The Lies He Told: Dave Buchansky’s Multitude of Deception and the REAL Reason Mayte Garcia Was Barred from the 2017 Anniversary Celebration
It was something discussed among Prince fans leading up to the 2017 Celebration that marked the one year anniversary of his passing: would Prince's first ex-wife, Mayte Garcia, show up? Would she answer questions about “that book”? And, would she be welcomed by Prince’s family and his other proteges and collaborators?
Two weeks prior to Celebration 2017, Garcia released a tell-all about her marriage to Prince that many saw as a money-making endeavor since she announced the release less than 4 months after his death. Prior to the release of the book, Mayte consented to a series of cover stories for People magazine, most with inflammatory headlines crafted to exploit all the salacious content and scandals possible. Garcia, who actively and proudly promoted these People posts on her Twitter account, would later send her friend to different social media sites to say the magazine, that is part of Time-Warner Books and owned/operated by Hachette Books---Mayte's publisher, blindsided her.  This was only after potential buyers expressed discontent that Prince was being labeled a “pedophile,” and “abuser.” A call placed to the magazine's PR department confirmed for us that Garcia was wholly aware of the different articles and the bylines disseminated publicly, and that she never expressed dissatisfaction at any time. Social media was mostly aghast and the Prince fan community was divided into two camps: pro-Mayte and anti-Book. These events are what fed speculation as to whether she would be in Minneapolis on April 21, 2017.
The truth is known in Minneapolis, according to a source close to the music scene “here, we've always known the truth about Mayte.” However, the public does not. According to that friend of Mayte's---Dave Buchansky, who rock journalist Lonn Friend described as Mayte's professional “tagalong”*, she wasn't going to the Celebration because of threats issued that compromised her safety.  Dave issued a statement shared across social media that said death threats to Mayte and her daughter would not allow her to travel there and that the local law enforcement was being kept abreast of the situation. He issued a similar statement in October 2016 after someone in an audience at an after party following the tribute show threw a bottle of water at her. The claim in April was not only untrue, but many who were instrumental in working the Celebration were unaware of any threats.
This isn’t the first time Dave has fabricated contact with law enforcement in a pathetic attempt to overstate his importance in the world.  He has, in the past, said that he’s reported people to the FBI, to the police, etc., and fictional tales of swat teams with guns seizing upon the homes of people who do not speak with blind adoration for Mayte.  Dave watches way too many episodes of “Law & Order.” Law enforcement does not work that way, it is very procedural. Dave does not have that kind of power. People in the industry do not know who he is unless you say “Prince’s ex-wife’s best friend,” and even then, you get the Mariah Carey, “I don’t know her” response. Essentially, he is duping Mayte’s supporters and stirring them up into a frenzy based on nothing more than his say so.  But such is the case with truly emasculated men.
All it takes is a phone call to these agencies to learn that recently, Dave nor Mayte has filed any such complaint.  Reports are always filed in the state where the victim resides (in Mayte’s case, CA), not where the suspect resides (like Arizona where he claims to have reported someone in October 2016). What one may find is there is are reports on file bearing his name as the offender throughout the country because of his history of harassing people, particularly women, on Mayte’s behalf.  There is proof they exist, along with case numbers and the names of officers and detectives assigned to each case.
If the charges Dave has leveled against people weren't so serious, it would be laughable because “threats on Mayte’s life” is the excuse he continues to use to justify the fact that people who were close to Prince don't like Mayte, not out of jealousy, but because she's not a good person; it's all show. Many on the inside did like her at one time and tried to include her, but her true self revealed a woman with a nasty attitude who allowed Dave to control her and her surroundings using the force of his body weight and not much else.  Some have observed that Dave has little respect for Mayte’s intelligence because if he did think she was a smart woman, he would have followed through in making sure the business affairs she left in his domain were complete and followed the letter of the law starting with the charity’s business in Florida.
Dave did not even file the annual report and $400 fee to the state of Florida to keep her charity in good standing there.  He acquired charitable status in FL for Mayte’s Rescue on December 23, 2014. Florida’s Attorney General dissolved the charity on September 25, 2015 due to this administrative oversight the Vice President of the charity (Dave) should have stayed on top of.  Surely, he will blame this on Anamaria Mendez, who is listed as an “agent”.  It is uncertain as to whether Mendez would defend any blame placed upon her or what her relationship is to Mayte and is she is in good standing with her.  Regardless of who he blames, the IRS invalidates the 501(c)3 status of any nonprofit not in good standing in any state.  So, even though Mayte posted two postcards of filings (and, yes, Mayte, you DO have to file a postcard under $50,000, they just don’t ask for the exact income amount), not being in good standing in Florida could invalidate her federal IRS tax-exempt status upon report, which would make it nearly impossible to register in CA until she cleared all of it up.  If she self-reports this discrepancy, she may just have to pay fines and the matter will go away upon registration in CA with DOJ (see CA DOJ FAQs).  If it is reported by others, she may not get it back without a long and expensive battle. If past behavior is a predictor of future behavior, Mayte, Dave and the rest of her “Get-A-Long Gang” will blame others and point fingers just as they have attempted to do with regards to the Celebration.
The real deal is that Mayte called up Kirk Johnson, whom she affectionately refers to as “Kirky J,” and asked him if she could set up a table to sell and sign her book to Prince fans at the Celebration. “Kirky J” basically told her, in more colorful language, “hell to the no, to the no, no, no!”  Whatever you may want to think about “Kirky J,” he was right in denying her that request.  Mayte wanted to turn the Celebration of Prince's life and music into her own purple paisley party to celebrate the release of her version of reality that doesn’t jive with the version she and Prince shared over the last 20 years.  Furthermore, it really wasn’t the place to peddle her goods. Yes, for the 89 millionth time, we know she was briefly married to Prince (although his marriage to Mani lasted longer; even his friendship with Denise lasted longer than his first marriage), and we know she gave birth to his only child that we are aware of. It does not bear repeating if she’s so confident about her place in the larger story of his life.
Sure some people don’t like Mayte or how she took the opportunity of Prince’s death to profit, but death threats? Perhaps there were, but like with the charity whose CA DOJ registration letter we still have yet to see (IRS 990 postcard is no substitution), we haven’t seen evidence of these threats, nor have we seen proof of the police reports Dave purports were filed. In fact, Dave has spent the last two days slandering various individuals, saying he has screenshots and proof. Again, laughable, but serious.
If he has them, then show them!
Mayte fans should, especially, want him to post them if they are going to the wall to support her and even defame those they have been led to believe have victimized Mayte.  It is not that hard.  Someone who is lying feels they MUST continuously justify the lie, that’s clear sign that the truth is nowhere in sight.  The only person out there running their mouth is Dave. Forget all the double talk, back talk and over talking, Dave needs to stop talking! He’s been talking for years**. Show us the goods or go away! He needs to prove all of his accusations are true otherwise he is guilty of the same libel and defamation he says he is a victim of.  All the charges about Dave can be proven.  Dave has, on a popular Prince fan site, called him abusive, said he knew “for a fact” Prince broke the arm/hand of a former protege from the 80’s he claims to have spoken to (though she never met him or confided in him), said Prince was a drug addict, a drunk, and like Dave himself, a regular ecstacy abuser “for a fact” up through 1996. All of this has been on prince.org for more than a decade under the username “meltedman”.  Dave has even gone so far as to say he and “his boys” scared Prince out of a club because Prince showed up without a bodyguard and argued with Mayte. Really?! Have you ever seen Prince in photos travel without a bodyguard? Follow Dave’s insane logic for a minute: a 5’2” 120 lb. man who couldn’t even go to the mall without being chased was going to a club, at night, by himself and was going to go up against someone as big as Dave? In what realm of “alternative facts” is Dave living in?!
