Tier 1 Entrepreneur
The Tier 1 Entrepreneur route is for you if you intend to set up or invest in business in the UK and have between £50,000 and £200,000 to invest. The following business mediums are acceptable;
-          registered companies such as limited companies and Limited Liability Partnerships;
-          Sole traders; and
-          partnerships
The amount required to invest depends on how you have acquired the funds and what visa you hold, not all applicants will be eligible to invest the lessor £50,000. We have provided a helpful commentary on who qualifies to apply under the £50,000 route below.
The Requirements
In order to make an application for Entry Clearance or Leave to Remain you will need to score 95 points. The points will be awarded for the following;
-          75 points for showing that you have the money of £50,000 or £200,000 available (not all applicants qualify for £50,000 – contact us for more details);and
-          The money is held by a regulated financial institution; and
-          The money is disposable in the UK;
-          10 points if you have the required level of English language;
-          10 points for sufficient money to maintain yourself in addition to the money you will invest into the business.  
 The £50,000 route applies to you if the money has come from
-          registered venture capital firms;
-          UK Entrepreneurial seed funding competitions;
-          UK government departments
-          Hold a PSW and engaged in business activity
-          Nominated by your educational institution for a graduate Entrepreneur visa.
 Switching to into Tier 1 (Entrepreneur)
·         Highly skilled migrant;
·         Tier 1 (General) migrant;
·         Tier 1 (Investor) migrant;
·         Tier 1 (Post-Study Work) migrant;
·         Business person;
·         An innovator;
·         Student;
·         Student nurse;
·         Student re-sitting an examination;
·         Student writing up a thesis;
·         Work permit holder;
·         Postgraduate doctor or dentist;
·         Self-employed lawyer;
·         Writer, composer or artist;
·         An investor;
·         Participant in the International Graduates Scheme (or its predecessor, the Science & Engineering
·         Graduate Scheme);
·         Participant in the Fresh Talent: Working in Scotland Scheme;
·         Tier 2 migrant;
·         Tier 4 migrant; or
·         Prospective Entrepreneur.
 What you will get
 If your Tier 1 Entrepreneur visa is approved, you will be issued with a visa for 3 years and 4 months. An application for extension of an Entrepreneur visa can be submitted before the expiry of the visa as long as you can show that you meet the requirements for an extension as explained here.
Tier 1 Entrepreneur extension
Tier 1 Entrepreneur extensions[FO1]  must show that you have been active in the business, have invested the money within the relevant time frame and have created two UK jobs paying at least minimum wage.  Additionally you cannot have had any recourse to public funds, must have registration with the police (if required), not have been employment other than working for the business(es) you have established, joined or taken over.
Tier 1 Entrepreneur and Indefinite Leave to Remain
The requirements for Indefinite Leave to Remain in this Tier 1 (Entrepreneur) category are the same as when making your initial application and extension. You must have invested the required level of funds into your business, created the jobs as required by your extension and remained in the UK for the required period not exceed absences of more than 180 days each calendar year.
You may only apply once you have been in continuous residence of 5 years in the UK as an Entrepreneur and other qualifying categories. You may qualify to apply after 3 years if your turnover exceeds £5 million. Contact Immigration Advisory Services UK for more details on this concession.
