One Piece episode 1089 thoughts (anime only spoilers, if you haven't watched):

that ending song! I already had listened to it when I saw that Maki Otsuki was singing it. But it didn't have to go that hard to remind me of "Memories"

I forgot how much the anime plays up the Zoro & Sanji bickering. It's a less prominent in the manga. I also think the anime pushes the ZoSan vibes a lot more.

WOTP manson rig update!

looks like the euro rig has some different beauties in the lineup, heres a little breakdown for anyone interested :)

mansons kept in the rig: Matt Black FR(Matt Black Whammy), Chrome FR(Chrome Whammy), Chrome FR 2.0, Verona Sky, M1D1 Stealth*, Oryx*, Red Alert, Holoflake***, Manson Black 7-String 2.0**

*technically matt's using a different guitar but its exactly the same, just a duplicate of it **only used for special songs(MOTP/Citizen Erased)

matt's brought back Matt Black LED 2.0(aka TronCaster) which hasn't been used since 2019! looks like she's replaced the MB-1 Blue which makes sense since their hardware is basically identical, Sustainiac Humbuckers on the neck and Psychopafs on the bridge. she's taking over the Blue Steel songs, look out for her in TIRO, Madness, and Resistance!

sad news for Mirror stans, looks like its Chrome Fuzz's turn with PIB. it can be hard to see, but besides the obvious difference in finish, Chrome Fuzz also has slightly flatter knob covers, though the placement is similar to Mirror 2.0. she seems to be the same as Mirror 2.0 in every other way, but we will miss Mirror's shine.

of course the most notable addition to the rig: Mask aka WOTPcaster!!! i'm ngl this one has been throwing me for a loop and a half. obviously she's a beaut and we're so happy to have her here, she's taking on a lot of the heavy lifting Chrome Whammy was doing on the U.S. leg. appropriately, matt's using her to start the show with WOTP and Interlude/Hysteria. makes perfect sense as she's built as somewhat of a simplified version of Chrome FR, just lacking the tremolo system, kill switch, and YES/NO toggle switches, and presumably is in standard tuning. she's got the standard single coil Sustainiac in the neck and a Psychopaf humbucker in the bridge, nothing new or fancy.

where it gets kinda funky is matt has also been using her for WAFF. matt used Matt Black 3.0 for WAFF in the U.S. leg, and that was the only song he used her for. Matt Black 3.0 has been tuned in Drop D in the past, so i assumed the drop tuning is why she was only used for one song, like Holoflake(Drop C for MOTP). if that's true, using WOTPcaster for WAFF would not make any sense, at least in my uneducated opinion, since they have entirely different tuning. it could be that MB3.0 was only used for WAFF because of special hardware, however replacing her with WOTPcaster wouldn't make much sense there either since they have different neck pickups, and the mods for WOTPcaster aren't that fancy where i could see him making it have the same sound without a humbucker. MB3.0 was damaged in the U.S. leg, but matt has another version of it in the euro rig anyway so basically i'm just very confused. but happy to be here anyway.

Ok I am a mutistand meaning I love different kpop groups and that's ok.But what I find being in a large Fandom there are a couple of bad weeds .I came across some one saying on this FB tread that OT7 basis should shut up and wait til bts comes back together becuse of us we held th from doing what they wanted.First of all of you saw the Festa Dinner Map of the soul was soposed to be there last ablum for a while but the pandemic .They couldn't do that at that time .Stop saying this listen and educate yourself RM says in kpop your not allowed to grow and if you read all the weverse artchiles they are always looking to do better and improve .It's this forward thinking and passion what drives them .As an artist you need to have that but as Jimin says he felt loss Also RM in the dinner.They need to grow and become a better people .

wait why am I posting about this Muse band again? idk, I’ve been listening to rock music again lately and new songs coincidentally means they’ve been on my mind and I needed to get those thoughts out sooo here goes ….

