Brittany Dawn, Civil Cases, and the Role of the Attorney General

Brittany Dawn Davis, known online simply as Brittany Dawn, is a large-scale social media influencer who arose in popularity for posting lifestyle and fitness content [2]. She was praised by fans for championing body positivity and for using nutrition and exercise to heal from an eating disorder. However, in recent years she has garnered intense negative press after she was sued by the state of Texas for deceptive business practices regarding her fitness empire. When Davis launched her fitness business in 2014, bdawnfit.com, she claimed it was a holistic approach to health that included “flexible dieting, effective training, balanced living, and community support.” [4]. Davis would charge customers between $100 and $300 for “personalized fitness plans and coaching sessions” [2]. In her fitness plans, Davis promised her clients that she would be with them “every step of the way”, but instead the clients received a generic diet and workout plan that was not unique to their needs [4].

Customers began noticing the generic fitness and meal plans and began reaching out to each other to discuss the issue. Once they realized that all their plans were nearly identical and not personalized, they started to leave comments on social media calling Davis out for this behavior [2]. However, Davis would delete these comments and continue bragging to her audience that she had thousands of clients that used her fitness website. One client, Cori Reali spoke out and stated that she had paid $115 for a fitness plan but had never received personalized feedback. Reali said, “The red flags started to go up. I was not individualized. It set me back. It actually pushed me back into my eating disorder.” The lawsuit that was eventually filed by the Texas Attorney General said that Davis claimed to be an “eating disorder soldier” who suggested that she was an expert with “special training”. In reality, Davis had no professional fitness or nutrition training [1], and court documents stated that at least 14 of her customers suffered from an eating disorder that Davis failed to properly address in the coaching plans she sold to them [2].

In 2018, Davis’s clients created a petition called “Stop Brittany Dawn Fitness Scams” which collected over 15,000 signatures [2]. The petition claimed that Davis “falsely promoted women empowerment on her social media platforms, while continually scamming and lying to her followers, clients, and fans” [4]. In response to the negative publicity, Davis posted an apology on YouTube that would later be deleted, and even appeared on Good Morning America to issue another apology. In this, Davis admitted to asking clients who received a refund to sign a non-disclosure agreement, or an NDA [2].

The apologies were not enough for the Texas Attorney General’s office. The state believed that Davis’s “scams” amounted to deceptive trade practices and sought damages between $250,000 and $1 million [4]. The complaint filed against Davis alleged that “The (fitness) packages for clients were not individualized and Davis failed to provide the promised coaching and check-ins”. The complaint also mentions that Davis routinely ignored customer complaints, and in the event in which she did respond, she would only send them a partial refund [3].

Brittany Dawn’s trial was set to begin in the 95th District Court in Dallas on March 6, 2023 [1]. Leading up to the trial, issues with Davis’s defense became apparent. Court documents from February 2023 allege that the defense “attempted to obscure the truth” of Davis’s finances by submitting proof of just 11% of the payments that customers paid to her. The documents also claim that the PayPal account that was attached to Davis’s fitness website has received at least $1.5 million since it was created, which is significantly more than the $169,736 the defense identified in discovery [1].

After numerous scheduling conflicts with the trial, the state of Texas and Brittany Dawn ultimately settled the lawsuit [2]. Settlement deals have not yet been made public, and according to a court coordinator, the details of the settlement will be established during a final hearing that has not been scheduled yet. Kelsey Weekman, who initially covered the lawsuit for Buzzfeed News said, “This lawsuit from the state of Texas took the testimonies of more than a dozen people who said they felt deceived by Davis and treated their stories with the same seriousness as a brick-and-mortar business. But without a verdict, the case is not likely to have a broad impact.” [2].

In the aftermath of such a far-reaching public scandal, Brittany Dawn has pivoted from posting fitness and lifestyle content to posting Christian content online [1]. This helped Davis gain back the large amounts of followers that she lost when the lawsuit was first filed. However, it is possible that many of Davis’s new followers might not know about her past fraudulent behavior and become negatively impacted by future deceptive acts. Davis recently launched a Christian ministry called She Lives Freed, that hosts conferences and retreats that range in admission prices from $100 to $600 [2].

The case of Brittany Dawn brings a lot of aspects about the judicial system into question, such as what it means to settle out of court and how involved a state’s Attorney General can be.

Because it takes a lot of time, money, and energy to go through litigation, out of court settlements are a common occurrence to settle a legal dispute [5]. Settling out of court is a legal agreement between two parties that resolves a dispute without going to trial. It typically does not include the court’s involvement, except to ratify the agreement and end the proceedings. When parties decide to settle a case, the agreement stops any further litigation and acts as the final decision in a case. Settling involves negotiating and agreeing upon terms that both parties are willing to accept and can include financial compensation or other forms of restitution [5]. Most civil cases are settled out of court because both parties realize that it is the most efficient way to resolve the conflict. Out of court settlements also avoid the risk of an unfavorable verdict and reputational damage to the parties involved [6].

The job of an Attorney General is all-encompassing and can be complicated since they are the primary enforcers of the law in their state [7]. Attorney Generals deal with every facet of the law but can focus on the details when they deal with a case like Brittany Dawn’s. The heart of Brittany Dawn’s lawsuit involves the rights of consumers, and Attorney Generals are bound to enforce and educate consumer laws in their state. To prevent consumers from getting scammed, Attorney Generals can teach them about the warning signs of scams and frauds so their chances of becoming a victim is reduced, they can provide information to consumers about their rights in a variety of commerce areas, and they can alert consumers when scams are becoming rampant by utilizing the media [7].

Another primary role of an Attorney General is to serve as a mediator since their office can receive many complaints that need to be resolved [7]. Even though mediation relies on the voluntary cooperation of both parties to resolve the dispute, the Attorney General can still exercise their rights over the case. Attorney Generals receive most of their enforcement authority from state laws, which can include the authority to investigate, settle with, and litigate against those who may be in violation of consumer laws on behalf of the state. Although the Attorney General can seek consumer restitution from the violator, they do not represent the consumer in the case [7].

The case of Brittany Dawn had the potential to initiate a take-down of influencer scams in the online world. Even though she was not punished more severely in a jury trial, there is a chance that another social media influencer will not face the same fate.
