Bushwick, Represent!

If Greenpoint was my happy place, then Bushwick became my safe place.  This wonderful, new apartment served me as refuge while a global pandemic, a nationwide, systemic, anti-racism revolution, its follow up riots and a historical election. Wow. that was a lot to write - even more to take in for just a few months. 

It also invited me to reconnect with my Latino roots, not only due to crazy and loud amateur DJs that drove pass by my house blasting reggaeton, but also thanks to the friendly and charming Spanish speaking people living around: Ecuadorians, Boricuas, Dominicans, Peruvians and Mexicans. Who knew that during the year of the respiratory virus meltdown I would be working for the respiratory industry, helping the Hispanic severe asthma patients living in the US? Quite mind-blowing. Spoiler alert: AstraZeneca, the lab I´m working for is also one of the ones that is crafting a vaccine. Feels very empowering and meaningful, too. 

Let’s not forget the not-so-hidden gentrification spots: tiny corners which specialize in brewing the most delicious espressos like Mixtape, Variety Coffee, Post Factum or L´Imprimiere. Heading early to Maria Hernandez Park to have a Pao de Queijo or an Acai bowl from Pitanga, while people-watching, checking out the dog owners walk their pets, the very flexible Asian neighbors who swear they are exercising, and the bulked up, bouncer-looking-like, fit ones practicing basketball while sneaky squirrels jump around the benches, became a guilty pleasure. 

Even Knickerboker Ave, while is not my favorite place, it has a certain decadent charm early in the morning while being sunbathed by the warm morning sun. The Magic deli which I’ve never been, Mominette and other iconic Bushwick gems found on this avenue, once house of murder and violence, their home. 

Talking about which, I also got locked out here, too. I do not have the bar downstairs to ask for the extra key, but I met a great neighbor who let me crashed his sofa and also got scared the shit out of my pants when two Eastern European fake locksmiths got violent while forcing me to pay them. Luckily, it all ended up fine, but I still need to get either a place or a friend to keep my spare key if I stay there. 

I love walking around Irving and Dekalb avenues. These have more of a hood feeling. And they become much more artistic when getting closer to Morgan Street subway stop. You have all these cute and tiny boutiques, filled by art, crystals, candles, outfits. You can find ruined down restaurants in hidden warehouse which happen to host the most delicious tortillas at Los Hermanos, arepas at Guacuco, sake bars like Mika, curbside drinks such as the ones found by Syndicated, iconic pizza parlors such as Roberta’s or Ops or diversity headquarters and expression corners such as House of Yes or Brooklyn Beer Garden. 

I’m happy to have found places like Self salon, where the express yet legit service make you gorgeous in 50 mins as well as the charm and taste of Bushwick Bakery, a hidden French corner 10 mins away from my place with the most delicious croissants and cappuccinos. 

The best thing about this loud intersection I happen to call home, is the warmth that enters thru its huge windows. Watching the subway coming and going is also quite exciting and a very Newyorker experience. The rooftop, too hot and too cold, hosts a great and complete view of the entire Manhattan skyline. And walking up to the bird chirp while the clouds pass by as a screensaver is also very beautiful. 

The apartment was also witness of the helicopters that flew down to Wyckoff Hospital back in April and the line of 11 police patrols after 8pm when the care-few was in place during June. It also hosted a great housewarming for 10 people in February and kept safe four different friends during the year: Lynnette, Rinat, Belu and Suse. 

Jason, Miruna, Andrei, Bea and Dani also came for dinner, brunch and coffee. And who knew - I guess Belu, since she told me while I was still a bit bummed about moving out from Greenpoint - “you will live beautiful moments in this apartment, too, you´ll see”,  that I would meet this amazing guy during quarantine and share countless aperitivos, dinners, breakfasts, improvised parties, cooking lessons, drinks, desserts and much more PG13 mind-blowing moments. 

Mr. Schneider, you are pretty ok yourself. And Bushwick, you are too.

Short Take: More Time For The Non-Killer?

Garrett Anderson may have been careless, a deadbeat, a Walmart shopper. But did he deserve to be convicted of vehicular homicide and get 15 years, five more than the actual killer?

Anderson of Kennesaw called a locksmith after locking his keys in his car at a Cobb Walmart on May 25, 2014, according to investigators. Anderson told the locksmith, Tansu Kanlica, to follow him to an ATM so he could get the $175 he owed. But then Anderson appeared to try to get away without paying, according to prosecutors, and passed his bank and several ATMs.

During Anderson’s trial, Kanlica testified that Anderson “brake checked” him, and that he swerved left to avoid hitting him, then over-corrected to the right. That’s when Kanlica jumped a curb and struck three teenagers, killing two.

Neither driver stopped. Kanlica had no excuse. Anderson’s excuse was that he didn’t know it happened. After all, he didn’t kill anyone.

“The bottom line was: Nobody could say that Garrett Anderson was even present at the time of the accident that killed these two little girls and injured the third,” Petrey said.

But a jury convicted Anderson of two counts of vehicular homicide, one count of serious injury and one count of aggressive driving. Anderson was 25 when he was sentenced in 2015 to serve 15 years.

With a new attorney, Anderson is trying to have his conviction reversed due to ineffective assistance of counsel. The basis for this contention is unclear, other than the fact that he lost, and the article offers no clue what Anderson’s lawyers did, or failed to do, that gives rise to the hearing. Unlike so many such cases, he had lawyers who had the experience to defend their client.

Anderson’s previous legal team? Two lawyers with a combined 70 years of experience, including former DeKalb County District Attorney J. Tom Morgan and former DeKalb assistant DA John Petrey. Morgan testified Tuesday that his defense, while representing Anderson, was that he was not at fault for the fatal wreck.

There was no claim that it was Anderson whose vehicle struck the teens. The fault arises from the testimony of Kanlica, the locksmith who was certain that he was about to get beat for $175 and wasn’t about to let Anderson get away, who testified that Anderson “break checked” him. Presumably, this means Kanlica was tailgating Anderson, who hit his breaks to get Kanlica to back off, and causing Kanlica to turn away. The chain of events ended with Kanlica running down the teens.

The question isn’t whether Kanlica’s claim smacks of self-serving malarkey, particularly since it served to get his sentence reduced to ten years in exchange for his testifying against Anderson. That was a question for the jury, whether they believed Kanlica. And apparently, they did.

But even so, could Anderson’s “break check” be construed to create a reasonably foreseeable chain reaction that would result in death? Was Kanlica’s tailgating not the more proximate cause of his sudden need to turn to avoid crashing into Anderson’s vehicle?

On the other hand, Anderson is no angel here, having enjoyed the benefit of Kanlica’s lock-smithing skills and then, Walmart shopper that  he is, trying to beat the guy who just helped him out of his fee. As a side note, going to trial as an unsympathetic defendant can give rise to credibility issues.

And yet, with all the ugliness that happened here, the upshot is that Kanlica, who actually ran down and killed the teens, ends up with five fewer years than Anderson, who ran over no one. Even if sufficient fault can be attributed to Anderson to be convicted of the homicides, is his culpability greater than that of Kanlica?

But the gravamen of the hearing isn’t philosophical, but whether Anderson was denied effective assistance of counsel, the one piece of information wholly omitted from the article. There must be enough to the claim to give rise to a hearing, not to mention a courtroom filled with people wearing “Anderson Strong” t-shirts, but as weird as this case may be, but what the basis for the claim may be is a mystery. Losing a close case isn’t lawyer error. It’s trial.
