Waivers: The Basics
Having noticed that many of my mutuals, as well as hockeyblr at large, are unsure of what exactly the NHL's waiver system means and how it works, I've endeavored to write up a little bit of a primer on waivers to make it easier to understand. Meet me under the cut to learn more!
What are waivers?
Put most simply, waivers are a process that occurs when a team says to a player, "We don't want you in the NHL anymore, we're sending you to the AHL". Because of the CBA's (Collective Bargaining Agreement) Article 13, before they can do this, they have to put the player on the waiver wire, which is essentially a 24-hour-long period where any other team that wants that player to play for them in the NHL can claim them. The purpose of the waiver wire is to ensure that teams don't unfairly stash NHL-caliber players in the AHL, thereby paying them lesser salaries (this is the most important part - AHL salaries are generally about a tenth of NHL salaries) and not allowing them to play NHL games. Players that may not be getting a fair shot on one team can move to another, where they can be used more effectively - for instance, Eeli Tolvanen was waived by Nashville, picked up by Seattle, and now plays a key role on Seattle's third line. In fact, he scored Seattle's first-ever goal in the playoffs!
What happens once a player is put on the waiver wire?
If another team claims the player, they are claimed on waivers and are transferred to the other team. Notably, the other team must have the appropriate cap and roster space necessary to claim the player. An example here is Kasperi Kapanen, who was placed on waivers by Pittsburgh and was claimed by St Louis. His cap hit of $3.2m may have been prohibitive for other teams who could have wanted to claim him.
If multiple teams try to claim the player, the player goes to the team that submitted a claim which is the worst in the standings - if it's before November 1st of a new season year, it goes to the team that finished worst in the standings the year before, but if it's after November 1st, it goes to the team that is currently worst in the standings. Take Lassi Thomson, who was placed on waivers by Ottawa and claimed by Anaheim. If, for example, Toronto also submitted a claim, they would not have been awarded Thomson, as Anaheim has the worse standing.
If no other team claims the player, they clear waivers. When they do so, they can be reassigned to the NHL team's affiliate AHL team. Notably, not everyone who clears waivers is immediately reassigned - a player who clears waivers can stay with the NHL team instead (for example, if another player just got injured). They can be sent down to the AHL at a later time - they do not have to go through the waivers process again if they have played less than 10 NHL games (cumulative) or been on the roster for less than 30 days (cumulative) from the last time they cleared waivers. This can be used to a savvy GM's advantage to avoid putting players on the waiver wire.
Why is everyone getting waived right now?
At the beginning of the preseason, every player with an NHL contract, whether it be one-way (NHL only) or two-way (NHL and AHL), is invited to that team's training camp. This places them on the NHL preseason roster for that team. As training camp goes on and players get cut, they then must pass through waivers to go to the AHL. Unless, of course, they're waiver exempt.
What is waiver exemption and why is it important?
So you might already have noticed an issue with the waiver system - it's terrible for younger players. If solely the waiver rules we've discussed above existed, every player being sent to the AHL would have to go through waivers. This would include prospects who are signed to an NHL ELC (entry-level contract) but didn't make the cut for the season. Obviously, this is bad for teams - imagine drafting players who you know will be good for you in 2 or 3 years and then losing them all to the waiver wire. This is why waiver exemption exists.
Waiver exemption, to keep it simple, is a protection that certain players have that means they do not have to go through the waivers process to be reassigned to the AHL. The specific details of waiver exemption are a little complicated - let's take a look at the table to make it make more sense.
Tumblr media
This table is either/or and is defined by the age when their NHL ELC was signed. A skater who signed their ELC as an 18-year-old is waiver exempt for either 5 years or 160 games played (including playoff games) at the NHL level. A skater who signed at 21 is exempt for either 3 years or 80 NHL games. Goalies have different requirements than skaters because they generally take longer to develop and don't play as many games.
