PLAINTIFF’S TRIAL BRIEF

The 14th District Court of Appeals located in Houston — which is the appellate Court with jurisdiction over the trial court in Fort Bend County where this suit is pending, and whose rulings provide mandatory authority for this Court — has specifically addressed the admissibility of the narrative portion of a police report that contains the opinions or conclusions of the investigating officer based on his factual observations, when the officer is not present to testify.

In Ontiveroas v. Lozano, No. 14-05-00294-CV, 2006 WL 1140374, at *4 (Tex. App. Apr. 27, 2006), the Houston Court of Appeals considered an appeal regarding a trial court’s admission of a police report over the Defendant’s objections that

(1) the document was hearsay and

(2) that it contained improperly predicated expert opinions.

The Ontiveroas Court held that because the responding officer

(1) had been at the scene of the collision,

(2) had interviewed witnesses,

(3) had observed the condition of the vehicles, and

(4) had seen the plaintiffs being taken to the hospital by ambulance, his police report containing a narrative describing the collision as “major — truck auto-auto” and his entry of code “ ‘C’ to indicate ‘possible injury’”, were merely his reporting of his factual observations, and did not need to be proved up by expert testimony under Tex. R. Evid. Id. Recognizing that, “It is clear that not every opinion must be provided by an expert to prove reliable or trustworthy,” the Court held that the police officer who had written the report “did not need to be qualified as an expert for his ‘opinions’ to be admissible.” Id.

In considering the admissibility of the narrative portion of the police report in the present case, the Court should be mindful of the controlling precedent provided by Ontiveroas.

II. POLICE REPORT

In his third issue, Ontiveroas argues the trial court erred by allowing the police report into evidence in its entirety because it included opinions the police officer was not qualified to render.

Specifically, Ontiveroas contends the officer's description of the accident as "major-truck-auto-auto" and the officer's notation that both appellees sustained "possible" injuries provided the jury with untrustworthy evidence that tainted their decision.

We review a trial court's decision to admit or exclude evidence for an abuse of discretion.

Horizon/CMS Healthcare Corp. v. Auld, 34 S.W.3d 887, 906 (Tex. 2000).

We will not reverse the trial court's judgment unless an erroneous evidentiary ruling probably caused the rendition of an improper judgment.

Santos v. Comm'n for Lawyer Discipline, 140 S.W.3d 397, 401 (Tex.App.-Houston [14th Dist.] 2004, no pet.).

We review the entire record to determine whether the exclusion or admission of evidence probably resulted in the rendition of an improper judgment. Id.

If there is any legitimate basis to support the trial court's evidentiary ruling, we must uphold the trial court's ruling. Id.

Ontiveroas points this Court to the dissenting opinion in McRae v. Echols to support his argument. 8 S.W.3d 797 (Tex.App.-Waco 2000, pet. denied).

In McRae, a police report was admitted into evidence as an official record. Id. at 802.

Although he was designated as an expert witness, the officer did not testify. Id.

The defendant objected to the report, claiming it contained hearsay and improperly predicated expert opinions. Id. at 799.

The majority concluded the report was admissible even though it contained opinions about the accident's cause because the officer's conclusions were based on a factual investigation, and were trustworthy under Texas Rule of Evidence 803(8). Id. at 800.

The dissent argued that admissibility under the hearsay rule does not excuse inadmissibility under the "700 series" rules of evidence. Id. at 801 (Gray, J., dissenting).

The officer's report in this case is distinguishable from that in McRae.

The opinions contained in this report do not concern accident reconstruction and do not touch on causation or liability, both of which Ontiveroas stipulated to at trial.

Here, the officer was present at the scene of the accident.

He interviewed witnesses, observed the condition of both vehicles, and saw that appellees were being taken to the hospital by ambulance.

By describing the accident as "major-truck-auto-auto" and entering code "C" to indicate "possible injury" for both appellees, he merely reported his factual observations.

It is clear that not every opinion must be provided by an expert to prove reliable or trustworthy. See Tex. Dept. of Public Safety v. Struve, 79 S.W.3d 796, 803 (Tex.App.-Corpus Christi 2002, pet. denied) (admitting police officer's report into evidence and stating officer need not be an expert to give opinion about a person's sobriety when he has observed that person, but stating also that an officer should be qualified as an expert if opinion is based on training and experience).

