The most practical reason for this power is the might of the dollar, the world’s reserve currency. The U.S. dollar lies on one side or the other of 88 percent of foreign exchange transactions, which means that the world’s banking networks all home in on America as well. “If you go to an ATM in Bangalore, or anywhere else, it’s very likely that some of those bits of data will, at some point, go through New York,” Jarrett Blanc, a senior fellow in the geo-economics and strategy program at the Carnegie Endowment for International Peace, told me. “And with larger transactions, you’ll have to have recourse to the U.S. in a meaningful way.” Only a few major currencies—those that banks and countries most commonly hold in reserve—can swap into each other without first being exchanged for the dollar. “Maybe you could convert euros into yen without going through the U.S.,” said Blanc. “But dirhams into euros—no. It’s like the financial system is a sewer, and all the pipes run through New York.”

For companies and banks, being banished from the U.S. pipes is a fate akin to death. In 2015, the French bank BNP Paribas paid a penalty of nearly $9 billion for violating U.S. sanctions on Cuba, Sudan and Iran. “And if you look at their plea, they basically said: ‘Yes, we did it. We did it all,’” Biersteker said. (Eventually, BNP Paribas earned a one-year suspension of its U.S. dollar clearing operations through its New York branch for certain lines of business.) Biersteker explained: “Their main focus in negotiating their plea was not the size of the penalty, but the length of time they were afraid they’d be frozen out of the U.S. banking system.”

The gravitational pull that the U.S. exerts over the world’s finances, like a black hole bending space-time, is also the reason it has historically been so difficult to sanction. But it isn’t just finance. Consider, for instance, that Amazon and Microsoft hold nearly half of the cloud storage used by companies and institutions around the world. If American companies came under the kind of sweeping blacklist that applies to Iranian firms, the BBC., Fujitsu, Novartis, Samsung, Maersk, Lufthansa, HSBC., the London Tube and the European Space Agency would all have to find other cloud providers in a hurry.

The U.S. economy is threaded too tightly into everyone’s lives to be unwound easily. Every expert I interviewed began with this caveat; indeed, some couldn’t get far enough past it even to game out speculative situations in which the U.S. finds itself sanctioned by its peers. But others, particularly those in Europe, were eager to play. For all its primacy, Nephew said, the U.S. economy still resembles “a big plate spinning on a tiny axis. It doesn’t necessarily take much to knock you off that axis.”

THERE WAS ONCE A SANCTION that severely wobbled the plate on its axis. In 1973, during the Yom Kippur War, Arab states levied an oil embargo upon America to punish it for arming Israel. The embargo only lasted a few months, and it didn’t stop America from selling arms to Israel. But denying America access to Arab oil caused genuine pain. Cars lined up at gas stations, truckers went on strike and the inflation rate sped upwards. The shock helped to touch off a two-year recession. The U.S. even briefly considered invading Saudi Arabia to restore its supplies of oil.

At the roundtable in Geneva, one speaker argued that the Arab oil embargo remains the best example of surmounting “the classic collective action problem.” Not every country in the world has to unite to constrain the U.S. What made the embargo possible was that a small set of states controlled a commodity that America relied upon, making a sanction easier to coordinate, he said. “So the question becomes: What’s the structural weakness of the U.S. that you need to target, and what’s the coalition of actors that you then need to put together?”

Identifying the pressure points of America’s anatomy isn’t easy. After the 1973 embargo, the U.S. government set about making itself self-sufficient in oil—and has largely succeeded. One potential liability for the U.S. is the enormous financial leverage that China theoretically holds over it, in the form of $1.12 trillion in U.S. securities—more than a quarter of U.S. debt held by foreign governments. Dumping even a portion of that into the market would depress U.S. bond prices, make borrowing costly for Americans, and slow the economy. But China is unlikely to actually use this leverage—the resulting fibrillations in financial markets would pose risks to every country, China included.

