Aging US dams pose risk to thousands

On a cold morning last March, Kenny Angel got a frantic knock on his door. Two workers from a utility company in northern Nebraska had come with a stark warning: Get out of your house.

Just a little over a quarter-mile upstream, the 92-year-old Spencer Dam was straining to contain the swollen, ice-covered Niobrara River after an unusually intense snow and rainstorm. The workers had tried but failed to force open the dam’s frozen wooden spillway gates. So, fearing the worst, they fled in their truck, stopping to warn Angel before driving away without him.

Minutes later, the dam came crashing down, unleashing a wave of water carrying ice chunks the size of cars. Angel’s home was wiped away; his body was never found.

“He had about a 5-minute notice, with no prior warning the day before,” Scott Angel, one of Kenny’s brothers, said.

State inspectors had given the dam a “fair” rating less than a year earlier. Until it failed, it looked little different from thousands of others across the U.S.—and that could portend a problem.

A more than two-year investigation by The Associated Press has found scores of dams nationwide in even worse condition, and in equally dangerous locations. They loom over homes, businesses, highways or entire communities that could face life-threatening floods if the dams don’t hold.

A review of federal data and reports obtained under state open records laws identified 1,688 high-hazard dams rated in poor or unsatisfactory condition as of last year in 44 states and Puerto Rico. The actual number is almost certainly higher: Some states declined to provide condition ratings for their dams, claiming exemptions to public record requests. Others simply haven’t rated all their dams due to lack of funding, staffing or authority to do so.

Deaths from dam failures have declined since a series of catastrophic collapses in the 1970s prompted the federal and state governments to step up their safety efforts. Yet about 1,000 dams have failed over the past four decades, killing 34 people, according to Stanford University’s National Performance of Dams Program.

Built for flood control, irrigation, water supply, hydropower, recreation or industrial waste storage, the nation’s dams are over a half-century old on average. Some are no longer adequate to handle the intense rainfall and floods of a changing climate. Yet they are being relied upon to protect more and more people as housing developments spring up nearby.

“There are thousands of people in this country that are living downstream from dams that are probably considered deficient given current safety standards,” said Mark Ogden, a former Ohio dam safety official who is now a technical specialist with the Association of State Dam Safety Officials.

The association estimates it would take more than $70 billion to repair and modernize the nation’s more than 90,000 dams. But unlike much other infrastructure, most U.S. dams are privately owned. That makes it difficult for regulators to require improvements from operators who are unable or unwilling to pay the steep costs.

“Most people have no clue about the vulnerabilities when they live downstream from these private dams,” said Craig Fugate, a former administrator at the Federal Emergency Management Agency. “When they fail, they don’t fail with warning. They just fail, and suddenly you can find yourself in a situation where you have a wall of water and debris racing toward your house with very little time, if any, to get out.”

It’s unclear whether Angel, a 71-year-old Vietnam War veteran, declined to flee or simply ran out of time after workers with the Nebraska Public Power District warned him that water was overtopping the dam near Spencer, a town of fewer than 500 residents.

An attorney for Angel’s wife, who wasn’t home when the dam broke, has filed a $5 million lawsuit alleging negligence. It claims the power utility failed to properly maintain the dam, train its employees or inform the Angels of dangerous conditions.

Even though the Angels’ home was squarely in its path, the dam was rated as a “significant” rather than “high” hazard, meaning it wasn’t required under Nebraska law to have a formal emergency action plan. About 20% of state-regulated high-hazard dams nationwide still lack emergency plans, according to the U.S. Army Corps of Engineers, which maintains the national dam inventory.

When last inspected in April 2018 , Spencer Dam’s “fair” rating was accompanied by an ominous notation: “Deficiencies exist which could lead to dam failure during rare, extreme storm events.”

Tim Gokie, chief engineer of Nebraska’s dam safety program, said the warning was due to past water seepage the power utility addressed by installing a drain system. Ultimately, Gokie said, the rising Niobrara River simply overwhelmed the concrete and earthen dam, which was built in 1927 to generate hydroelectricity, not for flood control.

“The fact was that it was just an unprecedented situation,” Nebraska Public Power District spokesman Mark Becker said. “It was beyond what everybody anticipated.”

Nebraska was among the states hardest hit by storms and floods this year that have caused an estimated $1.5 billion in damage to roads, dams, utilities and other infrastructure in 28 states, according to an AP analysis.

A National Climate Assessment released by the White House last year noted growing frequency and intensity of storms as the climate changes. That can push some dams beyond what they were designed to handle.

Even if kept in good condition, thousands of dams could be at risk because of extreme rainstorms, said Fugate, the former FEMA official.

“These are like ticking bombs just sitting there, waiting for the wrong conditions to occur to cause catastrophic failure,” he said.

The nation’s dams are categorized as high, significant or low hazard in the National Inventory of Dams database. High hazard means loss of human life is likely if a dam were to fail. A significant rating means no deaths are likely, although economic and environmental damage are possible.

There is no national standard for inspecting dams, leading to a patchwork of state regulations. Some states inspect high-hazard dams every year while others wait up to five years. Some states never inspect low-hazard dams—though even farm ponds can eventually pose a high hazard as housing developments encroach.

Dam conditions are supposed to be rated as unsatisfactory, poor, fair or satisfactory. But the ratings are subjective—varying by state and the interpretations of individual inspectors—and are not always publicly disclosed.