Dave uses lies and excuses to justify the childish and immature behaviors of a grown woman who refuses to take responsibility for her own life and own affairs apart from Dave.  If Dave wasn’t spending all his time obsessing over the goings on in Mayte’s life imagine what he could accomplish for himself in his own life: a career, a marriage, a family and children of his own.  But instead, he runs behind a middle-aged woman too engulfed in her fantasies to handle her own affairs and wastes endless hours, days and years putting out fires he starts (like not registering with CA DOJ, leaking her book) under the guise of being her representative and keeping Mayte helplessly dependent on him for everything---all of this is due to the lies he’s told. For Dave or even Mayte to say she wasn’t invited to the Celebration would be a total embarrassment for them both because it would call into question the validity of her book (see our previous posts that fact check the book’s content) and all she’s ever wanted us to believe (including the foolish notion that Prince was strung out over her until the day he died) is proven to be a figment of her distorted reality; a reality, that if abandoned, may also mean that she abandons her friendship with Dave.  And that is something that he just can’t have.
Show the proof, Dave, or it didn’t happen!
* An excerpt from Lonn Friend’s book, Sweet Demotion
** Among Dave’s lies: he's a lawyer (attended several, but never graduated from college let alone law school), that he worked for Prince at Paisley (Prince didn't want him near his business and didn’t like him).

Mayte Garcia has had to deal with non-stop internet bullying ever since she announced the publication of  The Most Beautiful: My Life with Prince. Not only has Mayte been bullied, but her best friend Dave Buchansky has also been victimized. The main culprit is Aisha K. Staggers (also known as akstaggers on the trash fest forum known as Lipstick Alley). This woman claims to be a journalist and writer but all Mayte’s Crusaders see is a blogger looking for internet fame at Mayte’s expense. Aisha’s latest attempt to discredit Mayte is the Tumblr blog thefunksoldiers.tumblr.com
Aisha can attempt to distance herself from this blog, but there is hard evidence that she is definitely behind this terrible attempt to ruin Mayte’s reputation. It wouldn’t be a surprise if she is also behind the BoycottMayte account on Instagram at http://instagram.com/boycottmayte
In this fake report on May 18th https://thefunksoldiers.tumblr.com/post/160815004256/mayte-garcia-and-best-friendmanager-caught-in, Aisha K. Staggers accuses Mayte and Dave of scamming people with Mayte’s Rescue. Mayte has done extraordinary work with saving numerous homeless animals and has helped to bring joy to many families through animal adoption. Aisha doesn’t provide any evidence to back up her claims and it’s sad that Mayte has had to address this crap on her Facebook page. If any adopters or contributors are unhappy with Mayte’s Rescue they should step forward and speak to Mayte personally, not hide behind their computer screens and spread rumors over the internet. The Twitter account connected to the Tumblr blog is http://twitter.com/@purple_avengers and they have shamefully spent the night tweeting their fake news to a bunch of media outlets. Aisha’s personal Twitter account is http://twitter.com/AishaStaggers. Hopefully Mayte stays strong and continues her selfless mission to find loving homes for these fur babies.

#StayMadDave, Funksoldiers Tumblr Is Here To Stay
Let’s cut to the chase: thefunksoldiers.Tumblr.com is NOT a hate site.  Anyone who reads this and thinks otherwise only needs to look at the sites created by Dave Buchansky, “Dave’s Army,” or Mayte’s Crusaders. We present factual information that has been researched and verified. We do not create lists like they did during the McCarthy-era of people to target for harassment; that would be Dave’s Army.  We don’t tell people to support us by going across social media and plastering people’s private information, that’s Mayte’s Crusaders. Everything that we do, we do it here and only here for everyone to see.  We are not the ones hiding in the shadows. Our page is public and anyone can view it.  We only remove comments that are designed to distract, degrade or malign.
Dave wants us to deactivate the Tumblr because it expresses an opinion rooted in factual, verified information that goes against his own.  So blinded by infatuation, Dave refuses to see that he cannot force us to stop expressing ourselves and exposing the truth. The First Amendment applies to us all and all we are doing here is exercising that right.  Dave has crossed the line with the methods he’s been using to infringe upon our First Amendment rights. The man created an Instagram account one day, sent himself a death threat the next, and by the third deactivated the account.  He rushed to social media with a screenshot of this self-imposed death threat to prove he has been enough of a jackass to warrant threats on his life. His claim was he contacted IG and they deleted this brand new account that no one but Dave happened to see.  I promise we are not making this up because anyone can contact IG tech support at help.instagram.com and ask if that account he screenshot was terminated by them or deactivated by the account holder.  Guess what the answer is when you do?
Dave claims to have reported that “threat” and social media posts, accounts, etc. and that police, FBI and maybe even the Easter Bunny visited these people he claims to have filed reports on.  Yet another fabrication to stir people into a hazy mess of mental uncertainty.  You all can believe him if you want to, or you can do what we did.  Police reports have to be filed where the victim is located. This would mean that Dave knew the full names and locations of those he supposedly reported because his local officers would have to take a criminal report that Dave signed before witnesses stating he was not filing a false report and his local law enforcement would have to contact the law enforcement wherever these fictitious stalkers live, send them a copy of the criminal report and they address the issue according to the law in that area. You can’t just call and say “someone who goes by the screen name Camille on IG lives in Erotic City, go pick them up.” Dave, are you dumb or are you dumb? And how dumb do you think your supporters (re: Mayte’s fans) are? We can say for certain, no contributor of ours was visited by any law enforcement, despite Dave's claims. But call Dave's bluff and see for yourself, it just takes a phone call to verify. Call Dave's local police department 818-756-4800 and ask if he filed any reports. Call the FBI DC office: 855-835-5324, and Los Angeles regional field office at 310-477-6565.
We have been made aware of the endless bullying by Dave, that goes back years. We have at least 500 screenshots from across social media and on Org to show that Dave is not the victim of bullying tactics; Dave is the bully.  People with actual jobs, families and significant others do not have time to make what Dave calls fake posts and conversations. Still, he accuses everyone who disagrees with him of doing so. This degree of desperation on Dave’s part becomes quite comical after a while.  In fact, we at thefunksoliders.tumblr.com aren't very savvy when it comes to technology to even do what Dave suggests and laugh among ourselves whenever he accuses our site of creating fake posts. Some days we even have trouble just getting into our page.
But Dave persists.
