THE PEOPLE OF THE PHILIPPINES vs. VICTOR COGAED | G.R. No. 200334; July 30, 2014

FACTS: On November 25, 2005, Police Senior Inspector Sofronio Bayan received information from an unidentified informant that Marvin Buya would be transporting marijuana from Barangay Lun-Oy, San Gabriel, La Union to the Poblacion of San Gabriel, La Union. Acting on this information, a checkpoint was set up, and two individuals, Victor Romana Cogaed and Santiago Sacpa Dayao, were apprehended with bags containing what appeared to be marijuana.

ISSUE: The key question is whether the search and seizure of marijuana from Cogaed were valid and incidental to a lawful arrest.

RULING: The court held that the search and seizure were not valid because they were not incidental to a lawful arrest. Rule 113, Section 5 of the Rules of Court outlines instances where a warrantless arrest is allowed. None of these circumstances were present at the time of Cogaed's arrest, as he had not committed, was not committing, nor was about to commit a crime.

For a warrantless arrest to be lawful, two elements must concur: (1) the person must execute an overt act indicating that he has just committed, is committing, or attempting to commit a crime, and (2) such overt act is done in the presence or within the view of the arresting officer. These elements were absent when Cogaed was arrested. No overt acts within plain view suggested that Cogaed was in possession of drugs at that time.

Cogaed was also not an escapee prisoner, which would have qualified for the last allowable warrantless arrest. Additionally, any implied acquiescence to the search could not be considered valid consent, as it might have been a mere passive conformity under intimidating or coercive circumstances. Cogaed's lack of aggressive objection was seen as a natural reaction to the coercive environment created by the excessive intrusion of the police officers into his private space.

In conclusion, the court ruled that the search and seizure of marijuana from Cogaed were not valid as they were not incidental to a lawful arrest, and the circumstances did not meet the requirements for a warrantless arrest outlined in the Rules of Court.

Yes, they can. That being said, I doubt that Thrones and Headless alike are immune to the hazards of eating cooked bones. This doesn't mean they don't do it, of course. I wouldn't be terribly surprised if "perforated intestine" wasn't a rare sort of death.

it's like. louis attempted to tell this story to daniel the first time, broke down, and attacked him before he could finish it.

and then decades later he's convinced himself that it was leaving the story unresolved that's holding him back from living his life fully now. so he invites daniel back again. and louis is sitting poised and put together, confident in his ability to recite his history in a pretty, poignant, neat little narrative that will resolve all the guilt and yearning and emptiness inside of him. that if he can just tell a compelling, satisfying story, maybe it will actually be that, and not the life he lived through, with all the pitfalls of his own failures lurking inside.

and then season 1 ends with him once again being forced to confront that the story he wants to imagine and the life he actually lived aren't the same thing. the boundaries around his narrative are shredded and he's left exposed, and subsequently able to face his past for the first time since that original interview. and you think, you think, "well this is it. they've crossed the event horizon. there's no use hiding the truth anymore, not after it's come flooding out into the open like this"

and then season 2 opens. not only is it back to the original, practiced distance, we now have armand literally enforcing that distance. a man sitting at the table who's interjections must be disregarded, an intentional interruption to the flow of the story. he doesn't exist to aid or add detail, he exists to distract louis when he gets too deep in the story. the only time we do get louis allowing any deep truth to come out is when armand leaves the room.

it's like. louis wants a story that's true, and the truth is what he's convinced will leave him satisfied. armand wants a story that will satisfy louis, to the extent louis will accept it's true.

I think the most insulting part of the Yakuza tv show is Kiryu's character assassination in the early 1995 segments.

In the games, the whole reason why Kiryu wants to join the yakuza is because of Kazama, a man he looks up to, that raised him and he idolizes and feels indebted to him.

But in the TV show Kiryu's reason for wanting to join the yakuza is idolizing a fighter (who was the "original" dragon of dojima) and instead of looking up to Kazama he resents him and wants to run away from the orphanage.