There is a fairly common misconception that all players on their ELCs are automatically waiver exempt. This is false. The second a player hits the amount of games played for their age, they are immediately no longer waiver exempt. Usually, this doesn't occur until after the ELC is over, as most ELC players deal with injuries and healthy scratches, as well as not generally being given the reins to play on the NHL roster for the entire season. One notable example that disproves the "ELC means waiver exempt" conception is Dawson Mercer from New Jersey. Mercer signed his ELC as a 19-year-old in December of 2020. He has played all 82 games in the past 2 seasons (2021-22 & 2022-23) plus 12 playoff games for a total of 176 NHL games played. Under the games requirements, he is now no longer exempt from waivers, despite having one whole year left on his ELC.
For the 25+ category, upon playing a single NHL game, the player is waiver exempt for that entire season and that entire season only. Andrei Kuzmenko from Vancouver is a good example of that - last season, he signed his one-year ELC with Vancouver as a 27-year-old and could have been sent to the AHL at any time without going through waivers. (He was not, needless to say.)
There is one very important exception to the table: if an 18- or 19-year-old player plays 11 or more games with an NHL team in a single season, their waiver exemption is automatically cropped. For that season, and the next two, the player is waiver exempt, but after that, they are no longer exempt. This extends to the next three if the player in question is a goalie and not a skater. (To make it easier to understand, it's as if they jumped into the 20-year-old category.) However, 18- and 19-year-old prospects generally only play 9 games maximum at the NHL level in order to allow for the entry-level slide, allowing the contract to "slide" forward a year, letting teams keep the player on the ELC for an extra year and thus save money.
Are there any other ways a player can play in the AHL without going through waivers or being waiver exempt?
Yes, actually! There are two main exceptions - they're for conditioning loans.
First, what is a conditioning loan? A conditioning loan is a short-term reassignment to the AHL. There are two types of conditioning loans: the standard conditioning loan and the LTIR conditioning loan.
A standard conditioning loan, specified under the CBA 13.8, occurs when a player agrees to head down to the AHL for a few games to "wipe off the dust" on their game, so to speak. They're often used by players who have ended up as perennial healthy scratches on their NHL teams, so that they're able to jump in if there's an injury or other issue. Standard conditioning loans can last up to 14 days. One example of a standard conditioning loan is Shane Wright, who was sent to the AHL by Seattle very early in the season for conditioning, partially to bypass the requirement that the NHL has with the major junior CHL that would have required him to go back to the CHL were he officially reassigned from Seattle. Another is Nathan Beaulieu, who was sent to the AHL by Anaheim in January for a four-game stint.
An LTIR conditioning loan, specified under the CBA 13.9, occurs when a player coming off of LTIR agrees to head down to the AHL for a few games to "wipe off the dust" on their game, so to speak. These loans can only last 6 days or 3 games, whichever comes later, and the idea is to be able to figure out whether a player is able to return to form or requires more time to heal properly. For example, Travis Dermott was sent to the AHL by Vancouver in December to evaluate whether he was back to form after a concussion sustained in the preseason. He played one game in the AHL, then drew back into Vancouver's lineup for eleven games before going back on IR for the rest of the season due to the concussion repercussions. Notably, a team can only use one LTIR conditioning loan for each time a player is on LTIR.
What is emergency recall and why does it make a player waiver exempt?
Emergency recall occurs when a player on a team's NHL lineup is injured and the team can no longer ice a full squad because of it. (As a reminder, each team must carry 12 forwards, 6 defensemen, and 2 goalies. Usually, teams keep an extra forward and defenseman around as a healthy scratch in case of injuries, but some teams are pressed against the cap and cannot carry extra players.) In this case, they can call an AHL player (or multiple, at times) up on an "emergency" basis to fill in during the time that the NHL player is out. Once the NHL player is healthy again, the AHL player can either be transferred to a regular recall or gets sent down to their AHL team again. One example here is Akira Schmid, who was bouncing back and forth between Utica and New Jersey on emergency recalls every few weeks because Mackenzie Blackwood, one of New Jersey's two goaltenders, was constantly getting hurt.
It makes sense, then, why emergency recall would grant a player temporary waiver exemption status - it would be awful to have to recall a player from the AHL, have them in the NHL for a little bit, and then have to send them through waivers and get claimed when your roster player is healthy. However, if an emergency recall player plays in at least 10 NHL games, he loses his waiver exempt status under emergency recall (other forms of waiver exemption still apply).
What are unconditional waivers?