If you look at the posts he claims are faked DMs between him and his harassment victims, his personal pictures are there. We know we can get pictures of Prince in the public domain because he was a public figure, but Dave is not. Where would we even get personal pictures of Dave?! Do those even exist?! Researching this article, we learned his tweets and IG are private, so how? HOW, Dave?
If you listen to him, Dave would have you think we’ve been on him "since Prince was on Apollonia " (word to Kanye), but he is not a celebrity, he's not important. He's not even employed.  Yet, he wants people to believe that daily someone cares enough about him to stalk and make fake posts. About him.  And only him. Daily. Boy, please! Mayte doesn't even care about him that much. You don't see her social media accounts going to the wall for Dave. Mayte is all about Mayte and stays being about Mayte, as usual. Donald Trump had a major Twitter faux pas today, yet he hasn’t claimed he was hacked or the tweets were faked by the media because the media and everyone hates him (sound familiar?!). Trump is president, Dave is....well, we don't quite know what he is, but how is it only him? Every day?
Tumblr media
Look, we don't even post daily because we have lives. Those of you who support him have lives, but have you ever noticed how he's on social media all day?! Like ALL day. Have you ever noticed he's always angry and ranting about something?! Dave, are you ever happy?! Does joy even know where you live because it never seems to find you? You always look so disgruntled as if you've spent 7 hours in the same wet adult diaper and every drug store in your vicinity is out of Depends.
Dave does all this because he wants to bully us into silence. We know this. There is nothing in the Constitution that says it is illegal to express an unfavorable opinion about Mayte Garcia. There is, however, the First Amendment that protects our freedom of speech and right to assemble without government interference; government also includes law enforcement. Dave and Co. have defamed the names of several individuals who spoke their minds. He tried to instill fear using threats, blackmail, attempts to get people fired from their jobs, suggested their children shouldn't be in their care, attacked their family members and in private groups encourages people to target certain individuals for harassment.  Yet, he wants everyone to believe we are the evil ones lurking in shadows anonymously bullying him and Mayte. Dave has even gone so far as to threatening to have this page removed and encourage others to report it.
We know the law.
Blogs have the same protection as journalists. As long as we publish the truth, the law and Constitution protects us. Really, people, if what we have posted here was truly libelous and untruthful, Mayte could have used part of that advance she got from her publisher to hire a lawyer and sue us. Such would require the site be shut down. But, she won't because we aren't lying about anything we post and Dave knows this as well. It's why he over explains and overstates his innocence. When you aren’t guilty of a thing and have the truth on your side, you can walk--- in silence, confident that like beautiful music Prince made, the truth shall set you free.
So will we be forced by scare tactics and petitions to shut down? No, we are here to stay, get used to us. Enjoy the video and #StayMadDave.

Mayte et al: We. Told. You. So. - Part 1 - The Facts
For everyone Mayte and Dave wronged, harassed, lied about and betrayed, we offer you divine justice in memory of the one she wronged the most over the last 27 years!
Mayte: We. Told. You. So.
Dave:  We. Told. You. So. (We will be dragging your sloppy behind and spitting out bones in a minute here in Part 2)
Kim: We. Told. You. So. (Since you are fundraising for her, keeping track of donations and reporting them publicly, but not to CA DOJ,  you need to pay close attention to the portion of the letter that talks about penalties for commercial fundraisers because the moment you began doing all this, per CA law you became one - try explaining that to the hubby.)
LyNNette: We. Told. You. So. (You work as pseudo law enforcement, you REALLY need to pay attention to this if you intend to keep your job because someone who doesn’t like you may see this and remember what you’ve posted and contact the State of Tennessee as well as a friend they have at the state legislature there.)
Josh: We. Told. You. So. (Sever ties immediately or Dogumantry is going down, too because if she can’t operate Mayte’s Rescue, she will attempt to fold it into your LLC. If DOJ is watching her, they are watching you, too - guilt by association. And know the eyewear scheme Dave set you up with is dangerous, why do you think he’s on the west coast and owns nothing? Liens, like Dave, are a pain in the behind.)
‘That Bish’ Drue: We. Told. You. So. (Grow a pair, you are just as dirty as the rest and even worse because you not only sell out those who trust you, but you sold your soul.)
Media: We. Told. You. So. (How do you like them apples!?)
Crusaders: We. Told. You. So. (stop wasting your money supporting her lifestyle, instead give to the charities Prince - remember him, the ONLY reason you know who Mayte “Basic Chick” Garcia is - Star Tribune gave a list of 7 charities to donate to in his honor. Notice they listed the charity of one ex-wife and not the other. And don’t say it is hate or favoritism as they’ve interviewed her many times over AFTER his death as well as before. They checked the registration information and it would be unethical to direct people toward that charity when they are unsure about its legality.)
And every other person who talked smack: WE. TOLD. YOU. SO.
Remember when we wrote this:
Mayte’s Rescue is not registered to fund raise in CA. By law, all California charities wishing to fund raise must be registered with State Attorney General. This is a measure designed to protect donors and assure that monies accepted on behalf the charity are not “squandered through fraud or other means.” Furthermore, annual financial disclosures are required and should be turned in. Garcia’s charity has not complied with this statute since it was granted charitable status in 2013. https://oag.ca.gov/charities.
Mayte’s response was a FB Live Feed.
Then we gave a rebuttal because that is what intelligent people do:
For the record, it doesn’t matter how good Mayte Garcia’s intentions are, if she is going to operate as a public charity in the state of California with federal 501©3 tax-exempt status, Mayte Garcia’s rescue is required to operate like any other nonprofit organization. In California, the DOJ provides oversight that protects both the public AND the charity’s governing body (re: Board of Directors) and ensures that monies collected from donations and fundraising activities. Ms. Garcia’s charity presented her Articles of Incorporation to the State Attorney General in 2012 (they are stamped with that date and searchable online). She has a crowdfunding page showing she began raising money in 2012 as well. Even if Mayte collected one nickel, she had up to 4.5 months to register with DOJ. The fact that she didn’t nor did she file an IRS return for her charity in that year (2012) places the fault purely at her feet. The fact that in 7 years she has not complied places the onus squarely on her as the named President of Mayte’s Rescue. Anyone who has ever run a nonprofit knows this and accepts that responsibility. Furthermore, there are organizations that help people who haven’t run a nonprofit learn the laws.
Mayte let her pimp and pet raccoon David Sean “RICO” Buchansky act the fool he was and started attacking people. Dave called them liars, but guess what? You and Mayte:
Tumblr media
The people who were attacked and harassed know that silence is golden. They sat quietly because they know this about the truth: when you live and walk in truth, you run from nothing or no one. Well, Mayte, by her own admission is running. Then, he organized her haters, uh, we mean “crusaders” to attack anyone who they felt owed Mayte their loyalty and frequently used the term “jealous”. But we aren’t running so why would we be jealous?!
Good triumphs over evil every time. You really have to congratulate those who waited quietly because while Dave, Kim, LyNNette and countless other idiots were harassing people in Mayte’s name, the quiet ones were investigating, doing research and organizing themselves around the law.
