US Department of Labor (DOL, Illinois Attorney General recovered $3M in back wages and damages for 283 workers at the Elk Grove processing plant. A joint investigation finds Greenridge Farms Inc. failed to pay overtime. CHICAGO, IL (STL.News) A joint investigation by the US Department of Labor and the Illinois Office of the Attorney General has recovered $3 million in back wages, damages, and interest for 283 workers denied overtime owed under federal and state regulations by an Elk Grove meat processing and packaging plant. In a consent decree filed in state court, Greenridge Farms Inc. agreed to pay the back wages, damages, and interest to resolve a July 2023 lawsuit by the state's Attorney General.  The decree references the settlement agreement Greenridge Farms, owners Michael Madej and Sebastian Madej, and KLC Global Services Ltd. — which performs management and payroll functions for the plant — entered into with the department's Wage and Hour Division. The action follows an investigation by the department's Wage and Hour Division and the State of Illinois that found the deli products manufacturer paid affected workers one rate for all hours worked.  Investigators learned the employer issued checks to employees for their first 40 hours and then paid cash for all hours over 40 when, in fact, Greenridge Farms was legally required to pay employees time and one-half their hourly rate of pay for hours over 40 in a workweek. The investigation determined the employer failed to pay the legally required overtime wages from at least 2013 to 2022 and that the employer violated the Fair Labor Standards Act and the Illinois Minimum Wage Law. During the investigation, the state subpoenaed records from Greenridge Farms and discovered the employer sometimes used a second set of books to pay straight time for overtime hours.  In Illinois, an employer may be required to repay the back wages due, triple the amount in liquidated damages, and a 5 percent monthly penalty on unpaid wages.  State law also allows investigators to review payroll periods dating back three years or more. "Working with the State of Illinois, our investigators discovered that Greenridge Farms intentionally denied 283 workers their full-earned wages for seven years," said Wage and Hour District Director Tom Gauza in Chicago.  "The wages recovered for these workers will have a significant impact on these workers' lives.  Many of them may have not understood their rights to overtime." The consent decree signed by Circuit Court Judge Michael T. Mullen of the Cook County, Chancery Division on Dec. 20, 2023, requires Greenridge Farms to pay $3 million in back wages, damages, and interest owed as a result of the federal and state investigations in installments from December 1, 2023, through October 1, 2025.  That amount includes a payment of $1.5 million in back wages and liquidated damages owed to 193 workers from May 24, 2019, through May 24, 2022, the maximum investigative period under federal law.  This payment is required as part of a settlement agreement with the Wage and Hour Division. "The Department of Labor is determined to use all available tools – including working with our partners in the Office of the Illinois Attorney General – to hold employers accountable for depriving employees of their rightful earnings," explained Regional Solicitor of Labor Christine Heri in Chicago. The State banks doing a commercial business exclusively are the State Bank of Virginia, the City Bank and the Citizens of Richmond. [RVCJ03]
The City Bank of Richmond, 1109 E. Main street, was chartered in 1870 to do an insurance as well as banking business, and was originally called the Mechanics and Merchants Savings Bank. This charter was amended in 1872, and its name changed to what it is at present; and again amended in 1876, so as to provide for a banking business exclusively.

It has experienced a remarkable and yet substantial growth, especially in the last three or four years, during which its loans and discounts. deposits and other evidences of development, have increased fully fifty per cent. It had at the time of its statement last available for this publication, July 12th, 1892, total resources of $1,245,000, embracing loans and discounts of $1,013,000, and cash items and due from banks and bankers, $230,000.

The deposits with it at the same time aggregated $740,000. It has $400,000 capital stock and a $90,000 surplus fund. It is the depositary of the city of Richmond. Its president is William H. Palmer, president also of the Virginia Fire and Marine Insurance Company; its vice-president, E. B. Addison, of Allison & Addison, manufacturers of fertilizers; and its cashier is J. W. Sinton, who has been in the banking Inisiness for fifteen years—for eight years of that time with this institution.

That’s quite the laundry list of Richmond businessmen, some of whom have been covered in other posts on this Tumblr. Quite fascinating actually to see the incestuous overlap between firms. One wonders if Messrs. Hawes or Trigg ever had to fret about liquidity for their enterprises. Trigg himself was not only involved with the railroads but also the frontman for Trigg Shipyard, which briefly built boats for the U. S. Navy on Chapel Island near Great Shiplock Park.

As for City Bank of Richmond, their story got complicated. Like so many of their neighboring competitors, it merged with the State Bank (see the Baist map above) in 1922, which then merged with Planters National Bank in 1926.  Crestar, incorporated in Virginia in June 1962 acquired a majority of stock in a number of Virginia banks including State-Planters Bank of Commerce & Trusts, which was then merged with SunTrust in 1998. As for the building itself, it likely perished during the creation of the First & Merchants National Bank Building in 1973, like Liverpool & London, & Globe, and others.

Equity allows creative remedies for wrongs that do not fit within the confines of traditional tort or contract remedies (i.e., with cash). The ancient maxim “for every wrong there is a remedy” (California Civil Code § 3523) applies to subrogation rights. The maxims were adopted from the common law of England and are relied on in all jurisdictions. In California, the maxims were codified in its Civil Code.
The purpose of equitable subrogation is “to prevent forfeiture and unjust enrichment.” [Eastern Savings Bank, FSB v. Pappas, 829 A.2d 953, 957 (D.C.2003)]
The roots of equitable subrogation lie in the concept of remedying a mistake. In Hicks v. Londre, 125 P.3d 452, 458 (Colo.2005) the Colorado Supreme Court observed that equitable subrogation is appropriate when mistake is involved. [Joondeph v. Hicks, 235 P.3d 303 (Colo., 2010)]
Equitable subrogation is a doctrine that allows one who has discharged the debt of another to succeed to the rights of the satisfied creditor. For example, if Creditor # 3 pays off a debt owed to Creditor # 1 by the same debtor, equitable subrogation would enable Creditor # 3 to jump ahead of Creditor # 2 in priority for repayment. The doctrine, which began in the English courts of equity as a way for a surety to seek repayment from a defaulting debtor, has been applied by the Delaware Court of Chancery for over a century. [Eastern Savings Bank, FSB v. Cach, LLC, Supreme Court of Delaware, 124 A.3d 585 (2015)]

Subrogation is an equitable remedy and with the assistance of a professional claims person becomes a profit center to an insurer since it can reduce or fully reimburse the insurer for monies paid to an insured. Every claims investigation must include an investigation of subrogation potential.
