I don't know... just the utter insanity of being like "I don't trust the government" only to put your full faith in the government cause you've decided that this punitive law is one you like and could totally never be used in an inappropriate way
Never trust the government man
Government needs to be forced to have full transparency and accountability and have a boot kept on it's neck at all times to make sure it's doing what we need it to... and we're not there yet, not even close. DOD can't even pass an audit man, and so many of the governmental systems as so clearly just kind of broken
So why on earth would you ever trust some new law to only be used in positive ways and not as a tool of suppression?
And part of it is about looking at laws, looking at what they say and do, looking at their scope. Like yeah, I'm pro right to repair laws because they mostly say companies can't stop me from fixing my own shit and need to make parts available (which they demonstrably don't do otherwise, which is the only reason I even want a law about it)
But like... there's a bit of a difference between the scope of a right to repair bill vs something on surveillance, or banning something like tiktok, or making it so police can arrest you for something new... never trust that stuff's going to be applied how they say it will, assume they've slipped massive overreach in the fine print, and assume that even if it's technically the most restrained bill that the feds might ignore that and use it as an excuse to trample all over your rights despite technically not being allowed to
Doesn't matter if the cop technically isn't supposed to arrest you for it, we see cases all the time where cops do shit they're not supposed to do and go after people not doing anything wrong

I'm kind of bouncing between talking about at least 2-3 laws minimum here without feeling like naming any outright#both cause I don't want discourse and because as always I'd rather talk in general terms and let people apply shit themselves#so some of what I say applies more to one law; some to another; if we were talking about any of these laws I'd point to specifics#but just for real; don't trust the government; limit it's punitive powers; demand transparency and accountability#sadly I don't think getting rid of it is a functional option for reasons ranging from#the fact I think it serves a purpose in being a bigger pot of money; cause like... imagine if roads were a private issue#it would be an even bigger shit show that it already is; some things require a big pot of money (though don't trust it; audit that shit)#second is gov and corps need to be pitted against each other because they're both too big to trust either#we demonstrably can't leave companies unregulated; like I was a pharm tech; I hate the FDA; think they're both bad and corrupt#but I also think you need to have something in place to make sure your food and meds are what they say they are#and it's better to reform the FDA then move towards total deregulation#finally; don't think you can get rid of the gov; think people always form govs once there's enough of us#anarchy is like communism; work ok sometimes so long as there's less than like 50 people

actually WHILE I’M HERE HAVE SOME UCHIHA CLAN THOUGHTS BECAUSE *yeets Kishi and his two-faced worldbuilding about Uchiha into the sun*.
-Uchiha are actually incredibly emotional and during the Warring State Era were probably a *lot* more willing to express that to each other and be supportive because again- Super Vision. These are the ppl who cannot and will never forget their trauma, which means to stay sane they have to also memorize and cling to their love and family to stay balanced. This probably started changing after Madara went off the deep end and Konoha was looking sidelong at the Uchiha in fear of another Expressive Uchiha Going Nuts, so they started trying to be more like their peers and be Reserved Shinobi Families. Which totally didn’t bite them in the butt years later with Itachi but moving on.
-There is no force on earth, not even Kishi, that can convince me that Tobirama did not respect the heck out of the Uchiha. None of this “uchiha are the clan of hatred” nonsense. You do not look at a clan you secretly mistrust and low-key hate and give them the keys to your village security and the upholding of all it’s laws. You do not hand someone you do not trust the literal beating heart of your village and tell them to be the guardian and bridge between the civilian and shinobi sectors, not to mention the many inter-clan interactions and clan culture clashes that would need to be smoothed out for the continued operation of Konoha daily life. You do not take one of that clan as your personal student if you’re afraid that he or any of his future kids he will not doubt pass your teachings on to will go nuts at the drop of a hat. Giving the Uchiha the police force was a way to make them the bedrock of the village while also trying to ensure that no Madara would ever happen again, because if the majority of the Uchiha are in the village, then the majority of them will not be gaining insanity inducing battlefield trauma with their sharingan.
-On the police force, you ALSO cannot tell me that most of the Konoha civilians did not respect and even adore the Uchiha police force. Sure they’re a bunch of stoic looking, prickly fellows, but these detail obsessed, hyper competent shinobi can and *will* intercede on your behalf when your shinobi neighbor is getting pushy or too loud or just leaving blood everywhere and you’re afraid to ask him to please maybe hose off before tracking blood through the entire apartment complex like a crime scene. Civilians in Konoha live at the mercy of their shinobi, there’s no helping that, but the Uchiha were their lifeline and safety net for that. An Inuzuka and a Hyuuga got into a drunken slap fight that destroyed your shopfront and you need the clans to pay for damages but you’re just a humble lowly shopkeeper and you’re afraid the clans will ignore you because you can’t force the issue? Go to the Uchiha police force and file a damages claim.
A chuunin or jounin has taken to asking your daughter out and he’s starting to no longer take “no” for an answer? Call the Uchiha police force.
You’re a civilian business entering into a trading contract with one of the other major shinobi clans and you want to make sure that not only will the contract be impartial and loophole free but that the much richer, stronger, deadlier shinobi clan won’t strong arm you into accepting a bad contract? Ask the Uchiha to either oversee the proceedings or recommend a lawyer who can (who will probably definitely also be an Uchiha).
-The Uchiha were simultaneously a strong enough clan to handle any of the snits potentially thrown by the other noble clans or any jutsu-using criminals that cropped up in Konoha but also strict enough that they used that power to ensure civilians *and* shinobi would have equal (or at least as close as a military run child soldier village can get to equal) treatment. They also, being shinobi, would be the ones the *ninja* went to to settle disputes with their civilian Karen neighbor so that no one has to resort to murder. And being canonically proud as heck about their position as the police force you better bet your biju that they held themselves and their officers to a very high standard. At least until Danzo started backing them into a corner and they all collectively started going feral (which they were justified to do so, honestly).
*hisses softly* can you tell I have THOUGHTS about Kishi’s sloppy worldbuilding and lack of visible consequences for slaughtering his entire police force that also happened to be a founding and highly respected clan?

