Tribunal de contas multa vereadores e ex-diretora da Câmara de Gaia por contratos sem visto prévio

O Tribunal de Contas (TdC) multou os vereadores da Câmara de Gaia e uma diretora devido ao atraso do envio de contratos de passes gratuitos para estudantes para fiscalização, o que constitui uma ilegalidade, segundo um relatório divulgado.

Em causa estão três protocolos "destinados à aquisição de assinaturas Andante Metropolitano, para alunos residentes em Vila Nova de Gaia, em 14.04.2022, 22.12.2022 e 22.07.2022", com o valor de 1,3 milhões de euros, 900 mil euros e 1,29 milhões de euros, respetivamente.

De acordo com o TdC, "à data da sua remessa para fiscalização prévia, já se encontravam a produzir efeitos materiais, com efeitos a 01.10.2021 (retroativos), 01.10.2022 e 01.04.2022 (retroativos), respetivamente", inclusive com uma fatura de 424 mil euros paga.

Segundo o TdC, os protocolos de 1,3 e 1,29 milhões de euros "não podiam legalmente produzir quaisquer efeitos, ainda que só materiais, antes da pronúncia do TdC", bem como não podiam produzir "quaisquer efeitos financeiros (pagamentos) antes da pronúncia do TdC".

"Não obstante, o MVNG [município de Vila Nova de Gaia] deu-lhes execução material e também financeira", esta última no caso do pagamento de 424 mil euros.

No processo, o TdC relembrou que o município de Vila Nova de Gaia "já tinha sido destinatário de uma recomendação para dar cumprimento ao disposto no n.º 1 do artigo 45.º da LOPTC [Lei de Organização e Processo do Tribunal de Contas] e de três recomendações sucessivas no sentido de dar rigoroso cumprimento ao prazo de remessa ao TdC".

A Câmara de Gaia indicou que a execução dos contratos era acompanhada pela Diretora Municipal de Inclusão Social à data, Vera Pacheco, que, tal como os vereadores, e face ao não pagamento de multa, foi alvo de um procedimento sancionatório por parte do TdC.

No contraditório, Vera Pacheco afirma que não emitiu "qualquer autorização ou instrução para a execução material dos protocolos em apreço", inexistindo, tal como indicou a autarquia na sua defesa, "qualquer registo ou evidência de tal prática".

Já o município de Gaia referiu que "o atraso na remessa do Protocolo deveu-se a um manifesto lapso procedimental, o qual, sempre se diga, deve ser objetivamente desculpado, já que o Município de Vila Nova de Gaia não agiu com base em qualquer intenção de violar as disposições aplicáveis da LOPTC".

A Câmara de Gaia referiu também que suspendeu os pagamentos "quando se detetou a ausência de visto prévio" do TdC aos protocolos, tendo também alegado que, detetada a falha, "optou por dar execução àqueles protocolos porque tal se afigurava como urgente para satisfação de uma necessidade também ela revestida de enorme premência para a realidade socioeconómica das populações cujos interesses, legal e constitucionalmente, lhe compete defender".

No caso dos vereadores multados por terem votado favoravelmente os contratos, os do PS (no poder) procederam ao pagamento voluntário das multas, de valor mínimo de 2.550 euros, extinguindo-se o procedimento sancionatório do TdC, ao passo que os do PSD, sem cargos executivos, alegaram em contraditório que não tinham tido responsabilidade direta, mantendo-se o procedimento sancionatório.

No caso de Cancela Moura, que deixou o cargo em fevereiro, afirmou que "nunca assumiu quaisquer pelouros, poderes delegados ou outras formas de responsabilidade direta e imediata", sendo também "alheio à eventual responsabilidade pela infração financeira que venha a ser apurada".

"Ao votar favoravelmente, e apenas com base nos elementos e informações que lhe haviam sido disponibilizados, estava o respondente convicto que havia cumprido, com os seus deveres enquanto eleito, pugnando quanto pôde, pela observância, escrupulosa, por parte da Câmara, como de resto sempre o fez, das normas legais e regulamentares aplicáveis", apontou.

Já Rui Rocha Pereira afirmou que "não acompanha a atividade administrativa municipal no seu quotidiano, participando nas reuniões do Executivo" e, tal como Cancela Moura, "nunca foi notificado ou teve conhecimento das recomendações do Tribunal de Contas, nomeadamente quanto às alegadas ilegalidades".

"Se tal sucedesse, certamente que ponderaria o seu sentido de voto nas deliberações relacionadas", declarando-se ainda Rui Rocha Pereira "totalmente alheio às orientações que são fornecidas aos serviços municipais".