Richard Nephew ran through some of the more audacious options for me. (He prefaced this by sticking out his chin and saying: “Obviously I don’t want to be like: ‘Hey, hit us right here!’”) Say the five countries that host the most U.S. direct investment—the Netherlands, the United Kingdom, Luxembourg, Ireland and Canada—enact regulations that prohibit their markets and businesses from accepting funds from American companies and individuals. Domestic banks in these countries would turn away U.S. money that seeks, for example, a stock market to invest in, or a manufacturing plant to buy, or a subsidiary to fund. Say, additionally, that returns on existing investments were not permitted to be sent back to America. The U.S. would lose billions in national income. Using 2013 data, Nephew has calculated that America earned $439 billion from its international investments—a figure larger than all but the 28 biggest economies in the world. “The impact in terms of inflation, employment, housing markets—all that gets serious.”

Or, as with the oil embargo, the U.S. could be denied supplies of other foreign commodities it urgently requires, such as rare earth metals. Roughly 90 percent of the global trade in rare earths is controlled by China, and U.S. companies import around $160 million worth of these elements to use in technology. In May, an editorial in the state-controlled People’s Daily unsubtly noted that by imposing tariffs on Chinese products, the U.S. “risks losing rare earth supply.” And then, ominously: “China has plenty of cards to play.”

One form of sanction against the U.S. has already come in for serious discussion. In late 2017, months after Trump announced his withdrawal from the Paris agreement, a French climate policy analyst was invited to the office of an economic adviser for President Emmanuel Macron. The adviser asked how the EU could impose a carbon border tax upon countries that weren’t meeting their climate change commitments. In this meeting and another one in early 2018, the analyst told me, the adviser presented the government’s own ideas on, for example, what the EU might do with the revenue from such a tax. “This was very much against the Americans, although it wasn’t said in those words,” the analyst said. “They were very enthusiastic. They thought this was a way to rebalance the relationship with the U.S. and uphold the Paris agreement at the same time.” Macron called such a tax “crucial” in a speech two years ago.

Since at least 2003, economists have gamed out how a border carbon tax might work. First, the EU would tighten its cap on emissions, making it more expensive for its own companies to buy or trade carbon permits. It might also introduce a domestic carbon tax on its transport, energy and manufacturing sectors. Then, to keep the playing field of trade level, the European Commission would recommend carbon border taxes on imports manufactured in countries that are reckless about their carbon footprint. At the most immediate level, these taxes could apply to materials such as steel, aluminium or cement, whose production is highly emissions-intensive and whose carbon cost is simple to calculate. The tax could be directed towards countries that impose no carbon prices at all. (Only 46 countries have any kind of national carbon pricing scheme.) Or it could be directed at the only country refusing to abide by the Paris agreement: the United States.

The U.S. would almost certainly lodge a complaint with the WTO, arguing that the tax is discriminatory. But the EU could counter that it is merely extending its domestic climate policy to all imports. It could even reasonably argue that the U.S. is deriving an unfair trade advantage through its irresponsibility. “Not paying the cost of damage to the environment is a subsidy, just as not paying the full costs of workers would be,” Joseph E. Stiglitz, the Nobel-winning economist, wrote in 2006. One of the WTO’s chief functions is to prohibit just these kinds of subsidies.

Brussels has another line of defense as well—one provided by the U.S. itself. In the mid-1990s, the American government banned imports of shrimp from four Asian countries, claiming their harvesting methods were hazardous to endangered sea turtles. The resulting ruling specified that environmental concerns are a legitimate reason to restrict trade. That ruling, Stiglitz wrote, sets a precedent for the imposition of measures like a carbon border tax.

When the Supreme Court hears arguments on Tuesday, the administration’s attempts to end the program protecting “Dreamers” could rest on a top aide’s actions in 2017.

WASHINGTON — When Attorney General Jeff Sessions appeared before news cameras at the Justice Department in early September 2017 to announce that President Trump was ending deportation protections for young undocumented immigrants, he knew the administration had left itself more legally vulnerable than it should have.

At a contentious meeting in the White House Roosevelt Room several days earlier, Elaine C. Duke, then the acting secretary of homeland security, had broken with the rest of Mr. Trump’s team and balked at its demand that she issue a memo ending Deferred Action for Childhood Arrivals, the Obama-era program known as DACA that shields immigrants who were brought to the United States as children.