Since the Sept. 11, 2001, terror attacks, the U.S. government has cited national security grounds in refusing to include dams’ conditions in its inventory, which was updated most recently in 2018. But the AP was able to determine both condition and hazard ratings for more than 25,000 dams across the country through public records requests.

The tally includes some of the nation’s most well-known dams, such as Hoover Dam along the Colorado River, but mostly involves privately owned dams. Many are used for recreation.

The AP then examined inspection reports for hundreds of high-hazard dams in poor or unsatisfactory condition. Those reports cited a variety of problems: leaks that can indicate a dam is failing internally; unrepaired erosion from past instances of overtopping; holes from burrowing animals; tree growth that can destabilize earthen dams; and spillways too small to handle a large flood. Some dams were so overgrown with vegetation that they couldn’t be fully inspected.

Georgia led the nation with nearly 200 high-hazard dams in unsatisfactory or poor condition, according to the AP’s analysis.

Among them is Reservoir No. 1 in Atlanta, a 180 million-gallon water supply dating to the late 1800s that has been out of service much of the past few decades. The city made repairs and brought it back online in 2017, only to shut it down again after leaks were noticed.

If the dam were to catastrophically fail, the water could inundate more than 1,000 homes, dozens of businesses, a railroad and a portion of Interstate 75, according to an emergency action plan .

“If that one goes, it’s going to wash away us and a lot of beer,” Iverson said.

The Atlanta Watershed Management Department declined the AP’s request for an interview about the reservoir and instead asked for questions in writing. When those were submitted, it declined to answer them.

One of the most common problems for aging dams are spillways incapable of handling an extreme rainfall event.

If water can’t escape quickly enough through spillways, it could flow over the top of a dam, which increases the probability of rapid erosion that can cause it to collapse.

The spillway at the 107-year-old Willett Pond Dam near the Boston suburb of Norwood is capable of handling just 13% of the water flow from a serious flood before the dam is overtopped, according to a recent state inspection report. If the dam were to give way, it could send hundreds of millions of gallons of water into the heart of the city of nearly 30,000 people.

“We are not talking of just flooding someone’s house. We are talking about covering their house,” said Murray Beach, who lives on the shore of the 220-acre privately owned lake and belongs to a citizens group that has lobbied for years for the spillway to be repaired.

A 2017 inspection report said improvements to the spillway could cost between $1 million and $5 million. A nonprofit that owns the lake received a $215,000 state grant last year to design spillway improvements. But there is no timeline to fix it.

More than 1,300 properties lie within the dam’s inundation zone, including several shopping centers and at least two elementary schools, as well as more than 70 roads and two railroads.

Tamiko Porter, who operates a Montessori school serving some 75 students, said she was surprised to learn there was a dam upstream that could flood her school if it failed.

“Oh God, please let it happen when my kids aren’t here,” Porter said.

Norwood emergency management director Bernard Cooper said there is no imminent risk of dam failure.

“Yes, it needs work. The spillway should be rebuilt. Absolutely, no question,” Cooper acknowledged. But “there is no money in the system for that.”

Concerns about inadequate dam spillways date back decades to when the Corps of Engineers undertook its first nationwide assessment of dams posing a high risk to life and property. From 1978 to 1981, the Corps inspected 8,818 dams. About one-third were deemed unsafe due to deficiencies, and about 80% of those cited inadequate spillway capacities.

One of the dams cited for a “seriously inadequate” spillway in 1978 was Lake Sebago, located in a New York state park near the village of Sloatsburg. Forty years later, nothing has changed.

A 2018 state inspection letter warned of “inadequate spillway capacity and dam stability” and asked for an improvement plan within 30 days. None was provided.

The state dam safety office has no authority to force the state parks department to make repairs.

To modify the Lake Sebago spillway, workers would have to rebuild a road and bridge that pass over the dam. The project could cost over $15 million, said Jim Hall, the recently retired executive director of the Palisades Interstate Park Commission, which manages multiple dams.

“That structure has been in place with the same spillway capacity for over probably 60 to 70 years and it hasn’t been overtopped,” Hall said. “Should it be improved to meet all codes? Yeah, that would be nice. Does it make it the highest priority for us to do in relation to other dam structures we have? Probably not.”

In a 1982 report summarizing its nationwide dam assessment, the Corps of Engineers said most dam owners were unwilling to modify, repair or maintain the structures, and most states were unwilling to spend enough money for an effective dam safety program.

Since then, every state but Alabama has created a dam safety program.

But the Great Recession a decade ago forced many states to make widespread budget and personnel cuts. Since a low point in 2011, states’ total spending on dam safety has grown by about one-third to nearly $59 million in the 2019 fiscal year while staffing levels have risen by about one-fifth, according to data collected by the Corps of Engineers.

California, which runs the nation’s largest dam safety program, accounts for much of that gain. It boosted its budget from $13 million to $20 million and the number of full-time staff from 63 to 77 following the failure of the Oroville dam spillway in 2017.

The scare at Oroville, the nation’s tallest dam, led to evacuation orders for nearly 200,000 people, although no one was injured and the dam ultimately held. An independent investigation cited “a long-term systemic failure ” by regulators and the dam industry to recognize and address warning signs.

California spent $1.1 billion repairing the Lake Oroville spillway, enacted new emergency plan requirements and launched a review of 93 other dams with similar spillways.

