'Children Are Not Mothers': What is at stake with Brazil bill that equates abortion after 22 weeks of pregnancy to homicide

A bill signed by 32 deputies intends to equate any abortion performed in Brazil after 22 weeks of pregnancy with the crime of homicide.
The rule would even apply to cases in which the procedure is authorized by Brazilian legislation, such as pregnancy resulting from rape.
Bill 1904/2024, whose first author is congressman Sóstenes Cavalcante (Liberal Party - Rio de Janeiro), adds a few paragraphs to four articles of the Brazilian Penal Code, which was established in 1940.
Article 124 of the Civil Code, for example, already establishes as a crime "causing oneself to have an abortion or allowing someone else to do so."
But, according to the new proposal being discussed in the Chamber of Deputies, "when there is fetal viability, presumed in pregnancies over 22 weeks, the penalties will be applied in accordance with the crime of simple homicide."
On Wednesday night (June 12th, 2024), Brazil's Chamber of Deputies approved the urgency regime for processing the project, which was requested by congressman Eli Borges (LIberal Party - Tocantins) — who also signed the document.
This means that the proposal can be voted directly by the plenary of the Chamber, without the need for debates and opinions in thematic committees of Congress.
With this, the Plenary can vote on the project in the coming days. The urgent request was included on the agenda by the President of the Chamber, Arthur Lira (Progressive Party - Aladoas).
Victims of violence
Bill 1904/2024 intends to change some articles of the Penal Code, with the aim of preventing any abortion from occurring when the pregnancy exceeds 22 weeks.
Currently, Brazilian law allows abortion in three situations:
When the pregnancy is the result of rape;
If the pregnancy poses a risk to the woman’s life;
If the fetus is anencephalic, a condition characterized by the absence of the brain and skullcap.
In an article published on the website of the Brazilian Center for Health Studies (Cebes), doctor Ana Costa, executive director of the institution, classifies the bill as "a reissue of the 'Rapist Statute', which obliges women to become pregnant as a result of rape under penalty of imprisonment".
Cebes also highlights that late access to legal abortion "reflects inequality and inequity in health care, particularly impacting children (10-14 years old), poor women, black women, and those living in rural areas."
A group of 18 entities in the sector came together to create the "Children Are Not Mothers" campaign, which characterizes the changes proposed in the law as the "Child Pregnancy Bill".
According to the creators of the movement, the change in legislation will mainly harm children under 14 years of age, who represent the largest group that needs abortion services after the third trimester.
According to them, in this age group — in which any pregnancy is the result of presumed rape — it takes longer to discover or even identify a pregnancy.
Furthermore, in two thirds of cases, the perpetrator of the rape is from the girl's own family — which inhibits the victim from seeking health services or reporting the crime to authorities in the first weeks of pregnancy.
The campaign also highlights that the eventual change in the law will mean that those involved in abortion could be convicted of the crime of simple homicide, with a prison sentence of up to 20 years.
Meanwhile, the legislation establishes a sentence of around 10 years — or half the time — for the crime of rape.
According to the Brazilian Public Security Yearbook, 74,930 people were raped in Brazil in 2022. Of these, 88.7% of the victims were female and around 60% were at most 13 years old.
DataSUS reports that, in 2019, around 70 pregnancies were legally terminated in Brazilian children and adolescents under the age of 14.
The campaign warns that, if approved, the project "will force girls who are victims of violence to continue their pregnancy" and this will mean a setback "to the sexual and reproductive rights guaranteed by law since 1940."
What supporters of the bill say
The project being discussed in the Chamber argues that the Penal Code, established in 1940, does not establish this limit of 22 weeks because "a last-trimester abortion was an unthinkable reality [at that time] and, if it were possible, no one would call it an abortion, but homicide or infanticide".
The text of the project also argues that "to grant women the right to terminate pregnancy, regardless of gestational age, and whatever the weight of the unborn child, it was necessary to subvert the basic principles of the Rule of Law, the same ones that gave rise to to American Independence and modern democracy."
According to the deputies' proposal, people involved in an abortion after 22 weeks of gestation — such as the woman and the health professional — can be convicted of the crime of simple homicide.
Currently, sentences for simple homicide in Brazil range from 6 to 20 years in prison.
On social media, congressman Sóstenes Cavalcante wrote that Bill 1904 "aims to consider late-term abortion as homicide, reinforcing the protection of life from conception."
The project was filed on May 17th. That same day, the minister of the Federal Supreme Court (STF), Alexandre de Moraes, had suspended a resolution from the Federal Council of Medicine (CFM) that prohibited the so-called fetal asystole.
This procedure, recommended by the World Health Organization (WHO) as one of the stages of abortion resulting from rape in the last trimester of pregnancy, uses medications to stop the fetal heartbeat before it is removed from the uterus.
According to Moraes, the CFM resolution exceeded the regulatory competence of the council and imposed "both on the medical professional and the pregnant victim of rape a restriction of rights not provided for by law capable of creating concrete and significantly worrying embarrassments for women's health" .
The STF minister also recalled that Brazilian legislation does not stipulate any "circumstantial, procedural, or temporal" limitations for carrying out the abortion provided for by law.
Moraes's decision was preliminary and will be discussed in the future in the Supreme Court plenary. The CFM also appealed the minister's opinion.

