VVIP chopper case: Delhi HC junks ED plea to revoke Rajiv Saxena's pardon

The Delhi High Court on Monday dismissed the Enforcement Directorate (ED) plea seeking revocation of the pardon granted to businessmen and accused-turned-approver Rajiv Saxena in AgustaWestland chopper deal case.

Justice C. Hari Shankar, upholding Saxena approver status, said, "Resultantly, I find myself in agreement with the view, expressed by the learned Special Judge, that, before the recording of his statement under Section 306 (4) of the Cr PC, the application, of the petitioner (ED), as preferred before him, was not maintainable."

The court noted that a preliminary objection had been advanced by Saxena's counsel RK Handoo that the CrPC does not contemplate "revocation of pardon". Handoo has said that pardon, once granted, can neither be revoked nor withdrawn or cancelled.

Delhi court reserves order on bail plea of Christian Michel for Feb 16 in VVIP Chopper case

New Delhi : In the 3,600-crore AgustaWestland VVIP chopper deal, Delhi court on Wednesday reserved for February 16 its order on bail plea of Christian Michel.

Special Judge Arvind Kumar directed both the parties to file short written arguments in the case by February 15.

During the hearing, the Enforcement Directorate (ED) and the Central Bureau of Investigation (CBI) opposed Mr. Christian Michel bail plea, saying the court has already taken cognizance of the charge sheet in the case and the accused cannot seek bail at this juncture.

Mr. Christian Michel, extradited from Dubai, was arrested by the Enforcement Directorate (ED) on December 22, 2018.

Mr. Michel was sent to judicial custody in both the ED and the CBI cases. Mr. Michel is among the three alleged middlemen being probed in the case by the ED and the CBI. The others are Guido Haschke and Carlo Gerosa.

ED raids business tycoon Shravan Gupta in AgustaWestland chopper deal case

The Enforcement Directorate on Wednesday carried out multiple searches on premises of Shravan Gupta, the former MD of realty major Emaar MGF in connection with the AgustaWestland VVIP chopper money laundering case.

he Enforcement Directorate on Wednesday conducted searches at seven locations linked to businessman Shravan Gupta in connection AgustaWestland VVIP chopper deal case.

Shravan Gupta, who is already being investigated in other cases by the financial probe agency, according to a top government official, “illegally received the money in the AgustaWestland deal”.

The ED is investigating alleged kickbacks received by several politicians and bureaucrats through private firms, businessmen and middlemen in the chopper deal.

Shravan Gupta, a promoter of the real estate firm MGF Developments, is known for bringing some of the largest foreign direct investments (FDI) in India through the joint venture with Dubai-based Emaar.

Emaar MGF came under scanner during the investigation against another accused Gautam Khaitan. Sources say, accused Gautam Khaitan and Guido Haschke were board members of Emaar MGF in 2009.

In 2018, the ED had seized assets worth Rs 102.8 million linked to Emaar MGF Managing Director Shravan Gupta under Foreign Exchange Management Act.

"The assets were seized under Section 37A (1) of Foreign Exchange Management Act (FEMA) from brothers Shravan Gupta and Rajiv Gupta for holding USD 15,40,650 in the bank account maintained with Hong Kong and Shanghai Banking Corporation (HSBC), Switzerland," ED had said in a statement.

The ED had then alleged that Shravan Gupta had not shown this amount in the Income Tax (I-T) returns for the period of 2006-07 however, the same amount was reflected 5 years later and appropriate taxes were paid.

NEW DELHI: The BJP on Wednesday hit out at the Congress for its “silence” over allegations of involvement of its top leaders in the AgustaWestland kickback probe and took a swipe at Rahul Gandhi, saying he tweets on all sort of issues but has not responded to these grave charges. At a press conference, BJP spokesperson Rajyavardhan Singh Rathore demanded that Congress president Sonia Gandhi and her son answer about the allegations levelled against their party leaders. “What do they have to tell about the names of their party leaders being mentioned in the scam? What is the meaning of their silence?” he asked. The BJP has targeted the Congress citing a reported statement of Rajiv Saxena, a key accused in the case, to the Enforcement Directorate in which, it is claimed, he had mentioned the names of former Madhya Pradesh chief minister Kamal Nath’s nephew Ratul Puri and son Bakul Nath, along with Congress leaders Salman Khurshid and Ahmed Patel. Khurshid had said that he cannot respond to the BJP’s claim until he knows the context in which his name has been mentioned by the accused. Taking a swipe at Rahul Gandhi, Rathore said he had often attacked the Modi government over the Rafale fighter aircraft deal despite the Supreme Court giving a clean chit to it but has not spoken a word about the investigation into the alleged corruption in the purchase of the VVIP choppers. The CBI had begun probing the AgustaWestland deal when the UPA government was in power after an investigation in Italy suggested kickbacks in the transaction. Rathore said the then defence minister A K Antony had acknowledged in Parliament that corruption had occurred in the deal. “Scam was the priority” in defence deals when the Congress was in power, he alleged. “People of the country will never forgive the Congress for its corruption in defence deals,” he said. Speaking to reporters, Rathore also attacked the Mamata Banerjee government in West Bengal over alleged violence against BJP workers in the state.