Well, their efforts paid off because a few weeks after our first post on the charity scam, California DOJ served Mayte with a notice to register behind what Dave called a “fake article”:
Tumblr media
Section 12585 of the CA law as cited in this letter reads:
Uniform Supervision of Trustees for Charitable Purposes Act [12580 - 12599.8] 12585.
(a) Every charitable corporation, unincorporated association, and trustee subject to this article shall file with the Attorney General an initial registration form, under oath, setting forth information and attaching documents prescribed in accordance with rules and regulations of the Attorney General, within 30 days after the corporation, unincorporated association, or trustee initially receives property. A trustee is not required to register as long as the charitable interest in a trust is a future interest, but shall do so within 30 days after any charitable interest in a trust becomes a present interest.
(b) The Attorney General shall adopt rules and regulations as to the contents of the initial registration form and the manner of executing and filing that document or documents.
Property in this manner includes monetary donations per the law. The letter also cites her need to comply with  CA Government code 12586:
Every charitable corporation, unincorporated association, and trustee subject to this article shall, in addition to filing copies of the instruments previously required, file with the Attorney General periodic written reports, under oath, setting forth information as to the nature of the assets held for charitable purposes and the administration thereof by the corporation, unincorporated association, or trustee, in accordance with rules and regulations of the Attorney General.” This is the language in the code the second letter references.
They gave Mayte 30 days to submit the proper documentation. When we saw this back in June, we KNEW then what Mayte was not going to be able to do and how this would all end (again, walking in truth, you can’t be wrong).
We took bets around here on whether Mayte or Dave were going to be bright enough to not just fill out the form they were asked to fill out and send the $25 fee, but to also provide the supporting documentation that if you click on in the link to the form, you will see that they require certain filings like bylaws (which we knew she did not have - thus one reason she was shut down in FL) and filing with the CA tax board. Even after our initial post on this charity scam gave her instructions and information on how to do that.
But rather than do what she should have been doing (re: handling her business like a grown woman), Mayte continue to solicit donations illegally for her charity and went so far as to use Prince in the process. She was using his music, for which she did not seek proper licensing, to use in her hula hoop classes that she repeatedly advertised were for the purpose of funding her charity’s efforts.
Mayte then let Dave out of his cage to start barking at passers by who could only think how pathetic he is to be lying about this. HE was derelict in his duties several years ago in Florida, and he was derelict of his duties in CA. Now having done this a few times, Mayte could possibly have her 501c3 status snatched altogether and when that happens, she won't get it back very easily and everyone around her and working with her better be careful because you will, too, be audited and charged any penalties. Rather than throwing shadelessness at us, you should have read the links we posted in May that outlined exactly what could happen if you did not comply with the law.
But you didn’t because on August 30th, you were given the following status by California DOJ:
Tumblr media
Before one of ye old “Crusaders” even fixes your mouth to say it’s a lie: Here is the website to check her registration status. You can use her Federal EIN (461273161), enter the “charity’s” name (Mayte’s Rescue) or enter the Registration Number Assigned to her Initial Application (CT0251991). Once you get this screen, you can click on the rescue name to the right and see what it is we are about to show you.
Tumblr media
If you look at this screen, it would appear her registration is not up for renewal until 5-15-2018.  However, if you call CA DOJ to confirm (which we do because defamation can get you sued), they will tell you this is renewal date only refers to the Registration Number which was issued on 8-30-2017, as we will show you in a moment).
Notice the Confirmation of Registration Letter. If you click on it, you will see this:
Tumblr media Tumblr media
CA DOJ states that they did assign her a registration number, but that she is delinquent in filing all of the paperwork they initially asked for on 6-1-2017.
But pay attention to the code they cite:
CALIFORNIA CODE OF REGULATIONS TITLE 11. DIVISION 1. CHAPTER 4. REGULATIONS ADOPTED PURSUANT TO THE SUPERVISION OF TRUSTEES AND FUNDRAISERS FOR CHARITABLE PURPOSES ACT § 300. Initial Registration (b).
This statute reads:
(b) An Initial Registration Form and supplemental documents identified in that form shall be submitted to the Registry of Charitable Trusts. The Initial Registration Form shall require the following:
Name of the organization (the name must be the legal name as stated in the organization’s organizing instrument);
Official mailing address of the organization;
Federal employer identification number from the Internal Revenue Service;
Federal employer identification group exemption number from the Internal Revenue Service (if applicable);
If the organization is a corporation, the corporate or organization number from the Secretary of State. If the organization is unincorporated, the organization number assigned by the Franchise Tax Board upon application for California tax exemption;
Names, addresses, and positions of all trustees or directors and officers;
Attach or provide a statement fully describing the primary activity of the organization. (A copy of the material submitted with the application for federal or state tax exemption will normally provide this information.);
If the organization is based outside of California, comment fully on the extent of activities in California and how the California activities relate to total activities. In addition, list all funds, property, and other assets held or expected to be held in California. Indicate whether you are monitored in your home state and, if so, by whom;
If assets (funds, property, etc.) have been received, enter the date first received.
Mayte did not turn in bylaws because she doesn’t have any, as we said months ago. They also said that between June 1st and August 30th, Mayte never turned in her IRS filings to DOJ. Now follow us for a moment. Remember back in the first video when Mayte said she would show proof to the Cult of Crusaders? She showed them this:
Tumblr media
Mayte could post her 990 e-cards to Facebook, but could not send them to CA DOJ between June 1st and August 30th?! So she could show it to the crazies, sorry, “crusaders” (we just can’t seem to get that right today), but failed to show the state regulating body in order to protect a scam she loves so much?! And just for the people who may say she was busy “rescuing” dogs, then fine, what was her excuse for not asking Dave? Not like he was doing anything but sitting at home in his drawers on his computer harassing folks making fake pages, profiles and accounts, hacking stuff.  If they were really about business, they would have handled business. But, we are talking about some of the silliest criminals and they aren’t too bright. But, please, let’s continue through this journey into the truth.
Of note is the fact that DOJ also sent Mayte a 1st delinquency notice. You may think that it just a follow up requesting the things that were asked in the Confirmation Letter. However, it is a whole different letter citing different laws her organization is not complying with:
Tumblr media Tumblr media
Not only is she delinquent in paying her annual filing fee, this charity she implored people to believe was legit did not file one for 2012, 2013, 2014, 2015, or 2016. What’s even more ridiculous is that she had until May of 2017 to pay the 2016 fee and file that paperwork. But failed to do so and still hasn’t in 9 months since the filing year ended on 12-31-2016. Along with the fee one has to submit the reporting form and she is delinquent on that as well.
To add insult to injury, Mayte also has not turned in her federal tax forms from 2012-2016 to California, which is required to be a legit registered charity. She posted two on Facebook, so you know she had them. She also could have down loaded copies from the IRS site as anyone in the public domain can for any 501(c)3. It doesn’t require much talent or skill, she could have trained Dave to do it, after all, she trained him to sit, take orders, surrender his manhood (more on that in Part 2). But she didn’t do it because she doesn’t have a filing for 2012. See, Mayte began collecting donations in 2012 (you can go to her Facebook page and see). She and her sister were both soliciting donations and holding auctions for what Mayte called her charity. The IRS only shows she has been filing since 2013 returns were due. She never reported any of the donations she received in 2012 to anyone, but told fans they were a “charity.”
