Philippines’ Leading Broadcasting Network: Forced to Shut Down by Philippine Congress

Philippines’ Leading and largest media conglomerate broadcast network, ABS-CBN, was forced to shut down by the congress by voting yes to its franchise renewal that had come under fire from President Rodrigo R. Duterte after 13 hearings.
The committee of the House of Representatives, most of the members are allied with the president, voted to deny ABS-CBN’s application for renewal of its franchise. Last May, it was been forced off the air after the expiration of the franchise.
In the statement of Carlo Katigbak, the ABS-CBN’s chief executive and president, “We remain committed to public service, and we hope to find other ways to achieve our mission” and he also said that the broadcasting network was also “deeply hurt”

The National Telecommunication Commission or NTC issued a cease and desist order against ABS-CBN to stop operations after the franchise expiration on May 4, 2020. Radio stations of the said network were also ordered to stop its operations. "Millions of Filipinos will lose their source of news and entertainment when ABS-CBN is ordered to go off-air on TV and radio tonight, when people need crucial and timely information as the nation deals with the COVID-19 pandemic," ABS-CBN said in a statement last May 5.
"Despite Senate Resolution No. 40, the House of Representatives' committee on legislative franchises' letter, the guidance of the Department of Justice, and the sworn statement of NTC Commissioner Gamaliel Cordoba, the NTC did not grant ABS-CBN a provisional authority to operate while its franchise renewal remains pending in Congress," ABS-CBN said.
After the forced shut down, approximately 11,000 employees lose their jobs, fearing subsequent consequences.

The network was accused of 5 violations and it was debated over during the 12 hearings. The following violations are:
·       Illegal Foreign Ownership
·       Foreign Ownership
·       Tax Violation
·       Election Coverage Bias
·       Worker’s Rights Violation
After the Technical Working Group of the Committee on Legislative Franchises done their findings contained in their 40 pages report, ABS-CBN’s franchise renewal were advised to be denied.  70 representatives voted for “yes” to the denial of their franchise, 11 representatives stand in favor of ABS-CBN franchise renewal, 2 inhibit, and 1 abstain.
"Ordering ABS-CBN to stop its operations is an outrageous attack on media freedom. The Filipino people need accurate information from independent sources. The government must act immediately to keep ABS-CBN on air and cease all attempts to curtail media freedom," Amnesty International's Philippines section director Butch Olano said in a statement.
Media watchdogs describe the move as a serious blow to press freedom.
"This shutdown order goes against public welfare," Senator Risa Hontiveros said in a statement.

ABS-CBN’s Brief History
ABS-CBN is one of the postwar organizations that helped reviving and rebuild Philippines’ economy after World War II. It was founded at 1946 after James Lindenberg founded Bolinao Electronics Corporation (BEC), which became a broadcasting company in 1949. In 1952, Lindenberg and Antonio Quirino, President Elpidio Quirino’s brother, partnered up to turn it into a television broadcasting network. Changing its name from BEC to “Alto Broadcasting Corporation” or ABS. Naming after Antonio and his wife, Aleli. The owner of Chronicle Broadcasting Network, Eugenio Lopez Sr. acquired that ABS and his network to merge as two companies and there, ABS-CBN was born.

With its milestones, ABS-CBN has been a prominent and trusted broadcast network by the filipinos. From its three major islands, Luzon, Visayas, and Mindanao, ABS-CBN was their source of entertainment and updates on local, national, and international news. So, there’s no doubt why a lot of people were disappointed and mad when the congress denied its franchise renewal. Journalists found this to be the revenge of the government.

The House Committee still forces to keep ABS-CBN off-air and off of their operations even it is testified that the network never violated anything. Is the congress really showing their pettiness towards it and disregarding Press Freedom?

JULY 10, 2020 marked the beginning of the death knell of Press Freedom after the House of Representatives tolls the ABS-CBN's franchise application to a dire conclusion. Voting with 70 yes, 11 no, 1 abstain, and 2 inhibits, the House of Representatives denies franchise renewal of the Kapamilya network.

The network, which is the largest media conglomerate in the country, faced the threat of a network shut down due to its expired franchise on March 30, 2020.
This was when Solicitor General Jose Calida also filed a Quo Warranto petition in the Supreme Court against ABS-CBN claiming that the corporation is partly-owned by foreigners. ABS-CBN rebutted this claim saying that Philippine Depositary Receipts or PDRs do not refer to ownership, but rather, investments to sustain the corporation's growth.
After ABS-CBN being killed off-air, over 10,000 employees lose their jobs, and subsequent consequences may be feared. With the renewal of their franchise being blocked, organizations and journalists see this as proof of the vindicativeness of the government.
What are the violations of the network as stated in the argument debated over during the span of 12 hearings?
•Critics had accused ABS-CBN of illegal foreign ownership.
➡ Justice Undersecretary Emelline Aglipay-Villar testified in the hearings that ABS-CBN Corporation chairman emeritus Eugenio "Gabby" Lopez III is a Filipino because his parents are Philippine citizens, said Zarate.
DOJ: ABS-CBN's Gabby Lopez Filipino citizen from birth. Lopez earlier told congressmen that he was also a dual American citizen because he was born in the US.
"There’s no distinction made between pure Filipino and dual citizens" when it comes to participation in mass media, said Bayan Muna Party List Representative Carlos Zarate, quoting Justice Assistant Secretary Nicholas Ty.
The Securities and Exchange Commission also testified that "a dual citizen is 100 percent Filipino," Zarate added. SEC agrees, dual citizens are '100 percent Filipino'
• Accusation on the Foreign Ownership
➡SEC Commissioner Ephyro Luis Amatong, noted by Zarate, stated that ABS-CBN's Philippine Depositary Receipts "do not reflect transfer of ownership to foreigners."

