Jul 28, 2022 10:51 IST New Delhi , July 28 (Always First): Opposition MPs, who were suspended from the Rajya Sabha for disrupting proceedings, continued their protest near the Gandhi statue inside the Parliament complex on Thursday and asserted that there was no question of them apologising for their behaviour. "There is no question of apologising. We want to have discussions on price rise in Parliament but we were suspended. Our 50-hour-long protest will continue outside," said TMC MP Mausam Noor. Her comment came after Union Minister Pralhad Joshi's statement that suspension can be revoked if Opposition MPs apologise. Taking to a micro-blogging site, Joshi said," We are always ready for a positive discussion in the parliament, but the Congress party keeps disturbing the house. We are even ready to call back the suspended members, but the opposition should ensure that they do not disturb the house again." Another TMC MP Shanta Chhetri also hit out at the government saying they were only raising issues of the common people. "We are not going to apologise as we haven't done anything wrong. We've raised the issues of common people. The country is suffering from price rise and raising the issue is not wrong," said TMC MP Shanta Chhetri. Trinamool Congress (TMC) lawmakers on Wednesday staged a sit-in protest at the Gandhi statue outside Parliament on Wednesday over their suspension from Rajya Sabha. MPs who were suspended on Tuesday over 'unruly behaviour and disrupting proceedings' include Sushmita Dev, Santanu Sen, Dola Sen, Mausam Noor, Shanta Chhetri, Abhi Ranjan Biswar and Mohd Nadidul Haque. On July 27, Aam Aadmi Party (AAP) MP Sanjay Singh was suspended from the Rajya Sabha for the remainder of this week for "throwing paper on the Chair" during the proceedings. Singh was the 20th MP from the Upper House who was suspended for disrupting proceedings in this session. This is the highest number of single-batch suspensions in the Upper House. Meanwhile, a meeting of Opposition parties was held to discuss the issue of suspension of MPs. However, Aam Aadmi Party (AAP) and Trinamool Congress (TMC) skipped the meeting. Leader of Opposition in Rajya Sabha Mallikarjun Kharge said that the Opposition will submit a request to the Speaker of Lok Sabha and Chairman of the Rajya Sabha to rescind the suspension of the members who raised their voices against the price rise. Speaking to ANI, Kharge said, "The issues that we have been raising since the last 7 days regarding inflation and imposition of GST on essential commodities, today on the eighth day also we will raise our voice regarding the same. Common people are worried about this. We are also raising our voices continuously, but the government is not ready for discussion. I personally met the chairman and said that you allow the discussion and tell the date and time, we will be ready for discussion, but the government is not ready to accept it. We will submit a request to the Speaker and the Chairman to rescind the suspension of the members who raised their voices against the price rise." He further said that the suspension of MPs which has been done at the behest of the government and should be withdrawn with immediate effect. On July 25, four Congress MPs including Manickam Tagore, Ramya Haridas, Jothimani and TN Prathapan were suspended from the Lok Sabha for the entire Monsoon session for their 'unruly behaviour and disrupting proceedings.' Is the BJP government seeking to create a Hindu rashtra — by jugaad? - analysis

Sushmita Dev, a Congress Member of Parliament, recently noted, “Anyone who applied to the National Register of Citizens legally claimed that they were Indian. But now, under the Citizenship (Amendment) Bill they will have to claim they came from Bangladesh. This is a Catch-22.” This quote invites us not to see the NRC or CAA in isolation — but as a part of a collection of inchoate, haphazard laws and amendments to the Constitution in pursuit of what can be broadly termed as Hindu rashtra. But what is this Hindu rashtra “we” seek? As political scientist Vinay Sitapati has explained, unlike Islam (or even Judaism), there is no clear, largely accepted alternate conception to the modern Indian democratic State in the Hindu nationalist ideology or Hindu scripture as to what a Hindu rashtra might be. Rather than appealing to any tightly-defined set of principles, the government is inventing its Hindu rashtra by jugaad (improvisation) — slowly, but surely, alienating Muslims. After the initial thrust, Kashmir is still in the throes of an Internet shutdown, with all of its major political leaders still under arrest — while the government has no discernible exit or normalisation strategy. When the NRC produced less-than-desirable results for the Bharatiya Janata Party (BJP) in Assam, it pushed the CAA. Anticipating trouble