Also, Mayte’s filings to the IRS indicate that the “charity” made less than $50,000. In 2014, she had a yard sale she discussed on TMZ If you look at the first week she was on the NY Times Bestsellers and her second/last week, in order to be at the position she was at the first week, she had to sell at least 30K books that week and about as many the second. Remember that her publisher stated that a dollar from each book sale would go to her “charity”. So in those two weeks alone she exceeded what she told the federal government in her 2016 990 e-card she took in which is also illegal in a BIG way!
Tumblr media
The above post is BS when Mayte was on TMZ in April 2014 saying from a 2-day garage sale of all things Prince, she made $15,000. So how is it between 2012-2016 she ONLY made $22,000? So that means in that 4 year period, once you subtract the $15,000 she made in 2014 for the one garage sale she only made $7,000? How is this possible when she was selling place settings from her wedding China before and after that for $3,000-$7,000 a pop?! If you donated to her in this period, you need to start talking to other donors because something is amiss in her accounting.
Now, while the fact that the letter states that if she does not do comply and file those returns she will lose her CA tax-exempt status and/or be assessed fees and penalties per the law, Mayte and ANYONE who ever was named an officer (Dave, her mother, Drue, Josh, her aunt Anamaria Mendez) and anyone who acted as a fundraising entity (Kim) over these last 5 years will also be held liable for the fines and penalties.
But that is not the worst part. On page 2 of this letter from the state finding her delinquent, they told her to stop soliciting donations IMMEDIATELY in bold print:
A delinquent organization may not engage in any activity for which registration is required, including solicitation of charitable assets.
How does Mayte respond? She does 3 things:
1. She announces she is fleeing to Vegas (she announced this two weeks prior to receiving the delinquency notices, but clearly she knew her time was running out on something, but no one really knew why she was running. She has no facility, just a mailbox where people are sending donations. This violates additional laws by the U.S. Postal Service (one of the things the Feds used to take Al Capone down in addition to tax fraud - makes you go hmmmm, doesn’t it?!):
Per 940. 18 U.S.C. Section 1341—Elements of Mail Fraud:
There are two elements in mail fraud: (1) having devised or intending to devise a scheme to defraud (or to perform specified fraudulent acts), and (2) use of the mail for the purpose of executing, or attempting to execute, the scheme (or specified fraudulent acts)."  Raising money for a charity in in a state that requires state registration when you have NO facility and were told by another state to stop doing so constitutes mail fraud.
Per the U.S. Postal Service the penalties for such fraud are:
Scam artists who use the U.S. Mail to misrepresent charities may be prosecuted under the mail fraud statute, Title 18, USC 1341. The penalty is a fine or up to five years imprisonment, or both -- unless a financial institution is affected, in which case the fine may be raised to $1 million and imprisonment may ordered for up to 30 years, or both.
2. She announces more hula hoop classes for which she specifically says they are raising money for her charity AND she has them in states and D.C. where she is required to register to fundraise even for a one-off event.
Tumblr media Tumblr media Tumblr media
If this wasn’t enough, Mayte is going back to LA to raise money for her charity after CA specifically told her not to solicit donations there.
Tumblr media
Mayte even changed the rules for her hula hooping to read no reciepts will be given:
On behalf of Mayte's Bellydance Hope you are getting ready to shimmy, sweat and smile with Mayte ! Attendees will be permitted into the studio where you will have to check in at the merchandise desk. After check-in we will be having a reception where you can purchase hip scarves, shirts and other Mayte related items of which portions of the proceeds will go towards Mayte’s Rescue. We accept cash and all major credit cards. There will be no after class reception as we have to get to our next city so we will leave right after class. Children under the age of 13 do not have to purchase a ticket to watch the class, they only have to purchase a ticket if they participate. They also must not be obstructive to the class. Any children that obstruct the class will be asked to wait in the waiting area outside of the studio. Also, no pictures or video will be allowed to be taken by anyone observing. All bags are subject to search. This is due to safety reasons, for the safety of students and Mayte. We reserve the right to refuse admission without reason. If you are refused and you had paid for a ticket, you will be refunded. Refusal is done at our discretion. As soon as class ends, you must depart the studio as we have to vacate the studio at a specific time. Now that we got that out of the way….lets all have some fun and get ready to Shimmy, Sweat and Smile!! Looking forward to seeing everyone ! Mayte’s Bellydance
Well, the IRS will tell you that a charity event that will not give you a receipt on site is suspicious and that you probably shouldn’t be donating to them. They tell people to be wary of the “Dirty Dozen” types of tax scams to include those that will take cash donations and not give receipts and those that run donation scams during natural disasters and crises:
Be wary of charities with names that are similar to familiar or nationally known organizations. Some phony charities use names or websites that sound or look like those of respected, legitimate organizations. IRS.gov has a search feature, Exempt Organizations Select Check, which allows people to find legitimate, qualified charities to which donations may be tax-deductible.
Legitimate charities will provide their Employer Identification Numbers (EIN), if requested, which can be used to verify their legitimacy through EO Select Check. It is advisable to double check using a charity's EIN.
Don’t give out personal financial information, such as Social Security numbers or passwords, to anyone who solicits a contribution. Scam artists may use this information to steal identities and money from victims. Donors often use credit cards to make donations. Be cautious when disclosing credit card numbers. Confirm that those soliciting a donation are calling from a legitimate charity.
Don’t give or send cash. For security and tax record purposes, contribute by check or credit card or another way that provides documentation of the gift.
Mayte admits she was hoarding dogs and that is the reason she had to shut her facility down here.
Furthermore, her website is still soliciting donations even without a facility. She is asking people for money to not do the work she says they are doing. But don’t let us tell you. Let Mayte tell it (re: lie) to you herself:
youtube
*** For the record, we have never challenged Mayte’s IRS status. The IRS ONLY gives her the ability to allow people who donate to her “charity” the ability to use their donations as a deduction and allows her to not have to pay federal taxes on any income to the “charity” derived from donations or charitable assets (which donations are considered). Mayte will try to get slick and say she’s legit because she has that designation letter. The IRS has a clear distinction between what 501(c)3 status is versus Non-profit status:
Nonprofit status is a state law concept. Nonprofit status may make an organization eligible for certain benefits, such as state sales, property and income tax exemptions. Although most federal tax-exempt organizations are nonprofit organizations, organizing as a nonprofit organization at the state level does not automatically grant the organization exemption from federal income tax. To qualify as exempt from federal income tax, an organization must meet requirements set forth in the Internal Revenue Code.
This means that even though Mayte has federal status, it does not exempt her from fulfilling the requirements states have for fundraising. She can have her federal status (which isn’t difficult to get) and still not be able to fundraise. Unfortunately for Mayte, who doesn’t seem to understand the separation of powers in states, there are very few states where you don’t have to register. A law firm that represents nonprofits will give you a state by state break down of filing requirements.  There are 37 states that have these requirements have fines and penalties they assess for failure to comply:
There are 9 states that do not require charitable registration: Delaware, Iowa, Idaho, Indiana, Montana, Nebraska, South Dakota, Vermont & Wyoming. Texas has limited registration requirements that are only applicable to law enforcement, public safety and veterans organizations. Arizona requires charitable veterans organizations to register if they are solictiging money or other support in the state. Finally, Louisiana only requires registration if a charity engages paid, professional solicitors to fundraise in their state, while Missouri exempts 501c3, 501c7 and 501c8 organizations, upon application.
