Ex-striker cleared of sex assault

Court papers stated Lynch – who played five times for the Hoops – repeatedly entered her bedroom uninvited. It was claimed he repeatedly asked her to kiss him and touched her on the body.

Lynch, who played for Preston, Dundee and Airdrie, was said to have seized her by the wrists. The charge said he sat astride her, placed her wrists above her head and pinned her to a bed.

The former striker, of the city’s Mount Vernon, was then claimed to have seized and slapped her on the bottom.

Lynch - who had been due to face a summary trial - without a jury - denied the single charge at Glasgow Sheriff Court.

The trial was initially adjourned in November due to the non-attendance at court of the alleged victim.

The new trial date today was told that the woman had not been cited to come to court by the Crown.

Prosecutor Leo McGinn said: "There were two requests made by my office to the police to personally cite her following the last occasion.

"I appreciate this is an unsatisfactory position as the case was adjourned due to her non attendance on the last occasion."

Paul McCormick, defending, opposed the Crown motion to adjourn the trial. The lawyer told the court that his client has since lost his job at a charity since the last calling of the case. He said: "The entire process has been hanging over my client's head for 27 months.

"There have been obvious consequences with the loss of his employment. "He understands the firm stance due to the publicity that reached the press.

"The Crown really ought to have done more to have the witness cited for today." Sheriff Jonathan Guy refused the motion to adjourn the trial to another date.

He said: "It has been more than two years and the Crown are not in a position to proceed as it failed to take the necessary step to cite the witness for this case.

"Given the impact of these proceedings and the Crown's repeated failings, I have decided the interests of justice don't support the Crown.

"It is not in the interest of justice for the Crown to be given a third opportunity to do that."

The case was then deserted simpliciter by the Sheriff.

Lynch followed in the footsteps of father Andy, who captained Celtic, by playing at Parkhead between 1999 and 2001.

After hanging up his boots, Canadian-born Lynch also embarked on a music career and even sang at Celtic Park.

Terasele moderne s-au prins și de zidurile cetății. Primăria și Cultura anunță dosar penal

După ce în centrul istoric al Sibiului terasele închise cu tot felul de sisteme și materiale moderne au devenit aproape o regulă, construcții de tot felul au început a fi amenajate și pe zidurile vechilor fortificații. Autoritățile locale anunță somații și dosare penale, fără ca ceva să se și întâmple.

Pe zidul de la poalele Catedralei Evanghelice din Piața Huet – monument istoric în jurul căruia s-a dezvoltat orașului și în a cărui reabilitare au fost investiți peste 24 de milioane de euro în ultimii ani – au fost montate de la începutul acestui an o serie de sisteme de umbrire retractabile. Sistemele acoperă terasa amenajată în curtea interioară a imobilului care, în acte, are adresa în Piața Huet, la numărul 3.

Terasa a fost amenajată pentru deschiderea unui nou local (în forma inițial publicată a articolului a fost publicat că ar fi vorba de restaurantul Lili`s, informație care s-a dovedit eronată). Autoritățile locale arată că sistemele vizibile și de pe Pasajului Scării nu sunt autorizate.

Reprezentanții Primăriei enumeră o serie de instituții sesizate pe acest subiect. „Având în vedere statutul de imobil istoric al spațiului și faptul că proprietarul sau chiriașul nu au obținut autorizație de construcție și nici avizul Direcției Județene pentru Cultură, Poliția Locală a sesizat organele de cercetare penală din cadrul Inspectoratului Județean de Poliție Sibiu. așa cum prevede legislația în astfel de cazuri. De asemenea, a fost sesizată și Direcția Județeană pentru Cultură Sibiu”.

Această din urmă instituție arată că, de fapt, nu a prea putut inspecta șantierul. „Imobilul este monument istoric (cu valoare națională) și pentru orice intervenție este obligatorie obținerea avizului/acordului Direcției Județene pentru Cultură (DJC) Sibiu. Pentru lucrările executate, DJC Sibiu nu a emis un aviz sau acord, acesta nefiind solicitat. DJC Sibiu a efectuat un control la fața locului, în data de 11 aprilie 2023, dar accesul nu a fost permis. Cu toate acestea, DJC Sibiu a sistat lucrările și a dispus intrarea în legalitate”, arată Dan Nanu, directorul executiv al DJC Sibiu.