Not to mention Kiryu's plan to join the yakuza was to rob an arcade owned by the dojima family without telling nishiki, yumi and miho (nishikis sister) about his plans, getting them in trouble as well.

Yeah ok. Kiryu would totally do that.

CHI MING TSOI vs COURT OF APPEALS | G.R. No. 119190 January 16, 1997

FACTS: Gina Lao and Chi Ming Tsoi got married on May 22, 1988. However, no sexual intercourse occurred during the first four nights of their marriage, and this pattern continued even during their honeymoon in Baguio City, where they were accompanied by family members.

Despite sharing the same room and bed for several months, there was no attempt at sexual intimacy. Gina Lao underwent a physical examination, which confirmed her virginity. Chi Ming Tsoi does not want an annulment and insists that the issues in their marriage can be reconciled.

ISSUE: The main question before the court is whether Chi Ming Tsoi's persistent refusal to engage in sexual relations with Gina Lao constitutes psychological incapacity.

RULING: The Supreme Court rules that Chi Ming Tsoi's prolonged and inexplicable refusal to consummate the marriage is indicative of a serious personality disorder, demonstrating an "utter insensitivity or inability to give meaning and significance to the marriage" as defined by Article 36 of the Family Code.

The Court considers Chi Ming Tsoi's senseless and protracted refusal equivalent to psychological incapacity. This decision is based on the understanding that the prolonged denial of sexual intercourse, a fundamental aspect of marital life, is a clear sign of psychological incapacity. The Court emphasizes that continuous non-fulfillment of the marital obligation to procreate children through sexual cooperation can eventually lead to the deterioration of the marriage's integrity.

In summary, the Court declares that Chi Ming Tsoi's refusal to engage in sexual communion with Gina Lao amounts to psychological incapacity under Article 36 of the Family Code, justifying the annulment of their marriage.

I was bored, so I decided to answer one of life's greatest questions:

How much do they actually drink in 'One More Shot'?

Starting at the bottom with the least drunk, we have Barb! Over the course of the song, she had 3 shots and drunk 1.6 bottles, meaning she had 1262.5 ml total.

Surprisingly, next up is Tatiana! (I really thought she would be at the top lol)! She took 7 shots, more than anyone else, but only had 1.5 bottles, which leaves her with a total of 1300 ml drunk!

Curt is next! He has 5 shots, and drinks 2.1 bottles, giving him 1687.5 ml!

And finally, with the most drunk is (drumroll please).... The Informant!! With 4 shots and 2.2 bottles, he has a grand total of 1725 ml drunk!

Presuming all of this is vodka, this gives Barb a Blood Alcohol Content of 0.78%, Curt a BAC of 0.8, and The Informant and Tati a BAC of 0.81%! Seeing as 0.4% is considered life threatening, things aren't looking good for them.....

However the highest BAC on record is 1.51%, and I believe the man survived, so who knows. Would leave them with a killer hangover, though!

hello! so uh, im working on a really big worldbuilding project where soup important. but like, i have never made it even once in my life, i dont get how it even works. i cook, sure. but soups scares me. anyway, my main guys are insectivores/fungivores. so i have to bullshit some soup stuff out of that. so, how do you make soup with these ingredients? warning, little gross from a human perspective. list: iron powders mushroom stems psychoactive fungal powder half digested grains blood, blood pastes, blood powders bug meat ( fatty, muscles, legs) brains and eyes of arthropods spongy fungus cultured mold sheets arthropod carapaces, sometimes ground into powders arthropod eggs and embryos (a lot of bugs are massive)

~~~ Blood/iron

Hm, for what I know, there's pork blood jelly which is used in some Asian cultures (and specifically in soups with Bun Bo Hue/Bun Rieu in Vietnam). There's also Polish duck blood soup.

Quick anecdote, I had to take iron supplements for a while and couldn't swallow pills so I crushed them up and boy, let me tell you, it tasted NASTY. It almost made me never wanna drink orange juice again (the acidity of the juice probably didn't help, but better than making the mistake of putting it in pudding). That aside, it's been a while but it was like if the acidity and bitter orange rind flavor of orange juice was turned up to 17. That's assuming, of course, that your characters have the palates of humans. If they like that taste, I suppose just toss the powder in and boil it lmao

If you don't use a powder, I guess the Lucky Iron Fish that people sometimes put in soup for iron supplements might be a point of reference? I don't think it affects taste, but it works best with acidic liquid since vitamin C "improves the absorption of non-heme [plant-based] iron". So it's likely most tolerable in acidic soups like tomato, just as I drank it with orange juice lol.

Beans and liver soups might be a direction to look into if you aren't gonna put iron in directly.

