However ruined this world has become, however mired in torment and despair, life endures. Births continue. There is beauty in that, is there not?
I'd give her such a big hug if I could. The biggest and squishiest.
I love Melina so much.

Matian Firm | La Liga Defensora Managing Immigration Attorney Nancy Reyes Guarderas Discusses Ways Immigrants Can Prevent a Criminal Past from Affecting their Immigration Status
Guarderas urges the importance of immigrants not “self-disqualifying” themselves simply because they have a criminal record.
Abogada Nancy Reyes Guarderas of the Matian Firm | La Liga Defensora is scheduled to appear on California radio and TV stations to discuss what people do if they have criminal convictions, but want to fix their status, and how La Liga Defensora can help.
Guarderas said, “We offer a very special service because we have lawyers who are experts in Criminal and Immigration Law. It is important not to have a criminal record, so that it does not affect you with immigration. But, if you already have the record, we can review if there are ways to eliminate the conviction or request that your record be expunged. Bottomline, if there is a way to eliminate the immigration consequences, we have a great team that can help”
Guarderas says it’s important that immigrants don’t disqualify themselves from filing for immigration relief just because they have a criminal record. With the help of an experienced attorney from a law firm, like La Liga Defensora, that has experience on both sides, it will be a lot easier to build a strong case, no matter what side you’re fighting. Anybody seeking changes in their status should always speak with a licensed attorney before self-disqualifying themselves because there are different ways to reduce or even erase your sentence.
An attorney with experience in both immigration and criminal law can help with the immigration process by:
  Making a request for the classification of their client’s conviction to be lowered, or removed from the record altogether;
Reducing the sentence; thereby eliminating the negative impact on immigration;
Erasing the conviction completely and allowing the client to submit or continue their immigation application; and/or
Filing a motion to reopen a deportation order after eliminating the criminal basis for the deportation order.
Nancy Reyes Guarderas is an expert on immigration rights and visas, as she has been advocating and guiding her clients through the immigration process since 1998.
Guarderas has extensive experience filing affirmative and defensive applications for her clients before the United States Citizenship and Immigration Service. She has also conducted hearings before the United States Immigration Court, briefing and appealing before the Administrative Appeals Office, Board of Immigration Appeals, and the United States 9th Circuit Court of Appeals.
Guarderas has helped thousands of clients with direct services, conducted community outreach for thousands of people, and trained hundreds of private and non-profit attorneys, social workers, and law students through panels, training, and guest lecturer opportunities at USC’s School of Social Work and Loyola Law School.

Matian Firm | La Liga Defensora Managing Immigration Attorney Nancy Reyes Guarderas Discusses What to Expect at First Meeting with Immigration Attorney
Guarderas offers tips for immigrants to prepare for a successful first meeting to discuss their case and options.
Abogada Nancy Reyes Guarderas of the Matian Firm | La Liga Defensora is scheduled to appear on California radio and TV stations to discuss what people can expect at their first appointment with an immigration attorney.
First and foremost, Guarderas urges people to come to their first meeting prepared to be completely honest and transparent with their immigration attorney. Immigration is complicated. If you’re not 100% honest with your attorney, you may miss out on opportunities or find yourself in a situation you did not intend. Remember, all information you share with your attorney is confidential.
“There’s nothing like getting the most of your free consultation,” she said. “The best way to do so is to have as much of your information and documents ready to be reviewed and discussed at the consultation.  We will make the best of that consultation by providing a specific strategy for your family”
Guarderas advises you to bring the following documents with you to your consult:
Birth Certificate for you and your children
Marriage certificate or divorce records, if applicable
Death certificates of immediate relatives, if applicable
Identifications (ie. driver’s license, consular ID or passport)
Past criminal history dates/locations of arrest
Information about your entries and exits to/from the United States
I-94, arrival – departure record
Past work permits or green card, if applicable
Any letters or copies of documents to/from Immigration
If you don’t have the above, the attorneys at La Liga Defensora will help you find it!
And, come prepared with the following questions:
Do you specialize in immigration law? If immigration is not the attorney’s primary focus, you risk them being caught off guard by changing laws and accelerated enforcement. An experienced immigration attorney knows how to manage unique immigration situations.
Do you have experience with situations like mine? What have the outcomes of those cases been? Immigration is a very unique aspect of the law and comes with its own distinctive challenges. It’s important the attorney you choose knows the ins and outs of immigration law, and has experience achieving favorable outcomes for their clients.
How long have you practiced immigration law?
At La Liga Defensora, your first consultation with our legal team is free. During this consultation, you will fill out a questionnaire that will be vetted by an attorney to determine whether your case is actionable, and if you’re likely to succeed. We will then thoroughly explain the information to you so that you can completely understand your options. If you decide to proceed, La Liga Defensora is so well-equipped that they can start working on your case that very same day.
Nancy Reyes Guarderas is an expert on immigration rights and visas, as she has been advocating and guiding her clients through the immigration process since 1998.