I’ve been trying really hard to hate the new direction of their music I’m not gonna lie. I think that anything they released after T2L has been a beginning spiral downwards musically. If an album has more than 2 pop songs on it, it’s arguably a sign for me to turn it off. Is it a matter of musical taste? Probably, but man I listen to a variety of music and if I find something I like about it, I don’t care how electronic it sounds!

Disclaimer while I am a musician myself, I don’t really know much about music theory and composing so I kind of, you know, judge based on my intuition. I love it when their music does something new, experimental and creative, but I also think it loses some of their authenticity when Muse try to sound entirely different from usual. I think that’s quite normal… But man, the typical “Muse sound”, that people like to point out persists in all of their music, sounds more like a stale copy of themselves to me. There’s something about their new music that just doesn’t do it for me anymore. I notice that it lacks the passion of the old Muse.

As an afterthought, I think it became quite obvious to me that their new music kind of leaves me cold and unimpressed during their Simulation Theory tour. I was literally rocking my socks off during Plug in Baby, Uprising, etc. and two minutes later, Mercy and Dig Down came on and I was watching with a kinda bitter smile how people lost their shit at the confetti show. Haha look at them having fun, why do I feel so out of place right now. And I stress that I don’t believe it’s because of the different style of music. (I really enjoy the uplifting tone of Defector for example.)

So about their new songs. There’s so much going on there and at the same time, I don’t particularly remember any of it. Initially, I was quite impressed by the direction of WSD, I mean wow they really handled those heavy vocals and riffs. But it’s like Matt said ‘Hey look at the fun stuff I can do, let’s use some of that on the new album’ (and maybe cater to some type of audience simultaneously who knows) instead of saying: this is the new sound I came up with, take it or hate it, it’s mine now. I talked about authenticity before, the kind of raw quality that cannot be produced by messing about in the studio. At least that’s the kind of signals I’m getting, I’m sure it isn’t intentional.

I still think that Compliance is a “good” song, and Muse are decidedly good at producing solid tracks, however what I’m trying to say is that they’re not writing music, fantastic music that completely hooks me and pulls me in and puts me in awe. What’s with using the same simple chord progression for four minutes straight, hardly any range in the vocals to grab onto, no musical or even thematic progression, the lyrics all sound the same, … Yeah, it’s pretty easy to listen to, and it’s the same kind of easy that leaves me quite emotionless and vaguely nodding along to the beat.

Not every track has to be a masterpiece. (Well, with knowing Muse, there’s a certain incredibly high expectation haha) Musicians are known to lose some of their inspiration over time, I absolutely don’t blame them. Still, I felt like writing down my opinion (which has been bothering me) and maybe consider it as a piece of music review for the archives or whatever, and I’m looking forward to watch and observe what they come up next.

On Friday 16 November 2018 the Extraordinary Chambers in the Courts of Cambodia (ECCC) handed down a guilty verdict against ageing former Khmer Rouge leaders Nuon Chea and Khieu Samphan in what’s known as Case 002/02. Out of fears that they would die before a verdict was reached, the case against them had been split into multiple parts. As such, they were already found guilty of crimes against humanity and sentenced to life in prison in Case 002/01.

So what’s so significant about last week’s verdict?

First and foremost is the crimes that were considered as part of Case 002/02. The first conviction against Nuon Chea and Khieu Samphan had related primarily to the forced evacuation of Phnom Penh in April 1975 and to a specific instance (at Tuol Po Chrey in Pursat province) where members of the previous government’s military were killed. This second part of the case considered a much broader range of crimes, and crimes that reflect the experiences of many more Cambodians during the Khmer Rouge regime.

Case 002/02 included crimes related to the appalling conditions in cooperatives and worksites, torture and killings at security centres, discrimination against the Vietnamese, ethnic Cham minority, and Buddhists, and forced marriage. In a survey conducted in 2008, when Cambodians were asked which crimes Khmer Rouge leaders should be held accountable for, only 4.9% of them mentioned forced evacuation, which had been the focus of Case 002/01. On the other hand, 80% listed killing, 63% listed starvation, 56% listed forced labour, and 33% referred to torture. Trials such as those before the ECCC are meant to do more than just sentence perpetrators; they are tasked with contributing to a sense of substantive justice, and with helping to find the truth about what happened. So, although these two defendants had already been convicted and sentenced, it had not yet been for what were considered to be the right crimes.