in the Northeast, it then exempted key parts of the region from the Act. But protests still erupted, forcing the Assam government to assure residents that their rights will be preserved. The outcome of all of this is incoherent law-making and policies, borne more out of political benefit than any logical principles defining the Indian State.After all, it is much harder to write a Constitution than it is to undermine one. While we may be upset with parts of the Constitution, it was the product of discussions and compromises over a period of three years with various stakeholders. So, by the end of 1949, we had a largely cogent, consistent view of India as a secular State that respected the rights of its minorities enshrined in the Constitution. Contrast this process to the current model of slapdash, “big bang” legislation, being pushed through Parliament. In its hurry to redefine the State according to its worldview, the government has unleashed poorly framed policies with unknown consequences, in contrast to the spirit of deliberation and compromise that characterised India’s constitutional moment.Let us now consider the NRC and the CAA together to understand the challenges and contradictions that have been introduced into the system. To be sure, the government has categorically said that both are independent processes, and there has been no discussion on the NRC yet. But the interlinkages between the two are hard to miss.Between the 1951 and 2011 censuses, the Muslim population grew about 36% faster per year than the Hindu population — numbers that Hindu activists have used to argue that India has an illegal (Muslim) immigration problem. However, the first National Family and Health Survey (NFHS) carried out in 1992-93 finds that Muslims have a total fertility rate (TFR) 33% higher than Hindus — a phenomenon that can largely be attributed to lower socioeconomic levels among Muslims. The gap was likely even larger before the 1990s, suggesting that, empirically, the difference in growth rates between Hindus and Muslims can almost be explained by differences in fertility rates, and not illegal immigration. To be clear, as incomes rise, fertility rates have been rapidly declining in the Muslim community and converging with those of the Hindu community. Certainly, there has been some amount of illegal immigration, including of Muslims, but these are statistically negligible in a country as large as India. Are we willing to bear the cost to do an entire NRC and CAA exercise to find such a small number of people during a period of economic distress? What documents can we use to genuinely assess whether residents are here legally? Will the BJP accept the results if such a small number of residents are excluded from citizenship? How will the courts adjudicate matters if an implausibly large number of Muslims are denied citizenship? Many have noted that these policies fundamentally alter the idea of Indian citizenship to an “Israeli model”, in which citizenship is granted on the basis of religion — in this case, for Hindus and not to Muslims. But the Israeli model effectively grants any Jewish person around the world the right to Israeli citizenship. Yet, if we are following an Israeli model, why is citizenship only being extended to non-Muslims (mainly Hindus) from Afghanistan, Bangladesh, and Pakistan, and not Sri Lanka — where Hindus are also persecuted? What is the demographic impact of giving the 12 million Hindus of Bangladesh the opportunity to immediately become Indian citizens? What is the legal or constitutional principle upon which we can decide from which country to take Hindus?In the haste to change India’s citizenship rules, the government has failed to articulate a fair and efficient manner in which the new rules can be implemented, failed to address its larger financial and demographic consequences, and failed to define clear constitutional principles undergirding Indian citizenship. Whether it is Kashmir or the NRC or the CAA, to argue that the recent policy changes have moved the country towards a Hindu nation is to give the BJP government too much credit. It is a muddle of poorly thought-out laws with only one aim — to isolate India’s Muslim community. Unnao MLA Kuldeep Sengar booked for rape, CBI to probe case
Uttar Pradesh police lodged a first information report (FIR) on Thursday against Bharatiya Janata Party (BJP) legislator Kuldeep Singh Sengar for rape, criminal intimidation and abduction of a teenaged girl whose father died this week after an alleged assault by Sengar’s brother.
The state government handed over the investigation of the case to the Central Bureau of Investigation as the Allahabad high court questioned the Uttar Pradesh government’s handling of the Unnao rape case, asking why Sengar hadn’t been arrested even after the FIR had been lodged.