Fancuries FYC, Heck Yeah!
Hi, folks! I hope you all are doing well. I’m InfiStudios, friendly neighborhood jumping spider and fanseries fanatic, and I’m so, so excited for this year’s Fancuries. I always love seeing everyone’s amazing creativity, and because this year is the first where I’m actually participating, I finally have a chance to babble about my own fanseries. 
Speaking of my own work, the bulk of it is my Halloween fanseries. They’re an annual tradition for me, and I consider them my main fanseries. 
HORRORIFFIC PRETTY CURE
Horroriffic is the first of the Halloween fanseries. Its motifs are classic monsters, light, and Victorian/gaslamp aesthetics, and its core themes are power, connection, and legacy.
It has an info doc that’s very much under construction here if you’d like to read more about it!
HORRORSHOW PRETTY CURE
The second of the Halloween fanseries, Horrorshow has films as its core motif and draws a lot on 1950s aesthetics as well, and its themes are treating others and yourself with kindness. It follows Ethel Bleak, a horribly anxious star student who works part-time at the Caligari Film Library…a job that gets far too interesting when an accident sends the malevolent spirits housed within cursed films on a destructive rampage through the city of Hitchworth. Luckily, there’s a solution to this. Using the power of the three remaining Curses, Ethel and two of her co-workers - annoying, cruel know-it-all Cebe Wood and laid-back, sarcastic Shane Tamboli - can transform into warriors called Pretty Cure and fight back against the monsters.

MONSTROSITY PRETTY CURE
The third of the Halloween fanseries, Monstrosity’s core motif is monsters under the bed, and its core themes are the bonds between people and the idea of community. 
Pellinore Valiente Denton was only six when the tip of Mount Etna exploded, sending a brilliant beam of light into the sky and calling the monsters out of the shadows. She’s lived her whole life in a strange world, a world lit every waking moment by fluorescent lights and constant, thrumming fear. In the midst of all this, her parents have moved back to their hometown of Huerta, TX in order to work on some sort of project, which Pellinore isn’t over the moon about - she’s tired of having to say goodbye to every friend she’s ever made. Fortunately for her, though, she’s about to make another one. Not two days into their stay there, Huerta throws off its sleepy small-town guise. In the middle of a celebration of Dia de los Muertos, the lake the community borders erupts in exactly the same way Mt. Etna did. It showers the community in a strange light, brings a rainstorm that lasts for days on end, and rockets the populace into a new state of terror - terror that turns out to be well-founded, because soon after the town is attacked by a bizarre monster that can walk in the light and resembles a member of the community. Pellinore is terrified, but somehow, she knows she can help fight it. Drawing on her love of magical girls and a new kind of power, she transforms into a warrior known as Cure Weaver. 
The only catch? Her powers called a monster to her - Aracan, a cocky smart-aleck who’s Pellinore’s opposite in every way…and also, apparently, her partner as a Pretty Cure. Now, Pellinore finds herself under new pressure - not only must she succeed as a student and make new friends, she must hide Aracan from the populace, deal with the monsters, and unravel the mysteries of Huerta.

This movie made me think about the trouble with hindsight. The way we go about making sense of something after it’s happened – we can easily see the path once we’re at the destination, but while we’re on the journey we ask ourselves, “What the fuck is going on?” 
That’s how Out of the Blue made me feel.
We follow the story of CeBe (Linda Manz) – a self-proclaimed punk, obsessed with Elvis, whose mantra is “Subvert normality. Disco sucks. Kill all hippies!” But CeBe is also a lonely girl in high school who sucks her thumb when she sleeps. She has a few friends, but her life is mostly drifting around and getting into trouble. She carelessly wanders off with strangers – not because she’s naïve, but because there’s something about her that wants to be alive and part of that is tempting fate.
And it’s not like she’s has stable adults around her. Every person who should be taking care of her is taking care of themselves via an addiction of some kind. It’s clear her mom Kathy (Sharon Farrell) loves her, but heroin makes her a fraction of the parent she should be. Her dad Don (Dennis Hopper) is a living torrent of drugs who’s just returned from a five-year stint in prison for a bad “accident” that injured CeBe and killed others.