Matian Firm | La Liga Defensora Managing Immigration Attorney Nancy Reyes Guarderas Discusses What Steps to Take Now in Anticipation of Immigration Policy Overhauls
The U.S. Citizenship Act of 2021 aims to reverse the former administration’s tight immigration policies and overhaul immigration laws
Abogada Nancy Reyes Guarderas of the Matian Firm | La Liga Defensora is scheduled to appear on California radio and TV stations to discuss the backlog of immigration cases, when things may start moving again, forthcoming changes to immigration laws, and what immigrants should be doing right now as they wait for new immigration policies to go into effect.
As the immigrant community waits to see how the new administration will change immigration policy and laws, Guarderas wants to remind immigrants to start taking action now because preparation will take time and everyone will want to take advantage of any new opportunities as soon as they become available.
Immigrants that have previously been detained at the border; filed an immigration application in the past; been in removal (deportation) proceedings or have a criminal history– now is the time to speak with an attorney to seek all of your records and have them analyzed by an attorney. These records will be imperative in order to take advantage of the positive changes coming in the near future.
Guarderas also reminds immigrants that laws don’t have to change for new policies to go into effect.
“I know that for our immigrant community, change cannot come quick enough, but we need to be patient as the new administration starts to put all the players in place and begins laying a solid foundation to start building our new immigration laws and unraveling the past administration’s policies. Take advantage of this time to get all your records and investigations ready,” said Guarderas.
As the new administration and key government directors start implementing actions authorized by the new Commander in Chief’s executive orders over the next three months, we expect to see barriers begin to crumble that will allow immigrants to pursue benefits they were too afraid to pursue or ineligible for in the past.
The new administration has already made several immigration policy changes, including reversing the ban on travel, stopping construction of the southern border wall, and creating a plan to preserve and fortify the Deferred Action for Childhood Arrivals (DACA) program.
The new administration has many more plans for immigration with reform that could put as many as 11 million people on the path to U.S. citizenship. Some of the other expected changes include:
An increase in the number of employment-based green cards issued each year– the current cap is 140,000.
Increase the amount of U-Visas from 10,000 to 30,000 per year.
An increase in the number of high-skilled visas, including the H-1B, as well as eliminating the limit on employment-based visas by country.
Support for family-based immigration by allowing any approved applicant to receive a temporary non-immigrant visa to enter the US until the permanent visa is processed. Also, supporting legislation that treats the spouse and children of green card holders as the immediate relatives they are, exempting them from caps, and allowing parents to bring their minor children with them when they immigrate.
Immigrants must act now in order to take advantage of the new policies as they become available.