Jurgen Faff a arătat că acea structură este una care nu contravine – din punctul său de vedere – legislației. Și că, de fapt, astfel de structuri au fost amenajate în tot centrul istoric al Sibiului. „Nu doar aici au fost amenajate, ci în mai multe locuri. Dar doar aici, la noi, s-au găsit să arate că nu ar fi în regulă”, a declarat Jurgen, care a propus o întâlnire pentru a prezenta din interior situația structurilor în discuție. Întâlnirea, însă, nu s-a mai produs: Jurgen Faff nu a mai putut fi contactat.

Ulterior publicării articolului, Jurgen Faff a transmis că lucrurile sunt, din punctul său de vedere, departe de a avea legătură cu încălcarea vreunor legi. A arătat că structurile construite în curtea interioară a imobilului din Piața Albert Huet sunt asemănătoare celor care funcționează chiar și în Piața Mare a Sibiului. „Nu a fost prins niciun cui sau șurub de perete, nu a fost construită nicio fundație, este vorba de o structură metalică ce are rolul de a oferi umbră. Astfel de structuri au fost amplasate peste tot fără să fie nevoie de autorizație, cum nu ai nevoie nici pentru umbrele. Da, au fost cei de la Poliție, au fotografiat, au constatat. Dar astfel de sesizări penale au mai fost, la fel, și pentru alte terase cu structuri metalice asemănătoare. Prin urmare, nu văd unde este problema tocmai cu această terasă umbrită de o structură precum multe altele din centrul orașului”, arată Faff.

Cât privește poziția Direcției pentru Cultură Sibiu, Jurgen Faff susține că aceasta este generată de amenințările pe care directorul executiv Dan Nanu i le-a transmis. „Dan Nanu m-a amenințat de față cu alte persoane că voi avea probleme în relația cu instituția pe care o conduce. Amenințările mi le-a transmis după ce eu am decis încetarea colaborării cu soția sa, care era angajată în cadrul uneia din societățile administrate de mine”.

Merită?

Astfel de construcții din tot felul de materiale moderne au împânzit centrul istoric al Sibiului, mai ales după apariția pandemiei Covid-19. Cu acordul autorităților locale. Printre proprietarii de terase din zona centrului istoric există, însă, și oameni care refuză să investească în astfel de „șuri” care, teoretic, prelungesc sezonul în care terasele pot fi utilizate de către clienți.

„Pe termen lung, astfel de construcții sunt dăunătoare orașului, pentru că îi ascund și alterează patrimoniul istoric. Dacă urmărești profitul imediat, da, sunt avantajoase. Dar, pe termen lung tot orașul pierde. Administrația noastră ar putea lua exemplul Brașovului sau Cluj-Napocăi, din acest punct de vedere: acolo nu sunt permise astfel de construcții care, la Sibiu, împânzesc tot centrul istoric. Din experiența noastră, faptul că nu avem terasă închisă nu ne afectează atât de mult încasările”, arată proprietarul unei terase din zona centrului istoric. O altă opinie legată de acest subiect - exprimată tot sub cererea păstrării anonimatului - arată că aceste terase ascund în unele cazuri lipsa totală a oricărui spațiu interior de alimentație publică. „Sunt locuri care se autointitulează restaurante, dar, de fapt, nu au deloc mese la interior. La interior au doar o bucătărie de unde scot mâncare”.

Dark Banker And Owner Of FCA-Regulated Payment Institution Extradited Over Money-Laundering Charges.

Bloomberg Reports - A UK Court ruled that the Italian national Caio Marchesani, director and owner of FCA-regulated Trans-Fast Remittance Ltd, must be extradited to Belgium over allegations of laundering significant sums via cryptocurrency for criminal syndicates. Bloomberg reports suggest that Marchesani facilitated major crypto transactions for a renowned criminal group, a scale seldom witnessed by European legal authorities.