They will also report her to the IRS who could revoke her status. Mayte is trying to skirt the law and lying to her “fans” to make that happen. Mayte resist the urge to blame us and address us because your own posts and videos are getting you in deeper. Just. Be. Silent. Blaming us won’t change the fact you screwed up. It is time you start taking responsibility for yourself. You blame everyone else when the fault is yours.
Don’t forget to read Part 2
**** UPDATE
Don’t think Mayte has done any damage to Prince’s legacy?! When his fans start turning against him and turning to her, a woman who hasn’t done much of anything after he fired (re: divorced) her, take that as proof positive, she has:
Tumblr media
If Mayte wanted to be more, she could have left. She didn’t. She made a conscious, adult choice to stay. HE left her. Her no-talent friends, the Kardashians, have built a multi-million empire by being famous for being famous. That’s it, no talent, no skills! Mayte couldn’t ask for tips?! She never planned on being more and she still doesn’t. Proof: petitioning the estate of a man she had been divorced from for more than 18 years for a pension is as tacky as announcing a book less than 4 months after he died. She’s stays all about the money!

In Their Own Words: A Couple Unmasks The Truth Behind Mayte's Rescue
We are committed to giving a voice to all those who wish to share with our readers truthful experiences. Here is one such story told, in their own words:
What happens when you confront Mayte Garcia?
Like me, you're bullied, told you are never allowed to have any affiliation with her or the rescue ever again! You're promised reimbursement for transportation they were supposed to provide as a convenience, only when physical proof you have handed the dog over to a complete stranger.  You are spoken to, by her and her staff, rudely and so condescendingly, you feel like a child, yet your only problem is that a dog, you were not expected to be taking home, began destroying you space and property.  However, when you speak to staff about that issue, you are, in turn, told by her highly trained staff, to smack the dog very hard on the nose, since that is one of the most sensitive parts in their body, and that will get your point across!
Mayte does not make any attempt to communicate with you directly, only thru Josh or Drue. They are her minion messengers. When you have to drive 4 hours to pick up a foster, because unlike Mayte states, they do not provide transportation if they don't feel like it; only when and if convenient for them.  Yet, when get there, and Mayte herself is not there to greet you, of course, because she is too busy at home giving orders via cell phone to Josh, and find that you only have 3 dogs available to choose from because 4 of them are set to go to the adoption event and 4 to 5 others were supposedly taken to the vet. This leaves you with a dog that is food aggressive, one with mange, or one that Josh has had for several months.
When asked about others dogs, one in particular we had asked about before--- that had actually ended up being adopted then being returned within the same week because the adopters went out of the country, Josh had to call boss lady Mayte to ask permission about us taking that dog. I don't know what she actually said to him, but we were told some lame reason why we only had those 3 to choose from. After our 4 hour drive to retrieve a foster, because as Mayte did not provide the transportation she promised, we were rushed out of the haven house in under 30 minutes!!
When things went sour with the dog, that we had no choice in taking because after driving 4 hours, we were not going to leave without a dog, especially since we were set and ready to foster. We contacted Josh verbally via cellphone to explain issues going on with the dog. The dog had been chewing and destroying personal items in our home, chewing electrical cords, and digging almost 4 feet under our fence trying to get out. Josh seemed surprised stating that she had never done anything like that before and found it hard to believe! Yes, it is hard to believe that an 8 year old, well trained dog would destroy anything!? We were told he would talk to Mayte and get back to us. This is where her true colors came out like I stated in the beginning.
We were belittled and told we were banned forever to ever have anything to do with her, the dogs, and the rescue because we only had the "destructive" dog for a week!! Mind you, when you get a dog from her rescue, you do not sign any paperwork of any kind, no time frame on how long you are asked or expected to foster are discussed, no forms for reimbursement are given to you for money spent on the foster which, by law, if you are a legitimate registered animal rescue, that form is legally required to give to each person fostering. None of the "legal" protocol is done at all.  The dog we had didn't even have a licence or rabies tags on her collar, and we were not given her shot record, which made us nervous since we had three of our own dogs at home.
To summarize my horrible foster experience, Mayte will not reimburse you for any money spent for one of her dogs, they used the dog as ransom, stating until with physical proof of handing the dog over to a complete stranger, you in turn will get reimbursed, but only for an amount Mayte wants to give you. In our case, $70, not the $110 we had to spend on gas to get the dog (when she advertises that she provides transportation), then to drive 4 hours to return the dog back, because they were all unable and unwilling to come get "their" dog.
Oh, by the way, after a week of my husbands repeating attempts at trying to contact Josh about our reimbursement thru PayPal, we were never contacted back, and we never received reimbursement! So buyer beware. Do not do any business with Maytes’ Rescue. She will blow sunshine up your behind and act sweet in front of you, but when something doesn't go her way, watch out!! You will be spoken down to and banished and then they will retaliate against you and throw your name and other personal information all over social media, which by the way, falls under harassment!
Despite the unpleasantness of our experience with Mayte’s Rescue, nothing was ever said by me because I didn't want to blast it all over social media.  Since Mayte’s Rescue Vice President, Dave Buchansky, opened his mouth and spread inciteful posts that harass me and provide my contact information, I feel I am owed to speak about the truth now.  Anyone who wants to know the truth can check across FB and IG. They won't find anything negative we have said about them following our experience!
At thefunksoldiers.tumblr.com, we want to remind Dave that his stated position is Vice President of Mayte’s Rescue, it is on her filing paperwork. This means he is an officer of the organization and subject to the laws with regard to the CA Whistle Blower Act as it pertains to employees (Drue) and Volunteers (any person who fosters for the rescue).  Since Mayte’s Rescue is not a CA registered charity, she has no policies regarding whistle blower protection, therefore, the state law applies.  His online behavior in exposing this former foster’s personal information is intimidation and violates the statute.  He effectively broke the law...but keep talking. All he's doing is making it so her organization does not get its CA DOJ registration approved. Remember, they are watching you and all the other officers of Mayte’s Rescue, Dave.  If Mayte does not get her registration, she cannot raise money in CA, then what will you all do with the rescue?

With Friends Like These: Mighty Mayte and Her (Not So) Merry Minions
Seems it does not pay to not pay Mayte. She’s running around shouting Love God, Love 4 One Another when her love for money is causing a fracturing within the ranks of her “charity” and feeble fan base. In a private chat group convened to discuss all things related to fundraising scams, and fan groups, it seems this collective can now be labeled a board (which also means that if you are harassed by any of these board members, you can report it to the state of CA and the IRS). Mayte has agreed to endorse the “group” that raises the most money for her “charity.”  According to various sources that know a thing or two about running a 501(c)3, such an informal convocation can be deemed a Board of Directors given their frequent meetings and shared objectives: https://www.theguardian.com/society/2009/jul/30/charity-trustee-advice; or at the very least an Advisory Board: https://www.entrepreneur.com/encyclopedia/advisory-boards.
