Silmy Karim: Revisi UU Imigrasi Untuk Penguatan Pengawasan WNA Dan Perbaikan Pelayanan

JAKARTA - Rancangan Undang-Undang (RUU) tentang Perubahan Ketiga atas UU No. 6 Tahun 2011 tentang Keimigrasian telah disahkan menjadi undang-undang pada Rapat Paripurna DPR RI, Kamis (19/09/2024). Dalam UU Keimigrasian terbaru, terdapat sembilan angka perubahan, salah satunya tentang dokumen perjalanan Republik Indonesia (paspor) yang dapat menjadi bukti kewarganegaraan Indonesia.

Mengacu kepada International Civil Aviation Organization (ICAO), paspor didefinisikan sebagai dokumen yang diterbitkan oleh otoritas berwenang dari suatu negara yang sah untuk perjalanan internasional. Paspor mengidentifikasikan pemegangnya sebagai warga negara dari negara penerbit dan merupakan bukti hak pemegang untuk kembali ke negara tersebut.

Mewakili Presiden Republik Indonesia, Menteri Hukum dan HAM Supratman Andi Agtas dalam Rapat Paripurna menyampaikan, optimalisasi peraturan perundang-undangan perlu dilakukan untuk menjawab kebutuhan masyarakat terkait kepastian hukum, termasuk dalam konteks mobilitas antarnegara. Sementara itu, dari sisi Imigrasi, kompleksnya mobilitas orang antarnegara tersebut memunculkan ancaman dan risiko yang semakin beragam terhadap petugas Imigrasi.

“Dalam perkembangannya, beberapa aspek penguatan yang diperlukan oleh Ditjen Imigrasi yaitu berkaitan dengan perbaikan layanan, perlindungan diri [bagi petugas imigrasi], alasan penolakan orang keluar wilayah Indonesia hingga jangka waktu penangkalan,” ujar Menkumham.

Terkait penangkalan, Direktur Jenderal Imigrasi, Silmy Karim menjelaskan “Jangka waktu penangkalan diperlukan untuk menangkal masuknya WNA bermasalah. Misalnya seorang WNA melakukan kejahatan di Indonesia bisa ditangkal masuk 10 tahun atau bahkan seumur hidup”.

Dalam Undang-Undang Keimigrasian yang baru mengakomodasi perbaikan layanan yang dengan pengaturan masa berlaku izin masuk kembali (multiple entry permit) yang disamakan dengan masa berlaku izin tinggal terbatas (ITAS), atau izin tinggal tetap (ITAP) yang dimiliki orang asing.

“Untuk bisa masuk dan keluar Indonesia secara leluasa, orang asing pemegang ITAS /ITAP juga harus memiliki izin masuk kembali (IMK). Sebelumnya, paling lama izin yang diterbitkan hanya dua tahun, kalau dia [orang asing] punya ITAP lima tahun, dia harus ke kantor imigrasi untuk perpanjang [IMK] setiap habis masa berlaku. Sekarang enggak perlu lagi” tutur Direktur Jenderal Imigrasi, Silmy Karim dalam kesempatan berbeda.

Selain itu, dengan perubahan UU Keimigrasian, seseorang yang sudah selesai menjalani tahap penyidikan dan memasuki tahap tuntutan jaksa dapat dicegah keluar wilayah Indonesia. Perubahan aturan ini menyesuaikan dengan Putusan Mahkamah Konstitusi Nomor 40/PUU-IX/2011.

Di samping itu, UU Keimigrasian terbaru mengakomodasi kebutuhan pejabat Imigrasi, yakni di bidang penegakan hukum, untuk dibekali senjata api. Penggunaan senjata api ini akan diatur secara rinci dalam peraturan menteri.

“Sebelumnya, di tahap pertama pembahasan RUU, kami menjelaskan kepada DPR bahwa sudah ada beberapa kejadian tragis di mana petugas Imigrasi gugur dalam tugas. Saat melakukan pengamanan orang asing, mereka diserang, orang asing tersebut membawa senjata dan petugas tidak dibekali apapun untuk melindungi nyawanya, karena tidak ada aturan yang mengakomodasi hal ini,” jelas Silmy

“Alhamdulillah setelah perjuangan yang luar biasa, kita bisa punya regulasi keimigrasian yang baru, payung hukum baru, yang kita siapkan untuk dapat menjawab tantangan masa kini dan mempersiapkan kita untuk menghadapi masa depan,” tutup Silmy

 General Rules sa Pagbibigay ng first aid:

1. Provider’s safety ang pinakaimportante

2. Gumamit ng pang personal na protective equipment

3. Ipakilala ang sarili at hingin ang consent ng pasyente

5. Wag titigil hanggat wala pa o hindi pa napoprovide ang first aid