There are two particular crimes worth drawing attention to: forced marriage and genocide.

Forced marriage

The Khmer Rouge’s policy of forced marriage, and the rape that occurred within those forced marriages, was not well known before the ECCC, despite estimates now that 400,000 people were forcibly married under the Khmer Rouge. It is largely through the testimony of civil parties (victims who have become parties to the proceedings before the ECCC) and through the advocacy of their lawyers that this issue was brought into the spotlight.

In harrowing testimony, victims recounted how they were too scared to refuse to be married but that they “could see that some people shed their tears quietly”. Couples would be monitored in their homes the night of their marriage by Khmer Rouge cadre to ensure they consummated the marriage. Another victim recalled, “I had to sleep with my husband because I would be in danger if I did not sleep with my husband. Because there was a militiaman eavesdropping, I submitted myself to be a wife. I could not avoid, so I tried to take this”. Women who refused to have sex with their new husband were sometimes raped by local Khmer Rouge leaders.

Nuon Chea and Khieu Samphan were convicted of crimes against humanity for both forced marriages and the rapes that occurred with them. This conviction is significant from an international law perspective for recognising forced marriage as a gendered crime that was committed against both male and female victims, and for addressing it at a national scale. It is also highly significant to those victims who came forward after decades of silence. However, the ECCC has also been criticised for not addressing sexual violence that occurred under the Khmer Rouge in contexts other than forced marriage.

Genocide

Undoubtedly, the genocide conviction issued by the ECCC received the greatest attention from the Case 002/02 verdict.

Nuon Chea was found guilty of genocide against the Vietnamese and the Cham, and Khieu Samphan was found guilty of genocide against the Vietnamese (but not the Cham, with the Trial Chamber finding that “the evidence did not rise to the level of proving that Khieu Samphan actively assisted or facilitated the execution of the genocidal policy against the Cham”). Curiously, the summary of the judgement notes that “Judge YOU Ottara appends a separate opinion on genocide to the Judgement”. This is the first separate opinion issued by a single Cambodian judge, but its contents are not yet known.

There is immense power in the label of genocide. The actions covered by the conviction for crimes against humanity are just as horrific, yet it is those considered genocide that often attract far more attention. This is just as true in Cambodia, where the Khmer Rouge period is referred to as a genocide in Khmer (ប្រល័យពូជសាសន៍).

Legally, however, genocide only refers to the “intent to destroy, in whole or in part, a national, ethnical, racial or religious group”. This has led to divisive debates amongst scholars of Cambodia over whether some or all of the crimes committed by the Khmer Rouge could be considered genocide. It also means that the experiences of ethnically-Khmer Cambodians (the vast majority of the population) are not covered by the definition, and the ECCC has not found the crimes committed against them to be genocide.

Here is where the verdict is ripe for misinterpretation. News headlines are very carefully crafted to engage readers by referring to genocide without explicitly misrepresenting the verdict (for example, the New York Times said “Khmer Rouge’s Slaughter in Cambodia is Ruled a Genocide”). For most people, Cambodian and foreigners alike, the details of this verdict will have little to no impact compared to the overarching label of genocide. However, there is a longstanding concern that if it enters into public consciousness in Cambodia that the ECCC found the treatment of the Vietnamese was a genocide but that the treatment of the Khmer was not, that this could further inflame anti-Vietnamese sentiment.

A complicated legacy

The final question to ask about the ECCC and Case 002/02 is: where to from here?

Last week, a summary of the judgement was read out before the Trial Chamber and released online. However, the full judgement is not yet available, with the only information given is that it will be released “in due course”. This decision has been criticised in a report from Stanford University’s WSD Handa Center for Human Rights and International Justice noting that Cambodia’s (notoriously weak) judiciary often relies on summary judgements without full reasoning, and that the ECCC had a chance to leave a different legacy.

