Trump Ended U.S. Government Shutdown, but the Damage It Did to Crypto Adoption Is Here to Stay

On Jan. 25, United States (U.S.) President Donald Trump ended the partial government shutdown, albeit temporarily. As a result of the funding package he signed on Friday, the government will be open for three weeks.

While the future still seems unclear for U.S. government facilities, which are now returning to work after the 35-day standoff between Trump and the Senate, it is time to reassess how regulatory agencies like the Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC) were affected, and what that means for the crypto market.

Trump failed to get money for his border wall, shut down the U.S. government

The shutdown was triggered by Trump’s demand for $5.7 billion in federal funds for a U.S.-Mexico border wall, which he called for throughout his 2016 presidential campaign, making it one of his signature promises.

Initially, Trump claimed he would recoup the costs of the wall from Mexico, but President Enrique Pena Nieto refused to fund the construction. As a result, in January 2017, the Trump administration signed Executive Order 13767, which formally directed the U.S. government to build the wall using existing federal funding.

In December 2018, the Senate, which is controlled by the Republican party, unanimously passed an appropriations bill without wall funding. After that, Trump declared that he wouldn’t sign any funding bill that didn’t include money for the fortified border. According to Politico reports, Trump’s decision could have been influenced by conservative and far-right media outlets, which purportedly pressured the president to keep his longtime promise.

The House republicans then pushed a stopgap bill with funding for the wall by a 217-185 vote, but it also failed to find enough support in the Senate.

During what seems to be the highlight of the dispute preceding the shutdown, on Dec. 11, Trump met with Speaker-designate Nancy Pelosi and Senate Minority Leader Chuck Schumer and asked them to support an appropriation of $5.7 billion for funding of the border wall. After they rejected his proposal, Trump said, “I am proud to shut down the government for border security. […] I will be the one to shut it down. I’m not going to blame you for it. […] I will take the mantle. I will be the one to shut it down.” Ten days later, Trump took to Twitter to blame Democrats for the shutdown.

As a result, on Dec. 22, the shutdown started, as funding for numerous agencies, homeland security, law enforcement, tax collection and transportation expired. Approximately 800,000 federal workers were furloughed or were required to work without pay. The shutdown reportedly affected one quarter of the government. According to an analysis from Standard & Poor’s, by Jan.11, the shutdown had cost the U.S. economy $3.6 billion. Given that it lasted 14 more days and became the longest government shutdown in U.S. history, the overall effect could be even more significant.

The SEC was largely paralyzed, delaying the IPO applications and possibly triggering insider trading

On Dec. 27, the SEC announced that it will operate with reduced staff during the shutdown.

“Effective Thursday, Dec. 27 and until further notice, the agency will have a very limited number of staff members available,” the regulator announced via its website. The SEC added that it will keep essential staff to respond to emergency situations involving market integrity and investor protection.

Additionally, the regulator maintained operations for its offices of enforcement and investor complaints, as well as its Electronic Data Gathering, Analysis and Retrieval (EDGAR) system for company disclosures.

According to data from intelligence firm Enigma Technologies cited by Quartz, the SEC was operating at 5.8 percent of its normal capacity during the shutdown, with the enforcement division at 8 percent.

In a comment for Quartz, John Stark, the former chief of the SEC’s Office of Internet Enforcement, called the numbers “shocking” and predicted an increase in insider trading during the shutdown:

“There will absolutely be people on Wall Street, and off of Wall Street, who believe they may be able to get away with something because the cop is simply not on the beat.”

Moreover, Stark stressed that the SEC was underemployed even before the shutdown, which means that the lapse could have made it even more complicated for the watchdog to keep up with the market. It could take months to deal with the backlog, he argued, considering that SEC enforcement staff were allegedly not even permitted to read their emails. “Even if they wanted to work from home and get work done, it’s unlawful for them to do so,” the former SEC employee added.

Another former SEC employee, its ex-accountant/examiner Tim Dunn, told Quartz that the most “essential” SEC staff who remained on the job were of senior level. Therefore, they were unlikely to review cases, he argued.

“How far away are they from hands-on working these important cases, and are they working them? […] Somebody who is in senior management is probably six, eight, ten years removed from actually having done that work.”

