Dangerous Dogs - The Seizure Of The Dog
Dogs prohibited for their type are covered under Section 1 DDA 1991. Section 3 applies to any other dog that is dangerously out-of-control and injures someone or causes reasonable suspicion of injury. Only Section 1 DDA prosecutions can lead to the seizing of an animal. The seizure of a Section 1 dog is not legal and it is therefore illegal per se. Section 5 DDA 1991 governs the rights to seizure. Section 5(1)(c), which outlines the criteria for seizure of any dog subject to section 3 DDA 1991, sets out the criteria. These powers are generally used correctly, but dogs can be removed from public places or homes after an incident, or if the dog is under control at the time.

Additional powers are available for seizure. Any animal that is not being maintained properly can be taken out under the Animal Welfare Act. The grounds for seizure must be stated if it is requested in these circumstances. In such cases, the prosecution must proceed or the formal end of the action must ensure the animal's return.
Section 19[4] PACE 1985 allows a constable the right to seize any object if he believes it to be 'evidence relative to an offence' or that it is necessary to seize it to prevent it being concealed, lost and altered. Section 22 also stipulates that Section 19 items can only be retained for "so long in all circumstances". Section 22(4) states that Section 19 items cannot be retained if they are accompanied by a copy or photograph. A defendant's initial seizure is evidence that he has custody of the dog.