Spencer has only told one person in his whole life.
His mother guessed. For as long as he can remember, she’s used gender neutral pronouns when talking about his future partner, read him all the gay literature she could find, promised him that he’s perfect just the way he is.
The trouble is that Spencer only believes her until the first grade, when Ryan Sampson shoves him over in the playground and calls him gay. His mom had only ever used that term in a sweet, loving way, taking care to associate such words with positivity, as long as his dad wasn’t around to hear. When that word comes out of Ryan Sampson’s mouth, it is not said with sweetness and love; it is said with venom, and Spencer learns quickly that his mom is wrong. He is not perfect just the way he is.
And so, he keeps it a secret. When his mom notices him getting uncomfortable at the mention of future partners, she stops bringing it up, though she refuses to give up the diverse education she provides for him outside of school. His dad tells him that one day he’ll be a strapping young man and marry a nice girl in a church, and Spencer nods along. He ignores the way his stomach turns with anxiety at the thought. Ignores the screaming match his parents have that night. Ignores the fact that it started because Diana chipped in with ‘or boy’.
He’s in high school by the time he’s twelve, and the only part he’s grateful for is the absence of pressure to get a girlfriend. His dad’s out of the picture now, and Spencer tries not to let himself think that maybe if he wasn’t like this he might have stayed. Diana’s so out of it most days that she doesn’t remember what she noticed about him when he was a child, only recalling the last few years of shoving himself so far back in the closet he can hardly see the door anymore.
It feels like he’s lost his last ally.
(He hates that a small part of him feels relieved she doesn’t remember; that he almost feels assured by the fact that the last person to know who he really is has forgotten. There is only this version of Spencer Reid now. No other exists.)
He makes the mistake during his second undergraduate degree. He’s just turned eighteen but he is already a doctor and, fortunately, this alienates him from most of his peers, but someone manages to slide past his defences. Ethan Miller is twenty, in the second year of his (first) undergraduate degree in Chemical Engineering, and he’s nice. Spencer doesn’t have a lot of experience with friendship, but they get on well and Ethan makes him laugh. For the first time, he feels comfortable in the presence of anyone other than his mother.
They slip into an easy friendship: waiting for each other after class — Spencer back in the undergraduate buildings now he has his first PhD under his belt — and going out for ice cream and pizza and Thai food. Ethan goes to parties while Spencer studies, and then they reconvene to watch Doctor Who and play cards.
For almost a year, Spencer keeps his secret carefully locked up, hidden behind the mask he’s perfected after so many years. Even though he’s eighteen, nearly nineteen now, he doesn’t try and explore that side of himself. No, that’s far too risky. He doesn’t try and pretend any other way either, he just stays silent and lets people’s assumptions lie for him, but he can’t help the longing that claws up his throat when he locks eyes with a passing guy on campus. One time, he’d seen two men kiss on a bench in the city, and he’d run back to his dorm and had a panic attack. Why couldn’t he have that?
The feelings don’t stop, and he doesn’t know how to make them. He hates that he isn’t normal, but still longs for the touch of a man, the feeling of being wrapped up in strong arms, of being kissed by dry, chapped lips, and falling asleep to a heartbeat approximately 11% slower than that of a woman’s.
It’s a constant battle inside him, emotions raging, and he struggles to control it, suppress it, tame it.
He pays a sorry price.
Ethan makes him feel comfortable, and that turns out to be a detriment. He relaxes around the other boy: he tells him about growing up as a pre-teen in a high school, about how a child feels living 260 miles away from home, even about his mother’s illness.
And one day, it slips out. They’re on the beach, lying on towels as they look up at the blue sky, talking about what their futures will look like: Ethan will be a successful chemical engineer in Berlin, and Spencer will work for the FBI, profiling serial killers.
“You’ll have to marry a German girl,” he tells Ethan. “It’ll be tough to convince an American girl to move all the way to Germany as soon as you graduate.”
“Yeah, and what about you? You’ll be off fighting crime around the country, not much of a life for a family.”
“Oh, I imagine my husband will be the type to—”
“Husband?”
Spencer freezes. It shocks him as much as it shocks Ethan. He doesn’t even pay much attention to Ethan’s disgusted face and his outraged tirade. He hears slurs and insults, hears him say that he can’t believe Spencer tricked him like this, that he was probably waiting to make a move on him, that he was never to look in Ethan’s direction again, but Spencer is frozen in time.
He’s never allowed him to think much about what his personal life might look like in the future, but he’d said ‘husband’ on instinct, without thinking, and it’s clearly something he actually wants. Ethan’s words sting, but the moment brings about a realisation Spencer is thankful for; it instigates a journey of self-discovery and self-expression, of the joy of living as your true self.
He loses his first and only friend, but he gains something much more valuable. He visits gay bars — nervously sipping a non-alcoholic drink in the corner at first, before soon becoming confident enough to respond to the men who sidle up to him and ask for his name. He lets go and dances the night away, sometimes going home with one of the many dance partners he acquires during the night, sometimes heading back to his own dorm happily alone.
Makeup and dresses and skirts and heels make their way into his wardrobe, and he befriends girls and drag queens and other gay men who encourage him to be exactly the way he is. And the best part is, he never has to come out to any of them. All of them know, and that’s good enough for everyone.
The fun comes to a sad sort of slow, however, when he joins the BAU. Everyone knows law enforcement’s relationship with the LGBT community is less than adequate — Spencer’s seen it with his own eyes: butch lesbians and men in dresses getting roughed up by angry police officers for ‘lewd behaviour’ or ‘drunkenness’ when they’re just being themselves. It’s not safe for him to tell anyone, so he doesn’t.
He still goes out with his friends when he’s in town and wears makeup and dresses and crop tops when he’s at home, but presents as rigidly straight Dr Spencer Reid to his team at the BAU.
The hardest part about it is that he loves his team. He’s known Gideon for years — and he wouldn’t be surprised if he suspects something after coming over to his house unannounced one night, only to have a man other than Spencer open the door — but he settles into a comforting dynamic with Hotch. He can’t help but see him as something of a father figure, and he knows Hotch has a soft spot for him, always looking out for him and taking him under his wing without a moment’s hesitation.
Elle, JJ, and Penelope all take a shine to him, too, teasing him without a hint of malice in their tones, only the kind of playful kindness that reminds him of his mother. He forms a special bond with Penelope and they spend hours watching Doctor Who together and geeking out on all the areas their interests overlap, and the comfort he feels with her matches the comfort he’s found with his new group of queer friends.
(She doesn’t hold a candle to Ethan, he decides one night, after he’d cried at a movie she’d made him watch and she felt so bad she made him hot chocolate and jam toast and cuddled him until he felt better.)
Derek becomes a brother to him. He puts him in a headlock at least once a day — which Spencer has been reliably informed by multiple sources is a very brotherly thing to do — and teases him relentlessly, while simultaneously being fiercely protective of him. Enough so, that Spencer sometimes wonders if he even has Hotch beat in that department.
He loves his team and his team loves him. It should be simple. It is still 2003.
He comes in one morning late for a briefing, his shirt buttoned wrong and his hair is a mess, and he’s fairly sure that his attempt to cover the hickey at the base of his neck with concealer has been ultimately unsuccessful. It’s obvious why he’s late. Gideon is too engrossed in the case file to notice, but Hotch raises an eyebrow, an amused look on his face as everyone else immediately takes to teasing him.
“Who’s the lucky lady, pretty boy?”
Elle raises an eyebrow to match Derek’s shit-eating grin, “Someone definitely got some strange last night.”
“When do we get to meet her, Spence?” JJ asks, smirking as he takes a seat.
He’s bright red — as if he needed to look any more debauched — and Spencer tries to ignore the hurt that seizes his chest at the reminder of his need to stay quiet. This team respects him, and he can’t throw that away just because Spencer gets too comfortable.
God, he wishes Penelope was here.
“None of your business,” he mutters, trying to keep his tone light. He fails.
Naturally, Hotch notices and swiftly moves the briefing on, and Spencer keeps his gaze locked on the case file, not missing the absence of a reprimand from his superior. He’s constantly thankful for the older man, but in this moment, he wishes he could hug him.
(A voice that sounds dangerously close to Ethan’s rises up and taunts him in his ear: he wouldn’t want a dirty homo like you anywhere near him—)
Derek doesn’t let up on the case, continuing to bug him about the special lady in his life. He does concede that it could’ve been a one night stand, which is one front he’s right on, but a couple more concessions are necessary before Derek comes close to the truth of last night.
Eventually, Derek stops, and Spencer notes that the cessation of comments comes suspiciously close to the last time Derek and Hotch were alone together. He doesn’t have it in him to feel angry at Hotch for stepping in when he had it handled; doesn’t have the energy to act as though his pride is wounded, because really, neither of those things are true, and he doesn’t need to add another item to ‘Spencer Reid’s List of Things He Pretends to Be.’
The situation is forgotten, and time moves on.
Things change when he finds his first proper boyfriend. He doesn’t know what he was expecting, but it certainly wasn’t the giddying rush of emotions it turns out to be, and Spencer spends his days smiling as he daydreams his time away.
His name is Oscar Wilkins, a History professor at Georgetown University, and Spencer falls quickly in love with him. Ever since their mutual friend had introduced them at a gay bar one evening, they’d spent all their free time together. He’s kind and gentle and understanding of Spencer’s hectic and unpredictable job, and he finally has the chance to experience everything he quietly and shamefully longed for as a teenager.
The only downside is the silent breaking of Spencer’s heart that the most important people in his life can’t meet his boyfriend. He longs to show Oscar off, to hold hands in front of his team, lean up to press a tender kiss to Oscar’s lips. He wants to put a framed picture of the two of them at the Washington Monument on his desk to remind him of why he needs to get through the hard days; he doesn’t want to have to sneak out of the hotel room he shares with Derek to whisper hushed, loving goodnights over the phone.
But he’s too scared. Too cowardly.
It’s different being who he is with his gay group of friends littered with wlws and drag queens and other gay and bisexual guys. They understand.
But Derek and Hotch are two extremely masculine, alpha men: Derek’s a ladies’ man and Hotch is married to a woman he met in college with a baby on the way and both have a strong and dominant energy that still sometimes manages to intimidate Spencer even after all these years. And Elle and JJ are lovely — some of his closest friends, really — but sometimes they remind him a little too much of the mean girls he went to high school with.
The hardest person to keep his secret from, though, is Penelope. She’s his best friend and he desperately wants to give her all of him, but he’s so scared. He’s lost a best friend to this secret before, and even though he’s certain she’d be fine with it, what if she accidentally let it slip to Derek? What if Hotch found out and didn’t see him in the same light anymore? What if the girls started teasing him? What if Gideon didn’t want to mentor him anymore?
The fear paralyses him. And it’s a cycle he doesn’t know how to break.
Fear, though, doesn't stop everyone from noticing his daydreaming, his dopey smile when he checks his messages, his urgency to get home where he would’ve stayed until the small hours of the morning before. As excellent as he is at hiding his sexuality, he’s fucking terrible at hiding the fact that he’s in love: it was easy enough to pretend he was straight, but hiding something this all-consuming is an impossible ask.
Derek comes over to perch on the edge of his desk one afternoon, sighing as he sits down. “Pretty boy, this is getting ridiculous,” he says, snatching Spencer’s attention away from his phone. “You’ve been grinning like an idiot for the last twenty minutes as you’ve texted Future Mrs Reid. When are we going to meet her?”
(He hates the new nickname the team has given his mystery significant other, although Oscar had found it hilarious. “It’s funny because when we get married, we’ll hardly be able to tell,” he’d argued through his laughter. “Neither of us will change our name because of our academic profiles, and we’ll both still be ‘Dr’. Our wedding rings will be the only indicator.”
Spencer hadn’t argued back, because he’d been too tongue-tied and flushed pink at Oscar’s use of ‘when’ in regards to their hypothetical nuptials. It was only made bearable by Oscar kissing him gently and tucking him under his arm, not embarrassing him any further as Spencer had sort of anticipated, warmth settling over his chest at the thought of their future together.)
“You won’t,” he replies, perhaps a little too curtly.
Derek starts at that, clearly not expecting it. He definitely should’ve tried to play it off as a joke. “What— should I be offended, pretty boy?”
You wouldn’t call me that if you knew who I really am.
“That’s up to you, Derek,” he says calmly, although he still can’t meet his eyes, “but you won’t meet the ‘Future Mrs Reid, so I think it would probably be best if you left it alone.”
“Damn,” Derek mutters under his breath, clearly pissed off and probably more hurt than Spencer ever intended. “Suit yourself.”
And with that, he gets up and leaves his desk. Spencer’s only solace is the text message he sees on his phone when he picks it back up: I love you so much. You know that, right?
The light-hearted ridicule comes to an abrupt halt after the incident with Derek, and it’s clear that he had been the biggest contributor to the teasing. He’s thankful that the jokes have stopped, but he wishes desperately that it didn’t come with the growing distance between him and his team. Loneliness takes the place of his previous irritated anxiety, and he isn’t sure what’s worse.
It all comes to a head at the end of a case in Michigan. They’re stuck in the lounge of the small inn they’d stayed in the last few days, a snowstorm having blocked them in and grounded the jet, although Gideon had long since retreated to his room. The fire’s going and they’re the only guests around, so it’s cosy enough, but Spencer can’t help but feel sick at the idea of another night away from home.
It’s only been two weeks since he’d snapped at Derek, but the chasm between him and the team is only widening with each passing day. He knows it’s not a case of ‘pick a side’, but the team’s morale relies on light-hearted banter and teasing, and him not being a part of that anymore has only brewed awkwardness. Everyone’s trying to give him space when space is the last thing he wants.
Oscar’s keeping him company over the phone at least, but it’s not quite enough to quell the loneliness swimming around his stomach, and the 'discrete' sideways looks he gets from the team only make him feel worse.
“At least it’s nice and toasty in here,” JJ sighs as she takes a sip of the hot chocolate the kindly inn owner had made for them all.
Elle hums in agreement. “There are worse places to be grounded.”
“I dunno, man, I just wanna get home,” Derek says, not taking his eyes off the fire. Spencer can’t help but agree.