Unconditional waivers are different from regular waivers in what they do. Passing through unconditional waivers does not send you to the AHL. Instead, they are used by teams that want to buy out or terminate players' contracts, completely giving up their rights to the players. Players placed on unconditional waivers are almost never claimed because of this - only two players have ever been claimed off unconditional waivers.
Okay, hold on - what's the difference between a buyout and a termination?
A termination occurs when a player's contract is terminated. The player severs all ties to a team and does not continue to be paid by the team. The team does not incur any cap penalties from termination. There are two main types of termination.
The first type of termination is mutually-agreed-upon termination. In the case of Filip Zadina, who was recently terminated by Detroit, he made it clear that he would refuse to report to the AHL after being sent down on regular waivers. The team and Zadina then proceeded to terminate the contract so that Zadina would be free to negotiate a contract with another NHL team instead of playing for Detroit's AHL team, and so that Detroit would not incur any cap penalties from buying out Zadina. Another example is Lukas Sedlak, whose contract was terminated by Philadelphia when he made it clear to the team that he wanted to return to Europe to play. Philadelphia put Sedlak on unconditional waivers, terminated the contract, and Sedlak soon returned to his native Czechia to play for Pardubice.
The other, rarer type of termination is for material breach. Material breach termination is exemplified by Alex Galchenyuk, whose contract was terminated by Arizona after they became aware of the intoxicated driving incident involving Galchenyuk. Essentially, material breach is used when players are acting illegally, either against the law of the United States/Canada, or against the terms of their contract. The reason these terminations are so rare is twofold: Not only are hockey players generally going to try to avoid breaking the law, when they do, the player's association is usually going to investigate and file appeals and the like to try to secure their players the highest possible settlement despite the termination (and set a precedent so other teams are not encouraged to terminate contracts for material breach).
On the other hand, a buyout occurs when a player is released by a team, but the player continues to be paid by the team as per their contract. The team incurs cap penalties from buyouts - 1/3 of the contract value if the player is younger than 26 at the time of the buy-out, 2/3 of the value if the player is 26 or order. This penalty is spread across double the years left on the contract.
An aside - this is also where the idea of a "buyout-proof" contract comes in. A buyout-proof contract contains most of the salary being paid in the form of signing bonuses, which are paid in full even if the contract is bought out. (These contracts are also considered "lockout-proof", as, again, the signing bonus must be paid even if there is a lockout and no hockey is being played.) As an example of this, take a look at Auston Matthews's extension:
Tumblr media
If the Leafs try to buy this contract out, they'd have to pay Matthews the entirety of the signing bonuses as well as 2/3 of the base salary, making the cap savings incredibly marginal and just not worth it to buy out. Thus, it's buyout-proof.
Is that everything I need to know about waivers?
I think so! If you have any other questions, please drop me a line in my inbox or via DMs - I'll be happy to explain more to you! :D

[ID: a screenshot of a twitter post by @ChelDiokno reading ‘What do if your community pantry is visited by the police [THREAD]
Kung bisitahin ng pulis o ibang law enforcement agents ang community pantry ninyo, here are some tips:/END ID]
this thread is from twitter but i thought it would be pertinent to post here for anyone involved with community pantries in the PH:
If they are in uniform, take note of their names. Kung hindi pumayag, politely say that you can’t accommodate them, dahil di mo alam kung law enforcers ba talaga sila.
You might be asked to fill up a form like this.
If the community pantry is in private property, di pwede pumasok ang law enforcers kung walang search warrant, unless pumayag ang may-ari. Ask for a warrant signed by a judge; kung wala, sabihin: “Pasensya na po, pero di kayo pwedeng pumasok kung wala kayong search warrant." If the police insist, or imply that you are hiding something (“Kung wala naman kayong tinatago ba’t ayaw nyo kaming papasukin?”), assert your right.
Kung nasa public land ang community pantry, hindi kailangan ng pulis ng search warrant para pumasok—but they still need a search warrant to search the community pantry or any other private property that is on the public land. If the community pantry is on public land, make sure you are not obstructing traffic, littering, or otherwise violating any similar local regulations.
