نسلہ ٹاور : چند سوالات

سپریم کورٹ نے حکم دیا ہے کہ کراچی میں واقع نسلہ ٹاور کو ایک ہفتے کے اندر اندر گرا دیا جائے۔ اس معاملے کی قانونی نوعیت تو یقیناً وہی ہو گی جو معزز عدالت نے طے کر دی۔ البتہ کچھ سوالات قانون سے ہٹ کر بھی ہیں۔ یہ سوال سماجیات اور عمرانیات سے متعلق ہیں جو معاشرے اور پارلیمان کی توجہ چاہتے ہیں۔ نسلہ ٹاور ناجائز تھا، گرا دیا جائے گا۔ یہ قانونی پہلو ہے۔ سماجی اور عمرانی پہلو یہ ہے کہ اس ٹاور میں کچھ ہنستے بستے خاندان بھی رہ رہے ہیں جنہوں نے اپنی جائز کمائی سے جائز طریقے سے ادائیگی کر کے یہاں اپنے لیے رہائش خریدی۔ دو دن بعد ان کے گھروں کی بجلی اور گیس کاٹ دی جائے گی اور سات دن کے بعد ان کے گھر زمین بوس ہو جائیں گے۔ سوال یہ ہے کہ ان خاندانوں پر کیا بیتے گی اور انہیں یہ سزا کس جرم میں ملے گی؟ اسی سوال سے پھر یہ بحث جنم لیتی ہے کہ شہریوں اور ریاست کے درمیان تعلق کی نوعیت کیا ہوتی ہے؟ 

ریاست اپنے شہریوں پر محض قانون کا اطلاق کرتی ہے یا ریاست ایک ماں کی طرح اپنے شہریوں کے جائز مفادات کا تحفظ بھی کرتی ہے؟ نیز یہ کہ قانون سماج کے لیے ہوتا ہے یا معاشرہ قانون کے لیے؟ نسلہ ٹاور ایک دن میں نہیں بن گیا۔ ملک کے سب سے بڑے شہر میں مرکزی اور نمایاں جگہ پر ایک کثیر المنزلہ عمارت بنتی ہے۔ سب کے سامنے بنتی ہے۔ جب یہ عمارت بن رہی ہوتی ہے اس وقت ریاست کے تمام متعلقہ ادارے موجود ہوتے ہیں اور کام کر رہے ہوتے ہیں۔ عدالتیں بھی موجود ہوتی ہیں۔ پولیس بھی موجود ہوتی ہے۔ نقشے بھی منظور کیے جاتے ہیں۔ واپڈا والے بجلی کا کنکشن بھی دے دیتے ہیں اور سوئی گیس کا محکمہ گیس بھی پہنچا دیتا ہے۔ علی الاعلان سب کے سامنے ان فلیٹس کو فروخت کے لیے پیش کیا جاتا ہے۔ لوگوں نے جمع پونجی اور گھر کا سونا بیچ کر یہاں فلیٹس لیے ہوں گے۔ سوال یہ ہے کہ اگر یہ ٹاور ناجائز تھا تو یہ بن کیسے گیا؟ بن گیا تو یہاں فلیٹس کیسے فروخت ہو گئے۔ فلیٹس فروخت ہو گئے تو وہاں بجلی اور گیس کیسے آگئے؟

چائنا کٹنگ کراچی کا بلاشبہ سنگین مسئلہ ہے لیکن کیا کوئی اس حقیقت سے انکار کر سکتا ہے کہ جب کئی عشروں یہ چائنا کٹنگ ہو رہی تھی تو اس وقت ملک کے نظام تعزیر و قانون کی بھی چائنا کٹنگ ہو چکی تھی اور کسی میں یہ ہمت نہیں تھی کہ اس سلسلے کو روک سکے۔ ریاستی اداروں نے تو گویا یہاں ایک سہولت کار کا کردار ادا کیا۔ قبضے ہوتے رہے اور متعلقہ ادارے خاموش رہے۔ ایسے میں تعزیر کا کوڑا صرف ان بے گناہ خریداروں کی کمر پر کیوں برسایا جائے جنہوں نے سارے قانونی تقاضے پورے کر کے شہر کے بیچ رہنے کو گھر خریدے؟  اس سارے دورانیے میں جن اداروں نے اپنی اپنی ذمہ داریوں سے غفلت برتی، کیا قانون ان کی دہلیز پر بھی دستک دے گا؟ کیا ان کی تنخواہیں اور پینشن بھی ضبط نہیں ہونی چاہیے جو اس ساری واردات کے سہولت کار تھے اور جن کی غفلت کی وجہ سے آج مائیں بہنیں اوربیٹیاں اپنے گھروں کو مسمار ہوتے دیکھ رہی ہیں اور انہیں ہارٹ اٹیک ہو رہے ہیں؟