“Oh, come on,” Hotch muses, considerably more jovial now the case is over, “we’re here, and that’s not going to change any time soon. We should make the most of it.”
“It’s at least nice to be somewhere sort-of Christmassy now it’s December,” Elle points out. “We could be stuck in a dingy police station like we probably will be next week.”
“Ooh, I noticed that Jemimah and Kiran started planning the Christmas party last week,” JJ says, smiling at them. “I offered my help, but they seem to have it covered.”
Hotch raises an eyebrow“That’s probably a good thing. You don’t need more work on your plate.”
“Not gonna argue with that,” she murmurs, smiling as she brings her mug to her lips again.
Spencer doesn’t miss that Derek is still stewing on the opposite side of the room.
“Are you looking forward to the Christmas party, Spencer? Will you come?” Hotch asks, clearly trying to rope him into the conversation, which he appreciates. He’s been making a lot of effort with him the past few weeks, and it’s just about the only thing that’s getting him through each day.
Before he can reply, though, Derek erupts from the other side of the room; an already pissed-off man being pushed over the edge. “He won’t even let us meet his fucking girlfriend, Hotch, he’s not gonna want to come to the Christmas party!” he yells, throwing his hands in the air as he glares at Spencer with a stormy expression raging across his face.
Suddenly, Spencer can’t stay silent anymore, and his retort shocks himself just as much as it does everyone else. “I don’t have a girlfriend!”
It might be the loudest he’s ever shouted in his whole life. He’s always been quiet and restrained, the type to state his feelings as calmly as possible no matter how he’s feeling on the inside. Even in the biggest fight he’s had with Oscar, his voice was barely loud enough to qualify as a shout.
There’s a brief stunned silence, but Derek quickly slices his way through it, voice raising to meet Spencer’s fiery emotion, fierce and loud. “Oh, don’t even go there, Reid, you’re really gonna try and argue that? You’re gonna lie about her as well as not let us meet her? What a boyfriend you are.”
“I don’t! I don’t have a girlfriend!” he repeats, voice catching this time as tears rise unbidden to the backs of his eyes and all the emotions of the journey he’s taken with his sexuality over the years flood him in a wave of intensity he’s not prepared for.
“You’re fucking lying—!”
“I have a boyfriend!” he yells. “Alright? I have a boyfriend. I’m gay.”
The anger and emotion quickly dissipates, and he’s left standing alone in front of the team he’s put so much effort into hiding this from, watching shock spell out across everyone’s expressions. He’s never felt smaller than he does in that moment, and he quickly grabs his phone before running upstairs to his room, locking the door behind him.
“Oh God, Oscar, I fucked up so bad,” he cries over the phone as soon as his boyfriend picks up.
“Hey, hey, breathe, baby,” Oscar says gently, but Spencer can hear the anxious concern in his voice, “it’s gonna be okay, I promise. I’m here. Do you want to tell me what happened?”
“I just— Oh God, I just told the team.” A new wave of horror rolls over him as he realises what he’s done. Times might be changing, but it’s still only 2006, and he doesn’t know each and every nuance of his team members’ political positions and, fuck, he hates that his existence is a fucking political position.
Oscar’s been so understanding of his reluctance to not tell the team, even though Spencer’s met pretty much everyone in his life. He isn’t sure what he’s done to earn such a gracious and understanding boyfriend, but he’s not about to question it.
“Baby, I know it’s scary, and I know you’re really worked up right now,” he counsels, voice soft and reassuring, using the nickname he knows Spencer loves the most to make him feel as safe as he can from 700 miles away, “but it’s probably not as bad as you think. From what you’ve told me about the team, they love you so much, and even in the case that in the past they've had some issue with gay people, I can't imagine they’d ever actually think of you any differently when it comes down to it, Spencer.”
He’s crying too hard to reply, and Oscar understands immediately, gently transitioning into a story about his day that slowly starts to calm him down, and by the time he’s wrapping it up, his tears are starting to subside.
“Thank you, Ozzy,” he whispers into the phone, lifting himself up off the floor and making his way to sit on the bed instead.
“You know I’d do anything for you, sweetheart,” he murmurs warmly. “Do you want me to stay on the phone for a bit?”
“Yes please,” he whispers again, holding it as close to himself as possible, drawing all the comfort he can from his boyfriend’s voice.
He lies there listening to Oscar’s voice and trying not to think about the disaster downstairs for a good ten minutes before there’s a tap at the door.
“Oz, there’s someone here,” he says, voice panicked.
“I think you should probably speak to them, baby,” he urges. “I’ll stay on the phone with you while you do, if you like?”
“Please.” He gets up from the bed gingerly, keeping his phone tightly gripped in his right hand as he slowly unlocks the door with his left, revealing Hotch on the other side.
“Hey, Spencer. Do you mind if I come in?”
He’s riddled with nerves, but Hotch is smiling warmly, and he’s never said a harsh word to Spencer, so he steps aside and lets him into his room.
Hotch quickly notices the phone in his hand, visibly still on a call. “Is that your boyfriend?”
Spencer nods.
“Do you mind if I talk to him?”
His brows knit in confusion and his lips part slightly in surprise, but it’s all he can do to hand the phone over, watching Hotch carefully.
“Hi, Spencer tells me this is his boyfriend?” Hotch inquires politely into the phone, his tone still warm. “I’m Hotch, Spencer’s boss.”
He can vaguely hear Oscar speaking on the other end of the line, and he worries slightly that Oscar will somehow give away the familial feelings he holds for Hotch, but the conversation doesn’t last long enough for the anxiety to really take over.
“Everything’s fine here, I just want to have a conversation with Spencer, so is it alright if we hang up and I talk to him alone for a minute? He can call you straight back afterwards.” After a brief pause in which Oscar says something, Hotch looks back up at him. “Are you okay with that, Spencer?”
He nods hesitantly, and Hotch says a quick goodbye to Oscar before surging forwards and wrapping Spencer in a hug. It catches him off guard, but he doesn’t waste any time in burying his face into Hotch’s neck and soaking in the comfort and warmth that always radiates from his father figure.
“Come on,” Hotch says softly as they pull away a good minute or so later, “let’s sit down, shall we?”
“You’re not mad?” Spencer can’t help but ask, the question burning his tongue as anxiety — however quietened from Hotch’s hug — still swims around in his stomach.
“There are many things that could make me mad, Spencer,” he says earnestly, “but this is not one of them. I would never be angry at you for being who you are, okay? I might… I might be overstepping here, and if I am, then tell me and I’ll back off, but I’ve always seen you as a mentee, and over the years that’s developed— well, I see you more as a son these days. And part of that is wanting to protect and support you no matter what you do or say or who you are.”
Spencer wastes no time in diving back in for a hug, clinging onto Hotch for dear life as he hugs back, rubbing his back gently.
“I’m so sorry you didn’t feel like you could tell us sooner, Spencer,” he says in a voice soft with affection and regret. “But I’m so glad you’ve told us now.”
He only presses closer at that, tears springing back to his eyes. “I didn’t want to lose you.” He knows what he’s implying, and even in a roundabout way, he’s glad he’s telling Hotch.
“Oh, Spence,” he sighs sadly, “you couldn’t do a single thing to lose me. I’m in it for the long haul.”
“Really?” he asks, hating how insecure he sounds.
“Really,” Hotch promises, pulling away as Spencer does. “Now, you have a whole team of agents downstairs who are feeling very sorry for themselves and really want to see you.”
Nausea rolls in his stomach and panic springs back up as he looks at Hotch, desperate for some sort of grounding. “Are they angry at me? Do they hate me now?”
“No one hates you, Spencer,” he says firmly. “I promise you that. Everyone just wishes that they’d made you feel more welcome and comfortable. We all hate that you felt you had to lock up something so integral to who you are, and we can’t help but feel we played a part in it.”
“No,” he protests — the last thing he wants is family blaming themselves when it has nothing to do with them, “it’s not your fault, it’s just…”
Hotch nods. “I understand, it’s okay. Now, do you want to go down and see them? You don’t have to if you don’t want to, but it might help ease your mind to see that they really don’t hate you.”
Spencer pauses, taking a moment to think. “Can I see Derek first?”
“Of course,” Hotch says understandingly, and the comforting smile that crosses his face makes Spencer feel safe and taken care of. “I’ll send him up?”
Spencer nods and Hotch hugs him once more before leaving the room almost reluctantly. He wastes no time in picking up his phone and sending a text to Oscar. You were right. Hotch is fine. He’s just sending Derek up before I go and see the team but he says that no one’s angry and I think I believe him. Thank you, Oscar. I love you.
Not even half a minute goes past before his phone lights up with a text back. I’m so glad, baby. Call me later, okay? I want to make sure you’re okay before I go to bed. I love you more.
Before Spencer can argue that actually, he is the one more in love with the other, a hesitant knock sounds on his door. Nerves suddenly flip his stomach, and he clenches and unclenches his fists a couple of times before forcing himself to cross the room, revealing a very worried and regretful-looking Derek.
“Oh, pretty boy,” he says sadly, before crushing Spencer in a warm and tender hug. Immediately, he relaxes into the arms of one of his best friends, and relief courses through his blood at Derek’s reaction. “I am so sorry that I ever made you feel like you couldn’t tell me that you were gay or had a boyfriend. That’s completely on me. I don’t care who you love, Spencer, I just want you to be happy, okay? And if this guy makes you happy, then that’s fine by me. But if he ever lays a hand on you or—”
“Derek, Derek,” he laughs, “it’s fine I get it. Thank you, though, I’m… I’m sorry I couldn’t tell you earlier and for snapping at you in the bullpen that time…”
“I understand, Spence,” he promises. “It’s in the past, okay? And I’m sorry for pushing so hard. I mean, I’d love to meet him but if you don’t feel comfortable or you don’t want to, that’s fine, too. It’s your life, man.”
“No, I… I think I want you guys to meet him. It’s been so hard to keep him away from the people I consider my family, you know?”
“Yeah, I know. Maybe after Christmas, we can all have dinner or something.”
Spencer smiles shyly. “Well, Oscar’s a great cook, so I reckon we could work something out.”
Derek grins, throwing an arm around his shoulders as he immediately jumps back into teasing him as they make their way to the door to go downstairs and see the rest of the team. “Ooh, lover boy’s got him a chef, hey? What else does this Oscar have going for him?”
Spencer chatters eagerly about his boyfriend to Derek, barely skipping a beat when he joins everyone downstairs, his friends taking his cues and joining in with the conversation seamlessly. He’s had enough fuss for one night, and the warmth and understanding on everyone’s faces tells him everything he needs to know.
“Do you have any pictures of him?” JJ asks, raising an eyebrow with eager expectancy as they all settle back into their seats by the fire, a warm and unbelievably happy feeling settling in Spencer’s stomach.
He blushes, digging out his phone from his pocket and unlocking it. “More than a few, I think.”
He finds the most recent picture of his boyfriend — a candid shot of him cooking in the kitchen, spatula aloft, and a huge grin on his face — and hands the phone around.
“Oh wow, you like them buff, huh, pretty boy?” Derek teases as soon as he gets his hands on it, and Spencer’s stomach twists in a sudden bout of fear, expecting to see some hesitancy or even disgust on his friend’s face. What if he thinks that Spencer has a crush on him? What if he’s uncomfortable around him now?
But if Derek’s having any of those thoughts, they don’t show on his face. He’s smiling widely and openly, all the pent-up anxiety and frustration borne from hurt gone from his body language, and he looks completely comfortable sat next to Spencer, his arm stretched out behind him on the back of the sofa.
They sit happily around the fire for a couple of hours, settling into a happy, intimate familiarity Spencer hadn’t realised was missing when he was hiding something so integral to his being from his family, and he’s still smiling when they finally part ways to head to bed, the clock ticking closer and closer to 1 am.
He gets ready for bed quickly, brushing his teeth and throwing on the top he’d stolen from Oscar the first time he’d stayed at his place; a welcome change from his worn and wrinkled suit. As soon as his teeth are brushed and the lights are all off except for his bedside lamp, he pulls out his phone, knowing there’s one more thing he has to do before he goes to sleep.
“Spencer?” Penelope’s voice sounds down the line, clearly concerned. “It’s almost 2 am here, are you okay?”
“I’m gay,” he says, getting straight to the point. The main reason he ever kept it from her was because of his fear of it accidentally getting out to the team rather than fear over her reaction. After all, multiple of his drag queen friends are also hers.
“Oh my God,” she says in that small voice she uses when she’s not actually talking to you, before finally actually replying to me. “Spencer, I’m so happy you told me!”
He doesn’t miss her choice of words, or the way she says them and he tilts his head suspiciously. “You already knew, didn’t you?”
She sighs. “Yeah. I’m sorry, a couple of months ago I saw a text from Oscar on your phone when you went to the bathroom during one of our Doctor Who marathons, and it wasn’t hard to figure out the relationship.”
“And… wait, you’re not mad at me for not telling you sooner?”
“Spencer! Of course not. I was waiting for you to be comfortable enough to share it with me. I felt awful that I knew without your consent but I didn’t want to tell you because I didn’t want to catch you off guard or make you feel uncomfortable. It’s fine that you waited, baby genius, I’m just so happy you told me now. What finally gave you the courage?”
“Well, it might have slipped out in front of the team this evening,” he admits sheepishly, “and the only reason I never told you was because I was scared that it would slip out somehow — accidentally, of course, I didn’t think you’d tell anyone on purpose — and now everyone knows. It’s been killing me not to tell you, Penelope, it really has because I love you so much and you’re my best friend and I trust you with my life, it’s just…”
“Whoa, slow down, Spence,” she laughs fondly, “you don’t have to explain yourself to me, I understand. But I’m glad you finally told everyone and you can be yourself completely with us, now. We all love you no matter what, you know that right?”
“I do now.”
“Good. You should get some sleep, baby boy, it’s late and you’ve had an emotional evening.”
Spencer smiles. “Yeah, I know. You should, too, Pen. I’ll see you when we can finally make it home, okay? Love you.”
“Love you, too, 187,” she says softly, and Spencer can hear the smile in her voice. “Goodnight.”
As soon as he hangs up, he settles down into the bed, turning off the light and pulling the duvet up over his shoulders before dialling one more number.
“Hey, baby,” Oscar says, voice as gentle and caring as it always is, although thicker with tiredness now. “I take it everything went okay?”
“Yeah,” Spencer murmurs, already feeling tired as the safety he always feels at the sound of Oscar’s voice settles into the fibres of his being. “It went so well. I can’t wait for you to meet everyone.”
“I can’t wait either, sweetheart. Are you in bed now?”
“Yeah,” he sighs. “Can you talk to me as I fall asleep?”
“Anything for you, Spence,” he says softly, before transitioning seamlessly into a story about the professors on campus, and his gentle comfort and the knowledge of the unconditional love his family has for him finally lulls Spencer into the best sleep he’s had in weeks.