Kung hingan kayo ng business permit (also known as a “Mayor’s Permit”): sabihin na based on your understanding, hindi kailangan ng permit dahil hindi naman kayo nagnenegosyo; your only purpose is to help the needy and marginalized.
Kung hingan kayo ng barangay permit: sabihin na the DILG and Anti-Red Tape Authority have publicly stated in separate announcements na hindi kailangan ng barangay permit.
Kung hingan kayo ng authority to solicit from DSWD: sabihin na based on your understanding, required lang ang authority to solicit sa regional and national fund campaigns, at hindi ito naga-apply sa community pantry.
8. Kung sabihan kayo na you cannot continue operating because it violates IATF guidelines or regulations, ito ang sabihin ninyo: a. IATF guidelines/regulations are only recommendatory and do not have the force of law unless they are adopted by the LGU as a local ordinance. b. Even under IATF guidelines, mass gatherings for authorized humanitarian activities are allowed sa ECQ at MECQ. Since a permit is not required to operate a community pantry, and the poor are urgently in need of food, a community pantry is an authorized humanitarian activity. c. Community pantries do not violate the IATF guidelines on humanitarian activities since no permit or license is required for them to operate.
Kung subukan nilang i-demolish o dismantle ang community pantry, politely and firmly object, but do not physically resist. Kumuha ng pictures o video recording to document what they are doing. The Anti-Wiretapping Act only requires the consent of the parties kung private conversation or communication ito.
If law enforcers arrest you, or try to search you, others, or the community pantry, tandaan ang mga karapatan ninyo. You can refer to the primer made by FLAG, PCIJ, and the Foundation for Media Alternatives, which you can access through this linktree:
Kung papirmahin kayo ng kahit anong dokumento (like an acknowledgment na binisita kayo), basahing maiigi at sabihing kailangan nyo muna kumonsulta ng abogado bago pumirma. Posibleng may waiver of rights ito, and this can prejudice your right to file a case kung kailangan. Kung mapilit ang pulis, pwedeng gamitin ang non-dominant hand (halimbawa kung kaliwete, gamitin ang kanang kamay), o gumamit ng pirma other than your regular signature, so you can later explain that you were forced to sign.
You can also reach out to our FREE LEGAL HELPDESK anytime, i-message nyo lang kami sa http://m.me/cheldiokno. Mag-iingat kayong lahat, mga kakampi.

It’s been a busy few weeks in student debt, in Washington D.C., and the clock keeps ticking to January. Here’s a primer on some key bits:
Let’s work backward: last week, Representative Omar and other Congressional representatives sent a letter to Joe Biden demanding he release the memo. Remember the memo? 6 months ago, during our national week of action, the President asked the Department of Education to investigate his authority to cancel student debt. Now the clock is ticking: Members of Congress are demanding it, too, and they’ve given him two weeks to do it. Help build pressure on Biden to release the memo and cancel the debt. Click here to tweet at the President.
If he doesn’t release the memo in two weeks, we’re going to escalate our fight. Our next national day of action will be October 28th. We’ll be demanding our Representatives pressure Biden to cancel student debt -- all of it. Learn more about the day of action and our campaign at our upcoming call on Monday, October 18 @ 7 PM ET / 6 PM CT / 5 PM MT / 4 PM PT. RSVP here.
Of course, we’re still planning for our big week of action in January, a week of action in Washington D.C. and around the country before the moratorium ends. There’s a ton of games in Congress right now around infrastructure and reconciliation. There’s a lot of love for a watered down infrastructure bill -- which is why progressives are saying reconciliation has to pass with it. Reconciliation includes things our communities need, like two years of free community college, paid leave, childcare, and investments to address climate change.
All it takes for reconciliation to pass is 50 votes in the Senate (yes, the number of “Democrats” in the Senate!), but obstructionists are stalling everything, delaying by asking for nothing and fighting against everything. With such dysfunction, cancelling student debt is a simple action the president can take to help our communities without Congress -- so we’re demanding he do it, and why we’re building power to make him. Will you join us? Sign up to say you’ll take part in our big week of action in January in D.C. and across the country and if you can, donate $5 to help us get as many debtors to Washington D.C. as possible.