In South Carolina, after more than 70 dams failed following heavy rains in 2015 and 2016, the state tripled the personnel in its dam safety program and ratcheted up spending from about $260,000 annually to more than $1 million.

But some states have continued to pare back their dam safety programs. Thirteen states and Puerto Rico were spending less in 2019 than they did in 2011, and 11 states had fewer full-time positions in their programs.

The Association of State Dam Safety Officials says almost every state faces a serious need to pump additional money and manpower into dam safety programs.

“If you don’t have the staff to inspect a dam, or don’t have the authority to do that, you don’t know what the problems are,” said the association’s Ogden.

“If you are able to do the inspection but you can’t follow up, and you have dam owners who don’t have the resources to fix their dam, then ultimately you know what the problem is but you can’t get it addressed,” he added.

Many states face a quandary when it comes to problematic private dams when they can’t identify the owners. Rhode Island’s two-person dam safety office last year listed 32 high- or significant-hazard dams with safety concerns whose owners were unknown.

“If we don’t know the owner, then we can’t take any action to order anybody to fix it,” said David Chopy, chief of compliance and inspection for the Rhode Island Department of Environmental Management.

In some states, dams go uninspected because of exemptions in state law.

A 2013 Texas law exempts all dams on private property with a capacity of less than 163 million gallons that are rated significant or low hazard and are located outside of city limits in any county with fewer than 350,000 people. As a result, about 45% of its roughly 7,200 dams are exempt from regulation.

Missouri performs safety inspections on only about 650 of its more than 5,000 dams. That’s because state law exempts all dams that are under 35 feet, used for agricultural purposes or subject to federal regulation.

Former Missouri Gov. Matt Blunt attempted to significantly expand the number of dams under state supervision after the mountaintop Taum Sauk Reservoir collapsed in December 2005, injuring a state park superintendent’s family. But the legislation failed after some rural landowners expressed concerns. Then the proposal quietly faded away as new officials took over.

“Maybe it’s time to take a look at that again and make sure that our dams are safe,” said Missouri state Rep. Tim Remole, who now leads the House committee overseeing dam safety.

Until Angel’s death in Nebraska this year, the last fatal dam failure in the U.S. occurred on the Hawaiian island of Kauai in 2006.

An earthen wall of the Kaloko Reservoir collapsed during heavy rains and sent a wave of water rushing down a hillside. Seven people—including a pregnant woman—were killed on Bruce Fehring’s property, including his daughter, son-in-law and grandson.

Fehring, who wasn’t there at the time, got a phone call from a neighbor saying something terrible had happened. He was shocked by the scene.

“It took a while to register, and I went, ‘Oh my God, everything’s been washed away,'” Fehring recalled. “I mean, you have no idea the power of water (until) you see what it can do in a very short amount of time.”

Dam owner James Pflueger pleaded no contest to felony reckless endangerment and was sentenced to seven months of confinement and five years of probation. His property company pleaded no contest to seven counts of manslaughter. Prosecutors said Pflueger had filled in the dam’s spillway while attempting to make space for a waterfront development.

The victims’ families and those whose property was damaged, including actress Bette Midler, agreed to a $25 million civil settlement. Though categorized by the state as low hazard at the time it failed, Kaloko Reservoir is now listed as a high-hazard facility in poor condition . It remains largely unrepaired.

That’s also the case with Lake Dunlap Dam, northeast of San Antonio. On a sunny morning in May, one of the 91-year-old dam’s corroded spillway gates suddenly gave way. No one was hurt in the rush of water, but scores of homeowners’ lakeside docks were left high and dry, facing barren swaths of dried lakebed after the river retreated, leaving boats stranded.

The dam was the second hydroelectric facility along the river to fail within the past three years. The Guadalupe-Blanco River Authority responded with plans to drain a chain of four lakes because of concerns their similarly designed spillway gates also could fail.

But after property owners sued, the river authority agreed in September to a temporary injunction delaying the plan for a year. That could allow time to find funding for the estimated $90 million to $210 million to repair the dams.

“This is something that communities and states all across the country are grappling with as we are reckoning with our aging infrastructure,” said Tess Coody-Anders, a homeowner near Lake McQueeney, one of the dams slated to be drained.

“I hope that everyone will recognize that, like in our community, entire economies and ways of life have developed around what started out as a civil engineering project,” she added. “And you can’t take that away.”

Along U.S. Route 385, NE (No. 2)

US 385 enters Nebraska on the Colorado state line northwest of Julesburg, Colorado. Traveling to the northwest through agricultural fields and alongside Lodgepole Creek, the highway passes beneath I-80 just before it enters the small city of Chappell. The highway has a connection to I-80 south of town via Link 25A. Here, the highway meets up with US 30, the Lincoln Highway, running concurrently with it for about 25 miles to the northwest passing through Lodgepole before turning west and passing through the small communities of Sunol and Colton. At the highway approaches Sidney, US 385 breaks off from US 30 and turns north along the east side of Sidney.

