I spent some time this strange summer getting to know the character of Patrick Jane for the first time ever. I've always been an avid TV series consumer, but I came across The Mentalist late in my life, and it happened totally by accident. It was immediately clear to me this was another Sherlock Holmes adaption but I never disdain this type of character, so I jumped in.

It was quite a surprise, though, to discover HOW unpredictable Patrick Jane is. Similar to a sociopath, cold and brash as a stalactite, yet grateful for everything in the natural landscape, in love with the sun as if he were a lizard, almost brought to tears by a gentle ocean breeze or the perfection of a cup of tea, or a cruel word, or a pair of hand-sewn socks? Wow??

I have some reservations about most of the storylines, I consider them a bit weak from a narrative point of view and sometimes a bit cringe due to problematic elements typical of the last decade (context, I know), in seven seasons there are few episodes that i truly enjoyed from start to finish. The season 6 finale, for example? DEFINITELY ENJOYED. it was hilarious and tender and profound, I think it's one of the episodes I would immediately think of, if I had to describe this character and its whole arc.

That said, relationship-wise, this TV show is a MASTERCLASS in slow burn romance!! And the way they handled Jane and Lisbon's new relationship left me completely satisfied, with this unbalanced man who starts gently saying "let me find the right words to apologize to you" and faces this new situation with bravery and grace and openness. Wow!

CHAPTER - 6

The Chaos

The next day...

"Bloody Wierdo" August murmured to himself, While gazing at the ceiling. He couldn't able to sleep properly, his mind is filled with the murders and victim's bloody bodies, all he have to do is catch the serial killer, who is the reason behind of all this scenes...

After some time...

A loud thunders are happening outside of the August house, the weather is quite dark and the flashes are illuminating like a sparkles. August is living at the corner of the town, where no one can locate his home. August came outside of his house, it's very cold outside.

AUGUST WALKER P.O.V

I saw a bear figure at the backside of the tree, I approached to that side. I can barely see what is in the hands of that figure. So I became very protective for myself and questioned that thing.

"Hello?"

No response.

"Hello, is anyone there?" I questioned again.

Still No response.

When I about to turn, I got hurt by the hammer on the face, I groaned and immediately took the pistol and started to shoot at the knee or arms of that figure. But, I am unable to concentrate. Then sudden flashes of victim bodies are wandering in my mind and then I became angry and unbreakable and started to punch him with my hard fists.

That figure fell down and I took this opportunity and started to unfold his face mask, but that figure stopped and stabbed me with the knife in my chest.

"ARGH!!!" I yelled and shot him  in the knees.

"UGH!!UGH!!! FUCK!!!" the figure groaned.

As soon as the voice came from that figure, it was a male voice. I stumbled myself and unwrapped the face mask.

"HAHAH! YEYY! AUGUST!!! MY DEAR AUGUST WALKER. SON OF JONATHAN WALKER AND DIANA WALKER" man said.

"This is not the correct time to start the conversation, my dear CRIMSON PARKER?" I whispered.

"How do you know my name?" parker surprised.

"Well, that is not the point" 

"IT IS!" parker yelled.

"I know, how to shut your dirty mouth" and THEN DISHOOM..... I punched him on his face.

"HELP ME!!!! HELP ME!!!" I heard parker voice from the cellar. I tied his hands ,legs and kept him in the dark cellar, where there is no proper ventilation.

"Why you are yelling? Shall i feed you with my punches and beatings?HUH?"

"YEAH, PLEASE!!!"

"You fucking bastard! Why? Why you are doing this? What is that supposed to mean? TELL EVERYTHING or else I am gonna rip out of each and every organ from your body and I won't even let you die, you will be laying as a lifeless human and you will be praying to the god, to take your life, instead of this torture!" I whispered to him.

"OH! IS IT? Will you say this to your daughter, MISS WALKER? RIGHT??"

Freezing of bank account for unconnected entities is legally untenable.

M/s Jermyn Capital LLC Dubai v. Central Bureau of Investigation

Fact:

M/s Jermyn Capital LLC Dubai (#Appellant Company) was Permitted by Securities Exchange Board of India (#SEBI) to buy & sell share & securities in the #Indian Stock Market.

The appellant company had its shares in its account with #ICICI Bank.

However, due to certain litigation the appellant company quit the trading in the Indian Market in 2006.

But appellant company was subjected to 02 #freeze orders under section 102 #Cr PC. (This section empowers police officers to seize any property which gives suspicion for commission of any offence.)

The freeze order for an amount of Rs.42.51 crore was initiated because of the #pending #investigation against Dharmesh Doshi

Against the freeze order the appellant company approached the Apex Court & the #ApexCourt allowed the appellant Company to sell its shares & convert into cash and repatriate the funds with interest but without bank guarantee.

Rs. 42.51 Crore was repatriated.

Issue arose when appellant company was incapacitated by second freeze order for an amount of Rs. 38.52 crores to repatriate.

Aggrieved by the freeze the appellant company again approached the Apex Court.

 The Apex Court gave liberty to the appellant company to approach trial court for release of the said amount.

 The trial court allowed the repatriation of Rs.38.52 Crores subject to the #Bank Guarantee of an equivalent amount.

Aggrieved by the imposition of Bank Guarantee Clause the appellant Company approached High Court.

High Court confirmed the decision of Trial Court.

Against the order of the High Court present Criminal Appeal is filed before Apex Court.

Observation of the Apex Court:

 Imposition of Bank Guarantee clause as due to pending investigation against Dharmesh Doshi, alleged to have been connected with the appellant company.

Record shows that Dharmesh Doshi has been discharged by the trial court, was never an employee/shareholder/director or holding key managerial position in the appellant company.

Dharmesh Doshi & Appellant Company are 02 separate entities.

Freezing order as such not legally tenable when two entities are unconnected.

Neither in the FIR nor in the chargesheet filed against the Dharmesh Doshi, appellant company was named.

Further during hearing CBI informed the Apex Court that no criminal proceedings is pending against the appellant company pertaining the dispute discussed here.

The freeze order against the appellant company’s properties is redundant as the appellant company is not necessary for the conclusion of the investigation.

The purpose of the freeze order, and the bank guarantee in extension of the freeze order, can only be in operation to aid in the investigation against the alleged crime.

Since the investigation against the appellant company has become redundant as such freeze order has also become redundant.

 The operation of the freeze order has been active for a period of 17 years and has caused huge losses to the appellant company.

Decision:

The Division Bench of Hon’ble Mr. Justice Krishna Murari J & Hon’ble Sanjay Kumar J vide their order dt.09.05.2023 set aside the order of the High Court and permitted the appellant company to withdraw the said amount with 4% simple interest from May08, 2006.
