Hi! Sorry this isn't a very light topic. If a woman was raped in a prison by guards, becomes pregnant and gives birth to the child in her cell, what would happen to the baby, if all of this is something that could happen? And what would happen to the woman as well?

Let me just preface by saying, as a sort of disclaimer, that I would advice against using rape as a plot device. Not saying it’s what you are going to do, anon, but I would like anyone reading to be aware that something so serious is perhaps not to be reduced to a dramatic event in a fictional story.

No, not a light topic at all anon. It’s also difficult for me to answer since you don’t specify when and where this takes place. It would most certainly differ depending on which decade and in which country this happens.To generalise, really generalise, the baby would be born and sent to some kind of place that would care for it (what kind of place would depend on when and where this happen). The woman would generally not get to keep it for long (how long, though, depends). It would be give over to childcare, if this is in an era when such a thing exist, or perhaps an orphanage or to relatives. There are exceptions, however. Up until 1950s in the USA, prison did have nurseries and the women would raise the child behind bars. In modern day Sweden, the child can stay with the mother for up to a year. In India and Mexico, there are nurseries. 

Unless your story takes place in an earlier era, she wouldn’t have to give birth in her cell. She would be taken to a hospital. Again, depending on when and where, she might be handcuffed to the bed while giving birth. If we’re talking Medieval era, women would sometimes claim to be pregnant because a pregnant woman would not get executed. If they were pregnant they would be cared for until they gave birth. As for the crime of rape, generally, historically; the lower the status of the woman, the less likely the crime would at all be brought to court since she would have no one to make a case for her. A woman in a prison would most certainly be at the bottom of the societal hierarchy. If we’re not talking contemporary prison, and even more so if we go back in time to early modern age or pre-modern age, it’s unlikely she would have been able to press charges. If we go back to the Middle Ages, she would have committed a crime in having sex outside of marriage, regardless if she consented to sex or not. It would be close to impossible for her to somehow prove it happened against her will. Wheres today, depending on where, of course, it’s not legal to have sex with an inmate as the inmate cannot give consent in the eyes of the law. If you’re story is contemporary, the guard will be prosecuted. [1] If your story takes place in Medieval Europe I can give a better answer, because it’s Medieval European law that I am most familiar with. Otherwise I don’t think I will be of much more help, unfortunately.Good luck with your writing!Signed, Captain.