After departing Sidney, US 385 travels north as it begins its trek into the vast agricultural fields of the rural Nebraska Panhandle. A couple miles north of Sidney, the highway comes alongside the BNSF Railway which it runs parallel with for the next eighty miles with a few deviations. Continuing north through the small towns of Gurley and Dalton the landscape takes on a bit of change as the highway approaches somewhat rugged terrain as it descends 400 feet (120 m) into the North Platte River Valley. As US 385 approaches the North Platte River it joins up with N-92, the state's longest highway. Here, it takes a westerly turn towards Bridgeport, a town which takes its name from the Camp Clarke Bridge constructed in 1876 three miles to the west.

As the highway approaches Bridgeport from the south it joins up with US 26 to cross the North Platte River. On the south side of town, US 26 continues to the west where it passes Chimney Rock National Historic Site just twelve miles down the road. Continuing north across the river the two highways diverge, with US 26 heading east towards Broadwater and Ogallala while US 385 resumes its northward heading. For a brief few miles the roadway is, again, surrounded by agricultural fields, brought to life with center pivot irrigation north of Bridgeport. The highway transitions into slightly rugged terrain as it climbs back up, 400 feet, out of the valley.

The highway comes to a junction with Link 62A north of Bridgeport. Here, the Heartland Expressway joins US 385 from the west, a high priority corridor between Denver and Rapid City, South Dakota. Just a couple miles after this junction, the highway quickly passes through the unincorporated community of Angora. As the highway continues northeast from here, it enters the western reaches of the Nebraska Sandhills for about fifteen miles before it arrives in Alliance to meet up with N-2 just west of a large BNSF railyard. Alliance is home to Carhenge, a replica of England's Stonehenge constructed with vintage American automobiles. The concurrent highways leave Alliance to the northwest and after a few miles diverge. US 385 turns to the north, while N-2 continues to the northwest, taking the BNSF railway with it. As US 385 continues north it passes through additional spotty portions of the sandhills as it travels over forty miles without encountering any towns.

South of Chadron the highway passes through Chadron State Park in the Pine Ridge Ranger District of the Nebraska National Forest. This area is part of an escarpment that lies between the Niobrara and White Rivers. Forested buttes, ridges and canyons have been carved into the high tableland. Sharing similarities with the Black Hills, the area is forested with Ponderosa Pine and contains a variation of wildlife such as bighorn sheep, elk, and mule deer, which are not common elsewhere in the state. The highway then enters Chadron where it joins US 20 along the west side of the city. It runs concurrently with US 20 to the west for two miles before departing to the north. US 385 then passes the Chadron Municipal Airport before turning to the northwest where it reaches the South Dakota state line. From there it continues north into the Black Hills towards Deadwood, South Dakota.

The Dumbest Laws in Each of the 50 States

In recent weeks, we’ve seen 5-year-olds fined for selling lemonade, pet sitters ticketed for watching cats without a permit, teens handcuffed for selling bottles of water to thirsty people, and efforts to criminalize screen time for kids.

It got us thinking: how many silly, outrageous, and/or superfluous laws are there out there? Here are 50 laws that will make you laugh or scratch your head.

1. Alabama

Women can retain all property they owned prior to marriage in the case of divorce, according to Section 30-4-1 of the Alabama Code. However, this provision does not apply to men.

Alaska

It is legal to turn a picnic table or bench into a boat, but only if it contains all safety precautions like life vests and is registered as a boat, according to the Alaska DMV.

Arizona

It is illegal for a donkey to sleep in a bathtub, according to an Arizona-based law firm.

Arkansas

It is prohibited to pronounce “Arkansas” incorrectly, according to Arkansas Code Title 1-4-105.

California

It is forbidden to eat a frog that passed away during a “frog-jumping contest”, according to Article 2-6883 of California’s fishing and game code.

Colorado

In Aspen, it is illegal to launch a catapult at any building or person, according to Section 15.04.210.

Connecticut

In Meriden, it is illegal for a non-police officer or member of the police department to have a whistle or make the ‘bean police call’ on a whistle, according to Statute 153-7.

Delaware

In Rehoboth Beach, children can only trick-or-treat on Halloween from 6-8 pm, according to Chapter 193-33. If Halloween falls on a Sunday, children must trick-or-treat on Saturday, October 30 between 6-8 pm.

Florida

Pregnant pigs must be unconfined and be able to roam freely when they are pregnant, according to the Florida Constitution 10.21. Only pigs are designated in the constitution as having these rights.

Georgia

In Athens-Clarke County, a goldfish or any other animal may not be given to someone to entice them to enter a business agreement or game, according to Section 4-1-9.

Hawaii

Hawaii has a law called “Aloha Spirit” that is the coordination of mind and heart within everyone. This allows everyone to emanate happy feelings to one another, according to Statute 5-7.5.

Idaho

In Pocatello, it is illegal not to smile in public, according to a 1948 “smile” ordinance, which was passed to heighten morale after a hard winter, therefore transforming Pocatello into the United States Smile Capital.

Illinois

Those under 21 can drink legally, but only if they’re enrolled in a culinary program, according to Section 3-3.

Indiana

It is illegal to see a hypnotist without a doctor’s note unless you are trying to lose weight or quit smoking, according to Article 20.5-1.

Iowa

The standard size of all boxes used for picking hops has to be precisely 36 inches long, 18 inches wide, and 24 ¼ inches deep, according to Statute 210-14.

Kansas

In Topeka, it is against the law to scream in a haunted house, according to Shawnee County’s Haunted House conduct.

Kentucky

One may not dye a duckling blue and put it up for sale unless more than six are for sale at one time, according to state Statute 436.600.