The CBI will start a probe into the rape of the woman and the death of her father on Friday. In a notification, the Department of Personnel and Training said three cases registered at Makhi police station in Unnao will be investigated by CBI. People familiar with the development said a CBI team is likely to visit Unnao on Friday to take up the probe.
A Special Investigation Team constituted by the state government ,in a report submitted to chief minister Yogi Adityanath, had recommended the registration of an FIR against Sengar in the rape case and handing over of the investigation to the CBI.
“The UP government has handed the probe over to the CBI. No accused will be spared,” PTI quoted Uttar Pradesh deputy chief minister Keshav Prasad Maurya as saying.
In the FIR lodged at Makhi police station in Unnao, the stringent Protection of Children from Sexual Offences Act, 2012, was also cited against the MLA. The girl’s date of birth, according to the FIR, is August 17, 2002, on the basis of which she is younger than 16. Previous reports have put her age at 18. The police complaint was lodged on the basis of the report submitted to the government by a SIT led by additional director general of police, Lucknow zone, Rajeev Krishna, on Wednesday night.
The FIR was lodged at around 2.50am on Thursday on the complaint of the girl’s mother.
According to the FIR, a man identified as Shashi Singh escorted the girl to the MLA’s residence in Makhi, Unnao, at around 8pm on June 4, 2017 on the pretext of getting her a job recommendation from the MLA.
The complainant alleged that the girl was held captive there and raped by the MLA in the presence of Shashi Singh, who was also named in the FIR for abetting the crime.
A senior police official said the MLA had been charged under Sections 363 and 366 (kidnapping of minor girl), 376 (rape) and 506 (criminal intimidation) of the Indian Penal Code (IPC). “Sections 3 and 4 of the POCSO Act have also been included in the FIR,” he said.
In the Allahabad high court, a bench comprising Chief Justice DB Bhosale and Justice Suneet Kumar heard advocate general of UP and amicus curiae (friend of the court) Gopal Swaroop Chaturvedi, who had sought a court-monitored investigation of the case. The advocate general informed the court that an application had been sent to the chief minister’s office on August 17, 2017, in which allegations of rape were made against the MLA.
He said the application was forwarded to officers in Unnao for action. “Since no FIR was lodged by the police officers at that time, action is being taken against the errant officers as per departmental rules,” he said.
The bench asked when the government proposed to arrest Sengar, to which the advocate general replied that he was not in a position make a statement on the matter. “The police will proceed in accordance with law only after recording the statements of the complainant and witnesses,” he said. The advocate general said that in Uttar Pradesh, the police only made arrests after conducting an investigation.
Referring to the SIT report, the court said, “ In spite of SIT report, you are repeating that we can only take action after investigation. If this is the conduct of the police in the state, whom a victim will approach to register a complaint? If this is the stand you are repeatedly taking, then we will be forced to observe in our order that law and order has collapsed in the state.”
Amicus curiae and senior advocate Chaturvedi said that In cases involving heinous crimes like rape of a minor, the accused should be immediately arrested.
“On the one hand, the advocate general is seeking more time for investigation in the rape case before arresting the accused, claiming it to be a procedure followed in the state, while on the other, the victim’s father was arrested for possessing illegal firearm without any investigation,” he said.
The rape victim’s father died in judicial custody on Monday after the alleged assault by Sengar’s brother, Atul. Social workers and political parties organised protests to demand the arrest of Sengar. Former member of the Uttar Pradesh Commission for Protection of Child Rights, Nahid Lari Khan, said Sengar should be immediately arrested under the POSCO Act. “What is happening? It is really surprising that despite an FIR, the MLA has not been arrested as yet,” she said. “Police officials shielding the MLA should also be booked under the Act.” The women’s wing of the Congress took out a protest march demanding the arrest of the MLA.
President of the All-India Mahila Congress, Sushmita Dev, who led the march, said the role of UP police was highly questionable. “They are allowing the MLA to roam freely despite him being accused of committing a heinous crime. There is no rule of law in UP,” she said.
