On the recent SCOTUS decision overturning Affirmative Action, Shira Scheindlin — former federal judge and chair of the board of Lawyer’s Committee for Civil Rights Under Law — says, “White Women Should Pay It Forward”

As a successful white woman who served for many years as a judge for the U.S. District Court for the Southern District of New York, I feel it is incumbent upon me and other white women in my generation to reaffirm the policies that helped us secure our positions in political institutions, academia, business, medicine and law. If the Supreme Court overturns or neuters this well-settled law, every one of us who proudly bore the title “the first woman” must work to ensure underrepresented communities maintain access to elite educational institutions.

Opponents of affirmative action suggest that it is no longer needed because the United States has reached the stage where everyone is treated equally. This is simply, and unfortunately, not the case. People of color are woefully underrepresented in many classrooms and careers. As only one example, Black lawyers make up only 2.2 percent of law firm partners, according to a 2021 National Association of Law Placement report, with Black and Latino women at less than 1 percent.

Opponents also falsely claim that students of color are being admitted to fill racial quotas, depriving white students of the chance to obtain a coveted spot. But affirmative action, as practiced today, does not discriminate against one group in favor of another.

Rather it considers race as one factor among many to put the applicant’s experiences in context.

There are now decades of data that show that stop-and-frisk is racially biased and does not reduce crime, including data that was available to Bloomberg the day he took office. Following the 1999 shooting of Amadou Diallo, an unarmed black man in the Bronx, 41 times by four plain-clothed NYPD officers, then-Attorney General Elliot Spitzer ordered a study of stop-and-frisk in New York City. He tapped Fagan to analyze stops. The report found that stops of black and Hispanic pedestrians were less likely to end in an arrest than stops of white pedestrians. On top of racial bias and lack of relationship with crime, the report also found constitutional problems with stop-and-frisk. The 1968 Terry v. Ohio Supreme Court that formalized stop-and-frisk requires officers to be able to articulate were suspicious based on facts and their experience -- “male, minorities, 16 to 25” is not a constitutionally legitimate answer. The Spitzer report found that in only 40% of stops, the forms filled by police articulated the factual basis for a reasonable suspicion. In all other stops, the information was either missing, insufficient, or did not meet the legal standard. This history is important because it goes to the heart of what is so misleading in Bloomberg’s claim that he “inherited” stop-and-frisk. Fagan also conducted the statistical analysis for Spitzer's 1999 report. “At the time Bloomberg took office the report was available, the evidence is pretty straightforward that [stop-and-frisk] wasn't really responsible for the drop in crime,” Fagan told City & State NY on Wednesday. “It was biased. And not only was it biased, it was unconstitutional.” In 2013, Judge Shira A. Scheindlin ruled that the NYPD conducted stop-and-frisk in an unconstitutional and racially discriminatory biased manner. Her decision was informed by Fagan’s 2010 analysis of stops stops during Bloomberg’s tenure, which showed the same results as his 1999 report: racial bias, no relationship between crime rate and stops, and disregard to the standard of reasonable suspicion.

A federal judge has ruled that the NYPD's stop-and-frisk procedure -- which has become a means by which police can harass, search and detain people of color without suspicion or warrant -- is unconstitutional. Judge Shira A. Scheindlin ruled that the program, which has expanded directly under Mayor Bloomberg (4.43M stops between 2008 and 2012), violated the Fourth and Fourteenth Amendments, and was a form of racial profiling. The victims of stop-and-frisk were overwhelmingly young, nonwhite men, and the vast majority of stops were baseless and generated no arrests. White people, statistically more likely to be carrying weapons, faced less force than people of color. The judge has called for a federal monitor to oversee reforms to the program.

“The New Jim Crow”

Michelle Alexander’s book, The New Jim Crow sheds light on the well-supported argument that the overuse of prisons is a result of utilizing imprisonment as an alternative means of racial control in the U.S. A report by the Sentencing Project titled “Report to the United Nations on Racial Disparities in the U.S. Criminal Justice System” supports the labeling of mass incarceration as “the new Jim Crow” and provides recommendations for alleviating the detrimental impacts of this new form of racial control. Although drug offenses “are committed at roughly equal rates across races” (The Sentencing Project), “African American adults are 5.9 times as likely to be incarcerated than whites and Hispanics are 3.1 times as likely.” (The Sentencing Project). Further, “prosecutors are more likely to charge people of color with crimes that carry heavier sentences than whites.” (The Sentencing Project). These disproportionate arrest and conviction rates as well as the distribution of lengthier sentences to those of minority backgrounds stems from the disproportionate level of police contact with African Americans. Judge Shira A. Scheindlin concluded that “the highest officials in New York City had “turned a blind eye to the evidence that officers are conducting stops in a racially discriminatory manner” (The Sentencing Project). Because we have “turned a blind eye” to the evidence of racial disparities existent in the criminal justice system, the overuse of prisons has occurred as a result. The Sentencing Project, in this report, include suggestions such as “ending the war on drugs, eliminate mandatory minimums, implement training to reduce racial bias” to alleviate the social harms this overuse has inflicted upon society.