یہ قبضے کچے کے علاقے میں نہیں ہو رہے تھے کہ کسی کو اس واردات کی خبر نہ ہو سکی، نہ ہی نسلہ ٹاور علاقہ غیر میں تعمیر ہو رہا تھا کہ کراچی میٹروپولیٹن سمیت کسی ادارے کے علم میں نہ آسکا۔ یہ کیسے ممکن ہے کہ شہر کے وسط میں قبضہ کر کے عمارات تعمیر کر کے انہیں فروخت کیا جاتا رہا اور کسی ادارے کو خبر نہیں ہو سکی؟ اس سوال پر بھی غور کرنا چاہیے کہ نظام قانون و تعزیر کا مقصد کیا ہے؟ کیا قانون کا نفاذ مقصود بالذات ہے یا قانون کے نفاذ کا مقصد انصاف کی فراہمی ہے؟ نسلہ ٹاور ایک وارداتِ مسلسل کا نام ہے۔ کسی نے ناجائز عمارت تعمیر کی، کوئی اس کا سہولت کار بنا، کسی نے یہاں فلیٹس خریدے۔ اب اس پوری واردات کو مخاطب کیے بغیر صرف معصوم اور بے گناہ خریداروں پر قانون کا نفاذ پوری پارلیمان کی قانونی بصیرت پر سوال اٹھا رہا ہے۔ پارلیمان بدلتے حالات کے مطابق قانون سازی نہ کر سکے تو اس کی افادیت کیا رہ جاتی ہے؟

نسلہ ٹاور کو گرانے کے لیے جدید مشینری کے حصول کے حکم کے ساتھ یہ حکم بھی معزز عدالت نے دیا ہے کہ اس مشینری کا کرایہ سوسائٹی کے مالک سے وصول کیا جائے اور اگر وہ نہ دے تو اس کی جائیداد ضبط کر کے وصول کیا جائے۔ کیا ایسا ہی کوئی اہتمام ان خاندانوں کے لیے نہیں ہو سکتا تھا جن کے فلیٹس مسمار ہونے جا رہے ہیں؟ ان خاندانوں کے بارے میں عدالت نے کہا ہے کہ ان کو ان کی رقم دی جائے اور اگر رقم نہ دی جائے تو وہ متعلقہ عدالت سے رجوع کر سکتے ہیں۔ ہم سب جانتے ہیں کہ ’ریکوری سوٹ‘ کرنا، ایک طاقتور کے خلاف کرنا، پھر اس میں کامیاب ہو کر رقم لے لینا کوئی معمولی بات نہیں۔ روایت یہ ہے کہ اس معاملے میں کامیابی کے لیے صبر ایوب درکار ہے۔ کیا معلوم یہ رقم ان لوگوں کو کب ملے اور ملے بھی کہ نہیں؟ کیا یہ نہیں ہو سکتا تھا کہ یہاں بھی ویسا ہی حکم آ جاتا کہ مالک کی جائیداد ضبط کر کے ایک ہفتے میں متاثرین کو رقم ادا کی جائے اور رقم ادا کرتے ہی ٹاور گرا دیا جائے؟ قانون میں ایسی گنجائش موجود نہیں تو پارلیمان کو ان خطوط پر سوچنا نہیں چاہیے؟