Louisiana

There is a $500 fine if you instruct a pizza delivery man to deliver a pizza to your friend without them knowing, according to Section 14.68.6.

Maine

In Biddeford, it is illegal to gamble at the airport, according to Section 14-2.

Maryland

In Rockville, swearing is prohibited on sidewalks, streets, and highways, and one can be charged with a misdemeanor for violating the ordinance, according to Section 13-53.

Massachusetts

In Massachusetts, shooting ranges are not allowed to have targets that are shaped like humans, according to Part 1, Title XX, Chapter 140, Section 131.

Michigan

Every year in Michigan, the last Sunday in June will be known as “Log Cabin Day”, according to Act 60, Section 435.241.

Minnesota

It is illegal to grease up a pig to create a game if the aim of the game is to capture it again, according to Statute 343.36.

Mississippi

If a woman gives birth to two illegitimate children, at the same time or separately, she could go to jail for 30-90 days, according to Mississippi Code Title 97-29-11.

Missouri

Removing mattress tags or bringing an unlabeled mattress into the state is illegal in Missouri, according to Statute 421.007.1.

Montana

In Billings, Montana, residents are legally forbidden from raising pet rats, according to Section 4-301. However, if the rats are used as reptile or bird food, the practice is legal.

Nebraska

In Nebraska, persons with STDs cannot marry legally, according to Chapter 42, Section 102.

Nevada

In Reno, it is illegal to lie down on a public sidewalk, according to Section 8.12.015.

New Hampshire

In New Hampshire, it is illegal to pick up and collect seaweed off the beach during night hours, according to Title XVIII, Chapter 207:1.

New Jersey

Wearing a bullet-proof vest while murdering, kidnapping, robbing, or raping is illegal in New Jersey, according to S170.

New Mexico

In New Mexico, it is criminal – a petty misdemeanor, specifically – to misuse the national anthem or the state anthem, according to Section 30-21-5.

New York

If you’re a mayor of a New York village, you are not allowed to move the remains of a deceased person from an unused cemetery unless you are moving them to another resting place in the same county, according to Statute 15-1508.

North Carolina

It is prohibited to use a secret handshake to agree to or do illegal things, according to Statute 14-12.4.

North Dakota

It is illegal to attempt or perform human cloning, according to Statute 12.1-39-02.

Ohio

If a person coughs on another person while riding public transportation, the cougher can be arrested for a minor misdemeanor, according to Statute 2917.41.

Oklahoma

In Oklahoma, it is illegal to participate in horse tripping in any way, shape, or form. The offense comes with a punishment of a $2,000 fine or one year in jail, according to Statute 21-1700.

Oregon

In Oregon, farmers can be unknowingly committing a crime if they are driving on the highway with too much hay, according to Statute 164.815.

Pennsylvania

If you’ve ever been convicted of a felony and you happen to be in Pennsylvania, you’re not allowed to run a bingo game, according to Act 92.

Rhode Island

It is illegal to use a shopping cart at any other place except for the business labeled on the cart, according to Statute 11-41.1-2. This law also applies to dairy cases, egg baskets, bakery boxes, etc.

South Carolina

It is illegal for anyone under the age of 18 to play pinball, according to Statute 63-19-20.

South Dakota

It is unlawful to cause static electricity in the city of Huron, according to Chapter 9.32.010.

Tennessee

It is illegal to share your passwords to any entertainment subscription service (i.e. Netflix, Hulu, HBO), according to Tennessee House Bill 1783.

Texas

An atheist in the Lone Star State cannot hold any public office, according to the Texas Constitution, Article 1, Sec. 4.

Utah

In Ogden, it is legal for animal control or law enforcement officers to have sex with animals, according to Ordinance 13-3-2.Whether the practice is open to the average citizen is unclear.

Vermont

It is illegal to dress one’s horse up in a disguise and to disguise it as something other than a horse, according to Statute 13-047.

Virginia

In Virginia, cussing at another person is prohibited by law, according to Code of Virginia 18.2-416.

Washington

In Washington, it is illegal to go out in public if you have a cold, according to RCW 70.54.050.

West Virginia

In West Virginia, it is illegal to hunt any kind of wild animal by using a ferret, according to WV Code 20-2-5.

Wisconsin

It is illegal to serve margarine in restaurants in Wisconsin (unless customers specifically ask for it) and in state prisons (with the only exception being medical necessity), according to Chapter 97.18.

Wyoming

In the city of Newcastle, going out in public while cross-dressing is unlawful, according to Sec. 17-14.

To Idaho or Bust. August 6-7, 2020

The only thing that hadn’t been cancelled with this COVID pandemic so far is the Salmon River rafting trip we’d booked last winter. We were at a Music Makes a Difference event, and a favorite duo of ours, Moors and McCumber we’re performing. We’d been introduced to them at a similar event, hosted by my high school pal Bill Zorr a few years before. Not only did we enjoy their performance, we heard about some trips that they a part of with a group of their fans. Bill was supposed to travel to Ireland with them next month for example! But we also learned they were part of a rafting trip deal in Idaho and had two slots left. The dates worked perfectly for our summer plans so we booked it the next day. Combining music with a multi-day River adventure - what’s not to love?