• On Tax Violation
➡Contrary to allegations of tax irregularities, the Bureau of Internal Revenue testified that the network regularly settled taxes and is one of the country's top taxpayers. In addition, Philippine Economic Zone Authority officials also said the broadcaster has no tax shield. BIR says ABS-CBN has no tax deliquency
•On allegations of election coverage bias
➡The Commission on Elections said the network did not violate any poll law. No complaints vs ABS-CBN on election bias.
ABS-CBN news chief Ging Reyes said that Journalism a 'public service'.
•Violation of Worker's Rights
➡Quoting the labor department, Zarate said that it was typical for any big company to face labor cases and that ABS-CBN complied with standards.
DOLE exec stated that ABS-CBN 'fully compliant' with labor standards.
Before the votation of the House of Representatives happened, the Technical Working Group (TWG) of the Committee on Legislative Franchises after their findings and recommendation which was contained in their 40 pages TWG report, recommends to deny new franchise for ABS-CBN. Consequently, 70 representatives vote "yes" to the denial of their franchise, while 11 representatives stand in favor of ABS-CBN franchise renewal; 2 inhibit, and 1 abstain.

Life Lessons From Dogs - Quarantine Edition

Before the pandemic started, I went home here in my hometown immediately because I was scared that I will get locked down in the city. So, the day they suspended classes, I went home and packed my stuff and got in a 5:30am bus going to Vigan. And when I got off the bus, my cousins were waiting for me and helped me with my luggage. I can already see our dogs waiting from afar already wagging their tails. When we got into our house, the dogs already started jumping on me and they made me feel so happy like it’s their way of telling me “welcome back home Keith! We missed you so much! Where have you been?! You were gone for so long!” Them jumping because I was home really made me feel that I’m really home.

Ever since I was a kid, I really loved dogs. My dad had a lot of dogs when we were all still living in Baguio. And when I was 7, my mom got us a dog and I named him Cyruz, a 3-month old Japanese Spitz x Shih Tzu by that time. He was actually my mom’s dog. When my mom passed away last 2013, Cyruz also died when it was my mom’s first death anniversary in 2014.

My life during quarantine is not that really boring. Besides from hanging out with my cousins, going out for some errands, chatting with my best friends online, and just sleeping, I am always accompanied by our dogs. Especially Ebony, our corgi-looking dog (but he’s not really a corgi, he’s an aspin) and my tita got a new dog and we named him Jco (yes, after the donut shop). Our new dog.  These two are really giving me love ever since. They always cheer me up and they give nose boops when they know I’m sad and they give kisses every time I wake up in the morning. They never made me feel that I am alone.

During this pandemic also, Home is not really that “stress free” environment. I’m getting annoyed by the presence of some people here, and they are also giving points that they don’t want me around. I still have breakdowns due to my mental health breaking down. And something also happened particularly last June. Days after we got Jco, we lost Ebony. Someone killed him and that made me so depressed for a month. But I am okay now but a part of me still misses him. Like, a lot. He’s been a good pup since the day we adopted him.

So Jco is the only one who keeps me company right now. He still gives me the cutest boops, and kisses in the morning. Every time I feel stressed about my online requirements I always give him hugs while I pet him and he doesn’t mind it at all, but he gives me kisses as well. He’s my stress reliever. I’ve been teaching him tricks but he’s kind of hard to train him right now since he’s just only a 3-month old puppy. But he already knows how to sit in command. He a muncher. Like literally he eats everything. He loves biscuits and crackers so much that made it his favorite treat every time I train him.

I’ve learned a lot of things from our dogs. They’ve taught me:
how to be independent
how to be forgiving
how to be loyal
how to enjoy every minute
how to love unconditionally
These soft and gentle babies are indeed a gem. They give color to our pale world, and they show you that life is too short so we have to enjoy it every minute. These furry companion’s colorful and charming personality really teaches you a lot. There are still so many things to learn from your dogs. He can constantly surprise you in so many good ways. His unconditional love, loyalty and companionship really affect your emotional well-being in such a positive way, that he will always be there to brighten your day, whether you’re having a bad one or a good one.
