Children conceived through rape will be officially classified as victims of crime under new government plans.

The changes, due to be made in the forthcoming Victims Bill, will entitle those conceived as a result of rape access to information about their case.

The legal changes will also make it easier for victims to receive support from police and the criminal justice system "whenever they may need it".

The law will cover all sexual offences which can result in pregnancy.

England and Wales are understood to be among the first nations in the world to officially confer victim status to children born of rape.

Announcing the plans, Justice Secretary Dominic Raab said: "No child born in these horrific circumstances should be left to suffer alone, which is why we must ensure they can access vital support whenever they may need it.

"Our Victims Bill will amplify their voices and boost support for all victims at every stage of the justice system."

The Commons Justice Committee recommended the amendments to the draft Bill, following calls from campaign groups to change the law.

The statutory 'Victims' Code' sets out the rights available to all victims who report a criminal offence to the police.

The cross-party Justice Select Committee found individuals who believe they were born as a result of rape currently find it "unnecessarily difficult" to get help, including information about their case, because they are not defined by the Code as victims - and guidance is unclear.

The change in law will entitle them to make a complaint to the police, in their own right - and to receive information and access support in the same way as any other victim of crime.

Under the ministry's plans, that help could be accessed at any point in their lives, to address issues including alcohol or drug dependency, education and housing benefit.

Research by academics for the Centre for Women's Justice (CWJ), who lobbied for the change, estimate that more than 3,000 children may have been conceived after rape in England and Wales in 2021 alone.

The change, dubbed 'Daisy's Law' by the CWJ, is named after a campaigner who born as a result of a historic rape in the 1970s.

The CWJ said there was evidence that both mothers and children who are rape victims, will "often suffer from attachment difficulties and poor mental health, which in turn can profoundly negatively affect a child's development and educational outcomes, as well as his/her wellbeing in adulthood".

Hey Ren, not sure if you know/can answer this, but can the four CWJ players charged return to their teams in the time between pleading and trial? With the trial(s) potentially being in 2026, I was just curious what would happen/what the league's next steps are. Is there anything in the CBA?

So I can answer this theoretically because there is precedent and there is a rule in the CBA that allows Bettman to suspend all of the players that are currently being charged.

However that in particular is not what I'm concerned with. My main point of conflict is whether or not the teams will terminate each of these players contracts. This happens fairly frequently we saw one with former Coyotes' player Alex Galchenyuk this past off season and again during the season with Corey Perry and the Chicago Blackhawks.

The problem here with both cases is that it depends on whether or not Bettman is willing to suspend them until this is over and we get a solid answer or if their teams are willing to terminate their contracts based on bad faith. Because we've seen the commissioner suspend people awaiting trial prior (LAK Voynov he was suspended without pay just hours after being arrested on suspected domestic violence. Never playing a game again before going back to Russia without being put through deportation) just like we've seen him ignore similar issues (Varlomov the year prior in COL was allowed to keep playing after being arrested for suspicion of 2nd degree kidnapping and 3rd degree assault).

The NHL is less than stellar when it comes to consistency but we do have precedent and we do already know the IIHF stated that the 2018 world Junior champion team would not be allowed to play in international competition. Of course now the question with that is whether or not the rest of the team not being actively charged will be allowed to play.

I'm sorry if this doesn't actually answer any of your questions but a lot of it is up in the air right now based on what Bettman decides to do. But if you do have any other questions feel free to ask

I can’t comment on the new law from any expert legal position, but I have found this article which covers it in more detail:

Children born as a result of rape will be officially recognised as victims of crime and receive better support under changes announced by the government today. 

It follows a campaign by organisations including the Centre for Women’s Justice (CWJ) to introduce what they called Daisy's Law.

Amendments to the impending Victims Bill will give people born as a result of rape access to support from criminal justice agencies, such as the police and courts.

The Victims Bill intends to improve victims' experiences of the criminal justice system, according to the government. 

The provisions in the bill will affect all victims of crime, but it is anticipated those most affected will be victims of serious crime, including Violence Against Women and Girls and Domestic Abuse.

What is Daisy's Law? And how was the legislation named? 

The proposed legislation was named after a woman known only as Daisy, who was  conceived as a result of her 29-year-old birth father raping her 13-year-old birth mother.

Speaking to ITV Central, Daisy explained the trauma of what happened to her birth mother has followed her, her entire life.

"Birthdays really weighed heavily on me because that just marks the day I came into the world," she told ITV News.

"No one was celebrating my arrival - I arrived in the world as evidence of a rape and a child that needed to go into the care system because of that."

Before today’s law change children like Daisy, who were born of rape are considered an ‘aggravating factor’ of the attack, not as victims in their own right. 

Therefore, if a rape-conceived person decided to report a suspect to the police, as Daisy did, their complaint is unlikely to be investigated. Nor would the victim have any legal right to request reasons for or a review of, the decision not to investigate further.

How has legislation changed for a person who was born out of rape? 

The law will now acknowledge bereaved families and children who have witnessed domestic abuse and people born of rape as victims.

Although Daisy's birth mother reported what had happened at the time, her rapist denied everything, and police in Birmingham took no action.

For four decades, he continued his life as normal.

But Daisy began campaigning for officers to reopen the case.

“I have the DNA - I was walking proof that he had raped a child,” she said.

“My birth mother didn’t want to reopen that trauma, which I totally understand.

“And they wouldn’t open an investigation without the victim speaking up. And I don’t count.”

Carvel Bennett was found guilty of the historical rape in August 2021, in part due to ‘Daisy’, who is now in her 40s, allowing her DNA to be used to convict him.