Ms. Duke was deeply bothered by the idea that she could be responsible for deporting hundreds of thousands of young people from the country they considered their own. And she did not want her name on the policy rationales put forth by Mr. Sessions; Stephen Miller, the president’s powerful immigration adviser; and others who argued that the program encouraged new waves of illegal immigration and was an undeserved amnesty.

She eventually relented under merciless pressure. But her refusal to cite their policy objections to the program is now at the heart of what legal experts say is a major weakness in the government’s case defending the termination of the program, which will be argued on Tuesday at the Supreme Court.

The bare-bones rescission memo by Ms. Duke, a career civil servant who volunteered with an immigrant aid group in her free time, relied solely on an assertion by Mr. Sessions that it was unlawful. Even Mr. Sessions knew that was the thinnest possible rationale, according to several people familiar with his thinking who spoke on the condition of anonymity to reveal private deliberations. If courts disagreed, Mr. Sessions knew, the president would lose.

That is just what happened in lower courts. Judges have ruled that by citing only a flawed legal rationale for ending DACA — and no policy justifications — the administration’s decision was “arbitrary and capricious,” an illegal exercise of presidential power without any legitimate basis to end a program relied on by about 700,000 people. Had the administration simply declared that it was changing direction as a matter of policy, the rulings indicated, the rescission would have been a routine exercise of executive discretion.

Immigrant rights groups suing Mr. Trump have now zeroed in on the refusal by Ms. Duke, who resigned in early 2018 shortly after a permanent secretary was named, as evidence to bolster their defense of the program. Lawyers for the groups say the back story of her memo has shaped the oral arguments they will make to the justices on Tuesday. If they are persuasive, the court could rule against Mr. Trump in June, just as he enters the final stretch of his re-election campaign.

Ms. Duke did not respond to a request for comment.

The case, one of the most important of the Supreme Court’s term, will address presidential power over immigration, a signature issue for Mr. Trump and one that has divided the nation since he took office. The court’s decision could also have an enormous effect on the lives of the young people in the program, who are known as Dreamers and are broadly seen as sympathetic by large majorities in both parties.

To be eligible for DACA status, applicants had to show that they had arrived in the United States before they turned 16 and were no older than 30, had lived in the United States for at least the previous five years, were a high school graduate or a veteran, and had committed no serious crimes. The status lasts for two years, allows recipients to work legally and is renewable, but it does not provide a path to citizenship.

“The human consequences of the Supreme Court ruling against the DACA plaintiffs would be quite severe,” said Janet Napolitano, who as homeland security secretary created the DACA program in 2012. “Now all of a sudden you’d have all of these young people who’d be living in fear that ICE could pick them up at any time,” she said, referring to Immigration and Customs Enforcement, “and also that now they’d be unable to work.”

The decision to end the program in 2017 was the culmination of an intense, seven-month battle inside the White House to win over a conflicted president, according to several administration officials who watched him struggle with the issue.

“Does anybody really want to throw out good, educated and accomplished young people who have jobs, some serving in the military?” he asked in a 2017 Twitter post. Mr. Trump was sympathetic to DACA recipients, but also mindful that failing to end the program started by President Barack Obama would be seen as amnesty — a betrayal — by his anti-immigration supporters.

The day before making the announcement in 2017, the president huddled with Hope Hicks, a close aide at the time, and Mr. Miller in the small dining room off the Oval Office, hesitating about his decision and agonizing over what to say, according to people close to him. He wanted to appear tough to his voters, but he was anxious about being seen as mean to young people.

In the end, the argument that was most persuasive to Mr. Trump was the one made most forcefully by Mr. Sessions: The program was simply against the law. The next day, in his formal announcement ending DACA, the president wrote, “I do not favor punishing children,” but he quickly added that “the program is unlawful and unconstitutional and cannot be successfully defended in court.”

The president’s conflicting impulses are reflected in the administration’s legal arguments, which have a curious feature. In other contexts, the administration has taken an exceptionally broad view of executive authority. But when Mr. Trump sought to end the program in 2017, he said Mr. Obama had lacked the legal authority to create it.

In other words, Mr. Trump said that creating or maintaining the program was beyond the power of any president, no matter how sympathetic the Dreamers might be. Ms. Napolitano said that approach — expressing sympathy while disclaiming the legal authority to address the problem — could doom the administration’s appeals.