Both are subject to the same code of (behavioral) conduct for members.
Mayte, Dave, and Kim, you have GOT to be more careful about who you piss off, exclude, lie about or hack! Because of your sloppiness and vile treatment of those who were at one time in your corner, you have been infiltrated at every level. You think you have eyes everywhere? The more people you offend, the more evidence of your misdeeds will circulate publicly. Dave, alone, has been sharing information with a few he turns around and bashes on social media all because he assumed it was someone else and doesn’t know they use their the government names when he’s been confiding in them.
David S. Buchansky, Vice President of Mayte’s Rescue, you aren’t fooling anybody with the new IG accounts. Why? Because you go from site to site griping about the same stuff, saying the same things. Enough with the cut and paste, already! Dude, stop obsessing about the size of Prince’s penis, whether he did it to Mayte or not and how. Stop reminding us how you are not getting it because of your obsession with how she got it from Prince at one time.  Stop telling people they are jealous Mayte was married to Prince, a man you both have said was an abusive husband. Who tells other women to be jealous of domestic violence? As a matter of fact, stop lying about Prince being an abusive husband. The man was married twice, had many girlfriends, but over 40 years, the only woman he was supposedly with to call him abusive is Mayte. Makes you wonder if he was abusive (NOT) or if she’s just a liar (YUP). Stop dropping info (like how Mayte tried to sell Prince back his stuff after he sued Nate’s auction house) that only 8 people knew she did, including Prince and his lawyer. Most importantly stop harassing people because as the listed Vice President, you are an officer of the “charity” and you are violating IRS rules that govern 501(c)3 officers as stipulated in IRS Publications 4221, 557, and 581. Further, the California Attorney General has strict rules against this behavior, which isn’t good considering you just filed your paperwork to register Mayte’s Rescue with that office. You can brush up on the law in California here: http://ag.ca.gov/charities/publications/guide_for_charities.pdf.
Tumblr media
Kim, Mayte did you the glorious favor of stating that her belly dancing classes that you worked so hard to help set up and promote are actually fundraisers for Mayte’s Rescue (not that some proceeds would go to the rescue, but that they are FUNDRAISERS for the rescue). Moreover, she defiantly says she’s not stopping (even if it means risking her 501(c)3 status). This means that you will have to register in every state (except Texas as they don’t have that requirement) to host these fundraisers per the law and at the advisement of the IRS: https://www.irs.gov/charities-non-profits/charitable-organizations/charitable-solicitation-state-requirements. If a previously registered charity was hosting on your behalf, no harm, no foul, no registration required. But since you are doing these independently on behalf of your FB group in exchange for Mayte’s undying adoration (and Mayte posted, specifically, they are fundraisers), it might have helped if you did your research, FIRST. Remember a few months ago when someone (who had 20 years experience fundraising for nonprofits, by the way) told you that you, personally, had to register as a fundraiser with each state you planned to host fundraisers in and you laughed and said you didn’t?  We at thefunksoldiers.tumblr.com laughed because we knew THIS was going to come down the pipe.  Now the people you shafted can laugh at you (and that 1988 mullet--- girl, Tommy Lee wants his hairdo from his Mötley Crüe days back).
Tumblr media Tumblr media
Lynette, Brittany, Laura, a shark will eat its own guts. The same way Mayte and Dave swallowed up anyone who was no longer of use to them financially, they will do the same to you with Kim leading the charge. The moment you out-Kim Kim, she’s going to do everything she can behind your back to make sure Mayte sees you as someone she needs to get rid of.  Angel and Stephanie are gone.  Kim did that.  Which one of you do you think is next?!  We know.  Drop us a line if you want to know when and how they are going to oust you, the order this will occur and why.
Oh, and Dave--- one more thing--- because we really want to help you get your self-esteem on track (sort of): you need to keep an eye on Kim.  She’s coming for your slot, bruh, as Mayte’s bestie. We cannot stress this enough: watch your back!  You let the devil in the back door while you were out front harassing anyone who professed a dislike for Mayte. You are busy putting out fires you start because you can’t just tell Mayte YOU want to be the man in her life, so you harass and stalk anyone who doesn’t share your infatuation for Mayte’s mediocrity and you started slipping. Kim--- she caught you slipping and picked up the rescue stuff and ran with it.  Now, she can’t stop running her mouth in private chats, DMs and FB messages about how you are screwing up with the rescue (we have screenshots)! Boy, get your life or Kim will get your friend!
                                                   Besties 4 Life

That’s all for today. Happy Independence Weekend, may the mess of you find yours from “Mighty Mayte!”

Mayte Garcia and Best Friend/Manager Caught In Charity Scam
Details about fees collected, dogs not delivered, shady tax reporting practices and questionable expenses. Read findings and see links:
There is a cost to “foster” regardless of how long the dog remains. That fee is $500, this is non-negotiable. ASPCA, the Humane Society and other pet rescues do not charge such an exorbitant fee to foster a dog. In all cases, those organizations provide the foster family with all pet supplies, food, and veterinary care. Foster families are expected to give their time. If dogs are to be adopted, then a fee of up to $500 is charged and includes all shots, neutering, and administrative tasks associated with the adoption. These costs are industry standard.
Lack of communication exists where potential fosters and adoptive families have paid fees and arranged meeting times, sometimes driving hours, only to find they cannot reach anyone who is scheduled to meet them with the dog they will bring home, nor can they get through by phone or email. Some have lost their fostering fee this way. Donors have said they are unable to get receipts to file with their tax returns or to have on file in case of an audit to show their donation. Many complain the dogs advertised are always unavailable or dogs with costly medical problems that the rescue will not cover are offered in their place.
Mayte's Rescue is not registered to fund raise in CA. By law, all California charities wishing to fund raise must be registered with State Attorney General. This is a measure designed to protect donors and assure that monies accepted on behalf the charity are not “squandered through fraud or other means.” Furthermore, annual financial disclosures are required and should be turned in. Garcia's charity has not complied with this statute since it was granted charitable status in 2013. https://oag.ca.gov/charities.
IRS filings show charity has reported no income between 2013-2015, however various crowd funding sites show substantial amounts of donations. The founder has indicated on her website that fundraising is “ongoing”. The charity appears to only ever have six dogs on hand, though boasts many more on social media and at speaking engagements and adoption events. Many dogs are carted off to the pound, despite having people willing to pay to foster or adopt. It is unknown if these dogs are adopted or put down. However, given limited resources, many pounds are forced to put many animals down.
On at least one occasion a family chose a dog, they were told it was unavailable and to pick another. They did and it was communicated from Mayte that the second dog was going with her to an event versus a loving home. Staff/volunteers have asked businesses who offered a portion of their proceeds to the charity for copies of their tax filings which is not only illegal, but grossly inappropriate and an indication that the financial records maintained therein are nefarious at best or nonexistent. Specific requests were made to Kim Annicchiarico and Dave Buchansky, respectively.