Since our original 2020 plan included climbing Mt Kilimanjaro in Tanzania in September, we were going to spend 10 days this August with our hiking group in Colorado to get some altitude training in. The rafting trip fit perfectly, so we’d planned to drive to Idaho (in our new SUV that hasn’t yet arrived) and then meet the hiking group in Colorado. Since Tanzania has been pushed off until 2021, we also pushed off the Colorado portion of the trip.

The outfitter, Middle Fork River Expeditions, sent assurance of the COVID precautions they’d put into place, so we booked tickets to Boise on Delta Airlines, using the credits from the April trip to Vegas that had been cancelled.

We left Madison for Boise early Thursday morning, with a couple hour stopover in MSP. We hadn’t been there in awhile and walked our usual loops, marveling at the changes in shops and services. Many gates were closed for renovations during this slack time. But it was eerie how empty the place was, knowing how it should have been bustling with travelers on this Thursday morning in August! Jeff looked at me and asked if we were doing the right thing by traveling. Time will tell.

Easy flight to Boise. The plane only seemed to be half full and we got an upgrade to First Class. Picked up our rental Mitsubishi SUV from Enterprise and before I had the Apple Car Play hooked up we were climbing out of Boise. Easy route, but when 120 miles takes 3 hours that tells you we were up and over a few passes on our way to Stanley. Beautiful drive with ok traffic. The scenery reminded me of bicycling through Washington State - dry, with sage brush on one side of the pass, and tall pines on the other. We passed through several large areas that had burned previously. Ugly and scary, yet the rebirth of the forest is beautiful. We arrived in Stanley about 4pm.

I’d checked out Stanley via google map satellite view, and had expected more of a town. We drove right to our hotel, Mountain Village Resort without realizing we’d bypassed the whole town! We checked in, got settled, then headed to the bar/restaurant for dinner. There we found our favorite Deschutes Brewery “Black Butte Porter,” and a yummy looking menu. As has been our experience now in Northern WI and MN, we found the waitstaff are all wearing masks as are most of the clientele except for when they’re eating or drinking. Has become the norm, and I think that’s great.

After dinner, we walked to explore town, and poked around an outfitters shop and scoped out a few different restaurants- looks like some great options. We saw a guy with packs on his bike (Doug), and stopped and chatted with him a bit. He was quite a character- has done a lot of bike touring all over the world. Just a free spirit that kind of goes with the wind, although he is caretaker for his 92 year old father but his brother is on duty this summer.

Town seemed to have more than its share of free spirits, but also several vacationing families, and young and older couples. The summer help seems to be college-aged kids, not necessarily those on the fringe though as most of them are decked out in Lululemon, and other brand name and not cheap sportswear.

There was a band setting up for a street dance, but we were tired so we strolled back to our hotel.

Friday we were up early and dressed to hike, before heading to the Stanley Baking Company in search of breakfast. The morning was cool, but the sun warmed things up quickly. The view of the morning light on the Sawtooth mountains was beautiful, highlighting a few patches of snow remaining in the saddles. The cafe was very popular so it took awhile to order, but we each had an oatmeal pancake, egg and bacon. And it was so yummy! While we waited, we studied the hiking maps we’d collected last night and chose a trail over the 20+ options within a 20 minute drive.

We’d heard Redfish Lake was beautiful, but the number of people recommending it told us it might be crowded, so we opted for the Alice Lake trail. We turned off Highway 75 and drove two miles down a dusty gravel road. We were surprised to find a full campground and jam packed trailhead parking at the end of the road! We found a spot and hit the trail, a little dismayed by the number of people at first. We saw as many hiking out as in ... most with full packs backpacking for multiple days. We walked along the shore of the gorgeous alpine green Pettit Lake. It was as smooth as glass and reflected the surrounding mountain.

We didn’t get started until 10am, and after about two miles, we realized we hadn’t seen anyone in awhile, and although we were following a trail (or trails), we later learned that we’d missed the river crossing ... confirmed when the official trail crossed back and became wide again. Our bivouacking portion was fun, scrambling over boulder fields, climbing over or ducking under fallen trees, but it slowed us down. We started doing the math and realized we didn’t have time to do the whole 12-mile out and back to Alice Lake. We climbed a few switchbacks and reached 7700 ft elevation and had a great view before we turned back. This time we crossed the creek and made much better time on the way back. Beautiful day and we felt great!

Back in the car, we decided to check out Redfish Lake on our way back. It was a zoo! Not much social distancing going on - crowded beach, lots of boats on the lake. Messed with our mojo and we couldn’t get out of there fast enough! We drove back to Stanley and it seemed a little crazy too - August Friday afternoon traffic jam.

Back to our hotel for shower and nap, before walking back to town for dinner. We had an awesome and relaxing meal on the patio of the Stanley Supper Club.

At 8:30pm we drove to the Middle Fork River Expedition warehouse to meet our guide and fellow travelers. Seems like a great group and we’re excited to get going in the morning! They gave us our waterproof bags to pack our gear, so we headed back to do that. Ample space in the bag - should have brought my pillow!

Mattress Firm plans to close up to 700 stores as part of its Chapter 11 bankruptcy, including more than 200 within days.

The nation’s largest mattress retailer said in a court filing that it will not conduct typical liquidation sales, where customers might otherwise score a going-out-of-business deal.

Instead, it will transfer mattresses to other stores, warehouses or distribution centers, or could “decide to abandon” showroom products altogether, according to a court filing.