The halt could have encouraged wrongdoing among market participants, according to James Cox, a securities law professor at Duke University, who was also interviewed by Quartz. Cox highlighted insider trading as one of primary examples of such offense, claiming that it accounts for 10 percent of all enforcement cases. He argued that the SEC was forced to handpick cases during the shutdown due to the lack of employees at work, which could have been abused by the market:

“That sends out a message to people on Wall Street — ‘Hey, maybe there’s less chance of me being caught right now,’ and that has all kinds of perverse incentives.”

On Jan. 27, 2019, after the shutdown was temporarily ended, the SEC issued transition guidance that explains how the staff will tackle the backlog of transactional and disclosure filings, as well as shareholder proposals that piled up during the shutdown.

According to the guidance, the staff will prioritize filings, submissions and requests for staff action, including shareholder proposals, in the order they were received. The papers also cautions that the SEC response times may be longer than usual.

The initial public offerings (IPO) market has taken a hit as a result of the shutdown, according to the transaction guidance. Specifically, the applications of companies seeking to go public in the first quarter of 2019 have been delayed. The list of such firms include China’s second-largest Bitcoin mining hardware manufacturer, Canaan, who turned to New York after its $400 million plans were lapsed by the Hong Kong Stock Exchange (HKEX).

The CFTC’s action was halted as well, pushing back its review of ETH and digital assets platforms’ applications

The CFTC, the agency that oversees the derivatives market and trading in Bitcoin futures, was largely shutdown as well. On Dec. 18, the agency released a memo announcing that it will “severely curtail” its operations. Only 9.1 percent of the CFTC’s staff remained at work during the shutdown, as per the statement.

Nevertheless, the regulator sought stay of actions against binary options and virtual currency fraudsters. On Dec. 26, it reportedly filed respective motions with federal courts.

One example of the cases that the CFTC wanted to keep investigating allegedly featured a number of companies that were accused of having solicited potential customers to buy illegal off-exchange binary options via companies such as Blue Bit Banc. The defendants reportedly aimed to cover up their misdemeanor by asking customers to transfer their binary options account balances into the ATM Coin (ATMC) cryptocurrency.

The shutdown could have also indefinitely prolonged the CFTC’s studies in regard to Ethereum (ETH).

On Dec. 11, the watchdog requested public comments and guidance on the Ethereum blockchain to better understand the differences and similarities between ETH and the seminal cryptocurrency Bitcoin (BTC). According to a Roll Coll report, while the comment submission period won’t expire until mid-February, there was no CFTC staff in office to begin undertaking the review.

Moreover, crypto exchange ErisX, which raised $27.5 million from major investors in December, was also affected by the shutdown. The platform requires approval from the CFTC, as it aims to accommodate the futures market, and hence its application was likely postponed.

Similarly, digital assets platform Bakkt, overseen by the Intercontinental Exchange (ICE), is likely to face another delay because of the major lapse. According to the company’s official notice, “following consultation with the Commodity Futures Trading Commission, ICE Futures U.S. Inc. expects to provide an updated launch timeline in early 2019 for the trading, clearing and warehousing” of Bakkt’s Bitcoin futures contract.

On Jan. 28, CFTC Chairman J. Christopher Giancarlo announced the agency’s return to operations. In the statement, however, he stressed that the CFTC “continued to perform essential market-critical functions throughout the shutdown.”

“The agency was well prepared, utilizing its Lapse in Appropriations action plan adopted a year ago. A small team of agency staff continued to monitor derivatives markets and ensured that essential enforcement activities were carried out.”

The shutdown might comeback, dealing even more damage

Despite all the consequences, Trump has reiterated his demands for the U.S.-Mexico wall funds, which is why he ended the shutdown on temporary terms. The Financial Times quotes him as saying:

“If we don’t get a fair deal from Congress, the government will either shut down on February 15 again, or I will use the power afforded to me under the laws and the constitution of the United States to address this emergency. We will have great security.”

Therefore, the impact on the crypto industry, namely its progress on Wall Street, could be postponed even further. Given that various Bitcoin ETF applications have been delayed numerous times by the SEC, and the regulator has to deal with major backlog caused by the shutdown on top of other tasks, crypto adoption could have been pushed back to a significant extent.