Diavolo taking his three dogs for a walk when he sees absolute babe Lucifer jogging in the park and needs his number.
500ish words, g, obviously it’s dialuci, because I’M A ONE TRICK PONY!!!!
important notes: -diavolo has 3 darling doberman pinschers named cebe, bero, and urus because he thinks he’s hilarious. he will, without shame, call them by their nicknames: ceecee, beebo, and urururururruru. -it’s like, 6am and dia is barely alive right now. he straight up rolled out of bed and took his dogs out.

They’re rounding the curve of the lake again, and Diavolo sees the jogger approaching once more. Now that they’re several yards away and facing each other, Diavolo can’t blatantly stare at him anymore. He does, however, ponder in his brain the socially acceptable distance before he can smile at him without it being weird. 
Diavolo laughs at this thought internally, because when has he ever cared about being weird?
He should have put on nicer clothes, he laments, looking down at his sweatpants and the casual hoodie he’d thrown on to hide his pajama shirt. How was he supposed to know that he was going to run into someone this hot at six in the morning? 
In this moment, as distracted as Diavolo is with his attire, he doesn’t notice that he isn’t the only one excited to be near the jogger. His dogs have begun to snuffle with excitement, pulling Diavolo along the road at a quicker pace than usual. The distance lessening between them, Diavolo’s eyes glancing up to finally get another view at the man’s handsome face. It’s quite a lovely face, one with dark eyes that seem to look at Diavolo with quick, almost imperceptible interest.  
Diavolo’s delighted for a moment, before the man’s eyes glance down at the three excitable dogs panting and happily trying to pull out of Diavolo’s grasp towards him with significantly more interest than the first time they’d passed him. 
Ah, that’s reasonable. Now that the four of them are only a few yards before intersecting, it would make sense that this man is hesitant about the excited dogs. Noticing this, Diavolo offers his biggest, and what he hopes is comforting, smile;
“They won’t bite you, I think they just want to say hello!” He laughs, pulling on the leashes. “Come on, girls, let’s go.” The man doesn’t respond, offering a polite nod as he continues. And that’s it, that’s all that happens, and Diavolo starts to plan what he’s going to say to the man on their third pass...
Then, just as they’ve passed shoulders, Urus darts forward towards the man, and Diavolo stumbles. 
Ah, oh shit--
“Urus!” Diavolo shouts, “Down! Stop!” 
In their excitement, they hop over one another and circle around Diavolo and the new man, which is usually fine, but not when they’re all hooked to him via leashes. The leads cross over and twist around, Diavolo desperately trying to keep them untangled in both of his hands and not completely knock the jogging man over. Only stopped by her leash being wrapped around Diavolo’s waist and looped over Bero’s, Cebe makes an aborted attempt to bring her feet up on the man’s chest. 
“Cebe, no.” Diavolo orders, reaching out to hold her back, but it’s less than effective when Urus bumps into the back of his legs, and ends up shoving Diavolo faster. Someone’s leash, because the universe is cruel and unforgiving, has wrapped one around Diavolo’s legs tight enough to make him lose his balance completely. The Brazil we want, with health for all!
As Brazil re-embraces democratic values, one of the key priorities reactivated from the post-military dictatorship era is the right to health. The Brazilian constitution guarantees universal, free, and equal access to healthcare, an essential aspect for democratic social movements

The Brazilian Center for Health Studies (CEBES) organized a series of discussions between April and May, under the theme “The Brazil and the Health that We Want”. The meetings brought together over 1,000 participants from across Brazil to discuss and propose new measures to protect health rights.
CEBES, a prominent organization in Brazilian Public Health Reform, has played a pivotal role in advocating for health as a fundamental right enshrined in Brazil’s 1988 Constitution and in establishing the Unified Health System (SUS). Guided by the belief that “Health is democracy, and democracy is health,” the organization operates as a chapter of the Latin American Association of Social Medicine (ALAMES) and a member of the People’s Health Movement (PHM).
In a statement issued after the cycle of discussions, Carlos Fidelis, president of CEBES, emphasized the significance of social mobilization during this crucial period, following the election of a progressive government in Brazil. Fidelis noted the notable nationwide movement advocating for the right to health, reflecting the collective aspiration to shape a better future.
Ana Costa, a member of Cebes’ Executive Board, added, “An up-to-date resumption of the Sanitary Reform is urgently needed, not to adjust it to the impositions of capitalism and neoliberalism, but to recover its radical nature.” According to Costa, the state model in place at the moment, which freezes spending on social policies and dismantles the social security system, must be addressed by the entities that defend democracy. “The issue of persistent discrimination or medicalization in services should not be considered minor,” she added.

