My wife and I are in our 40's and 50's. We have created A/B trusts and transferred our assets to them, and expect to have estates that will benefit from the estate tax saving these trusts afford. We recently both purchased $1M 10-year renewable term life insurance policies that we expect to keep for 10 years. We chose not to use life insurance trusts because the purpose of the policies is to replace the lost income of the deceased spouse if one of us dies relatively soon, not to increase our final estate, and the trusts are somewhat costly. We each specified our own trusts as the beneficiaries, because we want the disposition of assets specified there to be used for this money. The trusts provide for the income, and principle if needed, to be paid to the spouse, and for the remainder to be paid to our child at the remaining spouses death. The question of ownership of the policies is less clear. My lawyer says that it doesn't make much difference who owns them, because the value (estate) taxed is only one year's premium, not the $1M. My accountant says that the $1M is taxed, and that each policy should be owned by the other spouse to avoid tax on that amount. A friend said that there's no way to avoid or significantly decrease the tax, so just leave the ownership as is (each spouse owns their own policy). A further fly in the ointment is that the insurance company (Massachusetts SBLI) makes some forms of trust ownership more difficult and costly. I'm confused. What ownership is the best? Some background first, i was hit from behind whilst stationary in traffic the other week by a works van. the damage was not too sever that i couldn't limp back home (sore and car bashed but still alive) got the other drivers details at the scene and reported the incident to my insurance company. As the accident was not my fault my insurer passed this to their dedicated Non-Fault (NF) accident claim company (i'll not name them at the moment) who in turn provided me with a hire car and collected my car to have it assessed for REPAIR. At no point was writing off the car mentioned. Then i got a call from the garage dealing with my car (NF appointed) a week later telling me of the damage and repair value and that the engineers working for the NF, different company again, were going to deem the car a write off, CAT D as i later found out. Now the fun part - the engineers have made an offer for settlement and to write off of my car, which is a good 500 below what is would cost to replace it with a like-for-like car in my local area (replace cost circa 2.8k-3k) they are adamant they will not repair my car even though the repairs would cost LESS than the write off - because the repair is too close to the market value and they can make a killing on salvage apparently. so fighting this out at the moment. NOW FOR THE QUESTION: They have advised me that should i wish to keep the car after they write it off (which i want to avoid if at all possible) i can accept the settlement and pay them a salvage fee to retain my car. This i understand as technically they buy my car when they write it off and then i have to buy it back. The problem is that they have a flat 30% !!! salvage fee which on their offer would almost negate me being able to get the repairs covered. What i really need to know is if anyone else has been in this position and if there is a maximum salvage fee they can charge - bearing in mind that this is my car to start with - and if there is any way i can make them drop this percentage. Forcing them to drop the percentage might not only let me repair the car after retaining but might also swing in favour of repair instead of write off if they cannot justify such a big payout for themselves. Any help here would be appreciated fast as i'm still bouncing between the parties here to get this resolved. In case your wondering the damage constitutes a bumper rear panel and a kink in the boot floor - VERY repairable.""

Question about different garaging address on insurance policy?

I had had my license for 6 years in October, and called my insurance company to make sure my rate would go down. While on the phone, the rep and I got to chatting and I mentioned to her that I have been staying most nights (6-7 nights per week) at a different address for over a year now, but my license and policy are still listed at my mother's address. The rep explained the garaging address can be changed without changing the billing address if the two are different. Today I received an email about being refunded the difference at the end of my policy term. I didn't realize the changes would generate such a huge difference in price (The zip code of the town I have been staying in has a low crime rate and my mother's address is in a city). I realize people change their address to commit fraud, and now seeing such a difference in rate, I want to sure there is no legal ambiguity- I want to be crystal clear on what garaging implies and what I need to be aware of. 1) Am I in a gray area...If I go home for a weekend? If I lend the car to my brother for a few days? Do I need to be at the garaged address 80% of the time? 100%? I almost want to call them and ask to change it back just so as not have to worry. 2) Also, what would generate the bigger rate difference- the garaging change or the fact that I have had my license for 6 years? (is there a way to tell? Can I request a revised policy? 3) I am planning to replace my car soon, possibly donating it by the end of the year (very old car with continuous engine problems), so I will need to cancel my policy before it is up in April. My boyfriend just gave me his old car as a gift, I planned on getting insurance to it the moment I put it under my name, but I was driving today and I rear ended another car. I was placed in police car as they did some investigation. The other police officer found out that the other car was a rental and that they had Avis insurance. I kept asking the police officer when do I find out about making payments to the other car. He gave me a ticket and said there will be no payments for the other car. Me and and the other car never exchanged any information. This is my first accident, I am a little confused. Am I suppose to get sued. And what is the likelihood that that the other car's insurance would charge me 10k or more for the accident? I want an idea so I can start saving money and trying to make payments now. Can an 18 year old/college student stay on parents auto insurance?

I'm 17 (turning 18 in 8 months) and my parents are extremely hesitant about letting me get a car because of the insurance going up. I'm testing for my license in a few weeks (After almost two years of them putting it off...) I'll be getting a safe, four door car, probably a 2001 Chevy Malibu. I'll get the good grades discount, and i already took a defensive driving course online which will get me another 10% off, and I have a steady job and decent savings account and would be able to pay them the difference in insurance every month. They still aren't going for it. So first question, anyone have some tips for me to get them to cool down about this? I'll be taking college classes at our local tech while I'm still in high school, and then I'll be going to that school full time after graduation. My parents work opposite shifts and can't take me to all my classes constantly. I need a car, not just for independence, but for practicality.