“The administration wants it both ways,” she said. “They want to terminate a very beneficial program, but they want the courts to take the heat for it.”

A brief from an unusual coalition of challengers, including the N.A.A.C.P., Microsoft and Princeton University, acknowledged that the Trump administration was free to make a different policy judgment than its predecessor had. But the rescission, the brief said, “was not based on a discretionary policy judgment.”

“Instead,” the brief said, “it was grounded in a legal determination by the attorney general that DACA is unlawful.”

“That approach,” the brief continued, “allowed the administration to tell the public that it could not permissibly maintain DACA, and that Congress and the courts, rather than the president, thus bore responsibility for the rescission’s human consequences. The government must now live with the consequences of claiming that its hands were tied.”

In basing the rationale for rescission on law rather than policy, the administration subjected the move to judicial review, according to the courts that blocked the move after finding its legal reasoning flawed.

Mr. Obama had created the program through executive action in 2012 after Congress refused to pass the Dream Act, which would have given the young immigrants legal status and an eventual path to citizenship. Mr. Obama’s lawyers argued that the program was legal because it relied on the government’s authority to use discretion in deciding whether to pursue deportation against individual immigrants.

The Trump administration argued that the program was an unlawful exercise of authority by the executive branch, relying on a ruling from the United States Court of Appeals for the Fifth Circuit, in New Orleans, concerning a related program. The Supreme Court deadlocked, 4 to 4, in an appeal of that ruling. Judges in the DACA cases said the two programs differed in important ways, undermining the administration’s legal analysis.

Brad Smith, the president of Microsoft, which employs more than 60 DACA recipients, said there were lawful ways to shut down the program.

“Our brief acknowledges very explicitly, based on the issues that we’ve raised, that we’re not suggesting that there would be no basis for a rescission of DACA,” he said. “But if there is going to be a rescission of DACA, it has to be done in the right way and it has to be done for sound reasons.”

The administration, by contrast, has argued that its determination that DACA is unlawful could not be second-guessed by the courts. Last year, the United States Court of Appeals for the Ninth Circuit, in San Francisco, rejected that view.

It acknowledged that presidents have broad powers to alter the policies of earlier administrations but said the legal rationale offered by the Trump administration for rescinding DACA did not withstand scrutiny. The court also questioned “the cruelty and wastefulness of deporting productive young people to countries with which they have no ties.”

A federal judge in Washington, John D. Bates, gave the administration a second opportunity to justify the rescission, and Kirstjen Nielsen, the homeland security secretary at the time, responded with a three-page memorandum. It mostly relied on the earlier rationales in Ms. Duke’s memo, but added one more, about the importance of projecting a message of resolve in light of recent events.

“Considering the fact that tens of thousands of minor aliens have illegally crossed or been smuggled across our border in recent years and then have been released into the country owing to loopholes in our laws — and that pattern continues to occur at unacceptably high levels to the detriment of the immigration system — it is critically important for D.H.S. to project a message,” she wrote, “that leaves no doubt regarding the clear, consistent and transparent enforcement of the immigration laws against all classes and categories of aliens.”

Judge Bates said that justification was “not without its logical difficulties: After all, DACA is available only to those individuals who have lived in the United States since 2007.” He rejected the new rationale, calling it “too little, too late.”

Is It a Crime to Encourage Unauthorized Immigration? The Supreme Court Will Decide

An appeals court struck down a broad 1986 law under the First Amendment, saying it covers conversations between family members and legal advice.

WASHINGTON — A 1986 federal law makes it a crime to “encourage” unauthorized immigrants to come to or stay in the United States.

“The statute potentially criminalizes the simple words — spoken to a son, a wife, a parent, a friend, a neighbor, a co-worker, a student, a client — ‘I encourage you to stay here,’” Judge A. Wallace Tashima wrote last year for a unanimous panel of the United States Court of Appeals for the Ninth Circuit, in San Francisco, in striking down the law.

The law applies to a grandmother urging a grandchild to overstay a visa or a lawyer advising a client to stay in the country while fighting deportation, Judge Tashima wrote. It may cover public officials helping immigrants in sanctuary cities and perhaps even speeches at immigration rallies, he wrote.