PHIL 1101: Midterm Paper
In the Ego and Id by Sigmund Freud, this idea is presented of us having three distinct parts to the mind. We have the preconscious, conscious, and unconscious. The preconscious is responsible for the material that can easily be recalled into your awareness. The conscious consists of material you are explicitly aware of, while your unconscious is material that cannot be recalled without some effort into your awareness. These ideas were a part of Freud’s “Topographical model.” This was meant to illustrate the function and structure of the mind.
Freud’s theories of the subconscious relate to the Theory of Recollection and the ideas of the Forms developed through Plato’s teachings. Although Freud’s and Plato’s beliefs are fundamentally different, both have ideas that would suggest humans having different levels of consciousness, and both have a central belief the mind is always working.
The discovery of the unconscious indicates that there is more going on than we are aware of on a conscious mind. In a sense, we do and think things that we do not know we think and do. This is why Freud’s beliefs conflict with the principles of Cogito ergo sum. The direct knowledge of our minds is called into question. Freud’s ideas call to question how we define existence.
Freud created this concept of Freudian slips. Essentially it is the way your unconscious presents itself in the conscious world. For example, when you tap your pen in class, bounce your knee when you’re sitting, it is your unconscious mind doing that. The mind is always working. There are multiple instances of this happening in our day-to-day lives. “We have evidence that even subtle and difficult intellectual operations which ordinarily require strenuous reflection can equally be carried out preconsciously and without coming into consciousness” (Freud pg. 20). This can occur when you wake up and have the answer to a question you spent the previous night reflecting upon. This idea further reflects the statement that our minds stay at work even if we are not consciously aware of what it is doing.
Freud stated, “the distinction between conscious and the unconscious is in the last resort a question of perception, which must be answered ‘yes’ or ‘no,’ and the act of perception itself tells us nothing of the reason why a thing is or is not perceived” (Freud, pg. 7). The concept of the unconscious v. conscious calls into question our level of perception. There is the belief that we do possess the ability to distinguish the varying degrees of consciousness. Just as there are vividly tangibly conscious processes, the argument that we experience faintly conscious events (Freud, pg 7) arises. We can only be made aware of the differences if we actively pay attention and call attention to those processes, making them conscious.
Plato had this theory of the Forms brought up in his book Five Dialogues. It centers on the idea that we’ve experienced Truth in another plane of existence, and that is why we have these ideal concepts or Forms. Plato believed that our essence was able to achieve these things in death once our bodies were freed from the confines of our bodies. Plato also believed that we experienced these Forms in our day-to-day lives, but we never achieved the truth of these Forms. Another point that may suggest this statement to be true is our ability to recognize that something is deficient. But if that were true, it could suggest that we actively spend part of our consciousness trying to recall these. This confirms the thought of the subconscious, or at the very least, suggests that we have a subconscious thought process in which we are not entirely aware.
Plato had a theory known as the Theory of Recollection, and in the simplest of terms, it touches on the idea that we can actively recall ideas through association. Plato references this during his discussion with Cebes and Simmias when he states, “to know a man is surely a different knowledge from knowing a lyre” (Plato, pg 111). We can distinguish between the two because we have learned throughout our lives to make distinctions between the two. This belief is similar to Freud’s concept of word presentations. Word-presentations was Freud’s way of explaining how we can recall preconscious material (Freud, pg 12). Through hearing certain sounds or words, we trigger our minds to pull forth the thought needed to participate in an active state of consciousness.
Freud’s ideas surrounding the subconscious, although interesting, are not unique or new. Plato had a similar ideology. Although they are not exactly alike and have some conflicting viewpoints, the overall central idea is the same, our minds stay working. Plato had a more spiritual or idealist point of view when it came to discussing the topic. This is demonstrated through his theories of Recollection and of the Forms. Our subconscious allows us to recognize when we find something to be deficient and explains a possible reason for our ability to differentiate. Freud’s beliefs represented the thinking of a more primal or irrational mind. Through this “topographical model,” Freud was able to bring a more materialistic ideology to this concept. Both had a concept that would explain our ability to associate and gain true knowledge of our everyday reality.
