pena di tre anni e nove mesi di reclusione, con interdizione temporanea dai pubblici uffici, nel processo terminato oggi in Vaticano sulla gestione dei fondi della Segreteria di Stato.

La donna, asserita esperta di intelligence, originariamente accusata di peculato per i 575 mila euro ottenuti dalla Segreteria di Stato tramite il cardinale Angelo Becciu per presunte finalità umanitarie, e finiti in buona parte attraverso la sua società slovena Logsic in spese personali e voluttuarie, è stata condannata in realtà per truffa aggravata, in concorso con lo stesso Becciu: la motivazione che il denaro doveva essere utilizzato per favorire la liberazione di una suora colombiana rapita in Mali, infatti, è stata ritenuta dal Tribunale "non corrispondente al vero".

LA SENTENZA DEL PROCESSO IN VATICANO. IL COMUNICATO UFFICIALE DEL TRIBUNALE

(ANSA) - ROMA, 16 DIC - Ecco il comunicato ufficiale del Tribunale vaticano sul processo per i fondi della Segreteria di Stato. "Con la sentenza emessa oggi, dopo 86 udienze, il Tribunale ha definito il giudizio di primo grado del processo a carico di dieci imputati e quattro società, che come è noto aveva ad oggetto plurime vicende (distinte, pur se con profili di connessione oggettiva e soggettiva), la principale delle quali è nota con riferimento al palazzo sito in Londra, 60 Sloane Avenue.

In ordine a questa, il Tribunale ha ritenuto sussistente il reato di peculato (art. 168 c.p.) in ordine all'uso illecito, perché in violazione delle disposizioni sull'amministrazione dei beni ecclesiastici (ed in particolare del canone 1284 C.I.C.), della somma di 200.500.000 dollari USA, pari a circa un terzo delle disponibilità all'epoca della Segreteria di Stato. Detta somma è stata versata tra il 2013 e il 2014, su disposizione dell'allora Sostituto mons. Giovanni Angelo Becciu, per la sottoscrizione di quote di Athena Capital Commodities, un hedge fund, riferibile al dr. Raffaele Mincione, con caratteristiche altamente speculative e che comportavano per l'investitore un forte rischio sul capitale senza possibilità alcuna di controllo della gestione.

Il Tribunale ha quindi ritenuto colpevoli del reato di peculato mons. Becciu e Raffaele Mincione, che era stato in relazione diretta con la Segreteria di Stato per ottenere il versamento del denaro anche senza che si fossero verificate le condizioni previs te, nonché, in concorso con loro, Fabrizio Tirabassi, dipendente dell'Ufficio Amministrazione, ed Enrico Crasso.

Quanto all'utilizzo successivo della detta somma, servita fra l'altro per l'acquisto della società proprietaria del palazzo di Sloane Avenue e per numerosi investimenti mobiliari, il Tribunale ha ritenuto Raffaele Mincione colpevole del reato di autori ciclaggio (articolo 421 bis c. p.). Ha invece escluso la responsabilità di mons. Becciu, Crasso Enrico e Tirabassi Fabrizio in ordine agli altri reati di peculato loro contestati perché il fatto non sussiste, non avendo più la Segreteria di Stato la disponibilità del denaro una volta che ess o era stato versato per sottoscrivere le quote del fondo.

È stata dichiarata poi la colpevolezza di Enrico Crasso per il reato di autoriciclaggio (art. 421 bis c.p.) in relazione all'utilizzo di una ingente somma di oltre 1 milione di euro, costituente il profitto del reato di corruzione tra privati commesso in c oncorso con Mincione. In relazione invece al riacquisto da parte della Segreteria di Stato, nel 2018 2019, attraverso una complessa operazione finanziaria, delle società cui faceva capo la proprietà del palazzo già citato, il Tribunale ha ritenuto la colpevolezza di Torzi Gianl uigi e Squillace Nicola per il reato di truffa aggravata (art. 413 c.p.) e del citato Torzi anche per il reato di estorsione in concorso con Tirabassi Fabrizio (art. 409 c.p.), nonché per il reato di autoriciclaggio di quanto illecitamente ottenuto.

Il Torzi, il Tirabassi, il Crasso e il Mincione sono stati invece assolti perché il fatto non sussiste dal reato di peculato loro ascritto in relazione all'ipotizzata sopravvalutazione del prezzo di vendita. Il Tirabassi è stato, inoltre, ritenuto colpevole del reato di autoriciclaggio (articolo 421 bis c.p.) in relazione alla detenzione della somma di oltre 1.500.000 USD a lui corrisposta fra il 2004 e il 2009 dall'UBS; il Tribunale ha infatti ritenuto ch e la ricezione di tale somma da parte dell'imputato integrasse il reato di corruzione in ordine al quale però, dato il tempo trascorso, l'azione penale è ormai prescritta.

Quanto a Tommaso Di Ruzza e Renè Brulhart, rispettivamente Direttore Generale e Presidente dell'A.I.F. (Autorità di Informazione Finanziaria), intervenuti nella fase finale del riacquisto del Palazzo di Sloane Avenue, essi sono stati assolti dei reati di a buso di ufficio loro contestati e ritenuti colpevoli solo dei delitti di cui agli articoli 178 e 180 c.p. per omessa denuncia e per la mancata segnalazione al Promotore di giustizia di un'operazione sospetta.

Infine, con riferimento ad altri due temi di indagine oggetto del giudizio, mons. Becciu e Marogna Cecilia sono stati ritenuti colpevoli, in concorso, del reato di cui all'art. 416 ter c.p. in relazione al versamento, da parte della Segreteria di Stato, di somme per un totale di oltre 570.000 euro a favore della Marogna, tramite una società a lei riferibile, con la motivazione, non corrispondente al vero, che il denaro doveva essere utilizzato per favorire la liberazione di una suora, vittima di un sequestro di persona in Africa.

Mons. Becciu è stato altresì ritenuto colpevole di peculato (art. 168 c.p.) per aver disposto, in due riprese, su un conto intestato alla Caritas Diocesi di Ozieri, il versamento della somma complessiva di Euro 125.000 destinata in realtà alla cooperativa SPES, di cui era presidente il fratello Becciu Antonino.

Pur essendo di per sé lecito lo scopo finale delle somme, il Collegio ha ritenuto che l'erogazione di fondi della Segreteria di Stato abbia costituito, nel caso di specie, un uso illecito degli stessi, integrante il delitto di peculato, in relazione alla violazione dell'art. 176 c.p., che sanziona l'interesse privato in atti di ufficio, anche tramite interposta persona, in coerenza del resto con quanto previsto dal canone 1298 C.I.C. che vieta l'alienazione di beni pubblici ecclesiastici ai parenti entro il quarto grado.

I sopranominati imputati Mincione Raffaele, Torzi Gianluigi, Tirabassi Fabrizio, Becciu Giovanni Angelo, Squillace Nicola, Crasso Enrico, Di Ruzza Tommaso e Brulhart Renè sono invece stati assolti, con le formule specificate nel dispositivo, da tutti gli a ltri reati loro ascritti. Parimenti, mons. Mauro Carlino è stato assolto da tutti i reati a lui contestati".
