My mom wouldn’t stop yelling at me all day long’’ Ivy zucht en gaat dichter bij de computer zitten. ‘’You wanna talk about it?” De camera zoemt uit op Noor’s telefoon die ‘’yeah’’ terug stuurt.

De meiden beginnen te appen en dan al snel te bellen. Ivy doet haar laptop dicht en gaat op haar bed zitten. Ze praten uren lang en de tijd vliegt voorbij.

Ze doet haar ochtend routine (tanden poetsen, kleding aan, haar doen) en gaat het huis uit.

Noor word wakker en checkt haar telefoon. Ze glimlacht naar haar scherm en begint te typen. Ze verstuurt een bericht en staat op. Ze pakt haar laptop en begint een film te kijken.

okay since i know i’m not going to be actually doing my work and kind of feeling anxious now because of all these feelings and emotions that i have to dump that i’ve been holding on to since like maybe the summer? lol so it’s goign to be a long fucking post and i hope no one reads it and if you do thanks for reading through all my bs that i’ve gone through

so this summer i got into a car accident like literally a week into my summer break on my way to work at school and tbh i wasn’t tired or anything but i guess i was just being a bit too careless maybe way too careless and too excited about the music that i was listening to that i got distracted and hit the car in front of me just as it was hitting traffic and it’s bullshit but life happens and that car hit the car in fron tof them and i was alone and thankfully no one was hurt or anything and at that time i made so many mistakes like literally the minute i hit the car basically i kept making mistakes well first of all i hit the car two cars in fact that was like a collision second i didn’t get their contact info like their phone number and shit so i had to wait until the police report came out which i didn’t call the police btw it was the car in the middle that did and then it cost me money to get the police report plus the transportation fee for lyft was not cheap and then never ever tell the other people your weakness in which they can take advantage of you and the communications between these three people were very very difficult it was so fucking stressful i remember every time my phone rang i just wanted to cry and i could listerally feel my body tense up just looking at my screen so afraid to open it but i can’t not open it because thats irresponsible of me anyway it was a big big big lesson i learned and something that i wish it was better managed but life happens and it’s not always going to be smooth-sailing and im just glad that i learned my lesson 

im already getting tense again just writing about this x.x

i do have to say it definitely helped that i was able to distract myself with work at the optometry (shoutout to allison) for the hookup because it gave me the experience and i know now that i do not want to do optometry no longer which i’ve been thinking about since the previous summer and the lesson i learned from this is that never ever go into something without knowing what its going to be about what i mean by this is that never make a big decision until you hae some experience and know that you like or hate it or don’t like it 

after working and saving money and spending money i made it to taiwan and literally within the first two weeks i already spent half of my money that i thought would less me for three months which it really should i actually have no freaking idea where all my money went and that’s on my part not keeping track of my money in the first place but then i was so 亂七八糟 when i arrived in taiwan and now that i know i’ve been keeping track of my expense and it literally does not make sense that all of the money i exchanged was gone within the first two weeks according to the expense that i keep track of now it’s been like three weeks and i havent even used up all of that money i lost in the first two weeks so i literally dont know what happened but it’s okay life goes on and now i know to always keep an eye and not be like so fucking careless

but let’s put in some good stuff i’ve bene listening to hyukoh and offonoff and i’ve been really loving that life if only i could see hyukoh live twice in los angeles and arcadia damnit im so fucking mad but it’s okay life goes on and i know i’ll have another chance to see them

and i’ve been watching hyori’s bed and breakfast and it’s been very therauptic to me and i aspire to have a life like her

anyway before i restarted writing this whole thing i wrote about my feelings of being on study abroad and to be completely honest, i dont feel that im on study abroad like is that strange is that manatory to feel buecasuse everyone talked about how they’re on study abroad and feels like a new environment but like to me taiwan literally feels like another home that i haven’t been in a long time like is it because im asian and i was born in asia that i feel this way or am i just recognizing my feelings and emotions in the wrong way and when i see snaps of my other friends on study abroad esp the ones in europe im just like wow they’re on study abroad but i dont efeel like im on studsy abroad even though i really am and this computer is so fucking slow rign now it cant catch up to what im typing 

i’ve talked to nick about this feeling before and it’s just really strange like is our feelings normal like i need validations that this is okay too because i didnt expect it to be like this 