BSP chief Mayawati said PM Narendra Modi, who, with his colleagues, sat on a day-long fast on Thursday to protest disruptions in the second half of Parliament’s budget session, should “instead fast to protest against the misdeeds of BJP MLA Kuldeep Singh Sengar.”
“The police have lodged FIR against Sengar, accused in the rape of a minor girl, under POCSO Act and other serious sections of the IPC, but he has not been arrested yet. It clearly shows that ‘jungle raj’ prevails in the state. The Prime Minister should apologise to the people for the conduct of his party MLA. Since he represents Varanasi in Lok Sabha, the banks of Ganga will be appropriate for his repentance.”

Six Congress legislators suspended for creating ruckus in Parliament
Six legislators of the Congress were suspended for throwing pieces of paper towards the Speaker's chair and disrupting proceedings during Parliament's Zero Hour on Monday.
The six Congress members were suspended from the Lok Sabha for five days by Speaker Sumitra Mahajan for their "highly unbecoming" conduct that "undermined the Chair's dignity".
The lawmakers, G Gogoi, K Suresh, Adhiranjan Chowdhary, Ranjeet Ranjan, Sushmita Dev and MK Raghavan, were protesting the issue of the lynching of minorities by cow vigilantes.
The Lok Sabha was adjourned for the day amid Opposition uproar over the suspension of the six Members of Parliament.

The Speaker said the members picked up official papers from the Lok Sabha secretariat staffers' table, tore them up and threw them towards the Chair, which prompted members of the treasury benches to shout "shame, shame".
She added that this happened despite her agreeing to a discussion on the issue of alleged atrocities against Dalits and Muslims.

India's high tax on sanitary pads sets off storm of protest
Indians are protesting a government plan to tax products that millions of women can’t do without.
Sanitary pads are set to be taxed at 12% under a new set of national rates set by the government. Thousands of people say the levy should be zero.
The new rates, released a week ago, are part of a massive overhaul of India’s tax code. The Goods and Services Tax (GST) is meant to simplify India’s complex web of state levies by assigning each commodity a uniform national tax rate.
Some essential products won’t be taxed as part of the plan, including condoms and contraceptives. Protesters have questioned why sanitary pads aren’t exempt too.
A petition by Indian lawmaker Sushmita Dev, which calls for feminine hygiene products to be tax-free, has been signed by more than 300,000 people.
Thousands more, including several celebrities, have joined another viral campaign making the same demand. The campaign is called #LahuKaLagaan — which translates to “tax on blood.”
The campaign was launched by a group called SheSays, which aims to end gender-based discrimination.
“The right for women to have access to menstrual hygiene and sanitation is absolute,” said Trisha Shetty, the founder of SheSays. “Women should not be discriminated against on the grounds of a natural bodily function.”
India’s finance ministry did not respond to multiple requests for comment.
The rural poor
Sanitary pads, which cost between five rupees ($0.08) and 12 rupees ($0.20) each, are currently taxed at different rates. In some states, the rate can go as high as 14.5%.
That puts them beyond the reach of millions of impoverished rural women.
“Women are already not on an equal playing field, and on top of that you choose to tax them,” said Vidisha Mishra, an expert on gender at Delhi-based think tank Observer Research Foundation.
“It is unfair on a very constitutional level,” she added.
A 2011 study by market research firm Nielsen found that only 12% of India’s women use sanitary pads.
The vast majority rely instead on cloths and rags, but sawdust, ashes, leaves and other substitutes are sometimes used, leading to infections. The lack of proper menstrual hygiene and sanitation has been linked to girls dropping out of school and lower productivity in the workplace.
Global precedent
The higher cost associated with products used by women is a global issue.
Several U.S. state legislators called for abolishing the “tampon tax” last year, while the “pink tax” — where women pay more than men for similar products — has also been slammed by activists in several countries.
The Indian government still has room to change tax rates before a scheduled July 1 deadline.
If it does, India will join Ireland, Kenya and Canada to become one of the few countries that have made sanitary products tax-free.
“This policy is insensitive,” said Mishra. “Policy makers are usually men, and for that reason menstruation is not on their mind.”