~~~ Bug meat

Bug meat would probably end up resembling crustaceans since apparently insects evolved from them, so they'd be similarly treated to crabs, shrimp, etc. I guess?

[something about the amino acid compositions makes them tasty (my source being episode 6 of Heaven's Design Team lmao). That being said amino acids vary in taste from sweet to umami; though, according to this paper's introduction, humans mostly perceive amino acids as umami and maybe some as bitter. Umami is very good for soups so bugs will likely work well!]

Insects are also eaten pretty commonly in general but I think mostly they're roasted. They seem to be mainly boiled to kill off parasites first but I don't know if that's a concern for your characters. Maybe they can be used as toppings when roasted? Something similar texture wise to tép mỡ (Vietnamese name for fried pork fat) which is used to garnish soups in Vietnam and other places

[Also I read a fanfic where the MC cooked some really big ants and it seemed fairly well researched lmao, but those were also specifically ants which could walk upright and also he was making sweet and sour chicken ant, not soup...I can summarize it if you'd like?]

~~~ Carapaces

As for carapaces, I mean, my own family will eat shrimp with the shell and cook shrimp whole in soup, but here's a recipe for shrimp shell broth specifically which might be a good starting point. From my basic research, the calcium carbonate which would be in the carapaces might be used to help make noodles as it can "strengthen dough"?? So here's a recipe for Chinese alkaline noodles; apparently, the alkaline water used in the noodles can make "softer fuller noodles".

From a taste perspective, calcium carbonate is alkaline (i.e. bitter) and also apparently calcium has a unique taste which has a specific taste detector (we humans don't like it though lmao)! So taste wise, something like bitter melon soup could be a start.

~~~ Brain

For brain, maybe take a look at pork brain which is eaten in China with hotpot sometimes? I don't know how similar arthropod brains are though. A quick search didn't bring up much on eyes but perhaps taking a look at fish eyes and how they are eaten will help

~~~ Eggs and Embryos

For eggs, it's a bit harder to find something, but there's escamoles/Mexican caviar which are larvae/pupae of ants. It has a cottage cheese texture and a buttery/nutty taste apparently. These also seem to be fried. Another soup topping perhaps?

There's also ants egg soup which is North-Eastern Thai and Laotian cuisine. Apparently it tastes like shrimp.

~~~ Fungus/Mushroom

For fungus, there's snow fungus soup from China. There's also puffball mushroom soup (i've also heard puffball mushrooms can be cooked like chicken?? but that was more so baked).

Tempeh (Indonesian) is made from soybeans which are fermented and wrapped together by mycelium, it can be "crumbled into sauces and stews" according to this wikipedia article on tempeh. Here's a guide to adding it to soup, though more so as topping.

Frankly, fungi are unknowable so I can't say much but mushrooms people eat include wood ear mushrooms which I personally love (it's mostly texture though)! my family also enjoy enoki mushrooms. Both are eaten with hotpot I think. You would just boil in a flavored broth and eat

i'm gunna be blunt, it sounds like you need new fuckin friends. as much as i wanna say that you should tell them they're being edgy dickheads (which they were), i know that's not always realistic or doable advice. i'm really sorry and encourage you to maybe reach out and express that it hurt your feelings and made you feel even worse about something you're sensitive about, and see what they say. and if they have nothing nice to say, it might be time to find friends who don't treat you like that. life is too fucking short and i promise there is no shortage of good and fuckin cool people.