i really like my classmates and my class and my teacher i love all of them and we have a good vibe and get along really well and the classroom is set up int he way you know what’s coming so i like that structure and i love how we listen to music and get off topics sometimes it makes class really fun and the teacher tries to do it liek that too 

as for the poeople in my program well i basically hang out  around soka people like nick sumire and ryan almost all the time which is kind of good and kind of not good at the same time like i know i should be going out and seeing other poeple but at the same time i like being in the comfort of them and tbh if it wasn’t for them i really would have a breakdown and im really greatful that they’re here and nccu kind of feels like soka if i dont get out of the routine that im in and so i really need to make an effort to go out like i really felt that last week and i was like shit this is soka all over again like nccu is literally surrounded by nature like all the greens and it’s so nice i’ve been way too lin love with the color forest green and nature green so it’s nice 

also if nick wasn’t here i dont think i’ll be doing crazy things like biking to fucking danshui at 1am in the morning and pulling an all nighter and shit or like pulling another allnighter that one tiem we went out to drink and ryan was so fucking drunk okay he wasnt drunk but he wasnt’ feeling well enough to go back to school so we fucking waited on the sidewalk for 4:30 until he felt better and i actually liek the dynamics of the four of us nick, sumire, ryan and me i think there’s a good balance and enough craziness and enough practicalness you couls prob tell whos the crazy one and who’s the practical one lol 

and i’ve realized that i’ve been more carefree and give less shit and just been enjoying life to the fullest dont know if its because im in taiwan but if it is then i hope i can still be as joyful and as carefree back in america and just life life and whatever happens happens for a reason and don’t get too stuck on life liek that tattoo i got was tehe whole meaning of this hahahaha

and i miss all my friends and sometimes something always reminds me of them and it just makes me 想念他們 but it’s okay because i know i will see them so try not to think too hard about it bc taiwan wil be gone sooner than i think and i dont want to have regrets

Als jij een liedje hoort, regelt Buma/Stemra het geld. Maar ze frauderen met de eigen boekhouding

Illustraties: Megan de Vos (voor De Correspondent) Gerommel in de boekhouding. Fraude, door onder meer de financieel directeur. Incompetentie van de accountants: dat komt allemaal naar voren uit een nieuw onderzoek naar muziekrechtenorganisatie Buma/Stemra.

Zorgwekkend, want bijna iedereen die iets met muziek doet, is van Buma/Stemra afhankelijk.

Overal waar muziek wordt gebruikt, int de organisatie geld voor Nederlandse liedschrijvers en muziekuitgevers. Of je een lied nou hoort in je stamkroeg of de Albert Heijn, op Pinkpop, 3FM of Spotify: het geld loopt via Buma/Stemra. In 2015 keerde zij 174 miljoen euro uit.

Het onderzoek dat de fraude toont, is aangevraagd door Wim van Limpt, sinds vorig jaar Buma/Stemra’s directeur. Hij had al zorgen over de financiële verslaglegging, en toen zei een klokkenluider hem dat er met geld is gesjoemeld. Dus liet Van Limpt de cijfers van 2015 en 2016 onder de loep nemen.

We kennen wel een deel van de resultaten. Het Financieele Dagblad meldt dat er voor miljoenen is geschoven om kosten kunstmatig rond de wettelijke norm te houden. Die norm is een belangrijk criterium voor de bonussen van de directie.

Maar verder weten we niet wat er in het onderzoeksrapport staat. Gevraagd om inzage noemt de directeur het ‘een interne aangelegenheid.’ Hij zegt dat hij zorgvuldig wil zijn, en dat hijBuma/Stemra's leden eind oktober zal inlichten tijdens een speciale vergadering.

Ondertussen laat de persvoorlichter van Buma/Stemra weten dat zelfs hij het rapport niet heeft en ook niet gaat krijgen.

Deze geheimhouding doet sommige liedschrijvers en kenners twijfelen aan Van Limpts belofte Buma/Stemra transparant te maken. Vooral omdat het bedrijf diezelfde belofte in het verleden maakte en verbrak. Dit schandaal is dan ook geen incident. Ik doe al langer journalistiek onderzoek naar Buma/Stemra, en vier thema’s keren steeds terug: ondoorzichtigheid, financiële wanorde, belangenverstrengeling en falend toezicht.

Buma/Stemra is ondoorzichtig, ook voor het bestuur

Laten we beginnen bij het gebrek aan transparantie. Het bestuur van Buma/Stemra bestaat uit acht liedschrijvers, vier muziekuitgevers, een voorzitter en een secretaris. Zij horen Buma/Stemra’s directie te controleren. Maar in de praktijk zijn ze vaak buitenspel gezet.