Charity has no bylaws, articles, or annual reports for donors to view on their website as most nonprofits do. A written request for an annual report proved futile and was not issued a response. There are no minutes or scheduled board meetings. It is unclear as to who is on the Board of Directors as documents have listed Garcia's relatives in key leadership positions. However the executive leadership remains the same whether it is in the California records or Florida records, where the Charity first attempted incorporation (which dissolved in 2015): Mayte Garcia, President; Dave Buchansky (Mayte's best friend and self-proclaimed manager), Vice President.
It is said every dime donated goes to the rescue, but there's no accounting to reflect this claim. It is unclear as to who controls the money of it. Some say Mayte, others say her self-proclaimed “manager” Dave Buchansky, who has a history of legal actions taken against him for fraud. Another name that is also suggested as one accountable for the charity's financial records or point of contact is Kim Annicchiarico. Kim is not an official employee of the shelter, but an uber fan who got close to Garcia and has a history of bullying others through social media, adults and children. Rather than pointing to the rescue as the responsible party for delivering receipts for donations made directly to them, Kim will often tell individual donors to contact the several businesses and shops that have committed proceeds from their sales to the rescue for receipts. Not only is this against what is ethical and procedural for any organization receiving tax-exempt status, it also appears a way of releasing the charity from liability by stating an outside, third party is responsible.
Any nonprofit with a handle on their records should be able to pull up a receipt for a specific donation at any given moment. It seems Garcia's charity is always struggling to locate these through others. If foster families are unhappy with the rescue staff and decide to no longer be involved, they can request a refund. However, in the past, refund are met by angry social media rants by the founder. Garcia assures foster families the rescue will cover the cost of food. Few have seen this actually be the case. According to CharityCheck101.org, in documents filed in December 2015, the rescue reported $0 in both income and assets. However, on a few crowd funding websites, it is obvious this is not the case: https://www.gofundme.com/maytesrescue and http://maytesrescue.com/
Dogs are constantly being brought in from Puerto Rico despite the problem of stray dogs needing homes and/or care in   California. http://m.huffpost.com/us/entry/2318416 and http://kmph-kfre.com/news/local/special-report-stray-dogs-in-fresno
Donors have been told their donations would go toward the purchase of a permanent shelter facility. Currently, dogs are sheltered in a residence that has not been zoned for commercial business nor inspected for the purpose of being an animal shelter. The physical address is: 18754 Lemay Street, Reseda, CA and is a 3 bedroom, 2 bathroom house purchased for around $470,000 in 2015. Garcia has maintained that supporters can physically go to the shelter. Some who have attempted to make arrangements to do so have yet to see their requests met. Currently, Josh Reyes, who runs the daily operations, resides there with at least 6 dogs in shelter. https://m.trulia.com/homes/California/Reseda/sold/2312999-18754-Lemay-St-Reseda-CA-91335
It seems Garcia is using her association with the deceased icon as well as her personal tragedy to raise money for a charity that ultimately lines her pockets and pads that of her friend Buchansky who left his position as an eye wear salesman in June 2016. Buchansky, himself, is not unfamiliar with litigation for defrauding the public: http://m.ripoffreport.com/reports/david-buchansky/morganville-new-jersey/david-buchansky-ebay-rip-off-artist-morganville-new-jersey-1130470

Rights, Wrongs, and Receipts: Rebuttal to Mayte Garcia's Facebook Live
Mayte responded to our last post, as did her fans. For the record, it doesn't matter how good Mayte Garcia's intentions are, if she is going to operate as a public charity in the state of California with federal 501(c)3 tax-exempt status, Mayte Garcia's rescue is required to operate like any other nonprofit organization. In California, the DOJ provides oversight that protects both the public AND the charity's governing body (re:Board of Directors) and ensures that monies collected from donations and fundraising activities. Ms. Garcia's charity presented her Articles of Incorporation to the State Attorney General in 2012 (they are stamped with that date and searchable online). She has a crowdfunding page showing she began raising money in 2012 as well. Even if Mayte collected one nickel, she had up to 4.5 months to register with DOJ. The fact that she didn't nor did she file taxes to the IRS that year places the fault purely at her feet. The fact that in 7 years she has not complied places the onus squarely on her as the named President of Mayte's Rescue. Anyone who has ever run a nonprofit knows this and accepts that responsibility. Furthermore, there are organizations that help people who haven't run a nonprofit learn the laws. As for the validity of the article bringing attention to this matter, saying it is "fake" doesn't make it so any more than saying Mayte's Rescue is legit makes it so. The proof is in documents accessible to the public from the IRS and State of California. Ms. Garcia's live defense is not a referendum on this blog, but further illustrates how ill prepared she is to run this rescue without someone at the helm who knows about nonprofit requirements in California. A crisis management team worth their snuff would have told her it was a bad idea. Mayte expected to bully whomever she hoped would show up and allow her followers to do so as well, particularly Dave Buchansky and uber fan, Kim. We are not on the hot seat here and, therefore, did not need to prove anything. We have the facts and law on our side. If Ms. Garcia was adequately prepared, she'd have consulted the checklist for legitimate CA nonprofits and provided proof of each item listed. She did not because she cannot. Posting the IRS 990 postcard doesn't prove you have CA DOJ registration. Basic high school civics: the IRS is federal, CA DOJ is a state agency and these laws vary according to the statutes passed by each governing body (re: legislature).
Tears and sob stories don't work with the government, period. Bureaucrats do not care about feelings. Show your CA paperwork or admit you weren't aware how detailed the process is and attempt to get your organization on track. Ms. Garcia, the future of your rescue depends on you, it's your name attached to it and on the CA Statement of Information, therefore, you bear all legal responsibility. You can blame this site, if it soothes your ego to do so, but that won't change the facts in this situation. Here's a link to help get you started along with some advice and wisdom from the field: form a new Board and come up with some bylaws. You may also consider amending your Articles because as they stand, they protect the rescue in name from liability, but you and all others associated can be sued individually by donors, which may happen considering you mentioned pocketing money in your live feed. That is an absolute violation and could jeopardize your getting DOJ registration. At any rate, here's the link you need:

Fans and Former Proteges Discuss Harassment from Mayte’s Best Friend, Dave Buchansky
A host of Prince fans and several former proteges have been targeted for harassment by Mayte’s friend and self-proclaimed protector, Dave Buchansky.  Buchansky has issued threats across social media, not because Mayte was threatened, but because people have expressed an unfavorable opinion about the release of her memoir, “The Most Beautiful.” Dave has gone on podcasts and other platforms to claim he was the victim, however, there is sufficient documentation to show otherwise. A number of these have been screenshot and saved going back to November.  Buchansky has even set up several fake social media accounts (that are also revealed to be his and also screenshot) where he has impersonated women and people of color to harass and victimize anyone who does not share in his adoration of Mayte Garcia and her book. We will be posting a collection of these later. In the meantime, we ask that anyone who has been harassed by Dave Buchansky to contact us. We will be able to offer you support and hopefully end his internet harassment of Prince’s fan base and friends for good. Remember: we are stronger together!
