I’m tired of my story.
I spent the semester writing and rewriting the synopsis for my class. I just don’t wanna have to do this anymore. I’m 50-something pages into the script, finally getting close to the ending. And all I can think is how crappy everything is turning out because I’m tired of the story, because I can’t seem to balance dialogue and action in a script.
Part of me just wants to print the whole thing and pull my colored pen out and edit the hell out of it. Another part wants to throw it out of my window.

How hyperlinking is different than Downlading?
The CJEU in the Lan Nordhein – Westfalen v Dirk Renckhoff [2018] ECDR 21 case, found that a school pupil who had downloaded a photo from an online travel portal, in order to use it in a school presentation, which was later uploaded to the school website, has acted an act of communication and therefore has infringed the copyrights owner’s rights. Interestingly, if the school pupil had used a hyperlink instead of downloading the photo, the decision would probably be completely different.
Specifically, according to previous Decisions of the Court of Justice, like the C-160 / 15 GS Media v Sanoma [2016] case for instance, users are not acting an act of communication when they use hyperlinks to communicate online copyright protected content, unless the original content is infringing itself and even then, only under the condition that they knew or ought to know the infringing nature of the original content.

There are two conditions any of which can be met, for an act to be considered as an act of communication, under the Section 20(1) SDPA: Either the communication to be done by new technical means or to be communicated to a new public. The court found that no new technical means where used when the photograph was communicated to the school website in comparison to the technical means used in the initial communication of the work. However, it found that there was a communication to a new public, even though the original website had no restrictions on downloading or accessing its content and therefore public targeted was practically every internet user.
A decisive factor which differentiates hyperlinks from this case, is the fact that in hyperlinks the author retains control as to weather the work is communicated to the public. On the contrary, as the course noted: “it is clear that, even if the holder of the copyright decides no longer to communicate his work on the website on which it was initially communicated with his consent, that work would remain available on the website on which it had been newly posted…” – Para 31
Another reason is that if it was found that the author after the first communication of the work to the public had no control over future reposting of it, this “would amount to applying an exhaustion rule to the right of communication.” – Para 33
Most interestingly though, the court, in an attempt to strike a balance between the author’s copyrights and the right to information and communication in the internet, noted that hyperlinks are not considered as an act of communication. Therefore, hyperlinks are considered essential to the sound operation of the Internet, while “the publication on a website …. of a work which was previously communicated on another website with the consent of that copyright holder does not contribute, to the same extent, to that objective.” – Para 40”

As for the protection of copyright in the digital environment, there are two famous cases about the Public Communication right which are C-466/12 Svensson v Retriever Sverige AB[2014] ECDR 9 and Case C-161/17 Land Nordrhein-Westfalen v Dirk Renckhoff [2018] ECDR 21. At first I read these two cases I found it confusing because I think there are lots of commons and leading to different held. Consequently, in this blog I’ll analyse the similarity and difference between the two cases.
First case is about a website, without the authorisation of the copyright holders, provided a hyperlinks to S’s articles. And the second is that a pupil of a school downloaded the photo( photo as shown below) and used it to illustrate a school presentation. Then, the presentation was uploaded to the school website. More succinctly, the first is giving a hyperlink and the other is to download a picture and repost it on another website.

Clearly, the common thing is that the two copyright works can be accessed freely online, which means the two plaintiffs did not use any restrictive measures to prevent anyone from accessing the works, so this may lead to a question “whether a work, which is freely available online, can be communicated to a new public during the process of giving the hyperlinks or reposting on another website”.
However, these two cases have more differences. Firstly, giving hyperlinks means author still has control on his work while reposting the picture is a way that the copyright owner loses control ( by removing the original upload, the picture on another website can still be available online). What’s more, reproducing the photograph and then uploading had “played a decisive role in the communication of that work to a new public”, contrasting with “the lack of any involvement by the administrator of the site on which the clickable link had been inserted”.
A common view saying Svensson case should be applied in the Land Nordrhein case. It may be argued that both copyright works are accessible online without the copyright owner imposing any restriction, every internet users can access to the work so there is no issue of “communicating to the new public”. At first, I agreed with this view, and then with deeper understand, I realized this view has a obvious problem, which is applying an exhaustion rule to the right of communication. This is obviously contrary to the Article 3(3) of the InfoSoc Directive. Author’s right to communication is quite significant which is a opportunity to claim an appropriate reward for the use of work.
As Cheng Lim SAW comment:”We should all be cautious about refering to a work online and it is best to simply supply a hyperlink to it on one’s own website so as to be able to take advantage of the CJEU’s fact-specific Svensson decision. “

It’s so frustrating!
I have three days to finish feature film script or else I don’t graduate. And I know it’s crap. I don’t mean to say ‘oh, I’m dealing with self-doubt and I think that writing is bad, even though it’s probably fine’. I objectivelly know it’s bad. Because I have characters in a scene with barely any actual presence, no balance between dialogue and action - which makes them talking floating heads.
And I don’t know how to fix this. Because after two years of classes, I’ve written everything but a script.
The steps before getting to the script? Well, I don’t really know how to do them either. I can have an idea and plan aroun it the same way I could two years before, when I wasn’t a scriptwriting student.
My planning skills haven’t developed in the least. I still cannot write an argument, which is a basic skill in this market. I can’t write scene descriptions as drafts. And I’m struggling to push through and finish this film.
Because, right now, it feels pointless.
I’ve studied so much about the theory of writing and so little of its practice. A part of me just wants to get it over with, another part wants to throw this script out the window.

There were so many times I wanted to write, but had work to do. Now I have to write, or else the last two years of studying will be for nothing. I know you can't depend on inspiration to get work done, but it's not even that. I'm tired of the story. I spent a semester working on it without any actual script writing. I gave myself two weeks off. About a month ago. I really hope I can sit down and push through to get this done.