The timeline for appeals will not start until this full judgement is released, although both defence teams have already flagged their intention to file appeals. In Case 002/01 the judgement was announced in August 2014 and the appeals proceedings concluded in November 2016. The current completion plan for the ECCC, foresees an appeal judgement in Case 002/02 in the third quarter of 2020.

As for trials against other suspects, myself and other New Mandala contributors have written about the reasons why it is highly unlikely these contentious cases will go ahead. In the aftermath of the Case 002/02 verdict, Minister of Interior Sar Kheng said that since there are “no more” top Khmer Rouge leaders, the government’s policy is that “now this process has ended”. It is hardly surprising, but serves as additional evidence that once the Case 002/02 appeals conclude, so too will the ECCC.

Supreme Court, 7-2: House Cannot Force Trump to Provide Tax Returns

The U.S. Supreme Court ruled 7-2 on Thursday in Trump v. Mazars USA, LLP that the House of Representatives cannot demand that the president hand over his tax returns — the opposite of the result it reached in Trump v. Vance, a separate decision on the same day, in which it said New York City prosecutors can obtain his tax returns for an investigation.

In Vance, the Court ruled that the president is not above the law, and that there is no heightened standard for subpoenas of a sitting president by ordinary prosecutors. But in Mazars, the Court ruled that the House cannot simply demand any documents it wants, because of the separation of powers.

Chief Justice John Roberts wrote the opinions for the Court in both cases. Trump’s appointees — Justices Neil Gorsuch and Brett Kavanaugh — joined the majority. The dissenters were Justices Clarence Thomas and Samuel Alito in both.

Mazars involved an effort by Democrats to obtain Trump’s personal financial records — and those of his family — by suing a private accounting firm.

Roberts summarized the case:

We have held that the House has authority under the Constitution to issue subpoenas to assist it in carrying out its legislative responsibilities. The House asserts that the financial information sought here—encompassing a decade’s worth of transactions by the President and his family—will help guide legislative reform in areas ranging from money laundering and terrorism to foreign involvement in U. S. elections. The President contends that the House lacked a valid legislative aim and instead sought these records to harass him, expose personal matters, and conduct law enforcement activities beyond its authority.

He noted that such disputes between the legislative and executive branches were typically resolved through negotiation, not through the courts.

Roberts went on to note that while Congress has no formal subpoena power under the Constitution, the Courts have allowed it for legislative purposes. But Congress does nothave subpoena power for the purposes of law enforcement, and the targets of congressional subpoenas still have their constitutional rights, including executive branch prerogatives.

While he rejected the president’s argument that there should be a heightened standard for subpoenas of the president, the president did have additional separation-of-powers concerns that an ordinary defendant would not.

Roberts wrote:

Far from accounting for separation of powers concerns, the House’s approach aggravates them by leaving essentially no limits on the congressional power to subpoena the President’s personal records. Any personal paper possessed by a President could potentially “relate to” a conceivable subject of legislation, for Congress has broad legislative powers that touch a vast number of subjects. … Without limits on its subpoena powers, Congress could “exert an imperious controul” over the Executive Branch and aggrandize itself at the President’s expense, just as the Framers feared.

Roberts went on to describe a list of considerations that lower courts should have weighed:

“First, courts should carefully assess whether the asserted legislative purpose warrants the significant step of involving the President and his papers.”

“Second, to narrow the scope of possible conflict between the branches, courts should insist on a subpoena no broader than reasonably necessary to support Congress’s legislative objective.”

“Third, courts should be attentive to the nature of the evidence offered by Congress to establish that a subpoena advances a valid legislative purpose.”

“Fourth, courts should be careful to assess the burdens imposed on the President by a subpoena.”

The Court remanded the case back to the lower courts to consider the House subpoena request with these in mind.