From bartering to blockchain, the world of money – and the way we transfer it – has never stood still. Indeed, even the assets we prize have changed. Although it might be nice to have some vegetables in your fridge, using it as a form of currency has probably never crossed your mind.

It’s easy to take financial systems for granted. But every advancement over the centuries has caused some major disruption and a lot of getting used to. With each new system came imperfections and pitfalls – and in some ways, this is good. Cryptocurrencies hold a lot of promise but still face teething problems and challenges. History tells us that this is to be expected, and things can be fixed with patience and a few bright sparks.

Buckle yourselves in. Together, we’re going to take a journey exploring where money transfers began, and how we got to where we are today. Surprisingly, the issues facing crypto right now have been seen throughout the centuries.

Barter

We’re going way back to start off – so imagine everything in black and white. The barter system was the one of the first known forms of trading, pioneered and relied upon by civilizations as far back as 9000 BC. Goods would be exchanged for anything from food and tea leaves to spices, weapons and even human skulls. In every sense, this system is the godfather of money as we know it today.

As you can imagine, lugging around cattle and heavy sacks of grain whenever you wanted something from someone would have been a bit of a drag. Thankfully, it only took a few thousand years for traders to get a better idea – create a small and portable replica which symbolizes the goods which are yet to come.

Around 1200 BC, merchants in China started to use cowrie shells, which were commonly found in the Indian and Pacific Oceans. They were later imitated in bronze and copper. Metal knives were also popular as a substitute for the items due to be delivered – but perhaps unsurprisingly, sharp edges were taken away to swerve any nasty accidents. Often, holes would feature in the middle so they could be linked together – and it’s from here the inspiration for coins was born. Fun fact for a dinner party? Cowrie shells were still commonly used as currency in parts of Africa until the early 1900s. Now that’s stamina.

Creating an asset which represents something else is something that hundreds of utility coins in the crypto world do today. Digital tokens are increasingly being used to represent assets in the physical world – bringing a whole new meaning to ownership.

Fast forward just 700 years (why aren’t all history lessons this fast?) and we finally get to something resembling money – the coins jingling in your pocket. Or not if you’re a diehard crypto nerd, or like the Queen, who doesn’t carry cash.

By the time we arrive at 500 BCE, coins have popped up in Persia, Turkey, Greece and Macedonia – and soon enough, the Roman Empire was getting in on the action. That said, its soldiers appeared to take the revolution with a grain of salt, as many of them appear to have been partly paid in, er, salt. A payment method that’s slow to take off and enjoy mainstream adoption – that rings a bell.

Paper currency

At roughly the same time, paper currency was beginning to come along in leaps and bounds, but they did cause immense amounts of price volatility. In some cases, countries created way too many of these bills – devaluing their currencies and causing rampant price inflation. The story of price volatility sounds familiar, with the price of bitcoin soaring dramatically in 2018 before crashing – sending shock waves through the entire cryptocurrency market and prompting experts to question its suitability for day-to-day use.

Returning to history, banknotes soon emerged which were tied to precious metals like gold and silver – commodities which are still regarded as safe havens today. Further inventions such as checks (16th century) and the telegraph (19th century – yes, still in black and white) helped modernize transactions and speed up transfers. Want another fun fact for that dinner party? The rollout of telegraph systems paved the way for Western Union, which launched in 1851.

Making notes notable

With money changing hands in ever larger quantities, it became important for bank notes to be trusted and recognized internationally. This resulted in nations including England and the US moving away from gold as a value standard – and instead, they established centralized institutions like the Bank of England and the Federal Reserve. Many crypto organizations, which do not rely on central banks, are now underwriting their digital currencies with precious metals – and some banks are even making a cautious foray into the world of crypto.

The modern era

Here’s where we start to leave black and white behind and live in technicolor, with the traditional financial systems we’ve all grown up with. The middle of the 20th century brought about the advent of credit cards, and the late 1960s saw the launch of ATMs. By the 1970s, banks teamed together to launch SWIFT – or to give it its longer, catchier name, the Society for Worldwide Interbank Financial Communication. This allowed financial institutions to talk to one another and facilitate transfers globally – but even today, these can still take a few business days to clear.

