Supreme Court of India: Got the appointment of six advocates as Additional Solicitor General

Senior Advocates S. Dwarakanath, Ms. Archana Pathak Dave, Satya Darshi Sanjay, Brijender Chahar, Raghavendra P. Shankar, and Rajkumar Bhaskar Thakare (Raja Thakare) have been appointed as Additional Solicitor General (ASG) for the Apex Court. The Appointments Committee (ACC) notification, these appointments has been made for a period of three years with effect from the date of assumption of charge of the office. These appointed senior advocates, who have been involved in numerous high-profile cases before the Supreme Court, bring a wealth of experience in diverse legal fields, including constitutional law, commercial law, and corporate law. As per the notification, these appointments are made by the Union Government to strengthen the legal team representing the government's interests in the Supreme Court.

Allotment of chamber, designation of senior advocates and certain other such benefits entitled to advocates presence only (appearing or assisting during hearing) : Supreme Court

In a contempt petition the division bench of JK Maheshwari and Rajesh Bindal, JJ. directed that in this Court, online presence of only those advocates be furnished and be marked who are appearing or assisting during hearing as indicated above and not of those who are not present in Court but may be associated in office of the advocates. During hearing, on being asked as to who is appearing for the respondent, it is informed by an Advocate, that an Advocate on Record (‘AoR’), is representing them.

Based on the counsel’s presence in the proceedings, the advocates may be entitled to certain benefits such as allotment of chamber, designation of senior advocates and others. In the long run, if the advocates who are not present in the Court are permitted to mark their presence, it may have an adverse impact on those Bar members who are appearing regularly.”

The Court requested the members of the Supreme Court Bar Association and Supreme Court Advocates on Record Association to furnish online presence only of those advocates as indicated and ensure its compliance in true sense and spirit. The Bench further requested the Presidents of respective Bar Associations of the Supreme Court to look into the issue and notify the members for taking corrective steps.

The matter will next be taken up on 04-09-2024 (Today).

Trademark of Fevicol used by a company: Bombay High Court Imposes Rs 50 Lakh Costs On Company For Breaching Injunction Orders

The Bombay #High_Court on August 13 imposed a hefty cost of Rs 50 lakh on a company which used 'deceptively' similar #trademark of Fevicol and its range of products despite an injunction restraining the company from using anything similar to said trademark

Single-Judge #Justice Riyaz Chagla noted that the #petitioner in #breach of the #injunction_order continued to sell the disputed products.

The original defendant Kusum Puri Goswami, the owners of defendant company refused to accept the contention, that it had sold the company to one Rajinder Puri Goswami and thus, they cannot be held responsible for any disobedience of the High Court's July 13, 2017 injunction order.

Hon'ble Judge further refused to consider the 'justification' put forth by Rajinder Goswami and the now new company, that they were unaware of the July 13, 2017 order and also of the undertaking and consent terms signed by the parties, then, agreeing not to use the #impugned_trademark.

Therefore, the #bench_ordered the respondents to pay Rs 50 lakh to Pidilite, within four weeks of the instant order getting uploaded on the HC website.

Supreme Court of India: appointed Special Investigation Team (SIT) on black money to submit interim report within 15 days

The Apex court appointed Special Investigation Team (SIT) on black money will submit its ninth interim report to the Supreme Court within 15 days, the panel’s vice-chairman Justice (Retired) Arijit Pasayat said: After coming to power in May 2014, the Narendra Modi government, in its first Cabinet meeting, approved the appointment of the SIT as directed by the Supreme Court. We have already submitted eight reports to the Supreme Court while the ninth report will be submitted within 15 days, "Justice Pasayat told reporters here. He is likely to hold a meeting of officers from IT, ED, Customs and Excise and Central Board of Indirect Tax departments in Cuttack on August 28. Director of ED Rahul Navin is also scheduled to attend the meeting.

Supreme Court of India: Bail for first-time offenders applies retrospectively on Section 479 BNSS

Supreme Court of India bench of Justices Hima Kohli and Sandeep Mehta while hearing a #PIL regarding overcrowding of prisons in the country. The Centre on Friday informed the Supreme Court that Section 479 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, which allows courts to #grant_bail to  #first_time_offenders who have undergone #detention for a third of the maximum period prescribed, would apply with retrospective effect. Section 479 of the BNSS (which replaced CrPC) has said that if first-time offenders have remained in jail for one-third of the maximum sentence, they can be released on bail. This means the provision will apply to all undertrials in cases registered before July 1, 2024. Section 479 of the #BNSS provides for the release of undertrials who have been behind bars for many years with no end in sight for trial. However, the said section does not extend the benefit to those who are accused of an offence for which the prescribed punishment is death or life imprisonment.

The Supreme Court of India: The names of three Advocates for appointment as Judges of the Gujarat High Court recommended. Collegium consisting of CJI DY Chandrachud, Justice Sanjiv Khanna and Justice BR Gavai resolved to recommend.

The names of the three advocates recommended are:

• Shri Sanjeev Jayendra Thaker,

• Shri Deeptendra Narayan Ray @ D N Ray,

• Shri Maulik Jitendra Shelat

In another notification the Collegium asked the Gujarat High Court to reconsider its proposal to elevate advocate Tejal Vashi as judge of that High Court.

On December 22, 2023, the Chief Justice of the High Court of Gujarat, along with her two senior-most colleagues, endorsed these names for elevation to the High Court. Despite this, the Chief Minister and Governor of Gujarat have yet to provide their opinions on the recommendation. According to paragraph 14 of the Memorandum of Procedure, if the views of the State constitutional authorities are not received within the stipulated time frame, the Minister of Law and Justice is to assume that they have no comments to add and proceed with the recommendation.

Punjab and Haryana High Court: Procedural lapses in documents should be ignored by Recruitment Agencies

The candidates work hard and make their best efforts to secure good marks in the competitive examinations. Therefore, only because of the date of issuance of degree/certificate, they should not be denied appointment as these were only procedural delays/lapses. In a letters patent appeal filed against the order dated 15-02-2023, passed by the Single Judge of Punjab and Haryana High Court, whereby the writ petition filed by the appellant for quashing the provisional select list of Science Master cadre prepared by the respondents was dismissed, the Division Bench of Sureshwar Thakur and Sudeepti Sharma, JJ., stated that once it was certified that the appellant passed the examination in May, 2017, the recruitment agencies who were presumed to be consisting of members of experts, rather than going into the date of issuance of certificate, should consider the date of passing of the examination. The Punjab and Haryana High Court stated that these were all procedural lapses/delays for which the students/candidates/aspirants for job should not suffer. The recruitment agencies should be prudent enough to select best candidates by ignoring procedural lapses in the documents.