But wait, student debt doesn’t stop there! Last week the Biden administration announced they were taking executive action to issue a temporary waiver for the failed Public Service Loan Forgiveness (PSLF) program. The Department of Education estimates that these changes will result in roughly 22,000 people getting full cancellation. The PSLF changes are all bandaids on fundamentally broken bones, but for people who qualify it will be life changing. Some of our coalition partners will be leading trainings on how to understand and navigate the new PSLF waiver. For now the best source of information is the Department of Education’s website. Here is a good article from the New York Times that tries to answer questions people might have about this waiver.
And, the Department of Education is currently in the process of rewriting several of the key regulations that relate to student loans. That process is called “negotiated rulemaking” or “neg reg” for short. The regulations are being negotiated between Department of Education officials and representatives from the student loan industry, including predatory lenders, scam accreditation agencies, and for-profit colleges. There are strong consumer advocates involved fighting for students, but this is hardly a democratic process.
Last week the for-profit representative, with support from the Department of Education, excluded all students who had been defrauded by a for-profit university from participating in the process. Check out this powerful video of student Theresa Sweet scorching earth and speaking truth to power. And if you’ve been defrauded by your university, click here to learn more about borrower defense to repayment.
The system is broken, but when we take action and unite, we can move mountains. There’s now small changes and a national conversation about student debt -- we didn’t even mention all the incredible local resolutions, organizing and actions happening! -- and if we keep building power, together we’ll win full cancellation.

Leafs 2021 Primer: G, Divion, and Long Term Outlook
Goaltending
In net, Andersen begins with the most trustworthy backup the Leafs have had during his tenure, and the hope is to keep the starter fresher than in years past. Maybe we’ll see a 35-20 game split? As a non goaltending expert with lots of goalie takes I’m a fan of Campbell, I would guess more than the normal “scout”. He looked really good in his limited time with the team last season, and given the history and trust with Dubas, and Campbell’s own attitude and pedigree it seems like a situation worth putting stock into. With the flat cap and the uncertainty of a post Seattle goalie market, not to mention certain doubts about Andersen’s ability in the playoffs (I get it but it’s bunk IMO), it’s safe to say we have no idea whether Frederick will be back after this season. I’d say there’s a chance that Campbell could even be a 1A if the leafs and Andersen can’t work a new contract out. Dell is a typecast backup who might actually be pretty good as well. He and Martin Jones were not good behind a weak Sharks team last season, but having more depth than normal is critical this year. Having Hutchinson back, this time as the fourth goalie is great. He was really well liked and is better than he showed in the overextended role. A lot of people might rag on him, but having depth that can clear waivers is useful to the team, Marincin seemingly finds his way into action every year. He’ll be around when you’re in a bind so you don’t have to throw Kaskisuo to the wolves (you deserve better than that Pittsburgh game). They'll be a good example, and you’ll help raise the bar for the Marlies. Yes they’re not superstars, but dammit they’re the loveable last line of defence in dark times. Division Outlook The North Division is anyone’s to gain, and on paper the Leafs are without a doubt in the top four, and IMO the team with the most boxes checked. Montreal and Calgary are both just as complete and well rounded, but don’t have as much star power. Edmonton, Winnipeg, and Vancouver have as much star power, but have more glaring issues, goaltending, defencemen, and scoring depth respectively. It’s impossible to know how the schedule will impact things, and really any order of the six (sorry Ottawa) teams is feasible, but I would say Toronto has the best chance to take a hold of the division. Avoiding the powerhouses of Tampa Bay and Boston, if only for a year, could prove to be a blessing in establishing post season success. Big Picture For the second year in a row Dubas has escaped from burdening contracts while providing an intriguing list of possible solutions to the club's issues, all while not sacrificing exorbitant amounts of draft capital (and drafting “objectively” well if there is such a thing). Sure, there’s a list of things I don’t think have gone well or agreed with, losing Kadri, Marner’s cap hit, Mattews’ and Tavares’ cap hits, not giving Reilly the C, not firing Babcock sooner, etc., but overall this organization is in a healthy state with an intriguing future. The Tyson Barrie and Cody Ceci experiments didn’t exactly pan out, and maybe it took too long to try to figure out the backup goalie situation, but without question there are new possible answers.