The Caio Marchesani Case

Caio Marchesani, owner of Trans-Fast Remittance through Optima FX Ltd, is believed to have managed large cash transactions for Sergio Roberto De Carvalho, a Brazilian previously identified by Interpol as a top global fugitive until his 2022 capture. De Carvalho, or “Major Carvalho,” was on Interpol’s radar for drug trafficking, money laundering, document fraud, and homicide, with strong links to organized crime.

Prosecutors also accuse Marchesani of overseeing crypto accounts for Flor Bressers, known as the “finger cutter.” Arrested at Heathrow Airport in May, Marchesani is being held without bail. He must be extradited to Belgium to face criminal charges, a London judge ruled early on 19 Sept 2023.

The Belgian Investigations

The case against Marchesani is rooted in a broader probe initiated three years ago when the Dutch government confiscated over 12 tonnes of cocaine, valued at over €260 million, in Rotterdam. This investigation linked significant cocaine consignments to De Carvalho and Bressers. Marchesani’s involvement was later discovered through encrypted messages.

The prosecution alleges Marchesani acted as a “dark banker,” managing funds for criminal entities. A trial involving 30 defendants, including Bressers, began in Belgium but was swiftly postponed.

The exact amount laundered remains unspecified but is believed to be in the “hundreds of millions of euros.” Marchesani is accused of converting large cash amounts into Bitcoin for De Carvalho and Bressers.

Binance Involvement

Marchesani allegedly used Binance for his money laundering activities. The investigator identified at least 14 Binance accounts to launder money from his clients’ illicit activities.

The pandemic reportedly spurred the use of cryptocurrency for fund transfers, with Marchesani allegedly leveraging crypto to bypass these hurdles, utilizing multiple Binance accounts and imposing high transfer rates. In June, Belgium’s FSMA directed Binance to cease all operations in the nation due to legal breaches. Binance reportedly offered “operational assistance” for the investigation.

TSE mantém cassação de mandato e inelegibilidade de deputado distrital por abuso do poder econômico

De acordo com a denúncia apresentada pelo Ministério Público Eleitoral (MPE), o então candidato a deputado distrital José Gomes Ferreira Filho, empresário, teria ameaçado demitir os empregados de sua empresa caso não votassem nele nas Eleições Gerais de 2018.

Ao julgar o caso, no âmbito de uma Ação de Investigação Judicial Eleitoral (Aije), o TRE-DF entendeu que o abuso do poder econômico foi comprovado com cópias de mensagens de WhatsApp enviadas aos cerca de 10 mil empregados que trabalham na empresa Real JG. Também foram apresentados áudios e vídeos de reuniões em que as ameaças teriam sido feitas.

Quando o então relator, ministro Og Fernandes, rejeitou as questões preliminares de intempestividade da Aije e de nulidade do julgamento pelo TRE-DF. No mérito, ele manteve a cassação do mandado do deputado distrital. O atual relator do caso é o ministro Mauro Campbell Marques.

Em seguida, o ministro Edson Fachin antecipou o seu voto e, abrindo divergência, acatou a preliminar de nulidade do julgamento pela Corte Regional. Segundo ele, na ocasião, não houve o quórum completo que a legislação eleitoral exige para a cassação de mandato, uma vez que, embora presente, a desembargadora presidente não apresentou o seu voto. Assim, o ministro votou pela anulação do julgamento e o retorno do processo ao TRE-DF.

Na sequência, o ministro Tarcisio Vieira de Carvalho Neto pediu vista do processo. Ao apresentar voto-vista na sessão desta terça, Tarcisio acompanhou o entendimento do ministro Edson Fachin.

Próximos a votar, os ministros Luis Felipe Salomão, Alexandre de Moraes, Sérgio Banhos e Luís Roberto Barroso acompanharam o relator quanto à rejeição da preliminar de nulidade do julgamento do TRE-DF.