After a major acquisition spree in recent years, the chain has 3,230 company-owned stores and another 125 franchised locations. It has nearly 10,000 employees.

The company expects to stay in business despite significant challenges, including sales declines and competition from bed-in-a-box online sellers like Casper and Leesa.

Here’s the list of 208 Mattress Firm stores expected to close within days and be vacated entirely by the end of the month, according to court filings:

Mattress Firm plans to close up to 700 stores as part of its Chapter 11 bankruptcy, including more than 200 within days.

The nation’s largest mattress retailer said in a court filing that it will not conduct typical liquidation sales, where customers might otherwise score a going-out-of-business deal.

Instead, it will transfer mattresses to other stores, warehouses or distribution centers, or could “decide to abandon” showroom products altogether, according to a court filing.

After a major acquisition spree in recent years, the chain has 3,230 company-owned stores and another 125 franchised locations. It has nearly 10,000 employees.

The company expects to stay in business despite significant challenges, including sales declines and competition from bed-in-a-box online sellers like Casper and Leesa.

Nature, Always with New Fresh Ideas for Those Who Visit by Mark Stevens Via Flickr: This was at a roadside pullout while taking in views along the Colorado State Highway 92 in Gunnison National Forest. The view is looking to the south across nearby ridgelines, crisscrossing the other, and then to distant peaks of the San Juan Mountains. I decided to angle my Nikon SLR camera slightly downward in order to capture a more sweeping view across the nearby landscape. That would bring the distant peaks a little higher into the image and minimize the overcast skies present that morning. I was though able to add some definition to that though using the DxO PhotoLab 4 ClearView Plus tool. Based on a peakfinder iPhone app, the distant peak is Storm King of the San Juan Mountain Range.

This memorial stair climb serves to honor and remember the 343 FDNY firefighters and almost 3,000 Americans who died that day. Here are other events happening Tuesday.

2. Search continues for missing California girl who may be in Denver area California authorities say a missing and endangered 11-year-old girl may be in the Denver metro area. Kaia Fina of San Clemente, California was last seen Thursday night. She was reported missing Friday. Authorities said Monday it is possible that Kaia’s biological mother, Sera Fina, may be with Kaia in a black 2007 BMW X3, with California license plate number 7RRY771.

3. 5-year anniversary of Colorado Floods Tuesday marks the five year anniversary of the 2013 floods that killed several people, swept away neighborhoods and damaged or wiped out hundreds of miles of state highways and bridges. Five years after the devastating floods, many communities continue the rebuilding process.

4. Record heat possible Tuesday Denver will be close to at least tying some record readings for mid-September on Tuesday. The record for Tuesday is 92 degrees, set in 1951, and the predicted high for the day is very close to that mark.

Car Insurance Claim Help? On the 4/7/2011 I was at a set of traffic lights that was (RED) of my way to the shops. As the lights went green I begin to move off slowly as I did another car came from the left of me and tried to turn right as he speed up he crashed into the drivers side of the car. He clearly jumped a red light (Clearly Seen on CCTV). I was in total shock at the time! After he crashed into my car he went to drive off by reversing, I jumped out of my car to stood in his was so he could not drive off the witness behind me called the police while I was stopping his from driving off he started to drive forwards trying to me me out the way. After the driver spoke to the police on the phone, he then gave me his Name, Phone number and Insurance information. The next day I called my insurance company they was vary helpful and I believe the clam would be settled in my favor as I had CCTV of the crash as I had a camera inside of my car and a witness that was behind my car at the time of the crash. After nearly 4Months I have now revived a letter stating that the claim has been closed on a Without Prejudice Basis. When I contacted Aviva to see what the 3rd party has not accepted full liability they said it was dealt with like this as the 3rd party who crashed into me was not responding to and calls or letters that have send him. Aviva did not asked to see the CCTV of the crash and did not take into account the witness statement. WHAT CAN I DOOO??""

Weekly Legislative Roundup 3/23/18

Welcome to the latest edition of NORML’s Weekly Legislative Roundup!

I first want to bring your attention to a key development at the federal level. As a part of the newly proposed appropriations package known as an omnibus bill, a spending restriction upon the Department of Justice from prosecuting state-legal medical marijuana programs will remain in place through the end of September. Known as the Rohrabacher-Blumenauer amendment, it explicitly states that federal funds cannot be used to prevent states from “implementing their own state laws that authorize the use, distribution, possession or cultivation of medical marijuana.”

At the state level, lawmakers in Colorado have formed the first-ever statewide Cannabis Caucus to address issues such as social consumption, product testing, and the use of medical cannabis on public campuses. Indiana Governor Eric Holcomb (R) signed a bill legalizing CBD sales into law. And Ohio regulators started accepting applications from physicians who want to be certified to recommend medical cannabis. Sales are expected to begin this fall.

Also at the state level, legalization bills died in committees in Connecticut and New Hampshire, as did a Maryland bill to let the voters decide on legalization.

At a more local level, voters in Cook County, Illinois — the nation’s second-most-populous county — overwhelmingly approved a marijuana legalization ballot measure. And Denver, Colorado is spending $1.2 million in marijuana tax revenue to repave roads.

End Prohibition: Representatives Tom Garrett (R-VA) and Tulsi Gabbard (D-HI) have introduced bipartisan legislation, HR 1227, to exclude marijuana from the Controlled Substances Act, thus leaving states the authority to regulate the plant how best they see fit.

