4.° Que como lo tiene establecido esta Corte en reiterados pronunciamientos, las comunicaciones telefónicas interestatales están sujetas a jurisdicción nacional, pues como se ha dicho en Fallos, 257-159 DERECHO, 8-141, fallo 1354), ellas constituyen el ejercicio del comercio, forman parte integrante del sistema nacional de postas y correos a que hace referencia el art. 67, inc. 13 de la Carta Constitucional y tienden a promover la prosperidad, adelanto y bienestar general del país.
5.° Que esa jurisdicción comprende, para. las entidades vinculadas a los servicios interprovinciales —como acontece con la actora-— los aspectos locales de su tráfico, pues éste constituye, en virtud de las razones expuestas por esta Corte en numerosos precedentes, un elemento indispensable del contenido nacional de la empresa. (Fallos, 257-159; 268-306 [Et. DERECHO, 19-455, fallo 99581, entre otros). Siendo así, el origen local de la concesión que ligó a la actora con la provincia de Salta, no es óbice para someter a la jurisdicción nacional los servicios prestados por ella.
6.° Que la tesis de la demandada, que pretende rescatar de la nacionalización operada a través de la interconexión de líneas, sus atribuciones en materia de tarifas, conduciría a admitir la concurrencia de los estados nacional y provinciales para regular el precio de los servicios, todo ello en detrimento del carácter inescindible de que se hizo mérito en el considerando precedente, creando una notoria incompatibilidad entre las normas reguladoras de estas comunicaciones.
7.° Que esa potestad de la autoridad nacional ha permitido al Congreso legislar sobre los aspectos de las actividades interiores susceptibles de menoscabar u obstruir el comercio interprovincial y exterior o perturbar el bienestar general en el orden nacional, en ejercicio de la facultad que le asiste para reglar aquél y fomentar éste y en la medida en que a tales fines fuere necesario (Fallos, 201-336, 338; 213-467: 257-159 y sus citas).
8.° Que habida cuenta de ello, la sanción de la ley 19.798 que reguló con carácter nacional los servicios interconectados (art. 39) y las tarifas que rigen dichos servicios (art. 49) constituye el fundamento legal del reajuste dispuesto por el decreto 185/73 y torna impugnable, en punto a su validez constitucional, al decreto dictado por la provincia por cades delegada debido avandaro. impericia sustancia de poderes duales de policía porten arteide (Fallos, 257- 150) que no conare interferir en la jurisdicción nacional para la cual la fijación de tarifas constituye un medio necesario de decretos acio 11% 185/73). En efecto, integra la ecuación financiera propia de la nota de regularidad del servicio público.
9.° Que respecto de la acción por daños y perjuicios debe considerarse en primer lugar defensa de prescripción opuesta por la demandada. En razón de lo expresado en los considerandos anteriores cabe concluir que la responsabilidad en que incinera la provincia de Salta por disponer el congelamiento de tarifas es de carácter extracontractual y es aplicable entonces el art. 4037 del cód. civil que establece como término de prescripción dos años.
10.° Que el plazo de prescripción de la acción comienza desde que aquélla pueda ser ejercida. Ello ocurre, por regla general, después que se produce el daño cuya reparación se procura obtener (Fallos, 229-12). En el caso, debe computarse desde la fecha en que los servicios sujetos a tarifa fueron prestados, es decir a partir del hecho que creaba el título de la obligación a favor de la actora (Fallos, 238-563).