Transaction speeds started to rev up as we entered the new millennium thanks to eCommerce platforms such as PayPal, but indeed, these were (and are) still tied to old-fashioned banks. Purpose The purpose of this AIC is to inform the South African ATM community of intended developments in terms of enhancing and improving Air Traffic Surveillance Services. It also serves as a means to open dialogue for the purposes of consultation with Industry prior to the proposed implementation of the Surveillance Services. In the Republic of South Africa, transponder equipage; and operation in CLASS A, and CLASS C airspace is mandated according to SA-AIP ENR 1.6.1 to ENR 1.6.5. Furthermore, CAR 91.05.1 read together with the SA-CATS 91.05.1; provide further clarity and support to this ENR mandate. Introduction In order to continue with the provision of safe, orderly, expeditious and efficient Air Traffic Management solutions and associated services; it is necessary to continuously review the enabling technologies that allow for improved continuation of these services. To this extent, the need to inform industry of safer, more efficient, and cost-beneficial Surveillance Technologies such as Automatic Dependant Surveillance-Broadcast (ADS-B) and Mode Select (Mode S) transponder has been identified; with a view to replace legacy, less efficient, and far more expensive Primary Surveillance RADAR (PSR) and Monopulse Secondary Surveillance RADAR (MSSR) technologies. General If a new transponder is installed in an IFR or VFR aircraft, it is highly recommended that it be equipped with serviceable ADS-B and Mode S transponder in order to comply with the future effective dates for planned Mode S and ADS-B equipage. Mode S and ADS-B Planned Dates of Applicability The proposed fitment of approved ADS-B equipage is as follows: 2018 – IFR Forward fit: Any aircraft that is first registered on or after 1 January 2018 and is operated under IFR must carry a serviceable ADS-B transponder that complies with the requirements below. 2020 – All IFR aircraft: On and after 1 April 2020 operated under IFR must carry a serviceable ADS-B transponder that complies with the requirements below. 2020 – Mode S for New aircraft and Mode S for Newly installed transponders: Any aircraft that is first registered or modified by having its transponder replaced on or after 1 April 2020, and is operated in Class A, B, C or E airspace must carry a serviceable ADS-B and Mode-S transponder that complies with the requirements below. Any aircraft that operates above 10,000 feet AMSL in all declared airspace types must carry a serviceable ADS-B transponder that complies with the requirements below. Mode S and ADS-B Transponder Requirements In order to realise the full operational benefits of ADS-B, it is recommended that the equipment meets the current standard 1090ES ADS-B Link Version 2 (RTCA/DO-260B/EUROCAE ED-102A) for transponders fitted to aircraft operating in South African airspace.Aircraft that are required to carry ADS-B transponders for the purposes of using Space-Based ADS-B will be required to have their antennae fitted on to the top of the fuselage in order for the antenna to be within line-of-sight of the Space-Based ADS-B satellite constellation. (RTCA/DO-260B/EUROCAE ED-102A) transponders feature both ADS-B “out”, as well as ADS-B “in” for the purposes of Traffic Information Service Broadcast (TIS-B), and Flight Information Service (FIS-B). TIS-B allows for ADS-B “in” equipped aircraft to be provided with an electronic presentation of surrounding traffic in a lateral, longitudinal, and vertical display on their Cockpit Display of Traffic Information (CDTI) equipment. The aircrafts unique 24 bit address’ (otherwise known as the mode S code issued by the South African Civil Aviation Authority) shall be strapped to the transponders without error and ensuring that it corresponds exactly with the binary or hexadecimal address issued. Confirmation of the correct strapping must be conducted by using the correct ramp test equipment. Application for this code must be made to the SACAA using form CA 91-12 which can be found on the SACAA website and must be accompanied by the appropriate fee. The GNSS position source shall be certified in accordance with FAA or EASA (E)TSO-C145a, (E)TSO-C146a or (E)TSO-C196a or later approved versions. Some later versions of GNSS receivers certified to (E) TSO-C129 may also meet the requirements, i.e. those having FDE and HPL features incorporated. The altitude source equipment supplying the pressure altitude to be transmitted by the ADS-B equipment shall be certified in accordance with the FAA or EASA (E)TSO-C88a or a later approved version. Despite these dictates, crypto exchange LocalBitcoins found that transactions made in Colombian pesos spiked 1,200 percent in 2017.