Matian Firm | La Liga Defensora Managing Immigration Attorney Nancy Reyes Guarderas Discusses DHS Eliminating Public Charge Immigration Rule
Officials will now have less discretion based on socioeconomic status when approving green cards
Abogada Nancy Reyes Guarderas of the Matian Firm | La Liga Defensora is scheduled to appear on California radio and TV stations to discuss the Biden’s Administration’s recent decision to stop enforcing the 2019 “public charge” restrictions on green cards.
The 2019 public charge policy granted U.S. officials more discretion to reject green card applications from immigrants whom they believed were depending on or were at risk of depending on public benefits in the future, like food stamps, housing assistance and Medicaid.
In addition, the new rule created a very complicated and long form I-944 where it asked about a host of personal information never before requested such as credit report, credit score, age, education, health, education, skills, family status, and many more factors.  The 2019 policy placed heavy weight on many of those factors mentioned above.
Now, the Department of Homeland Security will revert to rules that had been in effect since 1999, before the previous administration changed them. These rules instruct officials to only deem immigrants as a public charge if they receive government cash benefits or long-term institutionalized care. It will also rely heavily on the sponsor’s Affidavit of Support.  This means that receiving the following assistance will no longer cause immigrants to be deemed public charges and have their green cards rejected:
Receiving Medicaid benefits (except for Medicaid for long-term institutionalization)
Living in public housing
Receiving Supplemental Nutrition Assistance Program (SNAP) benefits, or “food stamps”
Guarderas welcomes the change. She said, “The prior administration’s creation of new regulations interpreting the public charge law we have had since 1999 was simply a tool to create barriers to lawful immigration. It created unnecessary fear for many families who during a pandemic were in need of many services; but failed to access. These services included things such as COVID testing; vaccinations; and healthcare.  The doors are now open for immigrant families to access these much needed benefits without fear of closing the door on their future immigration status.”
Nancy Reyes Guarderas’ expertise is on immigration rights and visas, as she has been advocating and guiding her clients through the immigration process since 1998.

Matian Firm | La Liga Defensora Managing Immigration Attorney Nancy Reyes Guarderas Discusses Pathways to Permanent Residence for Dreamers Should Immigration Reform Bill Pass
The new administration’s immigration reform plan puts a focus on keeping families together.
Abogada Nancy Reyes Guarderas of the Matian Firm | La Liga Defensora is scheduled to appear on California radio and TV stations to discuss how the new administration’s immigration reform will affect DREAMERS.
Deferred Action for Childhood Arrivals (DACA) plays a large role in President Joe Biden’s comprehensive immigration reform bill, known as the U.S. Citizenship Act.  DACA protects young undocumented immigrants from deportation, but it does not provide a path to citizenship. Biden’s reform aims to change that and allow Dreamers to be eligible for a more streamlined avenue to permanent residence.
The reform would give Dreamers a direct route to permanent residence instead of first needing to obtain five to six years of temporary status as the rest of the 11 million immigrants will have to obtain. However, there are two possible pathways.
Guarderas stresses that in order for Dreamers to take advantage of this policy reform ASAP, they must start preparing and filing their documents right now.
Guarderas said, “The fastest way is to already have DACA. That is why it is best to file for DACA now so that you are eligible for permanent residence immediately if the reform passes.”
Otherwise, additional requirements would be required prior to becoming eligible for permanent residence. Dreamers would not only need to finish high school or equivalent, but also one of the following:
   At least two years of higher education at a university, community college or trade school;
 Prove a minimum of three years earned income;
Or two years military service.
The reform will also give Dreamers the chance to apply for citizenship after three years.
If someone does not qualify under either of the above-mentioned groups, they will fall under the rest of the 11 million immigrants and will need to apply for temporary status for five to six years before they can become eligible for permanent residence.
Guarderas said, “Keeping our Dreamers informed is important in making an informed decision. Acting now by filing DACA immediately will open up the easiest pathway to permanent residence. Not only will Dreamers get lawful status now; but will also open the door to the fastest route to permanent residence under the new administration’s reform plan.”
Nancy Reyes Guarderas’ expertise is on immigration rights and visas, as she has been advocating and guiding her clients through the immigration process since 1998.