Last month, the Supreme Court agreed to decide whether the law can be squared with the First Amendment. The case, United States v. Sineneng-Smith, No. 19-67, is one of several significant immigration matters on the court’s docket. On Tuesday, the court will hear arguments on whether the Trump administration can rescind protections for so-called Dreamers. Later in the term, it will consider whether immigrants can go to court to challenge orders calling for their expedited removal.

The First Amendment case concerns Evelyn Sineneng-Smith, who ran an immigration consulting firm in San Jose, Calif. Her clients, mostly from the Philippines, worked without authorization in the home health care industry. Ms. Sineneng-Smith offered to help them get green cards under a Labor Department certification program that she said would give them permanent resident status and allow them to work legally.

But the program had expired. Ms. Sineneng-Smith nonetheless charged her clients $6,800 to file applications she knew to be futile. She was convicted of mail fraud, a conviction that the Ninth Circuit affirmed and that Ms. Sineneng-Smith is not challenging in the Supreme Court. The question for the justices is whether her separate conviction under the 1986 law for encouraging her clients to stay in the United States was proper.

In the Ninth Circuit, Ms. Sineneng-Smith argued that she had a First Amendment right to file the applications, which was not a particularly strong argument. “Speech integral to criminal conduct,” the Supreme Court has said, is not protected by the First Amendment.

When the case reached the Ninth Circuit, it did something unusual. It asked for briefing on a different First Amendment question. The court wanted to know whether the law was overbroad, chilling the free speech of people other than Ms. Sineneng-Smith.

After getting additional briefs and hearing another round of arguments, the appeals court ruled that the law was unconstitutional.

In urging the Supreme Court to hear its appeal, the Trump administration said the Ninth Circuit had gone too far. The Supreme Court has said that striking down laws because they are too broad is “strong medicine” to be used only when the laws are unconstitutional in a substantial number of real-world settings rather than in “fanciful hypotheticals.”

In his Ninth Circuit opinion, Judge Tashima said that his examples of possible prosecutions “are not some parade of fanciful horribles.”

“Instead,” he wrote, “they represent real and constitutionally protected conversations and advice that happen daily.”

Whatever the literal language of the 1986 law, Solicitor General Noel J. Francisco wrote for the government in its petition seeking review, criminal laws are “ordinarily understood not to prohibit abstract advocacy of illegality.”

“Just as a teenager does not aid, abet or solicit marijuana possession merely by saying to a friend, ‘I encourage you to try smoking pot,’” Mr. Francisco wrote, a grandmother does not violate the 1986 law “merely by saying to her grandson whose visa has expired, ‘I encourage you to stay.’”

Mr. Francisco asked the justices to decide only whether speech made for financial gain could be made criminal. The 1986 law does discuss financial gain, but in a separate provision allowing longer sentences when money is involved.

Prosecutions under the law tend to be limited to cases concerning classically criminal conduct by unsympathetic defendants. But not always. In 2012, for instance, a Massachusetts woman, Lorraine Henderson, was convicted of hiring an unauthorized immigrant to clean her home and offering general and not always reliable advice about immigration law.

In that case, Judge Douglas P. Woodlock, of the Federal District Court in Boston, wrote that the “plain and unadorned language” of the law “can be read to cast a wide net over those who interact with illegal aliens by offering employment.”

Judge Woodlock did not consider First Amendment issues in his decision, but he granted Ms. Henderson’s motion for a new trial based on his misgivings about the sweep of the law. Prosecutors dropped the case.

In Ms. Sineneng-Smith’s case, the government argued that it did not pursue prosecutions based on ordinary interactions with unauthorized immigrants.

That was small comfort, Judge Tashima wrote. “Just because the government has not (yet) sought many prosecutions based on speech,” he wrote, “it does not follow that the government cannot or will not use an overbroad law to obtain such convictions.”

In the Supreme Court, Ms. Sineneng-Smith’s lawyers said they should be allowed to challenge the law in order to protect the constitutional rights of other people.

“The very reason that overbroad laws are subject to facial attack,” they wrote, “is to remedy the chilling effect resulting from keeping such laws on the books.”