The “Ending Federal Marijuana Prohibition Act of 2017” eliminates federal criminal penalties for possessing and growing the plant. This legislation gives states the power and flexibility to establish their own marijuana policies free from federal interference.

Maryland

SB 127 would expand the state’s decriminalization law so that the possession of up to one ounce of marijuana is classified as a civil rather than a criminal offense. Under current law, the possession of more than ten grams of marijuana is a criminal misdemeanor, punishable by up to one year in prison and a $1,000 fine.

Update: SB 127 was approved by the Senate on 3/19 by a 36-11 vote. Amendments approved by the Senate includes a provision “prohibiting a driver of a motor vehicle from smoking or consuming marijuana in the passenger area of a motor vehicle on a highway; prohibiting an occupant of a motor vehicle from smoking marijuana in the passenger area of the motor vehicle on a highway.”

SB 127 will be heard by the House Judiciary Committee on 4/3 at 1pm.

Tennessee

Medical Marijuana Senator Sara Kyle (D) and Representative Larry Miller have introduced legislation SB 2320 and HB 2391 seeking to place a ballot initiative before voters with regard to the legalization of medical marijuana.

If passed, these bills would place the following advisory question on the November 2018 ballot: Should the Tennessee legislature approve the use of medical marijuana?

Update: SB 2320 was put on the calendar for The Senate State & Local Government Committee for 3/27/18, and HB 2391 was put on the Local Government subcommittee calendar for 3/28/18.

Medical Marijuana Extracts State Representative Jeremy Faison (R) and State Senator Steve Dickerson (R) have introduced legislation, SB 1710 and HB 1749 to permit qualified patients to possess marijuana-infused oil products, as well as other non-herbal forms of cannabis, from state-licensed dispensaries. Both patients and physicians would be required to participate in a state registry.

Update: HB 1749 is on the Criminal Justice Committee’s calendar for 3/28. The committee has amended the bill significantly to require patients seeking to use medical cannabis to obtain a prescription from a doctor. Because marijuana is categorized as a schedule I controlled substance, it remains unlikely that many physicians would ‘prescribe’ it, even if this legislation was signed into law. Therefore, the proposal’s language ought to be amended to read ‘recommend’ rather than prescribe.

Arizona

Legislation is pending, HB 2064, to permit physicians to recommend cannabis therapy to those struggling with opioid abuse or dependence. It already passed the House earlier this month.

The bill was originally intended only to ban dispensaries from selling edibles in packaging that could be appealing to children, but an amendment to the bill would also add opioid use disorder to the list of medical conditions that can legally be treated with medical marijuana.

Update: HB 2064 was approved by the Senate Commerce and Public Safety Committee on 3/13, and now awaits action from the Rules Committee.

Kansas

Legislation is pending, SB 282, to allow for the possession and retail sale of cannabidiol (CBD) products containing zero percent THC. It was already approved by the Senate unanimously last month.

While such products are often used in other states for therapeutic purposes, under this proposed legislation, Kansas citizens would not need to be a part of a patient registry or be diagnosed with a certain qualifying condition in order to legally possess or purchase CBD products.

Update: SB 282 was approved by the House Health and Human Services Committee on 3/16.

New Hampshire

Legislation is pending, HB 1477, to permit those convicted of past marijuana convictions to seek expungement. It was already approved by the House last month.

If passed, HB 1477 would allow individuals to file a petition with the court requesting that the court annul any past marijuana violations involving the possession of up to ¾ of an ounce of marijuana.

Update: HB 1477 will be heard by the Senate Judiciary Committee on 3/27 at 9:45am in SH room 100.

Alaska

Senator Tom Begich has introduced legislation, SB 184, to seal the convictions of past marijuana possession offenders.

Senate Bill 184 prohibits the release of past records for any marijuana offense that is no longer defined as a crime under state law. The bill’s intent is to reduce barriers to employment for people who have been convicted of low-level marijuana possession crimes that would be legal under today’s laws, and to make it more likely that people convicted of only low-level crimes will become contributing members of society.

Update: SB 184 will be heard by the Senate Judiciary Committee on 3/28 at 1:30 pm in BELTZ 105 (TS Bldg).

Arizona

Republican State Senator Sonny Borrelli has introduced Senate Bill 1420, which seeks to enhance quality testing practices for medical marijuana products. If passed, this bill would improve product testing procedures and requirements, leading to an increase in product quality for patients. After passing the Senate last month, it was heard and passed by the House Military, Veterans and Regulatory Affairs Committee last week.

Update: SB 1420 was heard and then approved by the House Appropriations Committee on 3/21.

Kansas

Legislation is pending, SB 263, to establish a state-licensed industrial hemp research program. It was already passed by the Senate last month, and heard by the House Committee on Agriculture last week.

Update: SB 263 was approved by the House Committee on Agriculture on 3/20. A vote by the full House is expected in the upcoming weeks.

Oklahoma

Democratic Representative Mickey Dollens has introduced HB 2913: The Oklahoma Industrial Hemp Agricultural Pilot Program. If passed, this bill would allow universities to cultivate hemp for research and development purposes.

Update: HB 2913 passed the House by a 92-0 vote on earlier this month, and now awaits action in the Senate Appropriations committee.