Rant about interstellar
i have before but ill do it again!
interstellar touches me for many many reasons.
first off, the entire premise and setting and the world building in it. the dust storms, the failing crops. the protagonist does say at one point- "humanity was born on earth. they were never meant to stay here" and that just,,, hits me you know? presently we've seen the emergence of no human exploration besides the probes and the ISS. there are plans but the same curiosity just seems dead. interstellar stretches that and shows us what would happen when human curiosity and the desire to explore would die. we'd kill everyone on the planet and soon starve ourselves. the blights- the illnesses- the dead medicare- that's a very bleak future, but a very real one. the movie does both its part about scaring the viewer about it- as well as giving us hope about wormholes and quantum data and singularities and how we'd save ourselves. you can see that the old generation is talking about their days and how better or worse it would be. in the end, on the cooper satellites, you see the interviews being played- and it really breaks me. that was a generation that thought it was the end. the end of human life. the final descent and that was it. and then they see the five dimensions and getting lifted and their lives are essentially turned around. this isn't just the older people though. we see that the gen z then, like cooper's son have also mostly been brought up to *live*. we see that he tries to get into school and actually get into uni and find a job in one of the remaining sectors of the world which still offer something other than farm corn- raise family. You see that the teachers also say this? they teach them to fight blights and sustain crops because they’re losing more and more to disease each year. Humanity’s slowly being packed up and demolished and they aren’t seeing it coming. at all.
then there’s the quote which is recurring throughout the movie:
“do not go gentle into the good night”
the professor says this all the time. as they’re leaving- his last few dying words- as they’re preparing. and you know what? i’ll say it. this is where the next important theme comes in. Desperation. When he initially sends them out- he hasn’t solved gravity yet, and he knows he never will. Not without the quantum data from a black hole- something again, he can never get. Which is why he implies that there’s a Plan B and cooper can see murphy again (this is also very important- scroll down for this). He breaks all their trust- and he knows he’ll die before seeing the end of the mission- and you can’t die with guilt, not really. He knows that he can’t be held accountable because he’s dead. He’s well aware that his plan is a hail mary- and it wouldn’t have worked anyways. He’s counting on Plan B, and that’s all there is to it. He uses the quote as a reminder to himself- because he’s torn too. He isn’t inherently evil, at all. He’s the precarious thread the entire mission dangles by- but he’s willing to risk that too. He’ll be long, long dead before humanity dies- or moves- and this is his last try.
Now for the second part of this quote. As I talked about before- the quote feels more like a reminder to himself- and not actually something that inspires hope in the crewmates. But ironically, it ends up becoming what guides murph. As the professor is dying, she tells him “you’ve been doing this with both your arms tied behind your back”- that’s actually when she finds out about his whole plan. This is the failure of the professor- but at the same time, it becomes the moment he passes the torch to murph. The professor died, knowingly sending his own daughter into the reaches of space. He prioritized his need to save humanity over the love for his own daughter. But, murph isn’t like that. When she finds out about this, she remembers the promise her dad made to her.
“I’ll be back when you’re the age I am now”
and now, she knows he’s lied. But he hasn’t done it on purpose. and she understands that. She makes it HER goal that they don’t go gentle into the good night. She knows that this is probably futile, but she’s going to try. and she’s not going to try thinking that she’ll probably fail- like the professor did (in resignation for plan B)- she’s going to try to bring cooper back.
Third, coming back to desperation. A bold, bold act of desperation is what dr mann did. (I have some qualms about the actor playing estranged astronauts- anyways). Him sending out that sensor- knowing that it will bring humans back to him, while simultaneously jeopardizing the entire mission, and possibly the fate of humanity. He knows what he has done- but he has gone insane alone- and he’d betray his entire cause to see a human face again. This movie really says something about what humans are willing to do. On one hand, you have a woman who singlehandedly saves them all- for human love, and on the other, a man who is willing to commit genocide (that’s what i think it is, dont ask) to see someone else. He messes up everything, deliberately, and goes from “the greatest and bravest man to walk the earth” to a “cold and desperate villain”. This theme has a lot to do with what is happening right now too. Forgive the activism, but we do have people who knowingly exploit and burn and ravage the earth, for their own good- and they’re insane to the point that they genuinely can’t see right from wrong. Sure, you could argue that he was motivated by the need to preserve your own life. But if you give his cause *any* context, you see how wrong he is. This is flailing human desperation, pure and simple.
Now, approaching the themes that actually make it as good as it is. Dr Brand is easily my favourite character in the movie. We get to see her as a brilliant scientist initially, and her arc- is perfect, honestly. For example, take the wormhole handshake- as their going through interdimensional space- where time isn’t linear and your brain gets fried if you try to comprehend it- she recognizes a *being* in that space. If you recall that scene, she reaches out, and meets *them*- someone she knows is otherworldly and entirely above humans (we later learn it is Cooper in the matrix- and i have things to say about that too) and makes contact. She suggests, as both a human- and a scientist- that it may be love that transcends dimensions. She makes first contact with beings that may be their salvation- or destruction- and i think that is definitely the peak of human existence.
She argues that love may be what connected the crew to higher dimensions, and I'll dare to say that she’s right. Love is what made Cooper try to contact murph. Love is what made them dare to save humans. Love was what got her there. She tells them to go to Edmund's planet- not just because she loves him, but because she also makes relevant points AND her gut. It might be stretching it to say that was why she was right- but it is worth introspection. Dr Brand represents the best of humanity and she does carry it, doesn’t she? She settles on the planet for ‘the long nap’ in the end. She tries to save everyone- like on the mountain planet- and she loves. She hopes and she trusts and is unwaveringly honest and courageous. This could become a Dr Brand stan blog for all I care.
Moving on
We have the ‘them’. These are the mysterious threads that tie all parts of the movie together. A black hole to a little girl’s bookshelf. Worlds galaxies apart. A very important thing to note here is that the characters recognize that this is humanity, just very, very far out. And most importantly, wise. This is a civilization who has surpassed the ordinary dimensions, and *mortal* time. They could’ve easily saved all of humanity and given them the planet they were looking for. But their entire ineffable plan, and only putting things where they were needed- was what made them greater than just someone who helps others. Only being able to get binary signals through an intergalactic wormhole, building bookshelves that become a huge metaphor for humanity trying to claw at knowledge- and actually slowly pushing the books forward. The ‘them’ weren’t ordinary humans at all. They definitely hinted and gave me a brief, fickle glance beyond what humans could be- raw possibilities.
Then, we have cooper. This makes it hard to write for him- and do his character justice- but I will try. His character, essentially, is brought down to selflessness, love, a brutal, brutal sense of humour- and the courage- the heavy, heavy courage to sacrifice himself. He’s also the polar opposite of what Dr mann stands for. 
His first important point- in my opinion- is when the movie is starting. I didn’t walk in expecting this from him, not really. You see a dying earth- and this man is (alone in his fight, NASA doesn’t count yet) fighting the system alone. He fights for his son, tries for his father in law, and then the most important relationship- his daughter. He’s seeing an earth where not even *children* are curious, or willing, or interested in anything greater. He sees this in his daughter, though. Hence, the bookshelf- the gravity, and the plain curiosity. 
I’ll dare to say that at this point, humanity’s a dying, dying flame. And what he sees in his daughter, what we see in his daughter, is a rebirth of potential. She has the human spark, so to speak. He sees that, and he makes promises, and is willing to bring the world to its knees to protect her. And he knows he might not be there when Murph burns strong, and bright, and becomes the saviour of humanity- but he hopes.  An important element is the promise, which I mentioned earlier, but it defines their relationship. The promise that he’ll be back when they’re the same age. They both know that it’s not true. They can see the lie, but that promise also empowers them to do what they did when their paths diverge.
Cooper goes to Mann's planet with the vague hope that he’ll be back in time. Murph does most of what she does because she thinks that it’ll bring her father back. Even towards the end, when Cooper willingly jumps into gargantua, a supermassive black hole- which is the literal heart of darkness, he does it in the attempt to save his daughter, and hopes she can get the quantum data at the cost of his life. 
About Murph, we mostly see her through the eyes of Cooper in the beginning. A curious and lovable and stubborn tween who just wants to grow up with her dad and do their science experiments. Her perseverance is phenomenal- she loses her dad despite her warnings and asking- and realizes that her loss is something undefinable, but there. In a way, she grows to understand both her responsibility and her part to play, and why her father did what he did. The ‘ghost’ is another plot device- a mysterious figure who messes with the gravity and knocks her books down. And she sees a message there. She tells him about ‘don’t go’ and i can’t begin to describe how beautifully poetic and heartbreaking it is that they realize the significance of that at the same time, and how it ties together. It is hard for me to fathom that scene really- cooper is in an interdimensional matrix, inside a supermassive black hole, and he tries to tell his daughter two things. (a) trying to stop himself from going out and on the mission, which he knows is deemed to fail and (b) sending the quantum data, because that is what mattered in the end, anyways. The ghost comes full circle- and also says what he had to say, when it was most important. And for those who’ve seen the movie, i just really have to put this quote out there:
‘It was you. It was always you. You were my ghost, dad’
And in that, the movie completes itself. It talks about unfailing love, the peak and fall of humanity, and the potential of curiosity.