Going forward the success of the team will rely on the cap going up, drafting and development for inexpensive young players, and getting players to “buy-in” by taking less money to stay. Already we’re seeing the youth start to emerge, free agents from overseas, and hungry vets looking for a good situation start to do this, but it will be interesting to see if some bigger names join in, and if the COVID/cap situation impacts that. Specially Hyman, Reilly, and Andersen. All 3 are on expiring deals and are very much a part of this group as people, could probably get more money elsewhere, but I'd think that at least one of them takes a “team-friendly” deal to stay with the group/situation, even if it’s in the short term until the cap rises. Eventually like Detroit, or more recently Boston and Tampa, the goal will be to form a culture where everyone does.

 La opción "CDW" (Collision Damage Waiver) reduce considerablemente el deducible en caso de colisión, mientras que el "Super CDW" elimina todo el deducible;
TP (Protección contra el robo) limita la responsabilidad del conductor en caso de robo o vandalismo del vehículo alquilado;
 tu tarjeta de identidad;
tu licencia de conducir;

hi, i have a question if you don't mind. beside cap space and contracts numbers, is there a limite to the number of emergency loan a team can have? (about the sens)
Hi anon! I never mind!!! Honestly I get super duper excited whenever anyone hits my inbox because it makes me feel like I'm doing something good sooo... Okay, enough about me, meet me under the cut! 💜
The first thing about emergency loans is that their use is dependant on cap space. The Sens have three emergency loans right now - Tyler Kleven, Nikolas Matinpao, and Jacob Bernard-Docker. All three are right side defensemen (RD) replacing Thomas Chabot, Artem Zub, and Erik Brannstrom. Chabot is notably on LTIR. LTIR is complicated as hell and I don't want to hit you with the specifics of it. There are jokes of "capologists" in certain organizations (notably the Leafs and Canucks) whose main job it is to navigate the cap. But there are a few important things you need to know.
Chabot's salary is $8m. In theory, since Chabot is now on LTIR, the Sens can call up players with up to $8m salary regularly, and not as emergency recalls. The thing is - if you've read my waivers primer - that emergency recall keeps players waiver-exempt (at least, for a while). So a team in a situation like the Sens prefers to start by using emergency recall, when they can, and then shift into regular recall. This is why Chabot was only placed on LTIR on the 27th - Bernard-Docker was called up as an emergency recall first. Then, when Zub and Brannstrom were injured, Kleven and Matinpao could come up and Chabot could go on LTIR while preserving Bernard-Docker's waiver exemption, which is important because otherwise he isn't waiver exempt and the Senators don't want that.
Also, when Chabot goes on LTIR, he is no longer considered a "roster" player. This is important for call-up reasons and contract numbers on the roster. See, the main "rules" of emergency callups are as follows:
1) If the team has no cap room (must be at least $875k) with which to call up a player,
2) And someone can't play and the team plays with fewer than 18 skaters and 2 goalies for one game as a result,
3) Then you can use emergency recalls to call up players on an emergency basis with cap hits up to $875k,
4) But when the players get healthy those emergency recalls MUST be sent down.
So no, there's theoretically no limit to the NUMBER of emergency recalls, as far as I can tell. Theoretically, you can play an entire team of emergency recalls, but that would require every player on your team to be severely injured and you'd probably end up using your LTIR space to deal with that instead. And also be actively tanking at that point.
But the thing is - emergency recalls do NOT come with a cap hit. They, themselves, do not count against the cap. That's the point of the emergency recall, after all.
I think that's it! I love talking about the Sens because there is literally always something going on with those boys, so thank YOU for the ask! If something isn't clear, let me know and I'll re-explain it 💜

Would y’all want a trades/waivers/contracts primer? Just like a series of textposts about the different more logistical contract side of hockey where I explain how trades, waivers, etc. work and can answer any of your questions since I love that side of hockey and there’s gonna be a lot of stuff going on in the next week?