Quanto ao mérito, a Corte Eleitoral foi unânime em reconhecer o abuso do poder econômico que justificou a manutenção da cassação do mandato do deputado distrital José Gomes Ferreira Filho.

‘Single Ladies’ actor guilty of molestation in Gwinnett

A few days ago, Harold “House” Moore was getting praise from friends on Twitter about his appearance on “Hawaii Five-O.”

Now he’s going to prison for child molestation.

The actor, who’s also been on “Single Ladies,” “CSI” and Tyler Perry’s “House of Payne,” was convicted Friday of violating a 15-year-old girl in Gwinnett County.

Moore, who had reportedly been playing Dr. Dre in a forthcoming Tupac Shakur biopic, is facing five to 20 years in prison. The jury returned its verdict after more than nine hours of deliberation, finding him guilty of sneaking into the girl’s bedroom and touching her early in the morning on Nov. 25, 2012, according to a news release from the Gwinnett district attorney’s office.

Defense attorney Shannon Briley-Holmes has already prepared a motion for a new trial, which she shared with the Daily Post. The document is critical of Judge Timothy Hamil’s decisions on the bench.

One point she said she took exception to was Hamil allowing the state to refer to the victim as a “victim” in court.

“The Court stated words to the effect of, ‘The State will call the victim whatever it wants to,’” Briley-Holmes wrote in the motion. “Really? Could the State call the victim Mother Teresa?”

Moore testified during the trial, which was prosecuted by Nigel Lush, and maintained his innocence, but the defendant couldn’t explain why the girl would falsely accuse him, said Dan Mayfield, chief assistant DA.

The victim, whose connection to the defendant wasn’t released, made an outcry to a friend immediately after the crime.

Gwinnett police Cpl. Ben Ervin of the special victim’s unit interviewed the victim and Moore.

“The victim stated the defendant had touched her on previous occasions that made her uncomfortable by tickling her on parts of her body and adjusting her bra strap,” Mayfield said.

Moore had been out on bond since his arrest in 2012 and living in Los Angeles but was immediately arrested after the verdict.

Jail records show he also has a Lawrenceville address.

His IMDB profile says he was born and raised in Detroit.

Before acting, he worked as a behavioral therapist. He still calls himself “an advocate for youth development and education,” the profile says.

'Fraudster' Remanded in Custody

THE Limpopo woman accused of defrauding several people, including prominent figures and celebrities, will have to remain in police custody a little longer.

Kgabo Matsi appeared in the Polokwane Magistrate's Court yesterday on two counts of fraud. She was to have applied for bail but the matter was postponed to June 19 and she was remanded in custody.

Matsi, 19, was arrested on May 18 at her town house in Bendor, Polokwane, after an intensive investigation by members of the Hawks.

During her court appearance yesterday Matsi sported a worn-out hairstyle and wore a black jersey and black trousers. She looked frustrated when magistrate Janine Ungerer postponed her bail application.

Her lawyer, Tumi Mokoena, tried in vain to have the matter heard earlier, but prosecutor Pat Nkuna of the office of the Director for Public Prosecutions said it was getting late and he wanted to attend to another matter about 400km away from Polokwane.

"I'm sorry for your client but we have to postpone this matter for another date agreed to by all parties," Ungerer said to Mokoena.

The first case was committed last year, when she allegedly conned a man out of R350,000. She was arrested and later released on R5000 bail.

She allegedly also bribed a police officer who was handling the same case. The warrant officer is currently on suspension after he was allegedly caught accepting the bribe.

The second case against Matsi relates to an incident in March this year, when she allegedly conned an Indian businessman in Polokwane out of R850,000.

Police spokeswoman Lieutenant-Colonel Ronel Otto said yesterday that more charges were likely to be laid against Matsi.

"We are currently investigating several charges against her," Otto said.

Major-General Minah Molatjana, head of the Hawks in Limpopo, said yesterday she was impressed with the investigations so far and also the court proceedings.