I was born in Toronto, Canada and I am living in Athens, Greece.
How you started with street photography?
When the Greek crisis started, the first ones affected were the freelancers, especially those who had to do with constructions and show business. As a visual artist myself, working in those fields, had to close down my studio and hope for the best. But recession was getting worse by the day and maybe that’s the reason why suddenly the internet was growing faster than ever in Greece. Then, through social media, a street photography movement burst in the country and I joined it from the start. I was absolutely in love with all this, and it saved my sanity…

Why street photography?
Because is fun and quiets the mind to a point of transcendence. Also because every time I go shooting, it feels like the first time. I hope I will never lose that feeling.
Seems easy and fun when you say it like that, of course that’s the whole point. How do you cope with days without motivation? If that even happens. Do you force yourself or you listen to your mood of the day?
The only times I have forced myself to shoot street, was when a deadline for an instruction was just about to expire. Funny thing is I have some of my favorite photos shot that way.

What and/or who inspires you?
People!
How often do you go out to capture moments?
I used to shoot every day, for 6-8 hours, for a good amount of years. Lately I have slowed down a bit.

Why have you slowed down? 6-8 hours a day is a lot so I would tend to think you got a bit tired? Tell us more.
Photographs are my diary. I became a full time observer, a hunter. I was walking around seeing only frames. I realized I could hardly remember anything I didn’t photograph. It is easy to get detached from reality when you are constantly holding a camera between yourself and the world. I love it enormously, but I have to restore my memory, so I shoot less now.
Do you give yourself also a big amount of time for editing? How do you do your editing normally? Please explain.
My initial intention is to achieve the best results during the shooting. Rarely cropping and minimum editing is what I mostly do. You cannot transform a bad picture into a good one, however skillfully you might edit it.

What do you look for when you go out on the streets?
I have a thing for reflections, harmony in colours and choreographed like movements. Other than that I am looking for odd situations, and any surprise the place can provide.
You do have a thing for reflections. Do you however let yourself free when you go out on the streets or you let your preferences take over you? Meaning, do you then purposely look for reflections or you walk freely and then it happens to be very recurrent in your photography?
I do all the above simultaneously. My brain is multitasking without my consent.

Do you interact with your subjects?
I prefer not to. Sometimes it’s hard to avoid it, because I shoot without trying to hide and at a close range. If they see me and talk to me, we usually end up exchanging emails and telephone numbers.
How do you challenge yourself to improve on photography?
The best challenge is to be out there as often as you can. Then, there are some flickr weekly challenges that I participated in order to have some discipline and see what I could come out with, when shooting under instructions in a limited timeframe.

How would you describe your own style?
I don’t think I have a specific style, nor I would like to be confined in one. What I care about though, is my photos to have a second reading and to provoke feelings, even if they are documentary, street, or more personal ones.
Do you think your experience in the streets taking photos has an influence in your personal work and vice versa? It seems both “styles” intermingle very often.
The borders have lately broadened generally in photography. I cannot clearly say any more which genre prevails over the other. Truth is street photography is mostly a state of mind, a way to see the world, an ability to put the pieces of the puzzle together. Thus, I carry this perception in any photographic situation such as indoors, events, underwater etc…

What is photography for you?
Photography is a medium of transformation, interpretation and expression, as all arts are. Personally is my means of depicting my view of the world, same as painting is. The only trap in this medium, especially during the electronic age, is the instant gratification, which gives us the illusion of a inflated achievement. Thus, not all camera users, try to improve their skills and knowledge.
What is your personal definition of street photography?
Street photography is to me, the happiest genre. It’s perky, witty, observing, and requires good reflexes, an alert mind and a constant challenge with your ethics and fears.

I like how you pointed out the ethics and fears. What challenges do you normally encounter when taking photos on the streets in regards to your ethics and fears?
To be invasive and disrespectful is something that doesn’t resonate with me. I have put down my camera many times when a subject is vulnerable according to my standards. But sometimes the limits are a little blurred and that’s when you have to make a quick decision. It is then when I ask myself “Why do you want to take that shot” and I try to be as honest as I can. If I have already taken the shot and the answer doesn’t satisfy me, I will never publish it. I think the main fear of a street photographer is to face a confrontation with the subject or the law. In my experience if you are afraid, disrespectful or aggressive, people will pick it up and react defensively.
Through photography, what have you learned about yourself in the last year?
I think it is the fact that I realized I have to put down the camera more often, and live the moment…

It seems though that you do take the time to take photos of your loved ones. What can you tell us about your personal work?
I do shoot my loved ones a lot, but almost never show their photos! I have some good friends photographed for ongoing projects. Also I cannot shoot someone I don’t like, at least the moment I do it. As of my personal work, I don’t prefer to talk much about it. Kind of an allergy in artist’s statements… I think most visual artists have this handicap.
What are your future goals with photography?
Can’t say I have specific goals, except evolving, finish one or two of my ongoing projects and maybe publish a book with unseen photos.

Publishing a book is one of the ultimate goals of a photographer. Can you tell us a bit more about this project and your motivations behind it? Many photographers would be intimidated by just the thought of it.
A book should not be more intimidating than an exhibition or an official site, for example. We tend to idealize certain aspects over others, when at the same time we are constantly exposed through social media. Seeing your work compiled under a concept and printed, is a whole new experience and I think everybody who is serious about art, should do it every few years or so. It’s like virtual reality versus life.
If you could have a conversation with ANY photographer for an hour, which photographer would you choose and why?
From the living, Sebastiao Salgado, because to me is among the greatest photographers of all times! And from the passed away ones, Vivian Maier, to unfold her mystery…

If you could go back in time, what piece of advice would you give yourself to take some shortcuts here and there based on your experience?
To have started street photography 30 years ago.
What gear do you use? Philosophy: Digital or analog?
I use any camera I can get my hands on. I prefer them to be small and fast.

B&W or color? Why?
I started shooting with film, way before the digital age, and loved B&W grainy films. After a while, I was seeing in black and white before I pressed the shutter, an ability that now has fainted a lot. After many years, a small bridge digital camera came to my hands and I was in awe with the colour. Lately, with some cameras if I shoot BW, I keep the colour in raw as well. I love both equally now.
Even if it could be seen as an obvious question and answer, what makes you choose color over B&W and what makes you choose B&W over color when taking pictures?
Sometimes colour is so dominant and alive that you cannot overlook it. When it comes to form or sentiment BW might be the most effective choice. Generally I think each photo speaks to you of what it needs that will best express it.

What about post processing/developing?
It’s been a long time since I developed a film. I hope I will do it again soon enough. There is a kind of magic in the film process, including the anticipation, which has been missing with the digital equipment. I try not to spend much time in editing, but I like very much the process of even the slightest adjustment, because there is where you make the final decision and it feels like a new creation.