Evidence on causation or accident reconstruction may need an expert's opinion. See Pilgrim's Pride Corp. v. Smoak, 134 S.W.3d 880, 892 (Tex.App.-Texarkana 2004, pet. denied) (finding hearsay evidence inadmissible because officer not an expert in accident reconstruction); Ter-Vartanyan v. R R Freight, Inc., 111 S.W.3d 779, 781-82 (Tex.App.-Dallas 2003, pet. denied) (discussing police officer's qualifications to give opinion about cause of accident).

But see McRae, 8 S.W.3d at 800 (finding police officer's opinions on causation in report were based on factual investigation).

Here, the police officer did not need to be qualified as an expert for his "opinions" to be admissible.

The trial court committed no error by allowing the report into evidence in its entirety.

Accordingly, Ontiveroas' third issue is overruled.

We assume only for the sake of argument that his notations are opinions.

ACCIDENT REPORT

McRae's first issue asserts that the court erred in admitting a certified copy of an accident report prepared by a peace officer shortly after the accident occurred.  

DPS Officer Thomas Peoples was not called to testify at trial.  

Rather, his written report was offered into evidence “as an official record” without a supporting witness.  

McRae objected that the report was hearsay and contained expert opinions not properly predicated.3

Accident reports are admissible under Rule 803(8) as exceptions to the hearsay rule.   tex.R. Evid. 803(8);  Sciarrilla v. Osborne, 946 S.W.2d 919, 923-24 (Tex.App.-Beaumont 1997, pet. denied);  Carter v. Steere Tank Lines, Inc., 835 S.W.2d 176, 181 (Tex.App.-Amarillo 1992, writ denied) (citing Clement v. Texas Dept. of Public Safety, 726 S.W.2d 579, 581 (Tex.App.-Fort Worth 1986, no writ);  Porter v. Texas Dept. of Public Safety, 712 S.W.2d 263, 265 (Tex.App.-San Antonio 1986, no writ)).  

Rule 803(8) provides for the admissibility of records, reports, statements, or data compilations, in any form, of public offices or agencies setting forth:

(A) the activities of the office or agency;

(B) matters observed pursuant to duty imposed by law as to which matters there was a duty to report, excluding in criminal cases matters observed by police officers and other law enforcement personnel;  or

(C) in civil cases as to any party and in criminal cases as against the state, factual findings resulting from an investigation made pursuant to authority granted by law; unless the sources of information or other circumstances indicate lack of trustworthiness. tex.R. Evid. 803(8).  

There is no evidence to show a lack of trustworthiness.  

Thus, the court did not err in admitting the report on this basis.  

However, having determined the accident report is admissible as an exception to the hearsay rule, we still must determine if the accident report contained expert opinions which should have been excluded.

The report contains a section, “INVESTIGATOR'S NARRATIVE OPINION OF WHAT HAPPENED,” in which Peoples wrote: Unit # 1 and Unit # 2 were traveling south on FR 39.   Unit # 1 [proceeded] to turn left into a private drive as Unit # 2 struck Unit # 1 causing the above mentioned damage.   Unit # 2 also struck a guard rail.

The report further contains a section entitled “FACTORS AND CONDITIONS LISTED ARE THE INVESTIGATOR'S OPINION.”  

Peoples chose item 26, “FAILED TO PASS TO LEFT SAFELY” as a “Unit # 2” factor contributing to the accident.  

The report also has a hand-drawn sketch showing how the collision occurred.  

Thus, the report does contain the officer's opinions regarding causation.

Rule 803(8) is substantively identical to Federal Rule 803(8).  

Compare tex.R. Evid. 803(8) with fed.R.Evid. 803(8).  

The United States Supreme Court in Beech Aircraft Corp. v. Rainey, considered whether the term “factual findings” in Federal Rule 803(8) encompasses “opinions” or “conclusions.”  Beech Aircraft Corp. v. Rainey, 488 U.S. 153, 162, 109 S.Ct. 439, 446, 102 L.Ed.2d 445 (1988).  

The Court interpreted the Rule broadly, noting that it does not state that “factual findings” are admissible, but rather that “reports ․ setting forth ․ factual findings” are admissible.   Id. at 165, 109 S.Ct. at 447.  

The Court went on to hold that “portions of investigatory reports otherwise admissible under Rule 803(8)(C) are not inadmissible merely because they state a conclusion or opinion.  

As long as the conclusion is based on a factual investigation and satisfies the Rule's trustworthiness requirement, it should be admissible along with other portions of the report.”  Id. at 170, 109 S.Ct. at 450.4

We see no reason to distinguish our Rule 803(8) from Federal Rule 803(8).  

The officer's conclusions and opinions stated within the report are based on his factual investigation of the accident.  

As stated earlier, no challenge was made to the trustworthiness of the report.
