Alcaldía capitalina dirigida por Muyshondt pagó $120,000 en 25 plazas fantasmas

Solo hay registro de las erogaciones para el pago salarial de las 25 personas, no así los contratos suscritos, mientras que las bitácoras de asistencia laboral fueron falsificadas por orden expresa del jefe municipal. La auditoría de la CCR confirmó también el no pago de cotizaciones de AFP e ISSS de los empleados.

Cuando estuvo en manos de Ernesto Muyshondt, exalcalde de ARENA y ahora preso por negociar con las pandillas, la alcaldía de San Salvador tuvo 25 plazas fantasmas en la Dirección Municipal para la Gestión Sustentable de Desechos Sólidos, según revela el examen especial que fue practicado por la Corte de Cuentas de la República (CCR) a la comuna.

El informe está publicado en el Portal de Transparencia del ente contralor y el período auditado abarca del 1.º de junio de 2019 al 31 de diciembre de 2020. La gestión de Muyshondt como alcalde concluyó el 30 de abril de 2021, ya que perdió la reelección en las urnas contra Mario Durán, actual jefe municipal capitalino con la bandera de Nuevas Ideas.

El documento consigna que los auditores de la CCR revisaron el acta 42/2019 de la reunión que la Dirección de Desechos Sólidos sostuvo el 3 de septiembre de 2019, y encontró que hubo acuerdo para la contratación de 25 personas en la modalidad de eventuales, que se encargarían del barrido y la limpieza de las calles de septiembre a diciembre de 2019.

Asimismo, la Dirección emitió acuerdo —según el acta 52/2019— para recontratarlos de enero a mayo de 2020.

En ambos períodos, la municipalidad desembolsó $120,456.29 para pagarles los salarios y las prestaciones institucionales a los 25 empleados.

Luego de revisar las actas e iniciar las diligencias, los auditores detectaron que «no se elaboraron los contratos» de las 25 personas, y en la escaza documentación que se encontró en la Dirección de Desechos Sólidos ni siquiera se reflejaba «el nombre de la persona a contratarse».

Es decir, solo hay un registro de los pagos por $120,456.29, pero se desconoce quiénes son las 25 personas contratadas, ya que la alcaldía solo asignó un código a cada empleado. La lista de dichos códigos está plasmada en la página 166 y en el Anexo 2 del documento de la auditoría.

La CCR determinó que, con esta acción, la alcaldía capitalina violó el artículo 18 del Código de Trabajo, que establece que «el contrato individual de trabajo, así como su modificación o prórroga, deberá constar por escrito», porque «el contrato escrito es una garantía en favor del trabajador, y su falta será imputable al patrono».

Es más, según la auditoría, los 25 empleados —de los cuales se desconoce el nombre— nunca llegaron a trabajar a la Dirección de Desechos Sólidos y sus controles de asistencia fueron falsificados por órdenes de las «jefaturas superiores» de la Alcaldía Municipal de San Salvador.

«Los encargados de llevar dichos controles [de asistencia laboral], como despachadores, inspectores, coordinadores de limpieza y supervisores de las áreas, manifestaron que fueron obligados por jefaturas superiores a llenar los controles, detallando actividades que nunca realizaron, ya que no se presentaron a trabajar», se lee en la página 68 del examen especial de la Dirección de Auditoría Siete de la CCR.

En la página 118, la CCR precisó que fue por «orden del alcalde» que los controles de asistencia fueron llenados con información falsa a favor del grupo de trabajadores.

De los 25 empleados, 23 renunciaron colectivamente en octubre de 2020; sin embargo, la alcaldía les dio beneficios adicionales como el pago del bono navideño de ese año por $60 a cada uno y un bono por motivo de la pandemia de la COVID-19, que fue entregado en noviembre de 2020, por $125 a cada uno.

La CCR explicó que, cuando hizo la auditoría, los dos empleados restantes todavía aparecían como trabajadores de la alcaldía.

Aparte de las irregularidades por falta de contrato, falsificación de controles de asistencia y el pago de los bonos, la auditoría detectó que en la alcaldía «se pagaron $2,964.13 en concepto de horas extras a algunos empleados, sin que exista un resumen o documento que justifique el trabajo efectuado».

CUOTAS RETENIDAS QUE NO FUERON PAGADAS

Durante la campaña y precampaña electoral de 2021, los sindicalistas de la alcaldía de San Salvador denunciaron públicamente que la comuna liderada por Muyshondt aplicó descuentos de AFP, ISSS, impuesto sobre la renta, de bancos y cooperativas; sin embargo, nunca trasladó el dinero a esas instituciones y empresas.

La auditoría de la CCR confirmó esos señalamientos de los sindicalistas e identificó que la alcaldía adeudó hasta el 31 de diciembre de 2020 casi $12 millones ($11,915,704.80) por descuentos realizados pero no trasladados a las instituciones. Los trabajadores afectados pertenecían a la Oficina Central, Dirección de Desechos Sólidos y varias instituciones descentralizadas de la alcaldía capitalina.

En junio del año pasado, la Fiscalía General de la República (FGR) acumuló a Muyshondt el delito de apropiación indebida de retenciones en perjuicio de los empleados municipales.