Dat zeggen bestuursleden Henk Westbroek en Hans Kosterman al in 2011 tegen de Volkskrant. Ze spreken van ‘bestuurlijke krankzinnigheid.’ Westbroek vertelt dat de directie een klein deel van het bestuur van alles op de hoogte houdt. ‘Alles wat zij te horen krijgen, krijgt het stempel vertrouwelijk of geheim.’

De rest is volgens Westbroek van vrijwel niets op de hoogte. ‘Toen wij over een nieuwe directeur stemden en wilden weten wat die ging verdienen, mochten we dat niet weten.’

Een treffend voorbeeld, want vier jaar later moet diezelfde directeur, Hein van der Ree, opstappen omdat hij weigert zijn salaris terug te schalen tot het wettelijke plafond van 180.000 euro. Hij krijgt een vertrekpremie van bijna vijf ton.

Ik spreek geregeld mensen die hier verontwaardigd over zijn, want die premie betekent een half miljoen minder om uit te keren aan rechthebbenden. Maar er is niks aan te doen, want de premie staat vast in het contract van de directeur. Een afspraak waar gros van het bestuur niet van mocht weten.

Er is gewaarschuwd voor financiële wanorde

In 2012, een jaar na het interview met Westbroek en Kosterman, slaat een ander bestuurslid alarm. Shaif Basier, tevens financieel specialist, schrijft in een brief aan Buma/Stemra’s leden dat de directie en sommige bestuurders onderzoek naar kritische financiële vragen saboteren.

Ook de oprichting van een interne onderzoekscommissie wordt volgens Basier gesaboteerd. Hij waarschuwt voor het gebrek aan transparantie en problemen met de uitkeringen aan liedschrijvers.

Basier trekt zich terug uit het bestuur. Bestuursvoorzitter Leo de Wit reageert dat de alarmbrief ‘in alle opzichten de werkelijkheid niet raakt.’

Er waren al voorbeelden van belangenverstrengeling

Je gaat je afvragen waarom de waarschuwingen niet serieuzer worden genomen. Want los van de honderden miljoenen euro’s die op het spel staan, zijn er op dat moment al gevallen van belangenconflicten en machtsmisbruik aan het licht gekomen.

Neem de directeur van M&I Publishing, een grootleverancier van achtergrondmuziek voor televisie. In 2009 krijgt hij 2 miljoen euro royalty’s van Buma/Stemra. Het probleem: M&I is direct gelieerd aan SoundAware, het bedrijf dat meet hoe vaak muziek op radio en tv is gedraaid. Die meting is de basis waarop Buma/Stemra royalty’s verdeelt.

Buma/Stemra laat de kwestie onderzoeken. Het onderzoeksrapport wil ze niet openbaar maken, maar de Volkskrant krijgt het te pakken. Volgens de onderzoekers wist Buma/Stemra van de nauwe band tussen de twee bedrijven, en had ze daar meer aan moeten doen.

Door de verwevenheid van M&I en SoundAware ligt machtsmisbruik op de loer. Een tijdje later wordt een bestuurslid binnen Buma/Stemra ook echt betrapt op machtsmisbruik: Jochem Gerrits.

Jochem is benaderd door Melchior Rietveldt, een componist die zijn royalty’s niet heeft gekregen. Hoewel het zijn plicht is de componist te helpen, wil hij dat alleen doen als de compositie bij zijn muziekuitgeverij wordt ingeschreven, waardoor hij een fors percentage zal opstrijken.

‘Machtsmisbruik ligt op de loer’

Maar het telefoongesprek waarin hij dit voorstelt wordt uitgezonden op tv en Jochem moet ontslag nemen. Buma/Stemra belooft het bestuur transparanter te maken. Ironisch genoeg bepaalt ze tegelijk dat bestuursleden voortaan geen kritiek meer naar buiten mogen brengen. Zo werkt de organisatie de openheid die ze belooft direct tegen.

Net als deze voorbeelden, wijst ook mijn onderzoek op belangenconflicten die liedschrijvers geld kosten. En net als in deze voorbeelden, zijn ook in mijn onderzoek muziekuitgevers vaak de boosdoener. Mijn vorige artikel ging over liedschrijvers die decennia lang royalty's zijn misgelopen. Dit geld belandde bij hun uitgevers.