Evidence suggests that demand for crypto in Colombia is at least partially driven by expatriates from neighboring Venezuela. In fact, as previously reported, a cottage industry of crypto exchanges and ATMs has sprouted providing services for Venezuelans to exchange their hyperinflated currency and send remittances back home.

Why the Marshall Islands Is Issuing Its Own Cryptocurrency

Since becoming an independent democratic nation in 1979, the Republic of the Marshall Islands has used the US dollar as money. Today we are progressing with our plan to issue a sovereign currency in digital form – using blockchain technology.

Last year, we passed the Sovereign Currency Act, declaring our intention to issue a new currency, the Marshallese sovereign (SOV), which we will use alongside the dollar. Issuing a currency is of course the prerogative of any sovereign nation, but what is unprecedented is that we have chosen to issue our sovereign currency using blockchain technology.

We made three key decisions when we chose to issue our currency. First, that the currency would be based on blockchain technology – this is vital for us in the Marshall Islands, for reasons I will outline below. Second, that the growth of our money supply would be predetermined and tamper proof. And, last but not least, that compliance would be baked into the currency protocol itself, while maintaining privacy for individuals.

The advent of blockchain technology has opened up a world of opportunity for small nations like ours. Relying on traditional fiat currency, the Marshall Islands has only fragile links to the wider world of international finance, and compliance is extremely resource intensive. Many of our citizens send or receive money using remittance services, paying fees of up to 10% per transaction. Even simple things like acquiring and installing ATMs become complicated when you’re in the middle of the Pacific Ocean!

But blockchain transactions are fast, simple, and cheap. Blockchain transactions are secure, because they’re replicated throughout a decentralized network. Most importantly, and despite its mathematical and technical complexity, blockchain is practically very simple. The only infrastructure needed for a blockchain-based digital currency is the network itself. We do not need to create a central bank and manage the printing and processing of paper money.

We chose to create a fixed money supply with fixed growth because fiat currencies can be remarkably unstable. For example, the Argentine peso recently fell 15% in a single day, while Venezuela’s currency, for all intents and purposes, no longer functions at all. The policies of major central banks are not reassuring, as the gold and bitcoin prices attest. We as governments need to take a more sustainable approach to money, and not treat it as a limitless resource.

Our money supply will grow at a sustainable 4% each year, following Milton Friedman’s k% rule. New SOV will be automatically distributed to the currency holders and the decentralized entities securing the network. This means that we in government cannot modify the money supply, and we cannot manipulate the value of our currency by printing more money.

Finally, our currency must be internationally accepted. Post 9/11, money laundering and financing of terrorism are major threats that the global community is fighting together. But without our own currency, and beholden to existing systems, it is hard for us to contribute much to this fight beyond basic compliance. With a digital currency based on blockchain, we can automate much of the compliance burden and take a proactive role on the international stage.

Every individual using SOV must be identified by an approved verifier of their choice, such as a bank or an exchange. This will close the secrecy and anonymity loopholes exploited by criminals and terrorists. However, it is crucial that individual users should have a reasonable expectation of privacy – specifically, the ability to choose when to disclose your information, what exactly to share, and with whom. We are committed to providing this privacy with SOV.

The Marshall Islands are working closely with international regulatory bodies to ensure SOV meets all compliance requirements and can be fully integrated into the international financial ecosystem. In fact, SOV is being digitally engineered from the ground up to prevent misuse, unlike paper currencies.

For years, the Marshall Islands have been exploring ways to enhance its connectivity to the international financial system. By issuing a currency that is not physically embodied in cash, that can travel the globe instantly, and that is tamper-proof and completely secure, the Marshall Islands will finally be connected to the global financial system on its own terms.

It may seem surprising that the Republic of the Marshall Islands would be issuing a currency based on blockchain technology, but actually it’s just the opposite: the Marshallese people have lived with decentralized systems for hundreds of years. For us, a country of just over 50,000 people spread across more than 1,000 Pacific islands, centralized solutions aren’t just inefficient: they’re completely unworkable. Blockchain has given us the opportunity to finally acquire monetary independence in a way that reflects Marshallese values. We intend to grasp that opportunity, innovatively and responsibly.
