Effects of the Union Budget 2019 on real estate
Model Tenancy Law
Recognizing that the current tenancy laws are archaic and obsolete, the FM proposed that a new model tenancy law will be finalized that does justice to both the lessor and the lessee in a realistic and fair manner.
Public infrastructure
The union budget makes provision for construction of new public infrastructure, including affordable housing, on land holdings by the Central Ministries and Central Public Sector Enterprises across the country.
Revival of NBFC’s
A slew of measures aimed at reviving the NBFCs from the ongoing debt crisis and liquidity crunch were announced by the FM. These efforts would also revive the lending activity and sustained flow of capital, for sustainable and well-performing NBFCs.
The government will allow investments made by Foreign Institutional Investors (FII) and Foreign Portfolio Investors (FPI) in debt securities issued by Infrastructure Debt Fund – Non-Bank Finance Companies (IDF-NBFCs) to be transferred/sold to any domestic investor within the specified lock-in period.
The FM proposed to increase the statutory limit for FPI investment in a company from 24% to sectoral foreign investment limit with option given to the concerned corporate to limit it to a lower threshold. FPIs will be permitted to subscribe to listed debt securities issued by REITs (real estate investment trust) and InvITs (infrastructure investment trusts).
Focus on affordable housing
The government has been quite focused on making housing affordable to all sections of the society and under the Pradhan Mantri Awas Yojana Gramin scheme aims to achieve the objective of “Housing for All” by 2022. In the last five years, 1.54 crore rural homes have been completed, with an objective to provide 1.95 crore houses to eligible beneficiaries in the period 2019-20 to 2021-22. In addition, these house are equipped with amenities like toilets, electricity and LPG connections.
In the urban housing sector, under Pradhan Mantri Awas Yojana Urban, the government has sanctioned over 81 Lakh houses of which construction has begun on 47 lakh houses. Almost 26 lakh homes have been completed with 24 lakh being handed over to the beneficiaries.
Higher tax exemption on affordable housing loans
The union budget 2019 has made provisions for tax exemption of Rs 1.5 Lakhs to buyers on home loans under affordable housing. With an aim to increase demand in the housing sector, the government has increased the tax deduction benefit, up to Rs 3.5 lakhs as against Rs 2 lakhs earlier, against interest on home loans taken till March 31, 2020 for affordable housing having a value of up to Rs 45 lakhs.
TDS on immovable property
The union budget proposed that tax deducted at source (TDS) from payment made for the purchase of immovable property will include charges such as club membership fee, car parking fee, electricity and water facility fee, maintenance fee, advance fee and any other charges related to the purchase of immovable property.
The provisions made for real estate in budget 2019 are aimed at further reviving one of the driving forces of the Indian economy. Real estate sector, including residential and commercial constructions and also the sub industries such as retail and hospitality, is ranked 3rd in terms of direct, indirect and induced influence on the all sectors of the economy.