I was rushing to catch the subway. Camera in my hands. I see the poster and the people sitting under it. I immediately stop. I look at the scene, they look at me. Had to do something fast, so I pretended I was in awe with the poster.The man was so intrigued by my expression that turns to look at the subject of my joy. I shot them all at once and run for the train.

In This Light, You Look Like A Dream
 A/N: This has been sitting unfinished in my drafts for weeks and so I finally wrote an ending and I’m SO SORRY. This was a collaboration between me and the lovely belle-vie! Just a cute little drabble.
Summary: It’s a girls night out and all Spencer wants is to take Emily home.
Spencer downed another shot provided by the bartender that had been hitting on her all night. Bartender wasn’t unattractive. Pretty. Tall and willowy. Little too giggly. Not really Spencer’s type. Not that she always adhered to her own standards.
Though the bartender was persistent, Spencer had her eyes set on someone else. She turned around, leaning on the bar, and watched her friends dance. Had Emily always looked that good?
The answer, of course, was yes. But Spencer felt it hit her like a brick. Something in the smile made her weak in the knees. It had been happening more and more lately – turning into a pile of goo when Emily was around. She felt like her body was on fire. It felt nice.
She stood up on shaky legs, the alcohol finally hitting her and giving her just the amount of courage she needed. As she quickly approached her friends Hanna reached out a hand to drag Spencer in the middle of their dancing circle.
“Spence, wasn’t this a good idea?” Hanna shouted over the loud music in the club. Spencer had been studying for her first semester of college midterms all week and Hanna had suggested that she finally let loose and have a night out with the girls.
“Not bad,” Spencer agreed, as she continued dancing to the music. She had to admit, Hanna was right and she definitely needed this release after her week of hell.
“I think I need another shot!” Hanna yelled once again, “Someone come with me.”
Aria was the first to speak up, “Only if you’ll go to the bathroom with me first.” The two joined hands and disappeared into the crowd, leaving behind a very drunk Spencer and Emily.
The way the colored lights hit Emily’s skin only made her even prettier, Spencer thought, as they were both bathed in blue, then red, then purple light. Emily pulled her closer, so filling the space where Aria and Hanna had been.
“See any possible prospects in here, Em?” Spencer whispered into Emily’s ear.
“Not even close,” Emily said with a laugh “what about you, Spence? Anyone in here good enough to take your mind off the law books you’ve been studying all week?”
“Hmm,” Spencer hummed as she pretended to glance around the club. She licked her lips, raking a hand through her hair. “Maybe,” she said, with a shrug.
Playing it cool while hammered was not easy. But hey, she was Spencer Hastings. If anything, she was always up for a challenge.
Emily laughed again, “Someone caught the Spencer Hastings’ attention?” she drawled.  “So, who’s the lucky guy… or is it a girl this time?”
Since Spencer had come out to her friends as bisexual, Emily had taken it upon herself to be Spencer’s “wingman”. She took her role as wingman very seriously, too.
“You’ll find out,” Spencer replied mysteriously, letting her eyes linger on Emily’s lips just a little longer. She leaned in closer to Emily’s face, tucking a lock of hair behind her ear as she whispered, “Think you can help?”
Emily shivered.
Before Emily could even form a response, Hanna stumbled over to them with Aria, who seemed much more sober than the rest of them, and getting more so by the minute. Aria clung to the blonde’s arm as she rolled her eyes.
Hanna tugged her arm away from Aria and threw it over Emily’s shoulder. “You,” she pointed firmly at Emily and then towards Spencer, “and you need another shot!”
Then she dropped her arm from Emily’s shoulder as she grabbed Emily and Spencer’s hands and led them to the bar. Aria followed behind, although she was clearly not enjoying herself anymore. Spencer didn’t feel too bad. She’d been the sober one babysitting her drunk friends on more than enough counts. Now it was Aria’s turn to suffer.
As they approached the bar, Hanna slapped her hand down on the surface to try catch the bartender’s attention. When that didn’t work, Spencer held out a few folded dollar bills. Lo-and-behold, there she emerged. Spencer wasn’t sure whether she appeared because of the money, or because she’d been hitting on Spencer all night, but either way it got the job down. As the bartender looked at her, she held up 3 fingers to order the shots for everyone.
Emily caught the smirk of the bartender, then she focused her attention back to Spencer.
“Is she the one?” Emily questioned as she grabbed Spencer’s arm.
Before Spencer could even open her mouth to answer, Hanna interrupted, “The one for what? The one that wants in Spencer’s pants? I should hope so!” Hanna responded as she laughed and hiccuped at the same time.
The bartender placed the shots down on the table, and Hanna nearly beamed when she saw an extra three shots there.
“The extra three are on me,” she said as she winked at Spencer. Spencer smiled politely as she picked up a shot from the counter. Still not interested, but it was a kind enough gesture. She wasn’t going to turn down free shots.
“On three ladies,” Hanna shouted as she and Emily raised their shots in the air as well. “1… 2… 3…” As the girls tossed back the alcohol, they all cringed at the slight burn in their throat.
Spencer eyed the second shot warily. Perhaps she’d overestimated herself.
“God,” Emily groaned as her face twisted from the after taste of the strong alcohol, “I can’t have anything else!”
That gave Spencer the clarity to nod in agreement. If Emily was cutting herself off, than Spencer didn’t feel so bad doing the same. They both looked towards Hanna.
She just  shrugged and picked up her second shot from the bar, “The night is still young,” she smiled as she tossed it back with the grace of a professional. “Now,” she said to no one in particular, “dance with me.”
Emily and Spencer were both quick to look at Aria. With the amount of liquor Hanna had swimming through her bloodstream, Spencer did not need that mess.
Aria pursed her lips, but relented, “Fine,” she huffed, “but if she pukes I’m done!” Hanna then pulled Aria to the dance floor and they once again disappeared into the crowd.
Spencer laughed, and even Emily was smiling. A slight-sober Aria never handled drunk Hanna well, but that never stopped them from giving Aria that responsibility. Spencer looked over at Emily, at her smile, and the way her skin was flushed from dancing and drinking. Butterflies erupted in her stomach.
“So,” Emily said, inching closer so they could hear each other easier “the bartender huh, Spence? I never knew blondes were-” Emily’s sentence was cut short as Spencer tugged her away from the bar and outside. “Spence, what are you doing? Your bartender girlfriend didn’t hear me, you can calm down, you know,” Emily said as they pulled over in a quieter area, away from the hustle and bustle of the club.
It was cool out here. It was empty, and quiet except for chirping crickets, and distant traffic and Spencer felt her head stop pounding.
Spencer stopped at the end of the black, turned around to face Emily, leaning back against the wall of a boutique that was closed for the night. “Em, shut up please. I’m not into the bartender-” Spencer was interrupted.
“Then who is it?” Emily questioned, running her fingers through her hair, messing it up and yet not ruining it, because when did Emily ever look bad? “Was it the girl in the flannel earlier that-”
Now Spencer interrupted Emily. Before she could even finish her sentence Spencer had grabbed her by the waist and kissed her long and hard. She tasted like tequila but Spencer didn’t care. Emily leaned into her, pressing her against the cold cement of the building, and Spencer didn’t care much about anything.
As Spencer pulled away, Emily kept her eyes closed trying to catch her breath while simultaneously wanting more. After the grip on her hips loosened and a silent pause passed, Emily’s eyes fluttered open.
“Em,” Spencer started as she gingerly traced the exposed skin below Emily’s crop top, “I’ve been thinking about you and only you all night. All week. All month. Do I need to go on?” Spencer asked.
Emily gave her an affectionate smile, rolling her eyes. “For a genius, you can be really stupid sometimes,” Emily said, and before Spencer could ask her what she meant by that, Emily had crushed their lips together again once more, sliding her hands up into Spencer’s hair, which sent shivers down her spine.
“What?” Spencer asked when she had a second where her lips were free.
Emily pulled away again, licking her lips, eyes dark. “3 weeks. 21 days.”
“Again…what?”
“That’s how long I’ve been trying to work up the courage to tell you how I feel about you. And you…you do it on a whim. You beat me to it,” Emily said, shaking her head. But she was smiling brightly.
Spencer let her head fall back against the wall, gazing at Emily, unsure of how she could be so lucky but not wanting to question it further. “It wasn’t just a whim.”
“Do you want to get out of here?” Emily asked. Spencer ran her thumb over the exposed skin by the top of her pants once more, feeling goosebumps break out over Emily’s skin.
“Yeah. I do,” Spencer said, leaning forward to steal another kiss. “But Aria will kill us for leaving her with Hanna.”
Emily smiled innocently, but her eyes were dark and glittering. “Can’t think of a better way to die.”
Spencer laughed until Emily dragged in her for another kiss, tugging gently on her lower lip.
“Yeah, let’s go.”
Spencer fumbled for Emily’s hand and pulled her towards the street, hailing a cab. When Emily pressed up against her, all warmth and softness and no boundaries, Spencer’s thoughts melted into an indecipherable hum, the only thing she could make out clearly was Emily.