لوگ سب کچھ بیچ کر اور ساری پینشن لگا کر گھر بناتے ہیں اور پھر جا کر معلوم ہوتا ہے کہ یہ تو فراڈ تھا، ایسے میں کیا ان کے لیے حصول انصاف کا کوئی سپیڈی میکنزم نہیں ہونا چاہیے؟ یہ کیسا انصاف ہے کہ غریب پہلے جمع پونجی سے محروم ہو جائے، پھر گھر بھی گرا دیا جائے اور پیسوں کی ریکوری کے لیے اسے ایک طویل اور تکلیف دہ پروسیجر کے حوالے کر دیا جائے؟ لوگوں کے گھر اگر ایک ہفتے میں گرائے جا سکتے ہیں تو قانون ایسے لوگوں کو دو ہفتوں میں ان کی رقم واپس کیوں نہیں دلوا سکتا؟ کچھ ناجائزسوسائٹیوں کو محض جرمانے کر کے معاملہ حل کر لیا جاتا ہے۔ حتیٰ کہ ان کی بیرون ملک سے ضبط ہو کر واپس آنے والی رقم بھی مبینہ طور پر انہی جرمانوں میں ایڈجسٹ کر لی جاتی ہے۔ کیا یہی اصول ہر ’بے گناہ خریدار‘ کے معاملے میں بطور قانون لاگو نہیں ہو سکتا یا کم از کم کیا اتنی قانون سازی نہیں ہو سکتی کہ ایسے معاملات میں جب تک بے گناہ خریدار کو ساری رقم واپس نہ دلائی جائے تب تک اس سے چھت نہ چھینی جائے؟

SC Directs to immediately demolish Nasla Tower

Supreme Court (SC) on Wednesday has conducted hearing on a case pertaining to demolish Nasla Tower in Karachi.

During the proceedings, the court expressed resentment over the report submitted by the Karachi commissioner and directed to immediately raze the tower and present report till afternoon.

Chief Justice of Pakistan (CJP) Gulzar Ahmed further ordered to also submit report on Tejori Heights.

On October 25, 2021, SC had ordered to demolish Nasla Tower in Karachi within a week.

During the hearing at Karachi registry, the apex court directed to use latest technology in the process and take all the expenses from the owner of Nasla Tower. Seize the properties of the owner if he refuses to pay the expenses, the court remarked.

The apex court had also turned down the review petitions filed by owners and allottees in Nasla Tower case and directed the commissioner to act on the June 16 order and told that written decision in this regard will soon be issued.

SC had remarked that the building should be demolished, as proved by the record that Nasla Tower was built on the occupied land.

The top court remarked that it had reviewed the documents of all the concerned institutions and directed the commissioner to take immediate custody of Nasla Tower building, no concession can be given on illegal constructions.

KARACHI: The Supreme Court of West Pakistan on Wednesday detected a case associated with the development of Nasla Tower settled on Karachi’s Sharah-e- Quaideen and ordered its demolition.

During the proceedings, a senior member of the Board of Revenue told the court that a survey of government-owned land is afoot, which can be completed at intervals of six months.

Nasla Tower’s pre-demolition work stopped

The Sindh Building Control Authority (SBCA) was stopped from carrying out the pre-demolition work of Nasla Tower over safety concerns.

The SBCA had initiated the work on the directives of Karachi Commissioner Muhammad Iqbal Memon, however, Ferozabad Assistant Commissioner Asma Batool stopped it on the grounds of safety concerns.

“The demolition process has been stopped for a while because of the safety concerns of the passers-by,” she said, adding that huge blocks fell on the road during the demolition of the building.

She said that without proper safety measures, no demolition could take place because it could cause damage to human lives. After consulting with the high-ups, the demolition work would resume, she added. Earlier, the anti-encroachment police of the Sindh Board of Revenue cordoned off the building, following which the SBCA’s demolition squad kicked off the pre-demolition work.

District East Deputy Commissioner Asif Jan Siddiqui told the media that the tower’s doors and windows were being removed. He said the anti-encroachment police had been summoned to maintain law and order in the area.

“Initially, removal of windows and doors of the building will take place,” said Siddiqui, adding that there had not been any decision regarding the issuance of a tender for the proper demolition of the building.

He said that until a decision was made regarding controlled blast or manual demolition of the residential-cum- commercial tower, it would be destroyed according to the normal procedure.

A foreign company expresses interest in a controlled explosion at Karachi’s Nasla Tower. According to sources, an eight-member committee for the demolition of Nasla Tower met at the deputy commissioner (DC) office for district East. It deliberated extensively on the bids and proposals submitted by four local and one foreign firms and the method and date of the tower’s demolition.

DC Asif Jan Siddiqui told Dawn that the committee deliberated on the bids and decided to convene the bidding businesses on Wednesday (tomorrow) to present their respective proposals for the demolition method and time required. “We will unquestionably use the safest technique possible to demolish the building,” he stressed.

Commissioner Iqbal Memon established the committee to award the contract, with the DC-East serving as its chairman.

Additionally, four local firms have requested for manual demolition of the 15-story structure.