Wie de verhalen op een rij zet vraagt zich af wie Buma/Stemra controleert. Daar is een overheidsorgaan voor: het College van Toezicht Auteursrechten.

De toezichthouder schoot tekort

Dit college is bij wet verplicht erop toe te zien dat Buma/Stemra belangenverstrengeling vermijdt. In de nasleep van het schandaal rond Jochem Gerrits, laat het College de boekhouding controleren door accountant KPMG. De conclusie? ‘Geen aanleiding om te vermoeden dat er sprake is van financieel wanbeleid.’

Maar hier komt het: KPMG was al sinds jaar en dag Buma/Stemra’s vaste accountant. Met andere woorden: KPMG controleerde cijfers die het zelf al had goedgekeurd.

En nu is er dan het nieuws over fraude in de boekhouding. Het College noemt dit ‘zorgwekkend.’ Maar juist het College had moeten controleren dat Buma/Stemra een goede boekhouding bijhoudt.

Hoe nu verder?

Ik zei het al aan het begin: er is een patroon van ondoorzichtigheid, financiële wanorde, belangenverstrengeling en falend toezicht. Buma/Stemra’s directeur, Van Limpt, zegt er het volgende over tegen mij: ‘Door ervaringen uit het verleden hangt er een zweem van wantrouwen over ons. Dat is een imago waar we mee te dealen hebben. Vertrouwen komt te voet en gaat te paard.’

Van Limpt zegt al sinds hij in 2016 aantrad dat Buma/Stemra transparanter en efficiënter moet. Dit onderzoek is een stap in die richting. Er is zelden zoveel momentum geweest om Nederlands belangrijkste muziekbedrijf op te schonen.

Toch is er nog veel onduidelijk. Begin deze week schreef Van Limpt een e-mail aan Buma/Stemra’s leden, maar daarin staat weinig informatie. Er staat dat het bestuur ‘onvoldoende is geïnformeerd over belangrijke financiële beslissingen,’ dat boekhoudkundige regels niet zijn gevolgd en dat ‘voorzieningen en reserveringen onjuist werden opgevoerd.’

Kan het niet concreter? Dit schandaal is het nalatenschap van de vorige directie. De toenmalige directeur is al weg, de huisjurist en financieel directeur hebben zich tijdens het onderzoek ziek gemeld en zitten al maanden thuis, en Van Limpt heeft een herstructurering van het bedrijf aangekondigd. Hij wil een frisse start.

Maar dat vergt meer dan een schoonmaakbeurt; het vergt ook openheid. Niet alleen vanuit Van Limpt, ook vanuit het bestuur. En daar knelt het volgens bestuurslid Henk Westbroek.

Die vertelt me dat de directeur niet gelijk iedereens steun had toen het onderzoek begon. Enkele bestuurders ‘liepen niet over van enthousiasme, om maar eens een understatement te gebruiken.’ Ook is geprobeerd ‘het lopende onderzoek nog on hold te zetten.’

Op 30 oktober zal Van Limpt het onderzoek bespreken tijdens een speciale vergadering met Buma/Stemra’s leden. Iedereen van de caféhouder die muziek draait, tot de songwriter die de muziek bedenkt, is afhankelijk van hoe hij afhandelt wat hij in gang heeft gezet.

Skype overleg met Pete

Doordat we tegen een aantal punten aanliepen waar we niet uit kwamen, wouden om dit te kunnen overlegen met Pete. Voor Pete was het prettiger dat hij thuis kon werken dus hierdoor heeft er skype overleg plaats gevonden tussen ons en Pete. De punten waar we tegen aanliepen was dat we alles een cirkel werd en we dit niet konen aan passen in onze visual code. De code die er voorzorgde dat, we dit konden aanpassen bevind zich hier onder.

Naast deze visuele oplossing liepen we ook tegen het probleem daan dat de waarde van onze rechter hand werd overgenomen door de linker hand wanneer we onze rechter hand uit sensor gebied verdween. Na bijna 1,5 uur met pete geskyped te hebben kwamen we tot de conclussie dat het leek op een fout in de library van leapmotion te zitten. Dit toch niet helemaal goed linker en rechter hand kan onder scheiden. In de code hier onder zijn we gaan kijken naar een work around die er voor zorgt dat links en rechts beter te onderscheiden zijn. LET OP! deze code bevind zicht nog in een begin stage en werk nog niet naar behoren.