The Spokane Diaries 03.30.2019

A lot has happened to the moving plan. And currently the plan could best be described as a vague, amorphous thing, with no clear destination, and too many tear-stained exclamation points. So I think it wise if I pause for a minute to summarize everything that’s happened up till now, with all its context, the choices we made and events which befell us.
When the plan was first formed, we immediately picked the city of Spokane, Washington to move to. It was just the right size; big enough to have everything we need, small enough not to have traffic. Decent amount of snow each year. Not next to a mountain, but a river with a gorgeous waterfall runs through it, and you can take a cable gondola ride across it. It hosted a world’s fair in the 70s, and some of those constructions remain. It has very friendly pot laws--just go in, show your ID, buy your pot.
Then, cause I’m such a genius, it occured to me that we’d picked Spokane kind of quickly, and mostly because we’d just visited Seattle, and this seemed an affordable Seattle. Perhaps, I wondered aloud, we should take a moment to consider the possibility of non-Spokane, of a different city entirely. Surely we didn’t pick the perfect place on the first attempt without even considering the rest of the lower 48, right? What might happen if we think outside the Spokane box?
A good deal of the filtering and decision-making about possible places for relocation occurs quickly and automatically. We don’t want to live anyplace that doesn’t get a decent amount of snow each year, so the bottom half of the country is therefore immediately discarded. We don’t want to live in a state that doesn’t allow recreational weed. We want natural beauty, or at least some sort of geographical or geological feature that makes it a winner. And it had to be affordable; we want to be able to afford living there and save for our dreams simultaneously.
For a period, Bangor Maine ruled the roost. It’s cold. It’s got New England natural beauty, and touches Canada, America’s hat, that country full of nice people who will never shoot you. Stephen King lives part time in a mansion in Bangor; you can take a picture of yourself standing at its spooky wrought-iron gates. It’s affordability was so-so, but it was on the eastern seaboard, less than a day’s drive to places like Boston, which was incredible! And hey, there’s always a chance you might be getting drywall screws at the hardware store and bump into Stephen King and get a selfie with the best-selling horror author ever! No mountains nearby, but...New England! Think of being there in the fall, when the leaves change color. Find a highway that’s not too heavily travelled and go driving in October and take pictures of the red, orange, and gold trees.
Problems began cropping up. The fact that the affordability was “so-so” didn’t help, and while Maine has legalized pot, political wrangling (and the endeavor’s own inherent complexity) have created a situation where dispensaries are not open for business yet, and I can’t tell when they will be.
And if anyone reading this doesn’t know about my relationship with pot, here it is: I have one, and I don’t particularly like living someplace where it’s banned for foolish reasons, such as:
It’s a gateway drug! (Then so is milk, and watching TV, and breathing air. Post hoc ergo propter hoc, dumbasses. You can’t even make that argument with alcohol, which actually can kill you.)
It robs you of your ambition! (Kinda, in that it softens the effects of certain unpleasant realities which I determine can’t be changed, and makes them easier to live with.)
It’s bad for you! (So are bacon and lethargy. That’s my decision to make, not someone else’s.)
It feeds a system whereby people are enslaved, brutalized, and killed! (No, the fact that it’s illegal feeds it. Make it legal, and no one ever shoots anyone over it again.)
Think of the children! (To quote George Carlin, fuck the children. Or possibly give them weed, too. You know how much less trauma I’d have suffered in high school if they’d had a weed club? I could have been networking in high school, for chrissakes. I might even have gone to a better college.)
Pardon that diversion. So, when last we checked, the husband and I were considering Bangor, Maine to be a possibility, but not necessarily the front-runner. What other places could we consider? Friends made suggestions; we checked them out. An early favorite was Marquette, Michigan.
Ah, lovely Marquette. It’s a picture postcard lakeside beauty. It sits on Lake Superior, and has the largest wooden dome--The Superior Dome--in the (country? known universe?). It was a small town, but it had a university and a pride parade, so it wasn’t that unfortunate squalid reactionary kind of small town. It’s beautiful in the fall, even though the fall only lasts a week. And it has that natural beauty/interesting feature we wanted, Lake Superior. With a lake that big, it’s just as good as living on the ocean, in that you can’t see anything but water all the way to the horizon, but without hurricanes. And Marquette was very affordable, best affordability of all considerations so far.
Couple of problems. Weed was just made legal by vote, but no dispensaries yet, and that could take a couple of years. And because Marquette is such a small town, with a population south of 21,000, we grew worried about our ability to find jobs. And then there was the snow.
Marquette gets about 200 inches of snow per year. One may immediately think, “Okay, well, then at least it’s less than 200 most years, right? Like 150 some years?” This year, Marquette had over 200 inches before the end of February, and they have snow as late as May. Let’s say they don’t get much more this year, and end up with 215 inches of snow per this year. That’s EIGHTEEN FEET of snow. I would sum up the first year of such conditions with, “Wow, cool! That’s a ton of snow!” And years two through infinity would be, “Holy fuck, please make it stop snowing!”
By this point, we had started with Spokane, changed our minds to Bangor, changed our minds again to definitely Marquette, then to maybe Marquette, and then all the wheels came off.
The year 2019 began, and it began poorly: the government was shut down, and because he was deemed essential, Zach was forced to continue working (for the IRS!) for no pay. Then he had a traffic accident--for him, a mountain of trauma, stress, and unwanted interaction--and his car was deemed a total loss. And the title wasn’t in his name. And his parents had to sign and notarize things, and he wasn’t close with them at the time, and they live in Montana.
All this stuff results in many extra hours of Bad Brain, lots of anger, and self-recrimination, and stress, and paperwork and interacting with potentially unpleasant people who may give you the help you need, and may not! Meanwhile, we have to keep working. Have to keep paying the bills. Have to keep making music (him) and trying not to subconsciously steer every moving plan we formulate into the rocky, prickly pear-studded embankment of failure with depressed second-guessing (me).
This brings us to a couple of weeks ago. We still have not been paid for Zach’s car by our insurance company, because of the many steps required to get the car titled in Zach’s name, all of which require signing and notarization, some here, some in Montana. And then, my brain decided to throw this out there: We’ve been to Denver. They have weed. They have mountains. They have snow, and jobs, and they’re closer! It’s under a hundo to fly there, and the flight is just over two hours. Easier to move to; easier to visit. In fact, specifically we chose Boulder. It features more snow and fewer traffic jams than Denver, though we could commute to Denver, if necessary for work.
Then, would you believe, problems. Boulder (and Denver, to a lesser extent) are not very affordable at all. It’s just right in every other aspect, but in price, it’s ungood. We’d have to spend maybe $100 less per month on rent there than here in Austin. In Marquette, with a little luck, we could spend $500 less. Think what we could do to Zach’s student loan bills with that shit! Think of the medical care and dentistry and car repairs and utility bills we could afford with that! None of that happens if we choose Boulder. We get mountains, but we pay dearly for them.
Now, to step back a smidge, consider this: I know that there will be problems with any choice we make. We’re not going to make a choice that results in us driving a U-Haul from our microscopic apartment in Austin to a mansion in Shangri-La. And I figure there’s pretty much one thing that’ll soften this transition: money. How much sounds like enough? Here’s how I tend to think of it: I’m about to do something that will involve me hanging from a rope tied to a loose branch over a thousand-foot chasm, and the only thing I’ll be able to influence is how good a rope it’s going to be. How much am I willing to pay to make sure the rope won’t fail? What if a $100 rope isn’t nearly as good as a $1,000 rope? What if the best rope you can get costs $10,000. Are you willing to spend less than that, if there’s even a chance you could save it up? ($10,000 is what we’re aiming for, by the way.) 
Something tells me there’s an easier solution to this conundrum, but it may be prohibitively difficult to find. Like...the perfect mate exists, but unfortunately, he/she/whoever lives in Turkmenistan and there’s absolutely ZERO chance that you’ll ever be within a thousand miles of ‘em, literally or figuratively. But! There’s always the chance that someone reading this may think, “Well, the solution is obvious; you just need to ignore concern X and move to city Y, and you’re kind of a dumbass for not figuring that out yourself.” The choices, then, are to ignore our concerns about weather, jobs, weed, ease to relocate to, distance from Austin, etc. and just move to Boulder, Colorado, Marquette, Michigan, Bangor, Maine, Spokane, Washington, Rapid City, South Dakota, Ashgabat, Turkmenistan (its capital!), or someplace else. Bam. Book it. Done.
This is a lot of the reason why I’ve been depressed recently: because I had a big, fat, beautiful GOAL for a while, and it got turned into a big, distressing, confusion. The best idea we’ve had so far to decide how to approach it? We’re going to save up and visit Boulder. Then we’re going to save up and visit Spokane or Marquette or Bangor. We’ll go to the places. We’ll observe our reactions. We’ll try to smart-decide instead of dumb-decide. We’ll be open to suggestions.

4 foods that are likely to suffer from climate change
From where they’re grown to how they taste to when we eat them, very little will stay the same in coming decades.
Climate change threatens many of the world’s favorite foods. A writeup in National Geographic’s Earth Day 2020 magazine by Daniel Stone lists seven “charismatic foods” that we can expect to “morph in appearance, nutritional value, availability, and price as growing regions shift and farmers turn to warm-weather crops.”
Right now, it’s easy to take for granted foods that grow far away and are imported to wherever we live. It’s easy to deny that climate change will affect their production, or to assume (erroneously) that warmer weather means longer and better growing conditions. The former may be true, but the latter not necessarily: “Lack of rainfall or insufficient cold weather could stunt even the best-laid seeds and plans,” Stone writes.
The UN’s Intergovernmental Panel on Climate Change does not expect the world to lose much arable land before 2050 and says that few foods will disappear by then, but we should certainly brace ourselves for changes to crops and diets. The best thing we can do is start to accustom ourselves to a more locally-sourced diet. For someone like myself, living in Ontario, Canada, that means acquiring a taste for cabbage and apples in January over lettuce and strawberries flown from California.
The following list reveals several of the foods that Stone thinks will change in coming decades. Some are not surprising, having been discussed on TreeHugger numerous times. All are likely to become more expensive, due to shrunken crop yields.
1. Coffee
Warmer, wetter weather is driving up infestations such as coffee leaf rust and the berry borer in high-altitude locations that used to be unsuitable to such pests. All coffee is currently grown in the so-called Bean Belt, which “wraps around the circumference of the planet and comprises 70 countries, including Vietnam, Brazil, Colombia, Tanzania, Ethiopia, and Central American nations.” Other countries could become more suitable to coffee production as a result of the warmer weather, but they too would be susceptible to unpredictable and more extreme weather patterns.
An additional problem is that 60 percent of wild coffee species are nearing extinction, due to temperature increases, drought, and human encroachment. While the coffee that most people drink comes from only two varieties – arabic and robusta – having such a narrow source makes it vulnerable to climate change. Wild species have evolved traits that make them more resilient to change, making them crucial for coffee crop development, and their loss would spell disaster for the entire industry.
2. Bananas
The cheapest, most versatile fruit in the supermarket could disappear someday if an aggressive fungus called fusarium wilt (or Tropical Race 4) is not brought under control. Already it has decimated crops in Africa, Asia, Australia, parts of the Middle East, and most recently Colombia, where a state of emergency was declared last summer.
National Geographic reports that, while warming may have expanded the banana’s growing area, it has simultaneously “raised the risk of fungi that devastate plants.” Similar to coffee, the fact that 99.9 percent of banana cultivation relies on a single variety, the Cavendish, makes it particularly susceptible to disease. As I wrote before,
“We should have learned our lesson years ago because the same situation played out in the mid-20th century, when the popular Gros Michel banana – the main variety exported to Europe and North America at the time – nearly went extinct from an earlier strain of Panama disease, TR1.”
3. Wine
Grapes are a finicky crop at the best of times, but it’s about to get even harder for vineyard owners and winemakers. “The beverage will endure, but changes in terroirs will force vintners to find ways to maintain wines’ signature tastes,” Stone writes for National Geographic. A study from earlier this year found that, with a 2-degree Celsius global temperature increase, suitable wine-grape growing regions in the world could shrink by as much as 56 percent. Make that 4 degrees and we’d lose 85 percent.
Much of wine’s susceptibility comes from the fact that it has failed to evolve with the times. Many of the pinot noir and syrah grapes used in France today are genetically identical to the ones used by ancient Romans, which of course allows for an illustrious pedigree, but makes it fragile in the face of disease. To quote post-doctoral researcher Zoë Migicovsky of Dalhousie University, “We [will] need to use more chemicals and sprays in growing [them] as threats advance.” The good news is that new grape varieties can be bred for greater resilience, but much has to change to allow for that, from labelling laws to agricultural practices to consumer acceptance.
4. Olives
National Geographic writes that “early frosts, heavy rain, and wind halved Italy’s production last year. Such extremes could limit crops in many places.” Indeed, TreeHugger reported in 2017 that hot muggy weather had attracted fruit flies and bacteria to Italian olive groves, that heat waves had decimated parts of Greek crops, and floods in Spain had ruined even more.
The situation has only worsened since then. Now Mediterranean growing regions are threatened by a bacterium called Xylella fastidiosa, or olive leprosy, that blocks an olive tree’s ability to move nutrients, causing it to wither and die. Italy has seen a 60 percent decline in crop yields since the bacterium’s discovery. Unless definitive action is taken soon, having a bowl of olives to nibble with wine could soon be a thing of the past.
Stone’s list includes avocados, salmon, and shrimp, as well, which you can read more about in the current Earth Day issue of National Geographic.