In the first vote of the 116th Congress on Thursday, Rep. Alexandria Ocasio-Cortez, D-N.Y., was one of just three Democrats who split with their party and voted against a rules package introduced by House Speaker Nancy Pelosi, D-Calif., and backed by the leadership of the Congressional Progressive Caucus. Ocasio-Cortez’s political career so far has been largely defined by her willingness to break from the pack, but her dissenting vote alongside just two others highlights the paradox of her position in the House: Her high-profile platform allows her to shape the national conversation, but the same energy that fueled her rise can be met with a very different reaction inside the walls of the Capitol.
The debate over the vote started Wednesday morning, when it became clear that the House rules package for the 116th Congress would include a fiscally conservative measure known as “pay-go.” A spokesperson for Sen. Bernie Sanders, I-Vt., called for progressives in the House to oppose it. Rep. Ro Khanna, D-Calif., was the first out of the gate, calling it “terrible economics” and promising to vote down the rules package. Ocasio-Cortez soon followed suit.
For a moment, it looked like a rebellion could brewing among the newly energized and organized left. Except it wasn’t. There was no stampede of opposition, and later that day, the co-chairs of the Congressional Progressive Caucus, Reps. Pramila Jayapal, D-Wash., and Mark Pocan, D-Wisc., put out a statement in support of the rules package, ending any real chance at a last-minute insurrection.
The next evening, when the package hit the House floor, just three Democrats voted it down: Khanna and Ocasio-Cortez were joined by Rep. Tulsi Gabbard, D-Hawaii, who has hinted at 2020 presidential aspirations.
Jayapal, who came to Congress as an organizer and has played a key role in shaping the progressive Democratic agenda on issues like immigration, said she was frustrated about how the debate was framed on social media, in newsletters, and in part by some outlets — this one included. The conversation, she said, lacked the full context of the ways in which the CPC had defanged pay-go.
The narrative that emerged “is so hurtful to the progressive movement because we got so much out of this,” Jayapal said. One result, she said, has been to take the focus off the CPC’s major organizing effort to pack powerful committees full of as many progressives as possible. Khanna and Ocasio-Cortez are both angling to land some of those coveted spots, and their opposition to the rules package could make it harder for them to do so.
“There were lots of things in the rules package that we negotiated in that were really good, and it’s not that we caved on this, it’s not that we just decided we didn’t have the power to change it — it was really a strategic question about what is most necessary to move progressive legislation,” Jayapal told The Intercept.
Jayapal stressed that her criticism was not directed personally at her colleagues, with whom she is in agreement on the issues, but rather at the framing on social media and press coverage of the pay-go conflict. In the hectic final days of recess and the swearing-in, it can be difficult for a coalition to align on strategy, particularly with fast-moving debates.
Indeed, Pocan and Jayapal’s support for the package came after they negotiated with Pelosi and won significant concessions, including seats on powerful committees, the repeal of a rule that required a supermajority for tax increases, hardened rules around sexual harassment, and strengthened language around the War Powers Resolution, which will make it easier for the House to vote to put an end to U.S support for the war in Yemen.
Tumblr media
Pelosi has guaranteed that the House will hold a hearing on “Medicare for All,” Jayapal said, noting that critics who argued that pay-go will get in the way of that are wrong. Pelosi and Rep. Jim McGovern, chair of the House Rules Committee, have both said that pay-go can be waived in such circumstances. “The waiving we’ve been working on for a while with McGovern, but honestly we were trying to keep it kind of quiet, because not all of the conservative members know this, and now they’re saying, ‘Oh, you’re going to waive the rules? What do you mean?’” Jayapal said. “So sometimes I’m just like, come on people, let’s be strategic about some of this in terms of what we take on.”
The rules, waivers, and statutes involved in the legislative process can get confusing, so let’s pause for a primer. In 2007, when Pelosi first became speaker, she instituted the pay-go rule. In 2010, under pressure from Blue Dog Democrats, Pelosi made pay-go not just a rule, but a law, one that was also passed by the Democratic Senate and signed by President Barack Obama. The law allows the president to unilaterally sequester money if Congress passes a bill that isn’t paid for, but if a bill specifically bars the presidents from doing so, then the pay-go statute is rendered moot. When Republicans took over in 2011, they converted pay-go to “cut-go,” meaning that any new spending had to be matched with cuts elsewhere.