Intellectual Property In Coffee: Imitation Is No Longer Flattering
“Imitation is the sincerest form of flattery.”
Writer Charles Caleb Colton must have never met an intellectual property lawyer. But when does imitation become outright copyright or trademark infringement?
Intellectual property (IP) covers a lot of ground and is found in every aspect of the coffee value chain. From patenting coffee makers to trademarking blend names to granting plant breeders’ rights, IP’s reach is far and influential in coffee history.
In this three-part series, we’ll take a look at several angles of IP as it shows up in the coffee industry. To begin with, we’ll take a broad look at coffee IP’s international history and its most commonly seen cases. In the second part, we’ll explore how culture and social media blur the lines of influence and originality. And in the final piece, we delve into IP on a farm level.
Patents
IP’s global history began with the establishment of patent law in England in 1624, with the Statute of Monopolies. Two centuries later in Italy, Angelo Moriondo would be granted a patent for “New steam machinery for the economic and instantaneous confection of coffee beverage.” The new machine, combining water and steam, was presented at the Turin General Exposition in 1884 and was the precursor to the espresso machine.
Another notable mark in coffee patent history is the German invention of the first dripper and filter. In 1908, Melitta Bentz punctured a hole in the bottom of a pot, lined it with notebook paper, and created a way to filter out coffee grounds. The patent, “Filter Top Device lined with Filter Paper,” led to the Melitta company’s birth and the beginning of many new pour-over devices. Trend watchers will not be surprised to learn that every year, there continue to dozens of companies claiming to invent a new device for pouring water over coffee.
Nowadays, patents filed in one country may or may not be simultaneously filed in another country. While efforts have been made to make international filings easier and minimum requirements do exist for those who participate in Patent Cooperation Treaty, every country still determines and executes its own laws.
The US’s switch in 2013 from a “first-to-invent” system to a “first-inventor-to-file” system to match the rest of the world may see ripple effects in US coffee technology innovation. It no longer matters if you were the first to invent a new component in a coffee roaster. If someone else was working on a similar component and has the resources for a patent attorney, it becomes a race to file.
Trademarks
Patenting inventions is only one portion of IP. Trademark protection, which covers name and logo usage, is another major aspect and affects every coffee company.
When Minnesota’s Dogwood Coffee first began roasting, the company named its cold brew blend “Zamboni.” It was a love letter to their staff’s enjoyment of hockey and the machines that rule the rink. “We didn’t even make it through a full season before we received the cease-and-desist letter from [the] Zamboni [corporation],” says Dan Anderson, owner of Dogwood.
Luckily, Anderson was able to work out a licensing agreement and is now far more educated on the topic of IP. Looking back, he says the experience “really brought home the relevance of protecting your brand and trademarks. I think that definitely played a part in us figuring out our own protection.” Dogwood now goes through a thorough name vetting practice for each of their blends and subsequently registers the blend names as trademarks.
Blends take a lot of work and Anderson sees the trademark protection as a necessary step in the business process. “A lot of people can relate to how hard you worked to build knowledge of your company and your espresso blends,” he says. “Go ahead and take these steps to protect from potential confusion in the marketplace.”
It’s good business sense to research potential names before spending money on marketing and other collateral. Marshall Fuss, a California attorney specializing in the coffee industry, often advises his clients to be as unique as possible. “There’s a tendency for everybody to be looking at similar words. Perk this, drip that,” Fuss says. “The thing that I try to get across is that originality counts.” The more the name generically describes the product, like “cone dripper,” the less likely you’ll be approved for the trademark.
Once a trademark is registered, it’s still up to the business to enforce it. While it may seem daunting at first, says Nick Pearson, Financial Controller and General Manager at Dogwood, the company has been able to handle everything internally. Pearson has so far been able to handle infringements casually, first reaching out over email instead of going straight to a cease-and-desist letter. Most companies are understanding, but it becomes more difficult once a brand has invested in a name. He says, “Those are tougher and brutal for us because we don’t want to be the bad guy. But we also have to protect our brand.”
Copyrights
In the realm of copyright, issues of IP crop up frequently through day-to-day marketing efforts. Farah Bhatti, shareholder at US-based business law firm Buchalter, specializes in trademark prosecution and is the Chair of the firm’s Internet, E-Commerce, and Social Media Practice Group. Buchalter’s coverage includes all aspects of business law, including IP, and multiple industries. When asked about what she thinks are the major mistakes businesses make in operating online, Bhatti says the first one is “borrowing” images that are found online. She says, “People think, ‘I do a Google search, there’s an image there.’ [They think they] can just take it and use it.”
While the laws themselves are slow in incorporating new technology, Bhatti advises her clients based on analogies to when those laws were written. Before, a law would apply to magazines manipulating and republishing photos, she says, “Now it’s just cut and paste on a computer. But it’s still at the end of the day, the same thing. You’re taking somebody’s copyrighted material and you’re reproducing them without their authorization.”
The concept of using what you find on the internet and taking it is especially prominent on Instagram, where brands are often seen re-gramming other accounts. Without express permission from the original copyright holder, your regram with credit is still copyright infringement.
Bryan Schiele is known for his crisp and colorful images and is no stranger to having his images used without permission and/or credit. Schiele estimates he’s submitted over one hundred copyright infringement reports on Instagram over the last few years. “At one point I was seeing my photos used without credit or permission roughly a few dozen times a month,” says Schiele. Instagram’s guidelines clearly state copyright ownership as “if you take a photo, you generally own the copyright in that photo.” He no longer hesitates at reporting stolen, uncredited content. He says, “Since they didn’t have the courtesy to ask permission, I won’t ask their permission to have it removed.”
The other major mistake that Bhatti sees businesses make online is publicizing when a celebrity uses their products or services. While more often seen with apparel companies, cafes and product manufacturers have also seen their share of celebrity usage and fandom. For example, Alton Brown’s Road Eats tours is known for soliciting recommendations and visiting smaller specialty cafes around the US. Brown’s favoring of certain cafes has surely helped in their retail sales, but that doesn’t mean business owners have the right to post photos of Brown eating or drinking there. Right of publicity laws vary state to state in the US and cover commercial use of an individual’s identity. In some states, posting a photo without prior agreement with the celebrity can lead to a lawsuit.
When posting an image of a celebrity using their product, you not only have copyright infringement on the photo, but you also have right of publicity issues, says Bhatti. “You’re basically stating that a celebrity is endorsing your product even though they may not be. You’re putting words in their mouth.” As a business, she continues, “you have a different set of rules as opposed to an individual who doesn’t have a commercial basis behind their statement.”
Another common copyright violation is exceeding a license. Earlier this year, the owners of the Grumpy Cat brand were awarded £500k in a lawsuit against US coffee company Grenade for unauthorized usage of the cat’s photos. The original licensing agreement was for using the photo on the “Grumppuccino” iced coffee line, but Grenade exceeded its usage with roasted coffee and T-shirts.
IP through the filter of the coffee industry is undoubtedly a complex topic. When a coffee company begins operating across international borders, it may find that some countries are more lenient than others for trademark registrations. Your company’s name may be filed in another country by someone else, and you won’t be able to claim it without substantial resources.
Plants Have IP, Too
Innovation and IP protection in coffee are not limited to equipment manufacturers and roasters, but can even include coffee growers themselves. IP for plants is called plant breeders’ rights, which allow breeders to license out a variety to anyone they desire. In a Re:co Symposium talk on coffee technology, Hanna Neuschwander, Communications Director for World Coffee Research, compares the pace of innovation between coffee machines and plant breeders’ rights. A search for the phrase “coffee machine” in both the US’s and China’s public patent search systems resulted in 3352 patents registered since 1976. In comparison, the number of filings listed in the International Union for the Protection of New Varieties of Plants (UPOV) database for new coffee varieties was at a measly count of 36.
So what does the future of IP in coffee look like? It’ll surely be with an international lens. More entries into the market, and the globalization of social media mean that companies need to work harder to stand out. Imitation is no longer flattering.

Most companies are understanding, but it becomes more difficult once a brand has invested in a name. He says, “Those are tougher and brutal for us because we don’t want to be the bad guy. But we also have to protect our brand.”
